Abstract:
A, the owner of a house in Rome, hears that, when carrying out some building work, C intends to interfere with one of the walls. A gives notice to C that he objects to the work (prohibet). Despite this, C goes ahead with it. Or else, being aware that A would object if he knew, C deliberately carries out the work while A is away at his seaside villa at Baiae. In the first situation C is regarded as doing the work by force (vi); in the second he does it clandestinely (clam). In either event, the praetor will grant A an interdict ordering C to put the wall back to its original state so that the parties’ rights may be determined and any appropriate security given: quod vi aut clam factum est … restituas.

Abstract:

Abstract:
Abstract Scriptores Iuris Romani. On Schiavone’s Project of Roman Legal Writers and their first volume on Quintus Mucius Scaevola. Scriptores Iuris Romani is a new edition of the works of the Roman jurists, comparable to that of any other author of Antiquity. Under the stewardship of A. Schiavone, this new edition undertakes to replace Mommsen’s edition of the Digest and Lenel’s ‘Palingenesia Iuris Civilis’. Due to its basis in the ‘approccio biografico’, and also due to a naive attitude towards the problems of the textual tradition – which becomes obvious in the editorial choices made by E. Stolfi, who is in charge of this volume on Mucius –, the edition of Mucius’ Opera is not as reliable as it should be. The whole enterprise must be considered an important achievement of scholarship on Mucius, but will neither replace Mommsen nor Lenel.

This thesis sought to understand the discourses of Spiritism at the time of its emergence in the nineteenth century. How was this object of knowledge formed, and what knowledge did it mobilize to establish itself resulting in powers, subjecting individuals to a kind of self-care in modernity. Has it been from devices such as palingenesia, or the theory of successive lives, the so-called reincarnation, which was able to establish relationships that would subjectivate the subject for self-care? Spiritism pleads for itself, as a teaching of the Superior Spirits, the status of science and philosophy. It is developed from a methodology used according to nineteenth-century science, such as observation of phenomena and deduction of general laws, publication of results. Establishes knowledge, network of relationships with the individual, indicates the way to modern ascesis. It reflects the discourse of self-care for self-government to be happy in this life and in the next lives, not as proselytism but pleading that its truths are a path of happiness, what must be followed is a project based on natural laws. It proposes relationships and techniques of self to subjectivate the way in which the subject must build his life in the relation with the other. This work investigated this set of values from Foucault, through the primary and secondary reading of his work on ethics and the construction of an aesthetic of himself. Also the work of historians of religions and societies was fundamental to analyze the networks of relations between the discourses on an immortal man, an individual with great responsibility about himself, a subject of self care. The corpus analyzed was the Third Book - Moral Laws, from The Book of Spirits. As a methodology, I investigated the texts written by Allan Kardec and sought their relations with the nineteenth century and their social movements, economic relations and tensions established by capitalism, the proletariat and the bourgeoisie; the departure of the church, the rise of Protestant sects marked by psychic phenomena and the full range of ideas around spiritual manifestations. These relationships led to the understanding of self-care in a rule drawn in modernity.

Bestaggini, Antonella. "The theme of palingenesis in the Italian fin-de-siecle : Schopenhauer, Wagner, Nietzsche and the later works of Giovanni Segantini (1886-1899)." Thesis, Oxford Brookes University, 1997. http://ethos.bl.uk/OrderDetails.do?uin=uk.bl.ethos.389344.

Full text
Abstract:
This thesis reconsiders the late pictorial production of Giovanni Segantini (1858-1899) in the wider philosophical and cultural context of fin-de-siecle Italy. Its primary aims are: first, to re-evaluate the artist's involvement with the philosophy of Friedrich Nietzsche (1844-1900); second, to offer an interpretation of the intellectual concerns which informed Segantini's adoption of a divisionist technique for the articulation of Symbolist aesthetics in his later work; third, to demonstrate the central role played by the myth of rebirth (palingenetic myth) in informing the cultural climate of the fin-de-siecle. Evidence suggests that rather than being predominantly characterized by a set of pessimistic and decadent trends, the Italian fin-desiecle was permeated by a widespread concern with regeneration. During the 1870s the absorption of Richard Wagner's ideas into the Italian cultural arena can be seen as one of the earliest and most significant manifestations of such concern; Wagner's theories of cultural regeneration threw into relief the country's necessity for a national identity. Thus Chapter One offers a brief consideration of the ways in which Wagner's project for fostering the cultural unification of Germany through the power of myth and art came to have profound resonances both in the political and intellectual spheres of post-Risorgimento Italy. Chapter Two then considers the pivotal role played by the poet and political activist Gabriele D' Annunzio (1863-1938) in tailoring Nietzschean and Wagnerian notions of cultural regeneration to the peculiar context of the Italian tln-de-siecle with a view to embodying and engendering the archetypal homines noviwho would provide the catalyst for Italy's rebirth. Chapter Three moves on to tracing the dissemination of palingenetic discourse within the Positivist climate of turn-of-the-century Italy, and considers in comparative terms the regenerating ambitions which underpinned both the Positivist and Modernist paradigms. Chapter Four considers the emergence of Italian Divisionism in the context of the contemporary philosophical and cultural trends discussed in the preceding chapters. It also investigates Vittore Grubicy's theorization of 'musical Ideism' as a pictorial correlative to the Schopenhauerian assertion of the primacy of music over all the other arts. The chapter ends with a consideration of Divisionism in relation to the notions of artistic and scientific 'truth', and the role played by Nietzschean philosophy in determining a crisis of the principle of truth. Chapter Five explores in detail the divergence of opinion between Segantini and his mentor Vittore Grubicy over the capacity for tangible elements of the material world to function as symbols of 'the Idea', and suggests that Segantini's use of technique to render the visibility of the idea was informed by his reading of Nietzsche. The chapter concludes with an interpretation of Segantini's last works as embodiments of his Nietzschean ethic and aesthetic of this-worldly transcendence.

Abstract:
The essay resumes, with new historical sources, the research concerning the biography of the Sienese Jesuat Giorgio Luti, the prophecy of 1491 attributed to him and the exegetical evolution of this text in the Modern Age, published in Giorgio Luti da Siena a Lucca. The essay is divided into two parts. The first is a study of historical sources on Giorgio Luti in the Venetian area. The second part is dedicated to the study of historians from Lucca who lived between the XVI and XVIII centuries: Gherardo Sergiusti, Giovanni Cividale, Giuseppe Bonafede and Giovanni Domenico Mansi. They paid attention to the content of the Sienese prophecy for the description about wars and devastation of the Towers of Lucca, the conversion of Islamic peoples to Christianity, thanks to a company of Lucca men and women, attributing a meaning of political pacification and religious palingenesis. Overall, however, the evolution of the myth about Giorgio Luti, paradoxically, reflects in particulary the identity crisis of the Jesuats between the XV and XVI centuries.
