Full textThis thesis is a compendium of various of rights which are currently victims of African workers by their employers despite various legislations in the work that exist in all states parties ; to the point where they appear to live another operation after slavery and colonialism. They live poverty on a daily basis. These evils are recognized both in the individual employment relationship as in public reports. This is how some employees are recruited following tests of complacency, if not corruptly there, without a working document ; others work for years to collect wages, without bonus, without leave, in terrible working conditions. As for collective reporting irregularities, to better trick these workers are excluded from the management company born with the right of expression or of the right to participate in the performance of the company still less than exemplary collective representation by the staff representatives and trade unionists. In case of dispute they have virtually no state protection by labor inspectors and judges. So out of this acute crisis in the sector private work that wreaks havoc for many years after independance, well there is a view through the OHADA reform, national and international authorities to ensure the correct application of the right to work by taking the measures that are necessary. Otherwise the reform of the labour law envisaged by the OHADA of the Right Business is also doomed to failure

Full textThe dissertation proposes a cross-country analysis offinancial deregulation reforms and corporate govemance reforms in most of the OECD countries from 1970. Whereas standard models in economics tend to focus on efficiency effects this dissertation uses the institutional complementarity hypothesi to emphasize the impact offinancial markets on labor market. Using panel data models empirical results thus indicate that financial reforms have stron distributive effects. Financialliberalization and the rise of institutional investors have directly affected the way of firms' financing. It is argued that due to institutional complementarities the adoption of financial reforms is likely to affect the institutional equilibrium by modifYing the balance of power between social groups. More specifically, this dissertation investigates the following issues: (i) the political and economic determinants of financial reforms; (ii) the impact ofthese reforms on labor market institutions; (iii) how these changes affect the wage distribution in the OECD countries

Full textThis thesis is a compilation of empirical works on seniors' behaviors. It is set in the context of reforms of retirement pension systems in develop countries which leads to a growing individualization of retirement choices. The first two chapters focus on how work impacts health using reforms of the French main pension system as exogenous shocks. Two different criteria are used to measure health: subjective well-being and mortality. It appears that work has a negative impact on physical health and increases morbidity for almost everybody. However the size and nature of effects are heterogeneous according to gender, education or income. I find that lower educated people are more impacted physically by work and that pension improves social life, especially women's. Men getting the lowest pensions (less than 954 euros a month) are more affected by the length of working life than by their retirement age, contrarily to other income groups. The third chapter is an analysis of the rigidity of seniors' employment rates in OECD countries facing a reform of their pension systems. Results show that seniors' employment reacts much more to work incentives in a context of good and homogeneous labor relations. The sources of heterogeneity of behaviors thus need to be studied. The fourth chapter analyzes one of them which is the differences in the experience of economic shocks for seniors. I find that for given individual situations with respect to income, employment and marital situation, people who grew up in a context of growth are more optimist concerning the American economy's future and children of unemployment men are more pessimistic concerning their own future on the labor market, which is not justified by facts (they have a lower propensity to be fired). Unemployment benefits are found to have a strong influence that mitigates or even cancels out this effects

Full textThe main international sources of the irakien social legislation are norms adopted both by the international labour organisation and the arab labour organisation. Indeed, irak has ratified 64 conventions of i. L. O. And 14 conventions of a. L. O. The central question posed all through our study has been to know, if irak has really integrated dispositions of conventions ratified in the internal legislation, and if it is the case, to what extent this has been in conformity with these norms. We have divided the international norms of labour ratified by irak in two categories. The first deals with general principles concerning human and employment rights. As for the second, it is linked with the execution of labour. In the first part, we have observed that the irakien legislator either ignores completely ratified norms, or integrates them but in a contradictory or partial way. This observation appears clearly concerning norms ratified in the area of the trade union liberty. We have equally observed that the irakien legislator imposes, in some cases, obligatory or slave labour. Similarly, irak's application of the convention n0 111 connected with the equality of opportunity and treatment poses the problem of some minorities in iraq, especially kurdishes and turkmenes. Finally, the principle of the productive and freely chosen full employment is difficult to realize, considering the economic and political instability of the country since 1980- continuation to the two great wars. In the second part, ratified norms, in general, have been integrated in the irakien legislation, but some dispositions of this legislation still remain in contradiction with these norms. The legislator should have to fix the duration of the week of labour to forty-eight hours. The role of the commission of fixing minima wages has to be more efficient. In the area of industrial hygiene and security of labour, the legislation is in contradiction with a great part of ratified conventions aiming particular risks or certain branches of activities. Finally, irak adopts a system of inspection of the tripartite labour, presided by a competent inspector and two members (workers and employers). But this system is difficult to apply by a country like irak

Full textThe utility of the euro is mainly estimated towards its capacity to guarantee the monetary stability. However, questions have been raised with regard to its impact on employment. Several recent studies suggest that, by altering the strategic link between the central bank and the wage setters, the switch to a monetary union may reduce wage discipline and thus increase unemployment. In fact, labour market institutions seem to perform less well in the European Monetary Union (EMU). That is why, in this thesis, we are interested in studying the wage bargaining organization in a monetary union. We first adopt the european decision makers’ approach and admit that full employment can only be achieved through labour market reforms. However, in this context, solutions to reduce unemployment are rather limited. One can either deregulate national labour markets or establish wage co-ordination at the monetary union-wide level. The first solution often leads to fierce protests from labour organizations. As for the second, it can only be reasonably envisaged in the long term. Thus, it is not clear that labour market reforms alone can solve the problem of unemployment in the monetary union. We show that national fiscal policies could ease the labour markets’ adjustment burden and thereby contribute to improve the employment level in the member countries

Full textThis paper studies the nature of the relationship between international trade and foreign trade direct investment, both theoretically and empirically. Theoretically, there is in general two sorts of relations between international trade and direct foreign investment: substitution and complementarity. The nature of that relation may either be the consequence of exogenous factors, determinants of country specialization or the result of endogenous strategy of multinational firms in the organization of their activities internationally. We speak of complementarity relation when there is a positive link between international trade and investment, and substitution relation when there is a negative link between international trade and investment. Empirically, with the gravity model, we apply econometric technics on yearly data of the panel during 2000 and 2014 period on bilateral data of eighteen countries main investors of OECD, at first in manufacturer industry and then depending on geographical areas, with a set of seventy-five countries divided up in these geographical areas. The seventy-five partner countries consist of seventeen other countries of OECD, seventeen Latin America countries non-OECD, three eastern European countries non-OECD, and thirty-eight Asian countries non- OECD. Regarding the analysis of the geographical area, the estimations point out, in exportation as in importation, a substitution relation for the OECD area and Latin America non-OECD area and a complementarity relation for eastern European non-OECD area. However, for Asian non-OECD area, the estimations show, a substitution relation in exportation and a complementarity relation in importation
