Abstract:
This thesis discusses Scottish rules of civil procedure and the United States Federal rules of Civil Procedure relating to four mechanisms of adding new parties to the pending action in the light of certain basic interests. These devices are intervention, third party procedure, interpleader by way of counterclaim and, joinder of parties. The thesis aims to accomplish two basic objectives as follows. First, to identify whether coherence exists between Scottish and the United States Federal laws in respect of the procedural rules which regulate the process of adding new party to civil action. Second, on the basis of identifying whether there is coherence between Scottish and Federal rules underlying the rules for inclusion of additional parties, it aims to study these rules and criteria in the light of three vital interests which are involved in any case when a new party is added to the pending action; the interest of the absentee, the interest of the original parties, and the public interest. Mainly, this thesis addresses the question as to what extent the Scottish and Federal rules of civil procedure accord respect to the above-mentioned interests. There appears to be no existing comprehensive legal and theoretical evaluation that addresses the question as to whether the Scottish and the United States Federal rules for admitting additional parties further or inhibit the proposed balance between the above-mentioned interests appropriately. In addition, the very few comparative studies which address questions of civil procedure in general and comparative procedural law between Scottish and the United States Federal rules in particular, provide an additional backdrop to this research. It is argued that, for the most part, Scottish rules accord respect to the proposed balance of interests to a greater extent than does Federal rules of additional parties. The reasons that Federal rules of additional parties do not accord sufficient respect to the proposed balance of interests as outlined throughout this thesis are due to the following: (i) the categorization of intervention into two lands; intervention of right and permissive intervention (ii) The non-availability of third party procedure for a defender against some one who is liable to a pursuer (iii) Adopting a long process to assert third party procedure against some one who is already a party to the action, (iv) Permitting a defender to assert a remedy of interpleader against the original pursuer and non-parties in the original action which may extend the scope of the original action to include ancillary issues. However, it was argued that in relation to the mechanism "joinder of parties" and for the most part, both Scottish and the United States Federal rules intend to protect similar interests that have been already protected by other procedural vehicles. It is argued that this trend causes particular difficulties such as producing an overlap between the process of adding new parties and may result in anomalous results by giving the same matter different meanings.

Abstract:
This thesis addresses the problem of the privilege against self-incrimination ("the privilege") in civil proceedings between private parties in Australia and New Zealand. This problem has been recognised by judges, law reform bodies and legislators in both countries for twenty years. However, the legislative response has been inadequate. The privilege is easily confused with other related concepts, particularly the right to silence in criminal proceedings. The reasons for the privilege in civil proceedings are not necessarily the same as for the right to silence. Care is therefore taken to define the terminology and scope of the thesis. It sets out the modern law on the privilege in civil proceedings between private parties. It describes how the privilege causes particular problems in those proceedings. It surveys the literature, finding that most of it concerns the right to silence. The thesis draws heavily on the history of the privilege. It argues that, although witness privilege came from the common law, the privilege in interlocutory civil proceedings had its origins in the discretionary remedies devised by the courts of equity. They were sensitive to abuse of their remedies. For the same reason, modern prosecutors should not be encouraged to rely excessively upon evidence acquired through compulsory powers. Derivative use immunity is one of several substitutes suggested for the privilege. The thesis looks at the various substitutes. It concludes that derivative use immunity is the only satisfactory substitute for the privilege in civil proceedings. Derivative use immunity originated in the United States. The thesis looks closely at the American experience. The history and scope of the Fifth Amendment are discussed in detail, particularly the supposed removal of its protection from documents. This will show that the removal of the privilege from documents is not as simple as law reform bodies in Australia and New Zealand suggest. Exaggerated claims have been made by Australian prosecutors about the problems caused by derivative use immunity. The claims are examined in the light of American case-law. This shows that an impossible burden is not imposed on prosecutors. The same point emerges when the thesis examines the operation of derivative use immunity under Australian certification procedures since 1995. Particular procedural and legislative difficulties need to be addressed, particularly when derivative use immunity replaces the privilege in interlocutory proceedings. However, certification by the court has an important advantage. The court�s exercise of its discretion provides the flexibility which automatic statutory immunity lacks. The question in the title is therefore answered in the affirmative. Derivative use immunity under a statutory certification procedure can provide the answer. Cooperation between the Commonwealth and States may be needed to overcome constitutional difficulties, but most other problems can be overcome if derivative use immunity is given a sound statutory basis.

