Author of thesis offers to construct her designed passenger terminal in International Vilnius airport. In this project author try to reach more expressive architecture, better comfort for passengers and to reduce the exploitation expeditures. A presente dissertação visa sistematizar o estudo da orientação jurisprudencial denominada pelos integrantes do Supremo Tribunal Federal de ofensa reflexa ou indireta à Constituição, analisando sua conformidade com o texto constitucional brasileiro de 05 de outubro de 1988. Partindo do problema fundamental da pesquisa consistente no questionamento se é compatível com a ordem constitucional vigente a partir de 1988 a aplicação da orientação jurisprudencial da ofensa reflexa à Constituição de 1988 pelo Supremo Tribunal Federal (STF) nos casos de controle difuso realizado por meio do Recurso Extraordinário a pesquisa se desenvolve apresentando preliminarmente a metodologia utilizada após inicia o estudo sobre as competências do STF e sua natureza jurídica. Prossegue adentrando na discussão sobre denominada “jurisprudência autodefensiva” enquanto conjunto de decisões em cuja interpretação os membros do STF reduzem o espectro de incidência de normas constitucionais fundantes do sistema jurídico brasileiro analisando sua ocorrência e sobretudo suas razões. Por fim na parte central do estudo a discussão se volta exclusivamente para a ofensa reflexa ou indireta como destacada forma de jurisprudência defensiva analisando seu surgimento no controle concentrado de constitucionalidade passando a incidir no controle difuso de constitucionalidade e a partir de dados objetivos sobre a capacidade do STF busca analisar o fenômeno decisório de forma razoável avaliando inclusive casos paradigmáticos. Conclui-se de forma crítica mas com a apresentação de propostas para tentativa de solução ou pelo menos mitigação do problema.

Full textThis thesis attempts to identify, from the earliest available sources, the details concerning Fatimah as a historical person but ultimately shows that there is little real evidence for her life and even what facts do exist are the subject of controversy. Following this it examines the growth of the hagiographical tradition which created out of her a true Muslim saint and discusses its significance particularly for the Shi'ah. Finally, the conclusion presents some of the possible reasons for Fatimah's exalted status and for the resurgence of interest in her in the context of the modern Islamic world.

Full textENGLISH ABSTRACT: This thesis seeks to evaluate MacIntyre's claim that recourse to the tradition of virtue ethics in the Aristotelian-Thomist sense is the only viable intellectual option, given the alleged demise of the so-called"Enlightenment Project". It raises a twofold question: First, is it coherent to argue that MacIntyre's reappropriation of an ancient moral tradition is possible? Does such a claim duly reckon with the conditions under which meaningful forms are understood? The first claim being defended is that MacIntyre does not sufficiently respect Gadamer's conditions under which understanding occurs. It is also argued that MacIntyre does not provide coherent conditions for rationally choosing between traditions in order to possibly vindicate them. As such, MacIntyre's re-appropriating of the Aristotelian tradition in moral theory is not coherent and convincing. Secondly, does the dichotomy of "Nietzsche versus Aristotle" represent the only viable alternatives for us in our efforts to continue the enterprise of moral theorising? The second claim being defended is that the dichotomy is not a coherent way of moral theorising. The third claim being defended is that Gadamer represents a viable alternative to the ultimatum in that his thought provides the possibility of a more coherent way of moral theorising than MacIntyre's.
