Este artículo, en un viaje a través del tiempo, pretende dar explicación de cómo se llegó a esta situación basándose en los documentos que sobre esta cuestión obran en los distintos archivos ovetenses, a la vez que se presentan otras discutidas actuaciones en materia de destrucción del Patrimonio monumental ovetense en los comienzos del s. Resumen: En la Edad Media, había una gran variedad de sudarios venerados en distintas zonas del mundo cristiano. El sudario de Oviedo, tejido en torno al siglo VIII d.C, aparece registrado en las fuentes a partir del último cuarto del siglo XI y forma parte de las reliquias conservadas en la catedral de la ciudad. Su existencia puede considerarse uno de los efectos de los esfuerzos conjuntos que el clero y la política realizaron para proveer una legitimación histórica y propagandística a la supremacía de la sede de Oviedo. En los últimos cincuenta años, como consecuencia de la poderosa propaganda efectuada por algunos exponentes de una pseudo-ciencia conocida como “sindonología”, el Sudario de Oviedo goza de creciente fama, sobre todo mediática, y es presentado como si fuera una reliquia auténtica, es decir, como el verdadero sudario que envolvió la cabeza de Jesús de Nazaret.Abstract: In the Middle Ages, there was a great variety of shrouds venerated in different parts of the Christian world. The Sudarium of Oviedo, woven around the eighth century AD, is recorded in the sources as from the last quarter of the eleventh century and is one of the relics preserved in the cathedral of the city. Its existence can be considered one of the effects of the joint efforts that the clergy and the political power made to provide a historical and propagandistic legitimation to the supremacy of Oviedo’s bishopric. In the last fifty years, as a result of the powerful propaganda carried out by some exponents of a pseudo-science known as “syndonology”, the Sudarium of Oviedo enjoys a growing fame, especially in the media, and it is presented as if it were an authentic relic, that is, as the true shroud that wrapped the head of Jesus of Nazareth.

Abstract:

Las reliquias de la catedral de Oviedo se describen y enumeran en dos conjuntos de fuentes medievales. La primera corresponde a finales del siglo XI y comprende el Acta de Apertura de 1075, la inscripción en el relicario conocido como Arca Santa y la epístola dirigida por el obispo Osmundus de Astorga a Ida de Boulogne. La segunda procede del scriptorium organizado en Oviedo por el obispo Pelayo, en el siglo XII. En este artículo se intenta analizar la secuencia de los diferentes relatos y cómo se relacionan entre sí.The relics of the Cathedral of Oviedo are described and listed in two sets of medieval sources. The first corresponds to the end of the 11th century and includes the Opening Act of 1075, the inscription in the reliquary known as the Arca Santa and the epistle written by Bishop Osmundus of Astorga to Ide de Boulogne. The second comes from the scriptorium organized in Oviedo by Bishop Pelayo, in the 12th century. In this article we try to analyze the sequence of the different stories and how they relate to each other.

Alfonso Marañón de Espinosa, arcediano de Tineo y miembro del cabildo de la catedral de Oviedo, fue el autor de El Libro de los estatutos y constituciones de la Sancta Iglesia de Oviedo, con el ceremonial y kalendario de sus fiestas antiguas, publicado en Salamanca en 1588. A partir de tres aspectos específicos de los que informa esta consueta: la celebración del día de Todos los Difuntos, los enterramientos y aniversarios por obispos, se tratará de conocer y estudiar las costumbres y espacios funerarios de la catedral de Oviedo durante la Edad Media.

Sostenemos que el Viaje de Turquía y la Turcarum origo son obras de un mismo autor: Gonzalo Fernández de Oviedo. La propuesta sobre el Viaje de Turquía se basa en un análisis léxico que abarca ambas obras y un conjunto de 192 palabras o expresiones poco usuales. Un primer cotejo deslinda dos autores que presentan índices léxicos muy superiores a los demás escritores de la época: Juan de Arze de Otálora y Gonzalo Fernández de Oviedo. El análisis de Turcarum origo identifica a Fernández de Oviedo como su autor y el rastreo léxico del prólogo y su cotejo con un capítulo del Viaje confirman que Oviedo es el autor de ambos textos. Turcarum origo es un texto anterior a la publicación del Lazarillo de Tormes y el Viaje es posterior. Se detectan en él las lecturas del Lazarillo, de la Peregrinación de Hernández de Villaumbrales (1552) y del Libro de la oración y meditación de Fray Luis de Granada, libros todos ellos erasmistas. Proponemos también un filtro metodológico basado en la aplicación de logaritmos neperianos para diferenciar las frecuencias léxicas.