En procédure civile, la connaissance des actes du procès par les parties est essentielle ; des garanties importantes y sont attachées, à commencer par le respect du principe du contradictoire. Une difficulté se pose, toutefois : il est malaisé de déterminer si une partie a eu connaissance de l’acte qui lui a été communiqué. Toute la question est alors de savoir comment le droit s’accommode de cette difficulté. À cette fin, deux modèles contraires peuvent être dégagés. Dans le premier, formaliste, il est fait le choix de favoriser la connaissance des actes du procès par les parties en amont, pour pouvoir se désintéresser de leur connaissance effective en aval, tous les moyens ayant été mis en oeuvre pour y parvenir. Dans le second, réaliste, on se désintéresse de la façon dont les actes du procès sont portés à la connaissance des parties, mais, par la suite, on prête beaucoup d’intérêt à la connaissance que les parties en ont réellement eue. L’étude révèle que le droit du procès civil reposait initialement sur un modèle à dominante formaliste, mais que ce modèle a évolué, particulièrement au cours des dix dernières années. Sous l’influence des soucis contemporains de rationalisation des coûts de la justice et de protection accrue des droits fondamentaux des parties, le formalisme du droit du procès civil s’est tempéré. However, a difficulty arises: it is hard to determine whether a party has in fact become aware of the act which was communicated to him. The question is to determine whether the law can accept such a difficulty. To this end, two divergent models can be provided. In the formalistic one, the choice is made to favor the knowledge of the acts of the trial beforehand, in order to be able to become disinterested in their actual knowledge afterwards, all the means having been implemented to carry this out. In the realistic one, the way in which the acts of the trial are brought to the parties' attention is neglected, but thereafter, there is a resurgent focus on the knowledge the parties have genuinely had. The study reveals that the law of civil trial was initially based on a predominantly formalistic model, but this model has evolved, especially during the last decade. Under the influence of contemporary concerns in order to rationalize justice costs and increase the protection of the parties' fundamental rights, the formalism of civil lawsuit has been tempered. Should it be even more moderate? This work neither pleads for the subversion of the classical model nor for its reinstatement. Instead, it is a nuanced evolution of the law which is suggested. It suggests to promote formalism when legal certainty requires it, without sacrificing the benefit of lightening the rules when it is necessary

La notion de partie comportant de nombreuses incertitudes, tant théoriques que pratiques, l'objet de cette thèse est de proposer une approche renouvelée de cette notion, en ne recherchant pas seulement quels sont les critères de détermination de la qualité de partie mais aussi quelles sont les personnes ayant vocation à disposer de cette qualité procédurale, car beaucoup de problèmes entourant cette notion nécessitent de pouvoir répondre à cette dernière interrogation. Il est ressorti de cette étude que le respect du principe selon lequel nul ne peut être jugé sans avoir été mis en mesure de se défendre impose que toute personne susceptible d'être jugée ait la qualité de partie, et que, sauf exceptions, le respect du devoir de non-immixtion dans les affaires d'autrui et de l'objectif de bonne administration de la justice implique de ne pas octroyer la qualité de partie à d'autres personnes que celles susceptibles d'être jugées. Dès lors, nous avons pu vérifier si les personnes étant parties ou tiers étaient légitimes à l'être et proposer, lorsque tel n'était pas le cas, des solutions pour y remédier. En outre, en analysant à la lumière de l'approche centrée sur la vocation à être partie les divers cas posant des difficultés de qualification procédurale, nous avons pu démontrer que les catégories de tiers et de parties ne nécessitent pas d'être complétées de classifications intermédiaires. A tese de doutorado trata da relação entre o instituto da substituição processual e o da coisa julgada, especialmente da eficácia ou não desta para aquele que foi substituído como parte no processo no processo civil de natureza individual. O tema ora discutido merece um tratamento atual, com a evolução da doutrina e dos institutos processuais. A doutrina majoritária sempre afirmou que a coisa julgada estende-se ao substituído porque ele é a parte material da discussão em litígio. Mais tímido é o questionamento jurisprudencial sobre essa questão. Poucas vezes os tribunais debruçaram-se sobre a possibilidade de a coisa julgada não se estender de forma automática ao substituído. Como essa clássica afirmação não satisfaz a todas as necessidades, alguns doutrinadores começaram a se questionar se essa fórmula estava correta. Alguns doutrinadores têm levantado que a proposta clássica da doutrina, de que a coisa julgada estende-se de forma automática para o substituído, não é suficiente para atender os ditames do contraditório e do due process of law. Como é exposto na tese, a extensão automática da coisa julgada ao substituído viola os princípios constitucionais do due process of law, contraditório, isonomia processual e inafastabilidade da tutela jurisdicional, e não tem amparo no ordenamento jurídico. A tese faz também uma abordagem no processo arbitral, especialmente porque são poucos aqueles que debruçaram seus estudos sobre o enfoque das peculiaridades sobre tal processo. Como é exposto, a tendência internacional, ao menos da Itália, Alemanha e Portugal, é a de estender a coisa julgada àqueles que não participaram de um litígio societário discutido em arbitragem, desde que lhes tenha sido dada a oportunidade de participar do processo arbitral. Há algumas questões que são enfrentadas, como a própria eficácia subjetiva de cláusulas compromissórias institucionais, o sigilo do procedimento arbitral e o critério de escolha dos árbitros. A primeira parte da tese aborda o conceito de substituição processual, a diferença com outros institutos, os limites dos atos do substituto e do substituído, os modelos de substituição processual e como esse fenômeno é tratado dentro da dinâmica do processo. A segunda parte aborda do conceito da coisa julgada e sua relação com a sua extensão subjetiva, bem como as razões constitucionais para que haja a sua limitação subjetiva. A terceira parte faz a conexão com o primeiro e o segundo capítulos, a fim de responder a questão a que a tese se propõe. É analisada a questão sob os princípios constitucionais referidos, em especial do contraditório. Em seguida, são analisados os argumentos que a doutrina utiliza para afirmar que a coisa julgada estende-se ao substituído e será feito um estudo crítico sobre cada fundamento. Após, é visto que a coisa julgada não pode estender-se de forma automática e indiscriminada ao substituído, e as consequências que essa afirmação tem, inclusive os limites de atuação quando o assistente é o titular da relação jurídica, enquanto a parte principal é o legitimado extraordinário.<br>The doctoral thesis considers the relationship between the principle of substitution of parties and the principle of res judicata, in particular the effectiveness or not thereof for the party substituted in an individual civil action. The topic discussed herein deserves an updated approach, since there have been changes in the opinion of jurists and in the principles of procedure. The prevailing opinion of jurists has always held that res judicata applies to the substituted party because it is the material party to the matter in dispute. The courts have been reluctant to challenge this view. Only rarely have they considered the possibility that res judicata may not automatically apply to the substituted party. But this standard assertion does not meet every need, and some jurists have started to question whether this formula is in fact correct. Some of them have suggested that the standard doctrine, which holds that res judicata automatically applies to the substituted party, is insufficient to meet the dictates of the adversary proceeding and the due process of law. The thesis argues that the automatic application of res judicata to the substituted party breaches the constitutional principles of the due process of law, adversary proceeding, procedural equality and non-obviation of judicial protection, and has no place in the legal framework. The dissertation also considers arbitration proceedings, which have their own peculiarities and have been afforded little study. It shows that the international trend, at least in Italy, Germany and Portugal, is to apply res judicata to those that have not participated in a corporate dispute submitted to arbitration, provided they have been given the opportunity to participate. A number of other issues are covered, such as the very subjective effectiveness of institutional arbitration clauses, the confidentiality of arbitration proceedings and the criteria for selecting arbitrators. The first part of the thesis addresses the concept of substitution of parties, the way in which this differs from other principles, limitations on the actions of the substitute and the substituted party, models of substitution of parties, and how this phenomenon is handled within the scope of the dynamics of a proceeding. The second part deals with the concept of res judicata and how broadly it is applied, as well as the constitutional reasons for its application to be limited. The third part makes the connection between the first two chapters, in order to answer the question posed by the dissertation. The issue is analyzed in the light of the aforementioned constitutional principles, especially the principle of adversary proceeding. Subsequently, the dissertation turns to the arguments used by the jurists to assert that res judicata is applicable to the substituted party, with a critical study of each of the arguments in favor of this assertion. The conclusion reached is that res judicata cannot be applied automatically and indiscriminately to the substituted party, and the consequences of this assertion are outlined, including the extent to which action is limited when the assistant is the party to the legal relationship, while the main party has extraordinary legal title to it.