AFRIKAANSE OPSOMMING: Hierdie tesis stel ten doel die evaluasie van MacIntyre se standpunt dat die deugde-etiek van die Aristoteliaanse-Thomistiestradisie die enigste blywende opsie is, aangesiendie sogenaamde"Verligtingsprojek" misluk het. Die tesis stel twee kernvrae aan die orde: Eerstens, is dit sinvol om te argumenteer dat MacIntyre se appropriasie van bogenoemde etiese tradisie moontlik is? Verleen so n aanspraak genoegsame waarde aan die kondisies waaronder sindraers verstaan word? Die eerste standpunt wat verdedig word, is dat MacIntyre nie genoeg ag slaan op Gadamer se opvatting oor die kondisies vir verstaan nie. Daar word verder ook geargumenteer dat MacIntyre nie koherente kondisies aandui vir 'n keuse tussen tradisies nie en as sodanig ondermyn dit die koherensie van sy werk. Full textABSTRACT: This dissertation is a critical edition of Ovid’s Metamorphoses Book X with a textual commentary. The text is based on more than 160 manuscripts, which I have collated personally, either in the library or by photographic means. Some of these witnesses have been collated for the first time and many of them had not been collated since Nicolaus Heinsius’ time. Moreover I have read 78 editions from the two principes of 1471 until the latest of 2004 by J. R. Tarrant (which is also the immediate reference to my text). Additionally every single commentary and critical bibliography at my disposal has been dully considered. Accordingly this dissertation can be considered the most complete critical work ever produced on Metamorphoses Book 10. The main aim of the dissertation is to offer to scholars all the data concerning the establishment of the text from the oldest manuscripts until the most recent editions and critical articles. Special attention is given to the huge amount of information gathered by Heinsius and Burman in their editions. Likewise, the author tries to offer a reasoned account of every textual problem discussed and tries to motivate his choices (he differs in about 40 places from Tarrant’ s text). Since the text has been horizontally transmitted and contamination and interpolation can already be detected in our oldest manuscripts, the so-called ‘eclectic method’ has been used. No acritical preference is given to readings present in our oldest manuscripts (not even to those manuscripts traditionally seen as boni or optimi) nor to any other specific source. It is sense and usage what allows to assess the plausibility of every option. The author has tried to reconcile some the following, and often conflicting, principles: 1) In an open and contaminated tradition the authentic reading may have survived in almost any combination of witnesses, even in just a few recentiores; 2) Some attractive readings with poor manuscript support could actually be (ancient) attempts to correct or embellish the text. 3) The degree of interpolation of the Ovidian paradosis is probably very high. So conjectural emendation might be required even where the text transmitted by the manuscripts is acceptable. Lastly, it is suggested that further inquiries should focus on manuscripts of the XIV and XV centuries. Some of those manuscripts seem to be related, although not directly, to some of our oldest and best witnesses. Readings not attested (or very poorly attested) in the so-called ‘ medieval vulgate’ re-emerge in some of those late witnesses. Maybe some unexpected findings could turn out in those late copies.

Full textFirst section of bachelor's work analysis negative people emotions, explores various articles and books from all kind of specialists in subject of anger and aggression ( doctors, scientists, socialists ). It also searches for sources of anger and for ways to deal with them. The second section provides examples of the works taken from designers, whom art are filled with anger and emotions. Works of sisters Mulleavy (Rodarte) were analyzed. Artists never intended to show anger and aggression directly, they only used those feelings as an alternative tool in order to create original collection. As an analog for collection, which is under creation, sisters Mulleavy collection “NYC fashion week - 2010 summer. Rodarte“ was chosen. The sketches was created in order for models to be expressive , to reflect the emotions of anger, but still not to be aggressive within. The third section explains the idea of collection, the search for models, sketches, technological samples and elements of decor. Fabrics, theirs structure and tone was chosen according to sketches. In order to better convey the idea of collection, different height models was chosen. 14 models was designed for collection , however only 4 sew .Dark colors, shiny fabrics was chosen for models. Full textLa principale liasse d’épreuves bernardines, constituée des quelque 185 folios de l’antiphonaire 12A-B de Westmalle, constitue le socle de la thèse et la matière du tableau liturgique général présenté dans l’annexe 3. Cette table distingue les pièces de première main de celles écrites par les correcteurs bernardins. Les autres épreuves, l’antiphonaire 6 de Tamié (Savoie) et les fragments de la Fille-Dieu (Suisse), ont été reproduites dans l’annexe 2. Avec les folios de Westmalle 12A-B, elles sont les seules à conserver une part importante des mélodies originelles, à révéler les corrections et les procédures bernardines. Les analyses codicologique et paléographique des documents, mises en relation avec les données historiques, ont permis de dégager deux phases de corrections et de situer l’achèvement de la réforme bernardine, vraisemblablement à Hautcrêt vers 1143.