Abstract:

La Convenzione di Oviedo del 1997 ha creato regole basilari ed uniformi in tema di consenso libero ed informato. Nonostante siano passati vent’anni, pochi Stati hanno firmato e ratificato la Convenzione. Oggi però la Carta dei diritti fondamentali di Nizza del 2000 ed il Trattato di Lisbona del 2007, riformando profondamente l’Unione Europea, possono dare finalmente alla Convenzione di Oviedo l’auspicata attuazione interna, seppur in modo indiretto. Il contributo affronta il tema dell’articolato contesto storico e giuridico delle fonti di questa Convenzione. ---------- The Oviedo Convention of 1997 has established fundamental and uniform rules in reference to free and informed consent. Even though twenty years have passed, few States have signed and ratified the Convention. Anyway, today’s the Charter of Fundamental Rights of 2000 and the Treaty of Lisbon of 2007, reforming deeply the European Union, can finally give the hoped implementation to the Convention of Oviedo, at least indirectly. The contribution deals with the articulated historical and juridical context of the sources related to the Convention.

Since his period, he is usually portrayed negatively as an inhuman, fierce enemy of the Indians. Kohut's monograph investigates the validity of such portrayal. Abstract:

El estudio de las rogativas públicas pone de relieve varias cuestiones. Desde el punto de vista conceptual, el análisis de estas prácticas muestra con claridad la excesiva simplicidad de la división entre formas culturales elitistas y populares, y la necesidad de hallar modos para definir adecuadamente la pertinencia de fenómenos sociales como éste. Desde la óptica cultural y sociológica, las rogativas informan sobre los valores religiosos de una sociedad; pero también sobre sus miedos y temores cotidianos, así como sobre los intentos de los poderes públicos para lograr una mayor cohesión social en determinados momentos. Tratamos de desarrollar estos tres puntos centrándonos en la ciudad de Oviedo.

Abstract:

In this article the author analyses some problems related to defining of biomedicine and bioethics through international law. As he says, numerous rules in this field are literally scattered around and can be found in various international documents. The author presents in detail the first international agreement that defines this subject - it is Convention for the Protection of Human Rights and Dignity of the Human Being with regards to the Application of Biology and Medicine: Convention on Human Rights and Biomedicine, adopted by the Council of Europe in 1996. He is of the opinion that very rapid and complex development of scientific knowledge in the field of biomedicine produces new problems. For that reason there should be soon adopted a convention or charter of universal character that would codify as precisely and fully as possible the rules in the fields of biomedicine and bioethics.

La Foncalada de Oviedo es una fuente monumental, datada generalmente en el siglo IX, durante el período del reino asturiano (718-910). En la fachada del lado este, donde se abre un arco de medio punto, se grabaron algunas inscripciones latinas. Era conocido el contenido de las situadas sobre el arco. Son similares a algunos epígrafes regios de la época. Del texto de las demás solamente se conservan pequeños fragmentos. En este artículo ofrecemos una reconstrucción, lograda gracias a haberse detectado el modelo en que se basan: una oración de santificación del agua, empleada, aunque no exclusivamente, en el ritual hispánico, y contenida en los Libri Ordinum. The Foncalada of Oviedo is a monumental fountain commonly dated in the 9th century, at the time of the Asturian Kingdom (718-910). On the façade of the east side, where a semicircular arch opens, some Latin inscriptions were engraved. The content of those situated on the arch is well-known, since they are similar to some royal epigraphs of the period, while only small text fragments have been preserved from the rest of inscriptions. In this work we offer a reconstruction of the latter, based on a finding that what we consider the model or source used for the creation of these epigraphs: a prayer form for the sanctification of water, used, though not exclusively, in the Hispanic rite, and contained in the Libri Ordinum.

L’emersione progressiva del principio di vulnerabilità viene interpretata come frutto dell’influsso del pensiero femminile nel dibattito e come lento ma consistente affermarsi di una concezione della giustizia meno liberal-individualistica e sempre più solidale e relazionale. ---------- This article thinks about the Oviedo Convention in a diachronic perspective, analyzing the evolution of the guiding principles of bioethics and biolaw in the millennium. The same convention and the 2005 Paris UNESCO Declaration on Human Rights and Bioethics are taken as milestones. The progressive emergence of the principle of vulnerability is interpreted as the result of the influence of women’s thinking in the debate and as slow but consistently affirming a less liberal-individualistic conception of justice and more and more relational conception.

