Abstract:
This paper empirically examines South Africa’s fiscal sustainability through a Markov-switching model which utilizes quarterly datasets for the period from 1960 to 2019. The results show that public debt responds positively, demonstrating a sustainable fiscal policy. Furthermore, considering the regime-specific feedback coefficients of the fiscal policy rule and the durations of fiscal regimes, the study finds that South Africa’s fiscal policy satisfies the No-Ponzi game condition. Therefore, from a policy perspective, the South African government should take measures such as pension reforms, reducing operational expenses, reducing subsidies, and funding micro and small enterprises to gain the double dividend on the expenditure side along with revenue-enhancing measures on consumption taxes to achieve stable public finances and lower debt levels.

Abstract:
This chapter comments on Article 35 of the Rome Statute of the International Criminal Court. Article 35 governs the service of judges. It also reflects a debate during the drafting of the Rome Statute about the nature of the Court as a permanent institution. There was a strong tendency to view the institution as a body that existed on a stand-by basis, one that would be called into action from time to time as a kind of permanent ad hoc tribunal, waiting for whatever assignments the Security Council might choose to give it. However, once the Court was actually established, it soon became clear that all of the eighteen judges elected to the Chambers would be required to work full-time. Thus, article 35 operates as more of a transitional provision governing the first few years of the Court's operation. Beginning with a team of six judges working full-time, the Court rather quickly moved to one in which all were employed full-time. Article 35 is related to article 40, on the independence of judges, and article 49, on salaries, allowances, and expenses.

Abstract:
This book seeks to revitalize the humanitarian mission of the international law governing armed conflict, which is being frustrated due to states’ actual practice. In order to achieve its two aims—creating an environment in which full abidance by the law becomes an attainable norm, thus facilitating the second and more important aim of reducing human suffering—it calls for the acknowledgment of realpolitik considerations that dictate states’ and militaries’ behavior. This requires recognition of the core interests of law-abiding states, fighting in their own self-defense—those that, from their militaries’ professional perspective, are essential in order to exercise their defense. Internalizing the importance of existential security interests, when drawing the contours of the law, should not automatically come at the expense of the core values of the humanitarian agenda—for example, the distinction rule. Rather, it allows more room for the humanitarian arena. The suggested tool to allow for such an improved dialogue is the standards and principles of military professionalism. Militaries function in a professional manner; they respect their respective doctrines, operational principles, fighting techniques, and values. Their performances are not random or incidental. The suggested paradigm surfaces and leverages the constraining elements hidden in military professionalism. It suggests a new paradigm in balancing the principles of military necessity and humanity, it deals with the legality of a preemptive strike and the leveraging of military strategy as a constraining tool, and it offers a normative framework for introducing deterrence within the current contours of the law.

Abstract:
How can we know if the peace that has been established following a civil war is a stable peace? More than half of all countries that experienced civil war since World War II have suffered a relapse into violent conflict—in some cases more than once. Meanwhile the international community expends billions of dollars and deploys tens of thousands of personnel each year in support of efforts to build peace in countries emerging from violent conflict. This book argues that efforts to build peace are hampered by the lack of effective means of assessing progress towards the achievement of a consolidated peace. Rarely, if ever, do peacebuilding organizations and governments seek to ascertain the quality of the peace that they are helping to build and the contribution that their engagement is making (or not) to the consolidation of peace. More rigorous assessments of the robustness of peace are needed. These assessments require clarity about the characteristics of, and the requirements for, a stable peace. This in turn requires knowledge of the local culture, local history, and the specific conflict dynamics at work in a given conflict situation. Better assessment can inform peacebuilding actors in the reconfiguration and reprioritization of their operations in cases where conditions on the ground have deteriorated or improved. To build a stable peace, it is argued here, it is important to take the measure of peace.