Le répertoire de l’hymnaire a été revu (chapitre IV) et celui de la messe, réexaminé à la lumière des reliquats du premier graduel cistercien, jusqu’ici inexploités. Ces bribes intactes ont été confrontées aux équivalents de la deuxième réforme et ouvrent (chapitre III) l’étude comparative des chants de l’office du premier et du deuxième Cîteaux (chapitres VII à X).
Au fil de l’analyse, des échantillons tirés du graduel ou de l’antiphonaire sont présentés dans les tableaux synoptiques rassemblés dans l’annexe 1. Chacun d’entre eux comprend, quand c’est possible, la première version cistercienne originelle reconstituée, la version bernardine et, selon les besoins, un panel plus ou moins important de référents grégoriens (décrits au chapitre VI), destinés à replacer chaque liturgie cistercienne dans son contexte culturel et à en établir les sources.
Ce travail tend à modifier l’image de la réforme bernardine, censée avoir appauvri la tradition grégorienne par l’application stricte des règles musicales. Elle montre que de nombreuses pièces introduites par les correcteurs sont issues de la tradition clunisienne et parfois spécifiquement de la tradition de l’abbaye de Molesme d’où sont issus les pères fondateurs de Cîteaux. Les reliquats de la liturgie molesmienne notée, reproduits en fac-similé (annexes 2) et inconnus jusqu’ici, ont permis d’établir l’existence d’une chaîne de tradition musicale reliant Molesme aux monastères de sa tradition (Montier-la-Celle et Marmoutier) ;et de faire ressortir les liens qui unissent la tradition des premiers moines blancs à de nombreuses corrections bernardines. L’examen du bréviaire Paris 3241, sorti de l’anonymat en 2007 et exploité ici pour la première fois, a en particulier permis de conclure au transfert de pièces et formulaires entiers de la tradition molesmienne vers le deuxième Cîteaux.
Bien plus que la théorie musicale, réputée si importante, mais en réalité modérément appliquée, ce sont la raison pratique, le souci de l’authenticité et de la bonne articulation du texte latin, l’esthétique et la culture mélodique du terroir bourguignon qui ont guidé les choix des réformateurs bernardins. La liturgie messine, adoptée à Cîteaux entre 1108 et 1143, était porteuse de variantes dialectales que les Bernardins ont abandonnées pour se réapproprier leur patrimoine ancestral, marqué par des segments musicaux expressifs et des idiomes caractéristiques du domaine latin.
L’interprétation musicale de spécimens du premier et du deuxième Cîteaux, mis en regard, illustre ce basculement culturel de l’ensemble liturgique « est » vers celui de l’« ouest ». La pochette musicale comprend aussi quelques unica et emprunts traditionnels ciblés qui illustrent la richesse de l’esthétique du deuxième Cîteaux.

A seguir, a análise passou a verificar a inserção da Fiocruz nessas políticas, desde a sua criação e no decorrer de vigência de diferentes formas de contratação, alternando da extrema rigidez para a total flexibilidade sempre com foco na gestão do trabalho, e, como essas políticas se refletiram no desempenho de Bio-Manguinhos. Baseado no contexto da conformação do Estado e na análise do desempenho da unidade, o trabalho critica a falta de planejamento e de prospecção dessas políticas, que favoreça a inovação de processos, produtos e procedimentos e o desempenho pleno de uma unidade de produção de insumos para a saúde, tão necessários ao atendimento das necessidades da população brasileira. Critica também, a ausência de um modelo de Estado consolidado que sirva de arcabouço à formulação dessas políticas. Devido às fortes críticas dos órgãos de controle acerca da extrapolação dos limites da terceirização praticada nas últimas duas décadas e à falta de definição clara desses marcos legais, o trabalho apresenta uma metodologia baseada nas atribuições dos cargos do plano de carreiras da Fiocruz e culmina com a apresentação de uma matriz de atribuições passíveis de serem realizadas por contratação indireta. Conclui pela necessidade de convivência de dois quadros de trabalhadores: um permanente formado por servidores, estáveis e de carreira e outro flexível, executado por contratação indireta, de caráter eventual, temporário ou de apoio às atividades relacionadas à missão de Bio-Manguinhos. O trabalho ainda sugere a aplicação da mesma metodologia às demais unidades da Fiocruz e que a instituição afirme, frente aos órgãos de controle, quais atividades que ela precisa manter no quadro de servidores permanente e quais ela quer delegar a terceiros sem contudo, ferir a legislação vigente. Por fim, constata-se que a metodologia apresentada ameniza, mas não resolve o problema, dessa forma, recomenda-se à Fiocruz buscar mecanismos que altere o modelo de gestão pelo qual está submetida a fim de viabilizar as duas formas de incorporação de mão-de-obra.