Abstract:

Los cambios coyunturales producidos por la pandemia del Covid-19 trajeron consigo diversas situaciones que atacaron a la economía, sobre todo a las micro, pequeñas y medianas empresas. Dado lo mencionado, la investigación tuvo como objetivo evaluar el impacto económico y laboral que generó la cuarentena sanitaria por el COVID-19 en las MIPYMES de la ciudad de Coronel Oviedo. Para tal efecto, se optó por una metodología de carácter cuantitativo, descriptivo, transversal, retrospectivo y no experimental. La población estuvo constituida por microempresarios de la zona céntrica de la ciudad de Coronel Oviedo, tomando como muestra a 60 (sesenta) de estos a través del muestreo probabilístico aleatorio simple. Por todos los datos encontrados, se puede afirmar que existió un impacto económico y laboral negativo en las MIPYMES, igualmente un alto porcentaje muestra que a pesar de las restricciones se han generado alternativas para el sostenimiento. Como conclusión, la pandemia ha generado un impacto en la economía, pero a la vez nos ha enseñado estrategias para la sostenibilidad laboral de la ciudad de Coronel Oviedo. ABSTRACT The economic changes caused by the Covid-19 pandemic brought with it various situations that affected the economy, especially micro, small and medium sized enterprises (MSMEs). Given the above, the objective of this research was to evaluate the economic and labor impact generated by the sanitary quarantine due to Covid-19 on the MSMEs of the Coronel Oviedo city. For this purpose, a quantitative, descriptive, cross-sectional, retrospective and non-experimental methodology was chosen. The population consisted of micro entrepreneurs in the downtown area of Coronel Oviedo city, with a sample of 60 (sixty) of them, through simple random probability sampling. From all the data found it, it can be affirmed that there was a negative economic and labor impact on the MSMEs, also a high percentage shows that in spite of the restrictions, alternatives have been generated to sustain them, the pandemic has had an impact on the economy, but at the same time it has taught us strategies for labor sustainability in the city of Coronel Oviedo. Il diritto alla tutela della salute, che include l’accesso ai servizi sanitari, è sancito in molte Dichiarazioni e altri documenti normativi a livello internazionale. Il riferimento all’equità è solitamente introdotto per affrontare i vincoli delle risorse disponibili e non eludere la realtà di persistenti diseguaglianze. Il riferimento all’adeguatezza è volto a sottolineare il ruolo delle competenze professionali e della conoscenza e dei progressi scientifici al fine di soddisfare esigenze reali, ma anche di ottimizzare l’utilizzo delle risorse. L’articolo 3 della Convenzione di Oviedo mira a proteggere i diritti umani e la dignità della persona umana e offre ancora un proficuo punto di partenza per continuare a sviluppare alcuni dei più preziosi strumenti concettuali e giuridici fra quelli perfezionati in questi ultimi decenni per affrontare questa sfida: il principio della realizzazione progressiva, che può innescare e rafforzare una dinamica emancipatrice; l’esercizio del bilanciamento di principi, interessi e beni sia nella giurisprudenza delle Corti costituzionali sia nelle politiche di settore; il concetto del contenuto essenziale del diritto ai servizi sanitari. Queste soluzioni si confrontano ora con le applicazioni dei progressi nuovi e senza precedenti della scienza biomedica, come la medicina di precisione. Allo stesso tempo, il riferimento della Convenzione alla giurisdizione delle Parti (gli Stati) come quadro istituzionale entro il quale gli obblighi sono assunti deve essere ulteriormente articolato misurandosi con l’orizzonte globale dell’impegno a “proteggere” la dignità umana e i diritti umani. ---------- The right to protection of health, which includes access to health care services, is enshrined in many Declarations and other normative documents at the international level. The reference to equity is usually meant to deal with the constraint of available resources and not elude the reality of persisting inequalities. The reference to appropriateness is to underline the role of professional competence and scientific knowledge and progress in order to fit real needs, but also to optimize the use of resources. Article 3 of the Oviedo Convention aims at protecting both human rights and the dignity of the human being and still offers a fruitful starting point to elaborate on some of the most valuable conceptual and juridical tools that have been refined over these last decades to address this challenge: the principle of progressive realization, which can trigger and strengthen an emancipatory dynamic; the exercise of balancing principles, interests and goods both in the case law of Constitutional Courts and in policies; the concept of the core content of the right (entitlement) to health care services. These solutions are now confronted with the applications of new, unprecedented advancements of biomedical science, such as precision medicine. At the same time, the reference by the Convention to the jurisdiction of the Parties (the States) as the institutional framework within which obligations are undertaken needs to be further articulated against the global scope of the commitment to ‘protect’ human dignity and human rights.