Abstract:
Rule 31.22 of the Civil Procedure Rules 1998 provides, as a general rule, that those who receive documents through disclosure during civil proceedings may use them only for the purpose of the proceedings at hand. The general rule is subject to three exceptions, and judges have discretion to authorise subsequent use for other purposes. However, the foundational presupposition underpinning CPR 31.22 is that subsequent use, generally speaking, is improper. The thesis has two primary aims: (1) to demonstrate that the rule governing subsequent use (as developed in the case law) is theoretically and practically flawed, and that maintaining a blanket, general rule against subsequent use is unsound in principle, unjust, and procedurally inefficient; and (2) to generate a normative and procedural framework suitable for reform. Part I outlines the content, origins and operation of CPR 31.22. Through historical analysis, it suggests that presumptively categorising as improper all forms of subsequent use beyond the original litigation contradicts traditional authority. By identifying and examining the three principal rationales said to justify the modern rule, it argues that none affords sound justification. By analysing the exceptions to the rule, including judicial discretion, it seeks to show that such measures are incapable of remedying the defects in the underlying rule. Part II attempts to formulate a theoretically defensible, procedurally viable model for reforming CPR 31.22. It suggests that the presumption against subsequent use should be abolished, and the law reoriented around two central norms: the harm principle and a balancing approach. It tests this theoretical model by applying it to seven paradigmatic categories of subsequent use. Finally, it outlines a possible structure for procedural reform.

Abstract:
Purpose: The primary purpose for this research was to evaluate the quality of psycholegal reports, and the qualification of the authors. Previous research had revealed generalised poor practices in psycholegal report writing and the authors seemed unqualified as expert witness. This negatively influenced the impression and usefulness of expert psychological opinion in South African courts. The secondary purpose was to compare the results to those determined by Ireland (2012), which was a useful benchmark study in the UK as her findings corresponded with the literature. Method: This archival research analysed a hand-search sample of 20 reports written by 20 psychologists based nationally. These reports were submitted as expert opinion in civil proceedings in the Grahamstown Division of the Eastern Cape High Court between 2011 and 2016. Ireland and Pinschof’s (2009) measure ‘Quality Rating Scale’ was adapted for a South African context and used to evaluate quantitatively the reports. Focus was on the reports’ contents (fact and opinion), methods, process and overall rating, and the qualification of the authors. Results: Overall, two-thirds of the reports were rated as ‘good’ and ‘very good’. The results were generally more positive than Ireland’s (2012) findings. However, there were practices in the report writing that were deemed detrimental to the quality of the expert’s opinion. This included vague referral questions and unclear basis for concluding opinions and diagnosis. There was also a lack of discussions surrounding the scientific trustworthiness of testing methods and absent ethical considerations. Lastly, the specialised expertise of the experts was not adequately documented. Conclusion: The findings painted a more positive picture of psycholegal reporting in South Africa than illustrated in previous research, which seemingly relied on anecdotes and subjective surveys. This study used a systematic and objective measure. The findings of this study, previous research and ethical Rules of Conduct were used to consider recommendations for psycholegal report writing, and the improvement of the field of psycholegal work. Lastly, the focus of future research was discussed.

