Full textThe aim with my essay is to find out if illegal migrant`s have the right to medical care. My material consists of interviews together with literature, and internet sources. They are main sources. The result of my study is that illegal migrant´s doesn’t have the right to medical care in practice, but they have so legally. Conclusions in my essay are: that people who work with medical care, must be able to give their patient medical care according to medical rules. The rules are that those who are in need of medical care should be given medical care. The criteria should not depend on whether a patient can pay or if they stay in the country legally. The people, who work with medical care, must be educated in illegal migrant’s right to medical care, and about how to act according to different rules, when illegal migrant´s visit a hospital. The Swedish council and government are responsible for illegal migrant´s medical care. They must take their responsibility and give them the right to medical care on the same conditions as those who stay in Sweden legally, and even pay for their medical care. Every person has the right to basic medical care needs, and to have them fulfilled.

Full textIn the beginning of 2002 a new kind of debate started inside the Swedish trade unions that also were published in the newspapers. The debate was about if the Swedish trade union
should organize the undocumented workforce or not. In this thesis I will deal with this issue and also investigate what kind of solutions the trade unions in Sweden use on this new
phenomenon, a phenomenon that recently have become a social and political problem during the last years. This is a new subject within political science and there is limited research made before. Because of that, this thesis will be empirical, inductive and exploring by its nature. The main question in this essay is “How do the Swedish trade unions think about organizing the undocumented workers and what do they believe that the union can do to make the undocumented workers circumstances easier?” In order to answer that I had to used four additional questions; which are the main trade unions in Sweden and which of them are in
contact with the undocumented workers? Who are undocumented and what does it mean? Which are the trade unions standpoints and arguments in the organization question? What do the Trade unions believe that they can do to make the situation easier for them who are undocumented?
Briefly are my conclusions that the trade unions in Sweden are divided about if they should organize or not. Sveriges Arbetares Centralorganisation is the only trade union that
organizes the undocumented workers today but Fastighetsanställdas Förbund express that they want to do it too. In the latest month, a new cooperation have started between undocumented workers and the trade unions LO, TCO, Fastighetsanstaälldas, Hotell och
Restaurang and SEKO. Perhaps this cooperation will make the situation at work and life a little bit easier for the undocumented.

Full textJuly 1 2013 a new law entered into force in Sweden. The new Education Act gives undocumented children in Sweden right to education. This is regardless whether the child has been rejected by the Migration Board on their residence permit application and shall be rejected or if the child lives in hiding and has not applied for a residence permit. Today, undocumented children's right to education does not mean that undocumented children have a school attendance, this determines the child himself or the family of the undocumented child´s the right to be utilized. This choice leads too many undocumented children do not exercise their right to education. There are several reasons for this, such that many undocumented families are not aware of the new Education Act, but also that the police actually have the right to seize an undocumented student from school. Then there exists no guarantee that the undocumented student's safety at school, many undocumented families declines this right because of the fear of being found and cared for by the police. In connection with this issue, we have identified various dilemmas for teachers, dilemmas that arise when there is a clash between teachers' professional ethics' and teachers' statutory obligations such as notification requirements to authority. In Sweden, teachers have an obligation to notify if they suspect or become aware that a child is being abused to social services. This notification requirement causes a big dilemma for teachers as the consequence of a notification can be devastating for the individual undocumented student and their family. To get a view of the teacher's dilemmas, we conducted interviews with teachers from Skåne. In the interviews we got told by teachers that the dilemma with the notification requirements and protection of undocumented students is something that teachers fear. Thanks to the Convention of Children´s Rights, teachers' professional ethics, teacher´s obligation to observe silence and confidentiality that exists at the school, teachers can protect the individual undocumented student. However, there are fears remain in the teachers about what happens if it comes to the situation where a claim must be made to social services. The results of the analysis gave us that the teachers' professional ethics is not as strong as other professional ethics so that teachers can stand up to other authorities and deny their request for the entry of the school.

