The concept of a multi-door courthouse presented by Frank Sander in 1976 combined with the concept of the vanishing trial presented by Marc Galanter in 2004, has transcended the boundaries of the civil trial. These concepts born in United-States, have crossed continents and are today relevant to European jurisdictions. This paper presents the emergence of these concepts, in three jurisdictions : Israel, France, and Italy. Those systems are based on different legal traditions. However, they have turned towards flexible procedures adapted to requirements of efficiency and speed. In Israel, the e

At his last conference in France, on 8 June 2004, in Strasbourg, under the title “Le souverain bien – ou l’ Europe en mal de souveraineté”, Jacques Derrida (1930–2004), always very concerned about Europe and the future of Europe, dared to admit that he dreamed of “a Europe whose universal hospitality and new laws of hospitality or the right of asylum would make it the Noah’s Ark of the 21st century”. Through the question of unconditional hospitality – which, as I try to point out, emphasizes the singularity of Deconstruction as a philosophical idiom and through which Derrida rethinks, with a v

Early modern people lived at the mercy of their surroundings. In an uncertain world, floods, storms, fires, and earthquakes could affect all levels of society across Europe. But destruction can also lead to creation. Accounts of such disasters were printed as pamphlets and then translated, suggesting a shared experience of disaster that could cross confessional divides. However, a closer look shows that more complex ideas about nation and experience were a feature of these understudied publications. This article focuses on three cases in particular: the storm and lightning strike of 1561, whic

By the entry into force of the current Code of Criminal Procedure on 01.02.2014, the national legislator aimed to create a clear, accessible and predictable judicial system for all participants involved in a criminal proceeding, but also to place this system on the pillars of new principles in order to precisely respect human rights and fundamental freedoms.
Its objectives have been specifically set out from the very preliminary theses of the adoption of the Code of Criminal Procedure, among which we mention that of establishing an appropriate balance between the requirements for an effe