Over the past few decades, globalisation, international trade, cross-border investments, travel, and economic and personal relationships between citizens of different countries have had a profound impact on law. An increase in international relationships is inevitably followed by a growth in international and cross-border litigation. Therefore, several initiatives have been launched with the aim of unifying, harmonising, and internationalising civil procedure. Today, the international harmonisation of civil procedure is mainly achieved through soft law instruments, such as the numerous Hague Conventions dedicated to this legal field and the ALI/UNIDROIT Principles of Transnational Civil Procedure. Moreover, in the European Union, harmonisation of civil procedure has reached even more advanced levels across member states. Any party who becomes involved in an international or cross-border dispute naturally needs to understand what is happening around them. Hence, translation is attributed a major role in international civil procedure. This paper will look at translation in civil proceedings, with particular regard to international and transnational disputes which fall under the Italian jurisdiction¬. Its purpose is twofold: 1) the first aim is to propose a potential resource which could facilitate translation in Italian civil proceedings, i.e. multilingual civil court document templates; 2) the second aim is to raise awareness on the importance of translation in international and cross-border disputes and highlight the peculiarities which characterise this particular type of translation and differentiate it from other areas of both general and legal translation. Chapter 1 offers an overview of Italian civil proceedings. Chapter 2 is dedicated to legal translation. Chapter 3 focuses on Italian civil court documents and the use of templates in Italian proceedings. Finally, Chapter 4 presents the German and English translations of six Italian sample templates.

Longtemps ignoré, le principe de concentration a reçu ses lettres de noblesse des mains du juge, dans le retentissant arrêt « Cesareo » du 7 juillet 2006. Une décennie plus tard, il est consacré par le pouvoir réglementaire et devient la clé de voûte du procès civil. Les exigences de réunion de la matière litigieuse encadrent désormais la liberté procédurale des parties dans la détermination de l’objet du litige. Principe directeur ou simple norme oublieuse des garanties du droit au procès équitable, la concentration inspire autant l’engouement que la défiance. Une étude apaisée de la relation entre le principe de concentration et le procès civil nécessite de redécouvrir ce principe. Ses origines et l’étendue de son champ d’application n’ont, à ce jour, jamais été étudiées. La dissimulation de la concentration derrière l’autorité de la chose jugée voile nombre de ses aspects. Identifier l’autonomie de la norme de concentration et sa valeur principielle est le but de la première partie de l’étude. Faire valoir sa légitimité par la mise en exergue de ses utilités est le dessein de la seconde partie. S’il est tentant de réduire le principe de concentration à la seule célérité des procédures, ses utilités sont en réalité bien plus riches. Une fois resitué parmi les autres principes du procès civil, il apparaît comme un modèle d’équilibre aux confins de l’efficience et de l’équité. Finalement, la compréhension de la relation entre le principe de concentration et le procès civil supposait de mettre en lumière l’existence et l’essence d’un principe directeur « émergent » dans un système normatif en quête de repères<br>The longtime ignored principle of concentration had its important status restored by the judge in the resounding Cesareo case on the 7th of July 2006. A decade later, this principle is enshrined by the regulatory power as the back bone of the civil action. The procedural freedom of the parties in determining the object of litigation is henceforth conditioned by the clustering subject-matter in dispute. As a guideline or a simple rule defying the due process rights, the concentration principal raises the interest as much as the diffidence.The mediating analysis of the relationship between the civil trial and the principle of concentration implies revisiting the later. The sources and the extension of the scope have not yet been studied, as the principle was commonly dealt with in the res judicata perspective, thus concealing its ontological aspects. It was therefore essential, in the first part of the analysis, to identify it as an autonomous norm, as well as to determine the value as a principle. In the second part, its legitimacy was revealed by underlining the manifold usefulness of the principal that can no longer be reduced to a mere expediting proceedings tool. Among the principles of the civil process, the concentration is an equilibrium model between efficiency and equity. Understanding the relationship between the concentration principle and the civil trial ultimately revealed the existence and the essence of a guiding principle that “emerges” in a normative system in search of reference points

Abstract:
This dissertation examines the emergence, survival, performance, and national impact of rebel parties following negotiated settlements. Building on a growing literature examining the environmental and organizational factors affecting insurgent-to-party transformations, this dissertation asks why some insurgent organizations thrive as political parties in post-conflict environments and others fail to make such a transformation. I propose that foreign actors play a pivotal role in the formation of what I call “protégé parties,” which are better equipped to make the transformation into political parties than other rebel groups. Further, different kinds of sponsors have varying effects on transformation. Empirical analysis supports these propositions, finding that protégé parties with authoritarian sponsorship are better equipped to develop than those backed by democracies or no one.