Full textSammanfattning Syftet med studien är att undersöka hur irreguljära migranter, eller ”papperslösa” flyktingars situation konstrueras diskursivt i svensk massmedia. Syftet är även att studera hur ”papperslösa” flyktingars villkorade mänskliga rättigheter i Sverige legitimeras diskursivt i massmedia och hur konstruktioner av motmakt görs. Följande frågeställningar behandlas i uppsatsen: - Hur konstrueras ”papperslösa” flyktingar och deras situation diskursivt i svensk massmedia?- Hur konstrueras samhällets roll i situationen? Följande underfrågor är relaterade till frågeställningarna:- Hur legitimeras situationen som ”papperslösa” ställs inför i Sverige diskursivt?- Vilka sociala konsekvenser kan konstruktionerna ha för ”papperslösa” och för samhället? Frågeställningarna besvaras genom en diskursanalys av ett empiriskt urval bestående av tio nyhetsinslag som sänts i Sverige Television och tio nyhetsartiklar från Dagens Nyheter, Svenska Dagbladet, Aftonbladet och Expressens Internetupplagor. Analysen genomförs med diskurspsykologiska analytiska verktyg utifrån de befintliga sociologiska teorierna. Resultatet visar att situationen konstrueras enligt skilda tolkningsrepertoarer som bygger på humanitära och ekonomiska diskurser som leder till olika sociala konsekvenser och ideologiska kategoriseringar av ”vi och dom”. Resultatet visar även att retoriska konstruktioner av situationen i massmedia bidrar till att legitimera att ”papperslösa” individer marginaliseras i Sverige genom att fokus i rapporteringen ligger på politiska och ekonomiska aspekter samt ”papperslösa” individers legala status framför mänskliga rättigheter.

Full textBackground: A person without a residence permit, often lacks certain rights to care. Health professionals encounter undocumented patients in different contexts which generates a large variety of perceptions of their right to health care. Clear guidelines and flexibility is required by the nurse in order to achieve a fair and effective care for this vulnerable group. Aim: To describe the experiences and ethical arguments of health professionals and nurses in particular in the care of undocumented migrants. Method: A literature review based on eleven scientific articles were used and selected from the databases SwePub, CINAHL plus with Full Text and Academic Search Premier. The articles have been reviewed and analyzed by the Friberg model (2012a). Results: The results are presented in five main categories and two subcategories. The first main category Health professionals’ attitudes towards caring for undocumented migrants indicates that opinions differ about their rights and access to health care. Ambiguities towards the regulations are shown in the second main category Experiences surrounding regulations. The third category Caring relationship shows that flexibility is required by the nurse when caring for undocumented migrants. The fourth category presents Barriers perceived by health care professionals. The fifth and final category Organizations and cooperation demonstrates a need for health care institutions, government agencies and NGO’s to collaborate. Discussions: The result is analysed according to Beauchamp and Childress (2013) care ethical theory concerning the four principles: respect for autonomy, non-maleficence, beneficence and justice. The discussion shows that conflicts occur between the principles. Laws and limits lead to ethical stress and costs.

Full textIn Sweden, a non-regulated labor market is growing, with workers standing outside both the state’s and the labor unions’ protection. The question regarding undocumented workers’ rights has become a complex issue for Swedish labor unions. This paper clarifies what the unions do for undocumented workers. The answer investigates a wider understanding based on what deep-seated assumptions they base their organizing on. The empiric material is mostly interviews and articles from the labor unions membership publications. The wider understanding of what they do for undocumented workers is derived from Carol Bacchis method What's the problem represented to be? It is also complemented with Dvora Yanows method interpretive policy analysis. The results show that the organizing of undocumented workers is mainly through the organization Fackligt center för papperslösa (Union center for undocumented workers) and is often motivated by assumptions of uneven competition. Parallels are also drawn between Hannah Arendt and her theories about pariah and Wendy Brown and Jason Reads view of neoliberalism and its penetration of the labor market. The examined labor unions are Svenska Byggnadsarbetareförbundet Stockholm-Gotlands, Stockholms LS av Sveriges arbetares centralorganisation, Hotell- och restaurangfacket, Svenska kommunalarbetareförbundet and Fastighetsanställdas förbund.
