AbstractSeit etwa 1870 wuchs die Kritik an der niederländischen Rechtspflege. Das Recht hatte sich nach Auffassung vieler fortschrittlicher Juristen von der sozialen, politischen und wirtschaftlichen Entwicklung und der Praxis des Lebens entfremdet, infolge einer zu weit geführten dogmatisch-juristischen Betrachtungsweise in der (Privat)Rechtswissenschaft einerseits, und eines zu lässigen Tätigwerdens des Gesetzgebers andererseits. Das Gesetz war wegen des mangelhaften Stils und der Unverständlichkeit des Textes dem Volke fast völlig fremd. Auch die richterlichen Entscheidungen werden kritisiert auf Grund ihres unergründlichen und dunklen Sprachgebrauchs, ihres Formalismus und geradezu Barbarismus. Die Problematik der Technik, der Sprache und des Stils der Rechtsprechung und der Gesetzgebung wurden ausgiebig diskutiert in 'Het Paleis van Justitie', einem populären Wochenblatt für nationale und ausländische Rechtspflege, wie auch anderswo. Die Inspiration zu diesem Thema sollte man suchen in den Werken deutscher Juristen, wie R. von Jhering, O. von Gierke und G. Beseler. Immer wieder bittet man in Nachfolge der deutschen Vorbilder um Beachtung der Sprache und der Technik der Gesetzgebung und um Aufmerksamkeit für die Prinzipien des sorgfältigen Sprachgebrauchs in richterlichen Entscheidungen. Die Bemühungen der niederländischen Juristen mit diesen Reformbestrebungen im Rechtsleben waren mehr oder weniger politisch inspiriert: Angst vor dem wachsenden Sozialismus und vor dem Abbau der bürgerlichen Gesellschaft war ein grundlegendes Motiv in der Diskussion. Gleichzeitig spielte das aufblühende Nationalgefühl eine wichtige Rolle bei den Bemühungen um die Populärisierung des Rechts: die Integration des Volkes in der Gesellschaft verlangte ein 'zugängliches' Recht.

Abstract:
A new species of the genus Sabellaria Lamarck, 1812, is described from shallow waters off Onjuku, the Pacific side of Boso Peninsula, Chiba, Japan. Sabellaria isumiensis n. sp. is a gregarious species building colonies of tubes made of sand and shell debris over 2 m wide in the intertidal to subtidal zone of the rocky shores. The new species is distinguished by the character combination of having 1 or 2 pairs of nuchal spines, median teeth of outer paleae with 3–5 lateral spines, two kinds (long and short) of opercular paleae in the middle row of the crown, with slender blades of long ones curved outward. Morphological features of the species are described in details and compared to those of congeners from Japan and world-wide. We re-describe three poorly known sabellariid species, Sabellaria javanica Augener, 1934 from Java, Indonesia, S. chandraae de Silva, 1961 from Galle Force, Sri Lanka, and Neosabellaria uschakovi Kirtley, 1994 from the Far Eastern Seas of Russia. The descriptions are based on the type specimens, and we particularly emphasize the head morphology and paleal characters. We provide a summary of diagnostic characters in the genus Sabellaria and propose new morphological groupings that later will be tested in the framework of a formal phylogenetic analysis.

A taxonomic revision of the West Palaearctic species of the genus Pales Robineau-Desvoidy is presented and the identity of the genus is defined and discussed. Pales abdita sp. nov. from some localities in the Mediterranean region and Pales marae sp. nov. from Sardinia are described, illustrated and compared with similar species. A key to the ten known West Palaearctic species of Pales is presented. The rare genus Schembria Rondani is suggested as the possible sister-group of Pales and the male genitalia of the only known species, S. meridionalis Rondani, are figured for the first time.

Abstract Using monotonicity methods and some variational argument we consider nonlinear problems which involve monotone potential mappings satisfying condition (S) and their strongly continuous perturbations. We investigate when functional whose minimum is obtained by a direct method of the calculus of variations satisfies the Palais-Smale condition, relate minimizing sequence and Galerkin approximaitons when both exist, then provide structure conditions on the derivative of the action functional under which bounded Palais-Smale sequences are convergent. Finally, we make some comment concerning the convergence of Palais-Smale sequence obtained in the mountain pass theorem due to Rabier.

AbstractResults of a field experiment indicate that adults of the pine weevil Hylobius pales (Herbst) respond to pheromones of bark beetles. Each sex of H. pales was more attracted to traps baited with the combination of a pine bolt infested with male Ips calligraphus Germar plus the synthetic Dendroctonus Erichson pheromones frontalin and exo-brevicomin, than to traps baited with pine bolts alone. The combined numbers of male and female H. pales caught in traps baited only with Ips calligraphus-infested bolts were significantly greater than numbers caught in traps baited with uninfested control bolts. The attraction of H. pales to bark beetle pheromones may represent a kairomonal response in which weevils exploit semiochemicals from other species that signify a suitable host resource.

The enigmatic fossil Wiwaxia corrugata is organically preserved in the Burgess Shale (Middle Cambrian, British Columbia) and is therefore extractable by careful acid maceration of the mineralic matrix. High magnification transmitted light microscopy and SEM of macerated Wiwaxia sclerites reveal a substantial amount of previously undescribed structural and microstructural detail. Anatomical and histological comparison with modern organisms indicates that Wiwaxia sclerites are polychaete paleae (flattened setae) and that Wiwaxia was a jawed annelid broadly related to the extant polychaete families Chrysopetalidae and/or Aprhoditidae (Palmyra). Canadia spinosa, an uncontested fossil polychaete from the same beds, shows a paleal microstructure identical to that of Wiwaxia, as well as a closely comparable gross anatomy and taphonomic grade. The unique combination of taxonomically significant characters shared by Wiwaxia and Canadia suggest that they are more closely related to each other than either is to any other fossil or extant polychaete. Thus they constitute a separate superfamily, Canadiacea superfam. nov., in the order Phyllodocida.

One is based on the notion of half-Reeb component and the other on the Palais–Smale condition. We improve the first condition using the notion of inseparable leaves. We provide a new proof of the sufficiency of the second condition. We prove that both conditions are not equivalent, more precisely we show that the Palais–Smale condition implies the nonexistence of inseparable leaves, but the converse is not true. Finally, we show that the Palais–Smale condition it is not a necessary condition for the global injectivity of the mapX.

Abstract:
La Palis is a literary character that appeared in anonymous couplets The Death of La Palis published in the early 18th century. The image of La Palis in songs is ambiguous: he is both a naive simpleton and a parodic counterpart of the panegyric image of Marshal Jacques de La Palice (1470–1525). The irony of these early verses about La Palis is usually explained by the simplicity of the soldiers who allegedly composed them in 1525 or by the further distortion of the original text. In reality, this irony bears the imprint of the 17th century burlesque poetry. In 1715, the literary image of La Palis was canonized by Bernard La Monnoy, the author of the term nizy style. The nizy style, also called the Lapalissade, is a special kind of tautology that, as Clement Rosset aptly put it, “for a moment causes a hallucination of difference.” In the 19th century, the typically Lapalissian formula “if they did not die, then they are still alive” is recorded in the tales of various peoples of Europe; the relationship between these national formulas remains unclear. The article also examines the mastering the nizy style by O. Goldsmith and Russian translators from the 18th century to the present day.