Forgé pour traduire juridiquement la relation nouée tout au long de l’instance arbitrale entre l’arbitre d’un côté, et les parties à la convention d’arbitrage de l’autre, le contrat d’arbitre est depuis longtemps reconnu par la doctrine et la jurisprudence. Sans doute l’origine privée de la mission de l’arbitre alliée à son caractère le plus souvent onéreux, a-t-elle inévitablement contribué à reconnaître l’existence de ce contrat comme une évidence. Cependant, une recherche et une mise à l’épreuve, à la lumière du droit positif, des mérites de l’approche contractuelle de la relation entre l’arbitre et les parties s’avèrent nécessaires. L’étude révèle en effet que le contrat d’arbitre, imposé comme un remède aux problèmes rencontrés par le droit de l’arbitrage à un moment de son histoire, engendre actuellement davantage de difficultés qu’il n’en résout. Cela tient au fait que nombre des obligations de l’arbitre traditionnellement rattachées à ce contrat relèvent déjà de son statut établi par le décret du 13 janvier 2011 portant réforme de l’arbitrage. Il en résulte de nombreuses incertitudes et incohérences mises en lumière à travers l’analyse du contentieux opposant les arbitres aux parties devant les juridictions étatiques de droit commun. À travers une analyse critique du contrat d’arbitre, l’étude se propose d’établir les fondements d’une approche renouvelée de la relation entre l’arbitre et les parties<br>The arbitrator's contract is designed to materialize from a legal point of view the relationship built up between the arbitrator and the parties to the arbitration agreement during the arbitral proceedings. In this respect, it has been recognized for a long time by both the doctrine and the case law. It is very likely that the private source of the arbitrator's mission, along with its usually onerous nature, have participated in deeming the existence of such contract a self-evident fact.However, the contractual approach of the relationship forged between the arbitrator and the parties is worth putting to the test in the light of positive law. The study carried out in the present thesis unveiled that the arbitrator's contract, although it has been imposed as a remedy to several difficulties arbitration had once to face, actually leads to more difficulties that it solves. This is due to the fact that various obligations that the arbitrator is considered to have to comply with according to the arbitrator's contract actually preexist as a result of the arbitrator's legal status, in accordance with the Decree of January 13th 2011 on the reform of arbitration law. This results in various uncertainties and inconsistencies brought to light through an extensive analysis of disputes between the arbitrators and the parties that have been brought to State courts. Through critical analysis, this thesis offers to lay the foundation of a renewed approach of the relationship between the arbitrator and the parties

History<br>Ph.D.<br>This dissertation makes three key arguments regarding politics and print culture in antebellum Florida. First, Florida’s territorial status, historic geographical divisions, and local issues necessitated the use of political parties. Second, Florida’s political parties evolved from a focus on charismatic men and local geographic loyalties to loyalty to party regardless of who was running to national and regional loyalties above local issues and men. Lastly, the central and most consistent aspect of Florida’s political party development was the influence of newspapers and their editors. To understand Florida politics in the nineteenth century it is necessary to recognize how the personal, geographical, and political divisions in Florida’s territorial past remained a critical factor in the development and function of national political parties in Florida. The local divisions within Florida in the 1820s created factions and personal loyalties that would later help characterize national parties in the 1840s. Political leaders, with the help of editors and their newspapers, created factions based more on personal loyalties than on ideology. By the 1850s party loyalty became paramount over personal or regional loyalties. In the last years before the Civil War Democrats linked Southern loyalty to the Democratic party and accused their opposition of treason against the South leading Florida and the nation to Civil War. Yet, throughout these political changes, editors and their newspapers remained central to political success, becoming the voice of political parties and critical to attracting and maintaining potential voters. In addition to understanding how politics functioned in antebellum Florida, this dissertation contributes to our larger understanding of the Second Party System and the South. An underlying argument of this dissertation is that while the Democrats tended to be better organized and more ideologically coherent, the Whigs suffered from constant in-fighting and splintering. This led to the Democratic domination of politics and, in the South, the ability of secession supporters to control the public conversation during the Sectional Crisis of the 1850s and lead the nation to war. This dissertation also claims that there is not just one South but many and exposes the myth of a changeless and monolithic South.<br>Temple University--Theses

Les règles de procédure civile d'abord établies à destination des personnes physiques ont été élargies aux personnes morales. Le Code de procédure civile ne présente ainsi aucune disposition spéciale à ces sujets de droit. Toutefois, personne morale et personne physique ne partagent pas les mêmes caractères. Par exemple, les sociétés se singularisent par leurs apparences. Ces dernières influent non seulement sur la personnalité juridique des sociétés mais également sur l'exercice de leurs droits. Or, ce particularisme a une incidence sur le régime procédural des sociétés. Dès lors que la personnalité processuelle est identique à la personnalité morale, si la seconde est influencée par les apparences, la première l'est également. Parallèlement, si les apparences ont une incidence sur l'exercice des droits des sociétés, il en est de même de l'exercice procédural. Partant, lorsqu'une société est litigante, certaines particularités apparaissent. Certes, le régime procédural est fondamentalement le même que celui des personnes physiques. Il subit toutefois des inflexions. La jurisprudence des gares principales illustre parfaitement cet infléchissement. En d'autres termes, en dépit d'une présentation unitaire des sujets de droit, l'étude de la société partie au procès civil révèle que les règles processuelles sont parfois infléchies afin de prendre en considération les particularités de ces personnes<br>The French rules of civil procedure established first with regards to natural persons have been extended to artificial persons. The civil procedure code thus makes no special provision for these latter legal subjects. Artificial persons and natural persons do not, however, share the same characteristics. For example, all companies distinguish themselves by their unique image, which influences not only their legal personality but also the exercise of their rights. This specificity has an impact on the procedural regime applied to companies. Since legal personality is simply the status under law of the artificial person, if the character of an artificial person is artly determined by its image, that of the legal personality is also. Likewise, if appearances affect the exercise of companies' rights, the same is true with respect to their involvement in civil procedure. Accordingly, when a company becomes a litigant, certain peculiarities emerge. Admittedly, the procedural regime is basically the same as that which applies to natural persons. It does, however, undergo a number of adjustments. The jurisprudence of mainline railway stations perfectly illustrates this shift. In other words, despite a unitary presentation of legal subjects, the study of companies as parties in lawsuits reveals that judicial rules are sometimes adapted to take into account the specificities of these artificial persons

