This book argues that constitutional review is an aspect of the separation of powers. In determining its scope, though, we do not only look to history. We look ahead as well, to the challenges our political order faces now and in the future. These challenges sometimes expose the deficiencies in the extant separation of powers and the need to update it so that it can sustain its legitimacy. Updating the constitution is a matter of a higher-order separation of powers and thus also governed by political morality. Political morality assigns constitutional authorship more liberally than we tend to think. Sometimes, it assigns constitutional authorship to actors and procedures beyond those specified in the amendment provisions of the original constitution, including courts themselves.

This chapter investigates the role of powers in the fragments of Porphyry’s On Statues, which derive principally from Eusebius of Caesarea’s Praeparatio Evangelica. It argues that powers had a core role in the original treatise and that this role is to be considered in connection with Porphyry’s doctrines of twofold power and of spiritual ascent. Given Porphyry’s dynamic understanding of the hypostases, contemplating statues in the right way can serve as a springboard for the ascent of the soul. On this reading, On Statues appears to be not an early work from the philosopher’s youth in Phoenicia (or even Athens), as Bidez had proposed, but a mature work in which Porphyry engages in dialogue with Iamblichus.

One of the most vexing questions for the framers of the Constitution was how to create a vigorous and independent executive without making him king. In today's divided public square, presidential power has never been more contested. This book cuts through the partisan rancor to reveal what the Constitution really tells us about the powers of the president. The book provides a comprehensive account of the drafting of presidential powers. Because the framers met behind closed doors and left no records of their deliberations, close attention must be given to their successive drafts. The book shows how the framers worked from a mental list of the powers of the British monarch, and consciously decided which powers to strip from the presidency to avoid tyranny. It examines each of these powers in turn, explaining how they were understood at the time of the founding, and goes on to provide a framework for evaluating separation-of-powers claims, distinguishing between powers that are subject to congressional control and those in which the president has full discretion. Based on the Tanner Lectures at Princeton University, the book restores the original vision of the framers, showing how the Constitution restrains the excesses of an imperial presidency while empowering the executive to govern effectively.

In an original assessment of all three branches, this book reveals a new way in which the American federal system is broken. Turning away from the partisan narratives of everyday politics, the book diagnoses the deeper and bipartisan nature of imbalance of power that undermines public deliberation and accountability, especially on war powers. By focusing on the lawsuits brought by Congressional members that challenge presidential unilateralism, the book provides a new diagnostic lens on the permanent institutional problems that have undermined the separation of powers system in the last five decades, across a diverse array of partisan and policy landscapes. As each chapter demonstrates, member lawsuits are an outlet for frustrated members of both parties who cannot get their House and Senate colleagues to confront overweening presidential action through normal legislative processes. But these lawsuits often backfire—leaving Congress as an institution even more disadvantaged. The book argues these suits are more symptoms of constitutional dysfunction than the cure. It shows federal judges will not and cannot restore the separation of powers system alone. Fifty years of congressional atrophy cannot be reversed in court.

Abstract:
This book explores the origins of presidential powers in new constitutions. Much is known about the effects of different presidential powers—less on the conditions that lead to their emergence. The book focuses on the origins of these powers. It argues that the most important predictor of whether a new constitution will expand (instead of restrict) presidential powers is power asymmetry, or more specifically, the difference in power assets between the Incumbent and the Opposition. These power assets can include electoral results, seats at key institutions such as the negotiating table, and even approval ratings. This argument draws from bargaining theories on self-dealing. Power asymmetry is a more powerful variable in explaining variations in presidential powers than others, such as the president’s ideology, class differences, or overall economic conditions. To make the case for this argument, the book reviews all the constituent assemblies from Latin America since the late 1980s, as well as several failed assemblies, and thereby provides one of the most comprehensive reviews of constitutional overhaul in Latin America thus far. The book also examines constitutional amendments that affect presidential powers, especially term limits. The conclusion is that to get more balanced constitutions (i.e., those that strengthen checks on presidential powers), neither side of the debate should have a huge power advantage over the other.

Private ownership played a central role in all periods of Roman society. In its early development, the Roman law of property knew two different ways in which private ownership of res mancipi and res nec mancipi could be transferred. In the late third century BC, the Roman jurists and the praetor were able to distinguish clearly between simple possession and full ownership: dominium ex iure Quiritium. Later on, they separated from this same dominium certain entitlements to use and enjoyment, which they classified as iura in re aliena. On one side, the original bundle of powers of the owner was hived off to constitute the usufruct, which coincided with what we might refer to as the “ordinary enjoyment” of the object. On the other side many praedial servitudes were created which allowed a landowner to make a limited use of another’s land. This chapter surveys that process.

