Abstract:
The rule of law requires political office holders to exercise their powers in accordance with the law. Most societies, however, rely not only on the moral obligation to obey the law but also require office holders to take a religious oath or solemn affirmation. The divine witness to the oath of office stands in as a guarantor of the political order but also looms above it. As such, the oath represents a paradox. It guarantees the performance of official duties while also subjecting them to external judgement. The oath thus encompasses the large question of the relationship between religious conviction, personal fidelity, moral principle, and political power. It suggests that law and religion are as much intertwined as separated in today’s politics. By tracing the oath of office as a sacrament of power, much light can be shed on the relationship between law and religion in today’s liberal-democratic politics.

Abstract:
This article is an ethnographic exploration of a promiscuously present and instantly recognisable legal and cultural artefact in India, the stamp paper document under the Indian Stamp Act, 1899. The ‘stamp paper’ is a documentary form that is constantly escaping from its legal moorings in revenue and evidentiary law, and is being replicated, mimed and recommissioned, both in form and in substance, and in ways which blur the domains of the legal, the quasi-legal and the non-legal. Its bureaucratic authority is produced through protocols and rituals of writing, verification, identification, attestation and authorisation performed by paper workers such as court typists, stamp vendors, notaries and oath commissioners. Yet the stamp paper is simultaneously viewed as notoriously fraudulent and legally invalid—its use redundant and truth functionaries infamously corruptible. Focusing on the materiality of the stamp paper, as it circulates through the interstitial spaces of Patiala House Court Complex in New Delhi, this article seeks to address this curious paradox and provides an account of the social life of law through the travels of an emblematic yet dubious legal form.

Abstract:
Job's bitterness arises as raw grief and bewilderment over the calamity that has befallen him. But under the press of the argument with his friends, which increasingly frames itself within the logic of reward and punishment and employs the imagery of a trial with its accusations and protestations of innocence, he falls into moral bitterness, a sense of outrage over the injustice done to him. When he finally swears an oath of innocence, this act, as often observed, unmasks the inadequacy of the courtroom imagery; for the God before whom he swears his innocence is at the same time the God whom he takes to be his accuser. I argue that this act shows Job reaching down to a sense of God experientially prior to and deeper than his sense of God as law-giver and judge. For he swears in the name of Shadday, giver of conception, birth and nurture. In this sense he may be said to appeal, in an elemental trust deeper in him than his moral bitterness, from God as judge to God as divine parent. The divine speeches come as a vindication of his trust, renewing his appetite for life in a world presented to him as a theater of manifold generative liveliness, dangerous but utterly worthwhile. Thus his personal struggle for the last truth about God ends with his discovery of the truth he had already encountered at the very beginning of his life. Reaching that last truth—or, rather, being reached by it—he resembles a tree which, though cut down, buds and puts forth branches like a young plant at the scent of water (14:7-9).

Abstract:
The existence of the oath in the courtroom can be traced back thousands of years throughout history, but the use, meaning, and effect of the oath in law has changed dramatically. The oath as we know it was once a powerful truth-telling instrument that our ancestors used to call upon a higher power. It was the belief of many that the oath itself was not sworn to man or state, but rather directly to a deity. The oath has since then evolved as a result of ever changing beliefs, fueled by increasing tolerance, shaping the oath into more of a tradition, and less of an edict. For centuries, theorists have attempted to determine whether an oath in court is actually effective at accomplishing its goal. The intent of this thesis is to examine the origin of the oath all the way up to the present day. It will be through a comprehensive study of federal law, state law, case law, articles, and publications that we will better understand the oath as a truth-telling instrument that in recent times has lost its effect. From there, it will be possible to better form a solution to a problem that plagues our courtrooms: perjury, or the act of lying under oath. This thesis will seek to establish the best way for our community to actively work towards ensuring the integrity and effectiveness of our judicial system.

Abstract:

The author of Hebrews is concerned that the persecution of a spiritually immature and discouraged Christian community may cause them to relinquish their mission and lose certain rewards inherent to obedience. He argues that God swears an oath in Psalm 2 and Psalm 110 in order to assure his people of the certainty of his promises (Heb. 6:13–20). He demonstrates that specific elements of the divine oath have been fulfilled in Jesus Christ, guaranteeing the eventual consummation of the inaugurated promises of this oath and providing certain benefits that enable Christians to fulfill their divinely appointed mission. These embattled saints can endure attacks from their enemies because Jesus Christ is the anointed king who will utterly defeat his enemies, and he is the promised priest after the order of Melchizedek who grants direct access to his heavenly throne for the power to persevere faithfully in the last days. Therefore, the thesis is that the author of Hebrews views Psalm 2 and Psalm 110 as oaths of God, reassures his audience by proving that God is bringing to completion all the elements of his oaths, and encourages them to take advantage of the benefits provided by God’s oaths.