Le procès civil est un des moyens essentiels pour le bon déroulement de la justice. Il amène une difficulté de fait et de droit à l’examen d’un juge par un ensemble des formalités qui doivent être suivies pour soumettre une prétention à un juge civil, ce qu’on appelle : une instance civile. L’objectif premier de l’instance civile est de permettre l’exercice d’une justice efficace, respectueuse du droit de chaque partie afin de créer un climat de sécurité juridique. A première vue, la répartition du rôle du juge et des parties dans le fond de l’instance civil semble simple, puisque les parties sont en chargent des faits et le juge doit rendre le droit. En réalité, l’articulation des fonctions du juge et des parties est plus complexe. Concrètement, les faits et le droit n’étant que les deux versants d’une même réalité, il est délicat de définir précisément l’étendue de la place que doivent occuper respectivement le juge et les parties. Faut-il aller dans le sens d’une extension ou d’une limitation du pouvoir du juge ? Le procès civil doit-il rester la chose des parties ? Et de même la forme de l’instance nécessite la comparaison entre les deux systèmes en essayant de connaître si ils sont arrivés à aboutir à l’objective du procès civil. Bien que les systèmes juridiques français et koweitien soit de prime abord quelque différent, l’intérêt d’une telle étude comparée réside dans le fait de faire ressortir les dysfonctionnements en matière du procès civile en premier instance, et cela notamment dans le droit koweitien. L’étude de l’instance civile française va servir de référence pour apporter des améliorations dans l’instance civile du Koweït. La procédure civile française est historiquement bien plus ancienne que celle du Koweït. C’est la loi du 14 avril 1806 qui institue le premier code de procédure civile en France alors que le Koweït n’en sera doté que bien plus tard. Il ressort que la dynamique donnée au procès civil en France et au Koweït n’est pas la même, et cela en raison de la formulation des dispositions relatives à la répartition du rôle du juge et des parties. Dans l’instance civile française, ces dispositions sont plus explicites et plus précises alors que dans l’instance civile koweitienne, elles apparaissent de manière plus implicite et plus éparse. Ainsi,« le flou » qui règne dans le procès civil koweitienne, laisse plus de place à l’intervention de la jurisprudence qui plus est n’est pas toujours cohérente. Il est alors nécessaire de combler les lacunes du système koweitien, pour garantir une meilleure sécurité juridique. Le modèle français pourrait alors constituer une source d’inspiration pour apporter des améliorations au procès civil koweitienne. Ces améliorations pourraient notamment consister à réorganiser le code de procédure civile afin de rendre plus visible les dispositions concernant la répartition du rôle du juge et des parties dans les procès de première instance. Il s’agit aussi d’apporter des précisions législatives pour expliciter et faciliter le déroulement du procès civil, en déterminant les rôles respectifs du juge et des parties dans le procès civil d’instance et d’en comprendre les implications et cela sous l’angle d’une étude comparative entre le droit français et le droit koweitien<br>The civil trial is an essential means for the proper conduct of justice. Hebrings a difficulty of fact and law under consideration by a judge by a set of steps that must be followed to submit a claim to a civil court, which is called: a civil proceeding. The primary objective of the civil proceeding is to permit the exercise of effective justice, respects the right of each party to create a climate of legal certainty. At first glance, the distribution of the role of the judge and the parties in the merits of the civil judge appears simple, because the parties are in charge of the facts and the judge must make the law. In fact, the articulation of the judge and the parties is more complex. Specifically, the facts and the law is that the two sides of the same coin, it is difficult to precisely define the extent of the space to be occupied respectively the judge and the parties. Should we go in the direction of extension or limitation of the judicial power ? The civil trial should he remain the party thing ? And even the shape of the proceeding requires the comparison between the two systems trying to know if they got to reach the objective of the civil trial. Although the French and Kuwaiti legal system is at first a different, the value of such a comparative study is that to highlight the dysfunction in the civil trial in the first instance, and that especially in the Kuwaiti law. The study of French civil case will serve as a reference for making improvements in the civil case of Kuwait. The French civil procedure is historically much older than that of Kuwait. This is the law of 14 April 1806 which established the first code of civil procedure in France while Kuwait will have not much later. It appears that the momentum given to the civil trial in France and Kuwait is not the same, and that because of the wording in relation to the distribution of the role of the judge and the parties. In the French civil, these provisions are more explicit and precise while in the Kuwaiti civil, they appear more and more sparse implied. Thus, "blur" that prevails in the Kuwaiti civil trial, leaves more room for the intervention of the law that is more is not always consistent. It is then necessary to fill gaps in the Kuwaiti system to ensure greater legal certainty. The French model could be a source of inspiration to make improvements to the Kuwaiti civil trial. These improvements might include reorganizing the Code of Civil Procedure in order to make more visible the provisions concerning the distribution of the role of the judge and the parties in the original trial. It is also for legislative clarification to clarify and facilitate the conduct of the civil trial, determining the roles of the judge and the parties in the civil trial of first instance and to understand its implications and that under the angle of a comparative study between the french law and the Kuwaiti law