The 9th International Conference on Heteroatom Chemistry (ICHAC-9) was held in the Auditorio Príncipe Felipe of Oviedo, Spain, from 30 June to 4 July 2009. The conference was chaired by Prof. José Barluenga (University of Oviedo, Spain) and attracted about 210 participants, mainly organic and inorganic chemists, from 30 countries all around the world. SummaryData from elderly suicides was obtained from two previous studies of community suicides in two localities of Northern Spain, namely, Oviedo between 1983 and 1990, and Gijón between 1975 and 1986. Data from the two localities were obtained by the revision of court register cases. A retrospective study on elderly suicide (over 60 years of age) was carried out. Mean annual specific rates for the elderly in Oviedo for 1982–1991 were 37.7 (58.1 for men and 23.3 for women) and for those in Gijón for the period 1975–1986, 23.4 (40 for men and 11.5 for women). A marked increase was seen in the rates for Gijón from the first (1975–1978) to the last period (1983–1986). This was particularly marked in men. The greatest increase in the rate was seen in men over 75 from Gijón and in those between 1970–1974 from Oviedo. In contrast a decrease was seen in the 65–69 age group rates for both men and women. A tendency for the rates to increase was seen but no important increase for elderly suicides was evident.

Il confronto tra la Convenzione di Oviedo e il Regolamento (UE) N. 536/2014 ha consentito di strutturare lo “standard etico-giuridico” europeo relativo alle misure di protezione dei soggetti vulnerabili coinvolti nelle sperimentazioni cliniche. Tale standard è stato analizzato seguendo il filo conduttore dei tre principi fondamentali della ricerca, enunciati dal Belmont Report: rispetto per la persona, beneficialità e giustizia. Le discrepanze riscontrate al suo interno hanno fatto emergere le criticità di talune categorie di base, ad esempio la distinzione tra beneficio diretto o beneficio sul gruppo e la nozione del rischio minimo. A 20 anni di distanza dalla Convenzione di Oviedo, documento di riferimento della bioetica europea ed internazionale, viene argomentata la necessità di ripensare criticamente quella dimensione “difensiva” della vulnerabilità, che prevale nella normativa europea e occidentale. ---------- The comparison between the Oviedo Convention and the Regulation (EU) No. 536/2014 has allowed to discover and structure the European “ethical-legal standard” on the protection measures for vulnerable subjects involved in clinical trials. This standard was analyzed following the three fundamental principles of research, as outlined by the Belmont Report: respect for persons, beneficence and justice. The discrepancies found inside have highlighted the criticalities of some basic categories, such as the distinction between direct benefit or benefit on the group and the notion of minimal risk. Twenty years after the Oviedo Convention, a reference document for European and international bioethics, there is a need to rethink critically the “defensive” dimension of vulnerability, that prevails in European and Western legislation.

Abstract The present article is aimed at critically assessing the ECtHR’s decision to dismiss the first request submitted under Article 29 of the Convention on Human Rights and Biomedicine (“Oviedo Convention”) by the Council of Europe’s Committee on Bioethics, for the purpose of clarifying certain aspects of the interpretation of Article 7 of the Oviedo Convention. While the ECtHR ultimately decided not to render the advisory opinion on the grounds that it would be outside its competence, the decision is of interest because it nonetheless was an occasion for the Court to assert in general terms its jurisdiction under Article 29 of the Oviedo Convention and to define the contours of its advisory competence. Yet, it will be argued that the Court’s reasoning is rather unconvincing, if not mistaken, and that it ultimately results in an unclear definition of the boundaries of its jurisdiction. The lack of clarity is further exacerbated by the fact that the Court seems to have treated as questions of competence some issues that most likely would have had to be addressed within the framework of propriety. This aspect will appear rather distinctly if one compares the ECtHR’s approach to the solutions adopted by other international courts and tribunals. This comparison will also be useful in order to suggest an alternative path that the Court could have followed, and which would have not only represented a more correct and coherent reasoning but also avoided the likely outcome of its decision, that is putting its advisory competence under the Oviedo Convention back in the attic.