This thesis endeavors to examine Margaret Atwood’s Oryx and Crake from a more scientific angle, proposing that Atwood actually criticizes the biological reductionism prevailing in the contemporary society by writing Oryx and Crake. This thesis is divided into four chapters. In the first chapter, I will present a brief introduction to Margaret Atwood, her latest novel Oryx and Crake, and their relationship to science. I will also offer the concise reviews and summaries of the academic critiques of this novel, and the motivation and argument of my thesis. Moreover, a condensed account of what scientific reductionism is will be given, too. In Chapter Two, I will trace the origin of the biological reductionism prevailing in the present days. I will illustrate how the discovery of genes and DNA structure in the beginning of 20th century influences the development of biology, including evolutionary theories, which formulate the mainstream of biological reductionism. Then, I will introduce two biological concepts that are often criticized for their biological reductionism: one is genetic reductionism, or gene myth in Ruth Hubbard and Ted Peters’ term, and the other is sociobiology founded by Edmund O. Wilson. Lastly, I will prove how Crake, the main scientist in Oryx and Crake, displays these two reductionist biological notions and hence becomes the representative of biological reductionism. In addition, I will also clarify why the Crakers created by Crake are the reification of Crake’s reductionist view of biology. In Chapter Three, I will firstly explain how Jimmy, the best friend of Crake, symbolizes the humanist conception that stresses the difference between humans and other creatures as well as the uniqueness of human beings to resist and criticize Crake’s biological reductionist attitude. Then, I will demonstrate how Atwood reveals her criticism and objection to extreme biological reductionism through subverting the Crakers’ features predestinated by Crake. I will discuss the emergence of curiosity, speculating ability, and deductive reasoning of the Crakers as well as the appearance of religion, art, and leadership among them that are all unforeseen by Crake. The last chapter will elucidate how the end of Oryx and Crake implies Atwood’s relatively optimistic attitude to human crisis of being reduced by reductionist view of biology. Through the open ending of the novel, Atwood provides more possibilities instead of the only absolute future determined by Crake, and hence enunciates her criticism against the extreme biological reductionism and scientific reductionism, which impels her readers to reflect seriously on this issue, too.

Full textSource-criticism of the Pentateuch suggests that the priests (Source P) alone authored the Holiness Code – the premise being that Source P forms one religious, literate and elite group of several. Through the endeavor to redefine Israelite identity during the Neo-Babylonian Empire of 626–539 BCE and the Achaemenid Persian Empire of 550–330 BCE, various ideologies of Israelite identity were produced by various religious, literate and elite groups. Possibly, the Holiness Code functions as the compromise reached between two such groups, these being: the Shaphanites, and the Zadokites. Moreover, the Holiness Code functions as the basis for the agreed identity of Israel as seen by the Shaphanites and the Zadokites. Specifically, in Leviticus 19:1-19a – as being the Levitical decalogue of the Holiness Code, and which forms the emphasis of this thesis – both Shaphanite and Zadokite ideologies are expressed therein. The Shaphanite ideology is expressed through the Mosaic tradition: i.e., through the Law; and the Zadokite ideology is expressed through the Aaronide tradition: i.e., through the Cult. In the debate between the supremacy of the Law, or the Cult – i.e., Moses or Aaron – the ancient Near Eastern convention of the ‘rivalry between brothers’ is masterfully negotiated in Leviticus 19:1-19a.