A motivação para o presente trabalho nasceu de um estudo sobre o art. 55 do Código de Processo Civil. Foi possível verificar, a partir daí, que o confuso e divergente tratamento que a doutrina dá a esse dispositivo legal decorre, em grande parte, da ausência de enquadramento sistemático adequado da própria assistência. Como saber quais os possíveis efeitos decorrentes da intervenção do terceiro no processo se não se sabe exatamente o motivo pelo qual ele pode intervir e nem mesmo os poderes que pode exercer durante o desenrolar da marcha processual? O direito brasileiro herdou do direito alemão a disciplina que pretendeu dar à assistência, mas sem anterior preocupação com a verificação de sua adequação, quer no próprio ordenamento germânico, quer no brasileiro. Acabou, assim, criando um labirinto do qual a doutrina ainda não conseguiu sair. Algumas tentativas doutrinárias de estudar o instituto com coerência apontam para a falta de lógica da disciplina legal da assistência, mas ainda não se pode dizer que exista no direito brasileiro um estudo sistemático da assistência. Foi o que se pretendeu fazer nesse trabalho ao demonstrar a necessidade de eliminação do art. 54 do CPC do ordenamento e a consequente reconfiguração da assim chamada assistência simples, disciplinada no art. 50 do CPC. A assistência, há tempos, está a demandar um estudo aprofundado que possa até mesmo potencializar sua utilização, já que não se pode dizer que seja algo comum nos processos embora sejam comuns as hipóteses que autorizariam sua ocorrência.<br>This work starts from a study about the article 55 of Civil Procedure Code. From that, it was possible to verify that the confusing and diverging treatment that the doctrine gives to this text comes mainly from the lack of a suitable systematic framing of the assistance itself. How to know which are the possible effects of third part intervention if one does not know exactly the reasons why the third part may intervene or even its powers in the procedure? Brazilian law have inherited from German law the discipline that it intended to give to assistance, but without thinking previously about its suitability, whether in the own German law, whether in the Brazilian law. This way, a maze was created from which the doctrine was not able to exit yet. Some coherent tries of studying the institute of assistance point to the lack of logic in its legal discipline, but there is not a systematic study of the assistance yet. That was the goal of this work, demonstrating the need of elimination of article 54 of Civil Procedure Code, with the reshaping of so called \"simple assistance\", ruled by article 50 of Civil Procedure Code. Assistance, for long time, needs a profound study that may improve its use, since it is uncommon in suits although the hypotheses that grant its use are very common.

O presente trabalho objetiva estudar sobretudo a valorização dos precedentes no processo civil brasileiro, com especial atenção para os mecanismos indutores da criação de precedentes, observando se há benefícios para a efetividade da tutela jurisdicional. São traçados breves contornos do que constitui um precedente judicial, da ratio decidendi e dos obiter dicta, dos precedentes verticais e horizontais, bem como da classificação das normas segunda sua abstração e generalidade e, por fim, da teoria econômica dos precedentes. Depois, se estudam os principais mecanismos de valorização dos precedentes encontrados no processo civil brasileiro vigente, sobretudo no Código de Processo Civil de 1973 (CPC-73). A seguir, a valorização dos precedentes é estudada do ponto de vista dos conflitos repetitivos, a relação entre demandas que veiculam questões repetitivas, e como isso afeta a indução da criação de precedentes. Ao final, estuda-se com maior atenção o incidente de resolução de demandas repetitivas, previsto no Anteprojeto de Novo Código de Processo Civil, sua origem, institutos similares de outros países e, ainda, eventuais dificuldades ou sugestões de alteração indicadas pelo direito comparado. Conclui-se o trabalho, então, tecendo-se alguns comentários a respeito de como as técnicas de valorização dos precedentes, que induzem a criação de precedentes (como o incidente estudado) poderiam melhor atender ao fim colimado, que é a efetividade da tutela jurisdicional<br>This work aims mainly at the study of the valorization of precedents in Brazilian civil procedure, with special attention to the precedent creation mechanisms, observing if there are benefits for a more effective adjudication (in lieu of the scopes of the jurisdiction). We streamline the main contours of a judicial precedent, its ratio decidendi and obiter dictum, the vertical and horizontal precedents, as well as the classifcation of legal rules according to their abstraction and generality and, at last, the economical theory of precedents. Then, we study the main mechanisms of valorizing precedents in Brazilian civil procedure in force, especially in the Civil Procedure Code of 1973 (CPC-73). Following that line of thought, the valorization of precedents is seen from the viewpoint of the repetitive litigation, the relation between repetitive lawsuits, and then how it afects the inducement of precedent creation. Afterwards, the attention is focused on the to-be-created incident of resolution of repetitive lawsuits (as of the Draft of New Brazilian Civil Procedure Code), its origins, similar mechanisms of other countries, and possible difficulties or recommendations inspired by the foreign law for amendment of the draft. Lastly, the work is closed by shedding some light on how the techniques for valorization of precedents could better serve the aim collimated, which is the effectiveness of jurisdictional protection.

This thesis is concerned with the changing relationship between political parties and civil society, focusing on the turn to community organising by the British Labour Party in the aftermath of its 2010 General Election defeat. It documents the model of community organising developed by Movement for Change (M4C), the application of this model within the Labour Party, and the impact of this model on the Labour Party's relationship to civil society. This thesis finds its theoretical home in debates about the role of political parties in modern democracy, the ability of parties to represent the myriad interests of civil society, and the extent to which parties with strong linkages to place-based forms of civil society associations are capable of bridging the divide between society and the state. Additionally, this thesis contextualises the Labour Party's turn to community organising within a history of the party's relationship to civil society from the late 19th century and throughout the 20th century, focusing on the ideas of Eduard Bernstein, Anthony Crosland and those associated with Blue Labour. Empirical material within the thesis was collected during a twelve-month period of participant observation within M4C between September 2012 and September 2013. This provided data on M4C's community organising projects in Southampton and Cardiff. Through the development of these cases the thesis considers the potential for creating a collaborative space beyond the institutional boundaries of the party in which actors from the party and civil society deliberate on issues of common concern, development campaign strategies together, and take action to affect change. The examination of this space allows this thesis to argue that the organisational capacity of a political party is enhanced when it forms strong links to civil society associations engaged in a tradition of place-based political organising, as well as offering a means by which political parties can evolve in response to external challenges they are likely to face in the future.

