Abstract:
Práce se zabývá mezinárodní ochranou práv k ochranným známkám, označením původu a zeměpisným označením. Práce začíná obecným úvodem do práva duševního a průmyslového vlastnictví. První část práce se věnuje úpravě ochranných známek, označení původu a zeměpisných označení v ČR. Hlavní část práce se zabývá mezinárodním zápisem ochranných známek na základě Madridské dohody o mezinárodním zápisu ochranných známek a Protokolu k této dohodě a dále mezinárodním zápisem označení původu na základě Lisabonské dohody na ochranu označení původu a o jejich mezinárodním zápisu. Dále je popsán i způsob přihlašování ochranných známek do EU a přihlašování označení národní cestou.

Abstract:
The diploma thesis gives the view of international trademark protection chiefly through its legal regulation in international agreements and through regulation' s application to the praxis. The thesis is divided according to particular sorts of rights (trademarks, marks of origin, unsigned marks), it consider their concrete regulation, international organizations protecting the rights and trademarks rights enforcement. The aim of the diploma thesis is to explain and to show the basic principles of international trademark protection functioning on concrete cases and decisions and therefore to offer the help to those subjects, who need to orientate themselves at the area of international trademark protection.

Abstract:
The master's thesis focuses on the perception of Czech origin of the products. The main goal was to analyze the perception of the origin of the products in terms of consumers that prefer to buy Czech products, and which designations of Czech origin on products they trust. In particular, the work deals with the so-called "official designations" of Czech origin, for example "Regionální potravina" (Regional food), "Regionální produkt"(Regional product), "Český výrobek - garantováno Potravinářskou komorou České republiky"(Czech product - guaranteed by Food Chamber of the Czech Republic) and others. On the other hand, it highlights the presence of so-called "unofficial designations" and their influence on the consumer's perception. It is also focused on the legal issue of the Czech products. In the practical part of the thesis, we deal with the quantitative and qualitative research of the perception of Czech products to the consumer, which verifies the preference of Czech products and confidence in official designation of Czech origin. Finally, my work deals with the designation "made in EU" and its perception of the consumer. The conclusion of the work is that the studied subject is missing a legal description (in the Czech law system) and enables a manipulation with customers that are not familiar with the current system and could be misled.

This thesis is dealing with legal means for enforcement of intellectual property rights. It is focused on rights to marking, namely trademarks, indication of source, apellations of origin and domain names. The work analyses and characterizes individual legal means and shows possibilities of their use. There are presented procedures of enforcement of rights to marking, definitions of terms and practical examples. The works concentrate not only on Czech legal regulations but also on legal regulations of the European Union and legal regulations of international institutions such as for example agreement TRIPS.

62 Designations of origin and geographical indications Resumé This thesis as an introduction briefly indicate subject which was chosen to deal with. There are determined objectives which author wanted to achieve. Following content is excursion to the history of law regulation of those institutes and definition of legal terms used in this thesis showing mutual differences. Main subject of interest in this thesis are rights of designation of origin, including geographical indication protected by different legal adjustments. This survey is performed in Czech system of law, international multilateral agreements, international bilateral agreements and law of the European Communities. Following two chapters are oriented more in detail of law of the European Communities. Diploma thesis deals with protected designation of origin and protected geographical indication. Theoretical part concentrates on national and community legislation of geographical indication, especially addressing differences in definitions, rights, and registration processes. Practical part deals with the economical influences of geographical indication for producers who use this indication for their products. Influences are re-searched especially with the help of variable cost, purchase price, and price elasticity. These variables are compared between producers who use geographical indication and producers who do not.

Abstract:
Protection of the appellation of origin under Czech law and international treaties This thesis deals with the topic of appellation of origin. Appellation of origin is governed by Czech law, European Union law and by international multilateral and bilateral treaties. Appellation of origin is an exceptional measure because it provides an indefinite number of users meeting prescribed conditions with protection. The paper is divided into four chapters. The first chapter deals with history and with theoretical introduction into the topic of appellations of origin. Following three chapters describe the protection in the Czech Republic, European Union and on the international level. There are examples of concrete appellations of origin at the end of each of these three chapters. The examples are used in order to better demonstrate different ways of possible use of the appellations of origin. The work uses legal enactments as well as administrative and court decisions. Specialized publications and opinions of some of the users are used as well. The core of legal regulations governing appellations of origin in many countries is formed by multilateral international treaties. Protection of the appellation of origin under Czech Law and international treaties The purpose of this thesis is to present the concept of the appellation of origin under Czech Law, international treaties and also under Community Law. The appellation of origin represents very specific part of the industrial property rights. Contrary to other subjects of industrial property, the appellation of origin has more public aspects. This fact is very important for legal construction of this institute and for its protection. Speciality of the legal regulation of the appellation of origin was one of the reasons, which motivated me to deal with the problems more deeply. The thesis consists of introduction, which is followed by four chapters and the brief conclusion, which closes the whole study. The first chapter focuses on general aspects of the concept of the appellation of origin. Firstly the term "appellation of origin" is defined, analysed and compared with the term "geographical indication" (as the superior term in relation to the term "appellation of origin"). The topic of this diploma thesis is the relationship between rights of designation and unfair competition law. The thesis is divided into five chapters. The first two chapters define rights of designation and unfair competition law in general and the following chapters concentrate on the relationship between them. The first chapter focuses initially on the place of rights of designation in the system of intellectual propert y law and afterwards it concentrates on particular rights of designation, i.e. trademark, designation of origin and geographical indication. This chapter deals with characteristic features of the rights of designation and differences between them and national, international and european legislation. The emphasis is also put on current issues, that are related to the rights of designation. Chapter two is devoted to unfair competition law. This chapter focuses on legislation of unfair competition and the concept on which unfair competition law is based (that is combination of general clause and non-exhausting list of merits). in English This thesis creates a complex overview of quality marks used on food in the Czech food market both strictly Czech and originated in the EU legislation as well as decribes the procedure of their creation, legal forms of use and control system. It discusses their legal basis in international law, European law and Czech law and their legal aspects mainly in industrial property law and food and agriculture law. It then compares and contrasts the legal base with the Austrian legislation and analyzes the differences and simmilarities in these two countries and also evaluates its social context. The aim of this thesis is also to clarify the term 'quality'as understood by each of the quality marks and hence on to devide these marks into different categories.

Abstract:
In the 19th and 20th centuries, the Czech lands were among the largest hop-growing regions in the world. Hop products became, in the interwar period, one of the crucial agricultural export goods of the Czechoslovak economy. This study aims to draw attention to the process of emergence of cartels in this particular branch of agricultural production. It traces the attempts to organize the industry by means of cartels from their very beginning in the late 19th century until the dissolution of Czechoslovakia in 1938. As a point of departure, it takes the assumption shared by many theoreticians of industrial organization who argue that the given structure of the industry to some extent pre-determines the ways how the cartels emerge and the particular forms they assume. These institutions, however, might in turn reshape the structure of the industry. The analysis indicates that the cartels in the hop industry were essentially 'children of opportunity' and their emergence was rarely correlated with an economic crisis. Even though the industry gave rise also to international collusive structures, the cartels in the hop industry were essentially unstable and weak and in most cases, the attempts to create them failed.
