Abstract:
This account of the evolution of outer space law examines key issues that fuel the debates over sovereignty and property rights designed to govern the future colonization and use of heavenly bodies other than our own. In the United States, lobbies for the commercial development of space have become increasingly antagonistic toward the international legal regime of outer space, condemning the 1967 Outer Space Treaty and the unratified 1979 Moon Agreement as anti-business. The Development of Outer Space: Sovereignty and Property Rights in International Space Law argues that the res communis prin

This chapter explores the law of armed conflict with regard to the weapons used in sea warfare. It addresses automatic contact mines, nuclear mines, submarines, missiles, and torpedoes. Relevant elements of the treaties of 1907, of instruments adopted in 1930 and 1936, of the writings of experts and in particular of the San Remo Manual and of the UK Manual are considered in relation to each class of weapon. A discrete section looks at weapons in outer space, noting the application of international law to outer space by virtue of article III of the Outer Space Treaty, and the important provisio

The remnants of human activities in space are very diverse; they can be tiny paint flakes, all sorts of fragments, or entirely intact—but otherwise nonfunctional spacecraft and rocket bodies. The amount of debris is increasing at a growing pace, thus raising the risk of collision with operational satellites. Due to the relative high velocities involved in on-orbit collisio

The European Union Space Policy (EUSP) is one of the lesser known and, consequently, little understood policies of the European Union (EU). Although the EU added outer space as one of its competences in 2009 with the ratification of the Lisbon Treaty, the EUSP roots go back decades earlier.Officially at least, there is no EUSP as such, but rather a European Space Policy (ESP). The ESP combines in principle space programs and competences that cut across three levels of governance: the supranational (EU), the international (intergovernmental), and the national. Space assets have provided the U.S. military a demonstrable edge against adversaries since the 1990–1991 Gulf War. Most space technology is dual-use, meaning it has both civil and military applications; this creates an ambiguity to know whether military applications are intended as offensive or defensive. This chapter examines four schools of thought on how to preserve U.S. space dominance, and what that realistically means, discussed within the context of issues related to dual-use technology, sustaining the space environment, and international law within which the schools have developed. With a case study of the Slovak punk band Hudba z Marsu, Chapter 6 illustrates discrepancies that became sources of creative energy in the 1990s and 2000s. It details how Hudba z Marsu incorporated popular motifs from the mid-twentieth-century space race, old Slovak folk recordings, and live folkloric singing. The chapter describes how Hudba z Marsu established connections with local Romani (Gypsy) musicians; the West European world-music industry highlights such collaborations, but this chapter argues that Hudba z Marsu and Romani performers treated their interactions as an everyday matter.