This chapter examines the origins and development of the European Union, its legal framework, and its institutional and decision-making framework. Of all the international and regional arrangements to emerge in the aftermath of the Second World War, the European Union is perhaps the most difficult to classify. More than a classic intergovernmental organization, and less than an embryonic State, the EU’s wide-ranging responsibilities and byzantine structures can make it a challenging prospect for diplomats from within the Union as well as for those engaging with its work from other countries. While the European Union may be classified as an international organization the nature of its powers and procedures mean that it is usually regarded as a sui generis entity. There are a number of elements which taken together distinguish it from other organizations which extend back to the Treaties establishing the original European Communities in the 1950s.

This chapter examines the case of States that lost their sovereignty to a colonial power and then gained political independence in the twentieth century. Should they be classified within the category of ‘original’ or ‘old’ states rather than ‘new’ states? It argues that upon regaining independence, States reverted to sovereignty rather than joining the family of nations as newcomers. A state reverting to sovereignty must be presumed to revert, not only to the measure of sovereignty which it lost in the past, but also to the régime of the law of nations (with the ensuing rights and obligations) which it was forced to abandon at the time of its elimination from the community of the law of nations.

This chapter contrasts the original, 1975 version of Rollerball with the 2001 remake. Whereas the original version of the film features a hero who dooms himself to a tragic end by actively, yet nihilistically, rebelling against the forces of corporate control, the remake depicts a hero who engages in a successful revolution against the powers that be. In so doing, he promises the establishment of a counter-order that overcomes nihilism. It is argued that while the original version of Rollerball presents a modernist perspective on nihilism, depicting it as a phenomenon that cannot authentically be overcome, the remake presents a postmodernist perspective on nihilism, depicting it as a transitional stage leading from personal despair to ultimate triumph. The ideas of Friedrich Nietzsche, Albert Camus and Jean-Francois Lyotard are drawn upon in order to characterize the differences between modernist and postmodernist renderings of the “problem” of nihilism.

Abstract:
China plays a variety of status games, sometimes emphasizing its status as an emerging great power and other times highlighting its status as a fragile developing country. The reasons for this are unclear. Drawing on original Chinese sources, social psychological theories, and international relations theories, this book provides a theoretically informed analysis of China’s global rebranding and repositioning in the twenty-first century. Contrary to offensive realism and power transition theory, the book argues that China is not always a status maximizer eager to replace the United States as the new global leader. Differing from most constructivist and psychological studies that focus on the status seeking of rising powers, this study develops a theory of status signaling that combines both rationalist and constructivist insights. The book argues that Chinese leaders face competing pressure from domestic and international audiences to project different images. The book suggests that China’s continual struggle for international status is primarily driven by domestic political calculations. Meanwhile, at the international level, China is concerned about over-recognition of its status for instrumental reasons. The theoretical argument is illustrated through detailed analysis of Chinese foreign policy. Examining major cases such as China’s military transformation, China’s regional diplomacy, and China’s global diplomacy during the 1997 Asian and 2008 global financial crises, this book makes important contributions to international relations theory and Asian studies.

This chapter examines the self-perpetuation of the executive branch. Since constitutions usually concentrate on the position and powers of the chief executive, they feed the mistaken impression that the executive branch is synonymous with the will of a single president or prime minister. In reality, executive power in a modern regulatory state is not a one-man show. The chapter provides an overview of where the executive branch comes from before discussing the origins and scope of presidential power. It then considers the role of cabinets, councils, and prime ministers in parliamentary systems, along with the confidence mechanism that serves as the lifeline between the legislature and the executive (cabinet). It was the original forever war, which went on interminably, fueled by religious fanaticism, personal ambition, fear of hegemony, and communal suspicion. It dragged in all the neighboring powers. It was punctuated by repeated failed ceasefires. It inflicted suffering beyond belief and generated waves of refugees. No, this is not Syria today, but the Thirty Years' War (1618-48), which turned Germany and much of central Europe into a disaster zone. The Thirty Years' War is often cited as a parallel in discussions of the Middle East. The Peace of Westphalia, which ended the conflict in 1648, has featured strongly in such discussions, usually with the observation that recent events in some parts of the region have seen the collapse of ideas of state sovereignty--ideas that supposedly originated with the 1648 settlement. Axworthy, Milton and Simms argue that the Westphalian treaties, far from enshrining state sovereignty, in fact reconfigured and strengthened a structure for legal resolution of disputes, and provided for intervention by outside guarantor powers to uphold the peace settlement. This book argues that the history of Westphalia may hold the key to resolving the new long wars in the Middle East today.

Derrida’s idea of deconstruction stems from three phenomenological insights: (1) the insight into the experience of others; (2) the insight into the role of documentation for knowledge; and (3) the insight into temporalization. But the chapter argues that there is a fourth phenomenological insight, the insight in the endless expansion of reduction. It is this fourth insight that leads to the idea of power, an immense power.