Bakgrund: Av alla som drabbas av stroke får cirka en tredjedel afasi som direkt följd av sjukdomen. Oförmåga att kommunicera kan ha negativa konsekvenser, därför är det viktigt att sjuksköterskan har kunskap om, och anpassar omvårdnaden för att kunna utöva en personcentrerad omvårdnad, vilket är bakgrunden för denna studie.Syfte: Att beskriva vårdpersonals omvårdnad av strokedrabbade patienter med afasi, samt att beskriva vårdpersonalens erfarenheter av att vårda strokedrabbade patienter med afasi – med fokus på kommunikation.Metod: Strukturerad litteraturstudie av kvalitativ empiri baserad på elva studier varav majoriteten härstammar från Skandinavien. Använda sökblock var: Stroke, Communication och Nurses. Resultat: Tre huvudteman identifierades: icke-verbal kommunikation, hjälpmedel samt sjuksköterskans bemötande. Sjuksköterskan använde icke-verbal kommunikation genom beröring, kroppsspråk och observation av ansiktsuttryck för att tolka patienten. Hjälpmedel sjuksköterskan tog i bruk var att dela upp information, tala långsamt, vänta på svar då tid var av betydelse, ta en sak åt gången, gestikulera tydligt, visa sitt engagemang genom att gissa och hjälpa patienten att finna orden samt återgivning av information för jakande eller nekande. De använde även närstående, bilder, illustrationer, och skriftligt stöd för hjälp i kommunikationen. Det tredje temat, bemötande, innefattade att sjuksköterskan hade ett uppgiftsorienterat bemötande framför personcentrerad. Sjuksköterskan var styrande i samtalen och exkluderande mot patienten när andra personer satt med. Osäkerhet kopplat till okunskap framkom som en förklaring till beteendet. Konklusion: Sjuksköterskan har en god intention med sitt bemötande av patienter med afasi, men välvilligheten till att anpassa sig kan ibland ha motsatt effekt då sjuksköterskan tenderade att styra kommunikationen. Detta hade grund i osäkerhet och okunskap om diagnosen. För att uppnå förståelse måste både parter vara aktiva i kommunikationen.
Background: A third of those suffering from stroke acquire aphasia as a direct consequence. Inability to communicate may lead to depression, which is why it is of importance that the nurse adapts her care according to the patients’ abilities. Nurses’ knowledge about aphasia can help strengthen the patients’ self-esteem and enable a higher level of care. Aim: Portrait nurses’ care of patients with aphasia aswell as describing nurses’ experiences of caring for patients with aphasia– focusing on communication. Method: Structured qualitative literature review including eleven articles, majority originated from Scandinavia. The search for scientific papers was conducted by using the keywords stroke, communication and nurses. Result: The articles generated three main themes: Non-verbal communication, tools and nurses’ reception. The nurse used non-verbal communication by touch, body language and active observation of the patient. Tools used was dividing and repeating information. Speak loud and clearly. Show interest and that there was time and help the patient finding the words by guessing. Using the relatives as a communication tool same as pictures, illustrations and writing as support in the communication process. The third theme, nurses’ reception, included that nurses tended to have a task based communication and directed the dialogue or excluded the patient when others were around. Insecurity due to lack of knowledge can be an explanation for this behavior.Conclusion: Although good intentions with reception of patients with aphasia, this showed reverse effect when the nurse tended to control the conversation due to insecurity by a lack of knowledge. To reach understanding both parts had to be active in the communication process.

Disertacijos tyrimas apima paprotinės ir pozityviosios teisės raidos etapuose susiformavusius teisinius santykius, atsirasdavusius ir tebeatsirandančius priesaikos instituto taikymo ir jo funkcijų įgyvendinimo srityse. Šiame darbe nagrinėjami istoriniai, lituanistiniai šaltiniai; nacionalinių, tarptautinių ir kitų valstybių teisės aktų normos, reglamentuojančios priesaikos institutą, taip pat šią temą nagrinėjanti Lietuvos teisės doktrina. Priesaikos teisinio instituto ir jo socialinio vaidmens tyrimas bendrąja prasme – tai vieno iš seniausių ir gilias tradicijas Lietuvoje turinčio teisinio instituto tyrimas. Priesaikos sampratos (sąvokos) pažinimas yra organiška teisės doktrinos, kaip vienalyčio darinio, dalis, tačiau šio instituto prasmė ir reikšmė teisės normose ir teorijoje (moksle) nėra plačiau tyrinėta. Šiuo tyrimu bandoma atskleisti socialinę teisinę priesaikos esmę, jos evoliuciją ir virsmą į tikrai talpų (vertybių ir atliekamų funkcijų požiūriu) teisinį reguliatorių, kuris laikytinas Lietuvos Respublikos Konstitucijoje įtvirtintų pamatinių vertybių koncentracija, o kartu ir jų veiksnumą užtikrinančiu įrankiu. The subject matter of the research and its relevance The subject matter. In the present paper one of the inter-branch law institutes namely – the oath is being under discussion. The treatment of the problem embraces the development of law from time honored stages up to the present state. Within the period the law terms has changed considerately and the process is still in progress, especially in the sphere of the implementation of its functions. In the given paper the objects of research are the historical and native Lithuanian sources; i.e. the norms of national, international legal acts and the acts of other states in which the oath institution is called upon, as well as the Lithuanian law doctrine dealing with this problem. The general approach to the research of the juridical Oath Institution and its social significance has a long standing tradition in Lithuania. The cognition of the concept of the oath is an organic element of the law doctrine, as an integral formation, however has never yet received a deeper research either in legal norms or in theory. The given paper is an attempt to reveal the juridical and social essence of the oath, its evolution and transformation into a really meaningful juridical regulation of values and its fitting functions.
