Full textThis thesis intends to highlight, thanks to a longitudinal study, a double paradox between union, management and environment. The process that has enabled unions and more precisely confederations to gain legitimacy about environmental issues since the 1970's was reconstructed based on trade-union archives. In reply to the absurdities of society and owing to the responsibility for the employees they defend, confederations set up union environmental policies. These policies, despite being irregular, are a support to activist actions to protect jobs, working conditions (health, safety) and personal life conditions of workers. Their expertise, partly outshined by other powerful actors, allows them to often be proactive with institutional decision-makers especially in order to have a legal framework favourable to a dialogue concerning the environment. That's how they participated in the creation of the first sustainable development report in 2001. Beyond the construction of a union history, this thesis contributes to the definition of the concept of participation in management and environmental management (Richard, 2012)

Full textLabour legislation could help to provide a juridical system suitable to reduce conflicts. A company should organize a peaceful coexistence, in order to avoid being forced, by excessive actions by the staff, to jeopardize its economic requirements. An employer has to adapt to syndicate movements, while knowing that a logic necessity exite between syndicalisme and politics, and that he has to act accordingly. The economic crisis entails the trade-unions'mobilization for the employment problem. An employer ought to adapt to circumstantial behaviour and discussion. If necessary, syndicate representation could be limited by restrictive criteria in determining the eligibility of those who may pass the threshold. Information provided by an employer,as well as the rules of collective discipline, habe to be adapted to the social partners. The checking of absenteeism does not preclude a system of medical counter-inspection. By adhering to the company's scheme, an association of the social partners can be obtained. If obligatory participation is inefficient, well-defined objectives habe shown to be an advantageous method to interest employees. Employee share-holding might be a peaceful solution. Juridical difficulties due to the liberty of the companies and to the competence of their sections can be solved. Employee participation in the business capital has to be planned harmoniously. By elaborating a social evolutive status, a solution can be found to the problems faced by those responsible for the achievement of labour contracts. At the beginning, during or at the end of a collaboration, compromises must be negociated, in order to avoid conflictual procedures. Individual merits can be taken into account by a system of dynamic remuneration. Very often, the social climate deteriorates for lack of will to explore different solutions. Juridical choices are only one aspect of a vast problem which has to be grasped by a pluridisciplinary and complexe approach

Full textTrade union militancy in VSEs: proposal for a typology of trade union participation of employee advisersThe literature has so far focused largely on union activism in large corporations. This study seeks to enrich it by attempting to understand the construction of union militancy of employee advisers in very small companies in France, an analysis that has so far been lacking to our knowledge. It is based on 132 semi-structured interviews with employee advisers, representatives of the five main representative trade union organizations (CGT, CFDT, FO, CFECGC and CFTC), employers' organizations and the State. By mobilizing the literature on union participation and job crafting, the study identifies three profiles of activism in the context of very small businesses: the "good soldier", the "rights defender" and the "societal fighter". The study highlights the mobilization of the job crafting process by employee advisers to build their union activism in very small companies. They manage resources and demands to build new trade union participation and extend their activism into new environments. The study also shows that union activism in very small firms is evolving towards more individualized relations with employees, greater autonomy and increasing professionalization of activities

Full textWhen a business is going through difficulties of the worst kind, is faced with the beginning of bankrupcy proceedings, questions on the outcome of work contracts and workers participation take on particular importance. As a complement to the 1982 auroux laws, the laws of 1st march, 1984 and 25th january, 1985 have been an attempt to find an answer. Although they are closely linked to work law, they ensure, in pratice, only a partial defence of employment. Article l. 122-12, para 2 of the work code is only of relative efficiency in employment protection. Despite the development of information and consultation with workers' representatives as well as a recognition of their involvement in the economic management both at a stage of prevention and treatment of difficulties, these initiatives have proved ill-adapted to any modification of the firm's trajectory. Finally no place has been reserved specifically for trade unions and the workers' representatives find themselves playing no role in the drawing up of an amicable agreement on these difficulties. Though there remains a feeling of incompletion, it must be recognized that the new laws are a social progress in comparaison with the law of 1967

Full textWhile the vote has a growing symbolic weight in the French system of industrial relations, especially since the reform of union representativeness in 2008, political science as well as industrial relations and labour studies have shown only marginal interest for electoral practices in the professional field. At the crossroads of these two disciplines, this thesis aims to render the individual, contextual and environmental logics of electoral mobilization and choice during workplace elections, building on the explanatory models of voting proposed by electoral political sociology.To this end, our thesis, which focuses on private sector employees in France, mobilizes and combines quantitative and, to a lesser extent, qualitative materials, collected at several levels: the MARS electoral database (Audience Measurement for the Calculation of Union Representativeness), the data from the REPONSE surveys (Industrial Relations and Company Negotiations) and from the 2010 SRCV survey (Statistics on Incomes and Living Conditions) as well as a questionnaire survey carried out among Pôle Emploi employees.In light of these materials, it appears that the workers’ electoral behaviour in professional elections, far from being inexplicable, depends on social logics. However, if the models proposed by electoral sociology prove relatively relevant, it appears necessary to adapt them to the specificities of the professional field. Thus, in the same way as Daniel Gaxie observed for the political field, there appears to be a "hidden census" in "industrial democracy". But the highlighted invisible barriers are much more related to the employees’ working conditions and contexts than to their educational capital: those who are both less likely to face workplace polls and, when they can actually vote, significantly more likely to abstain, are the most precarious employees, the least professionally integrated, the youngest as well as those employed in the smallest businesses. Similarly, if the employees’ electoral mobilization and choices depend on the contexts in which their votes are produced, what is decisive are the interactions in the workplace between the employees and their representatives or between the employees themselves.To reveal the reasons for employees' votes in professional polls helps to contribute, not only to the study of industrial relations, but also to the discussion on the explanatory models of voting in electoral sociology, especially since participations at political and workplace elections are closely linked