At a time when the majority of conflicts are non-international, providing arms to the legitimate government or to the opposition forces may influence and even determine the outcome of a civil war. It is, therefore, not surprising that such a provision is subject to a web of rules. This dissertation focuses on those applicable to the EU Member States, which arise from international, European, and domestic law. Sanctions regimes are an integral part of this legal framework. Of primary importance are, naturally, sanctions adopted by the Security Council under Chapter VII, but also the more controversial EU restrictive measures are accounted for. The dissertation aims to clarify to whom EU Member States can legally provide arms and weapons during a civil war. This investigation is justified also in light of the positions adopted by individual EU Member States vis-a-vis the conflicts in Libya, Syria, and Yemen, three conflicts particularly relevant in political and economic terms for the EU and its Member States. By analysing these three case studies and putting the whole legal framework to the test the dissertation sheds light on how EU Member States justify their intervention. The adoption of these specific case studies allows for the assessment of their positions both when they provide arms to parties that intervene on request of the legitimate government and when they provide support to opposition forces. Despite being EU Member States subject to common European rules on arms exports and being all party to the Arms Trade Treaty, their practice is far from uniform. The result of these differences is far-reaching and has an impact not only on the civil war where the arms are provided but also on the EU.

This dissertation seeks to demonstrate the legacy and historical significance of the Burma Socialist Party (BSP), and so, to solve major puzzles for scholars of Burmese history, particularly with regard to how the links between civilian and military groups in politics in Burma came about. Thus, this thesis addresses a major gap in the current historical literature, which has tended to underplay or ignore the role of the BSP. In so doing this work draws a wide range of interviews, archives and hitherto unused research sources, as well as the historical analyses in English and Burmese contribute. The thesis begins by examining the historical and cultural antecedents of the BSP. The party was formed as a major element of Burma’s independence movement, which developed from a core group of nationalist leaders. Among these leaders were founders and key members of the future BSP. The Peoples’ Revolutionary Party (PRP), the prewar version of the BSP, emerged in the struggle for independence and played a key role in that struggle as a core group around which the future state was founded. After the War, the BSP came out as separate party to compete with the Communist Party of Burma (CPB). The Tatmadaw played a key role in this process, and thus the process itself was a crucial turning point in Burma’s history. The BSP was the main political party after Burma’s independence in 1948. This situation can be seen through looking at the way the Anti-Fascist Peoples’ Freedom League (AFPFL) operated as the umbrella of the BSP. The BSP shaped domestic and foreign policies in the period 1948-58, and provided the basis of various forms of government, even at times of internal division. It was in these circumstances that the military aspect of Burmese politics became important. Careful examination of the sources dealing with the major political influences of the post-independence period shows that the Burmese military took their ideas from the BSP and launched their bid for power by taking over from the BSP.

Policy networks is a body of literature dedicated to modelling state-civil society relationship formats. In this particular relationship, an interest group with privileged (insider) access to the party in power gains advantage in the policy-making process by utilizing party’s ability to make political appointments in the civil service. The parentela (or type 1 parentela) was first discovered by Joseph La Palombara (1964) in 1960s Italy and was documented later again by Greer (1994) in 1920s-1970s Northern Ireland. Still, there has been no parentela research since 1994, save for Yishai (1992), who argued the parentela did not exist in Israel in 1980s. It seems the concept is considered of little utility to the academic community today. At the same time, as a category of policy networks, the parentela is also susceptible to the wider criticism of Thatcher (1997) and Dowding (1995; 2001) that the policy network literature is unable to introduce causal dynamics in its models and distinguish between network features and network independent variables. This study, therefore, addresses both criticisms by studying the party-group-civil service relationship in Bulgaria, for the period 2013-2015, using 26 elite interviews and a number of cases. Results show that this particular policy network is still viable today. They support Yishai (1992) that hegemonic parties have no effect on parentela formation. The study demonstrates that the cooperation between ruling parties, in need of funds, and organised businesses (groups), in need of market advantage, produces the parentela. In a case study on construction tenders, the study demonstrates La Palombara’s parentela, by exposing the process of how ruling parties intervene in the civil service through political appointees to ensure construction projects are granted to their party insider groups. The study also discovers a new parentela dynamic, labelled as type 2 parentela, where the party intervention extends further to the free market by affecting party insider’s market competitors through prejudiced regulatory inspections that disrupt targeted businesses’ operations temporarily or altogether.

Civil aerospace products manufacturers in the EEC may, as in the USA, be called into litigation as co-defendant following an aircraft accident by the victims or their dependents. As opposed to the airlines, their liability is not limited by international conventions.<br>This thesis examines their liability and insurance in case of damage to third parties after the entry into force of EEC Directive 85/374 on liability for defective products.<br>First, a brief description will be given of the evolution of the aerospace industry in Europe and its governmental regulation through certification. In the second part we will examine the evolution of product liability in Europe. The main focus will be on the Directive. After a discussion of aspects of conflict of laws and enforcement of judgments, the particulars of aviation products liability in Europe will be looked at. Finally, we will consider aviation product liability insurance.

There is disagreement about the role of civil society in the development of society, both among researchers and in national agreements between the public and civil actors. The thesis aims to study the political parties' view of the role of civil society in the development of society in Sweden. The main question sounds • What is the role of civil society in social development according to Socialdemokraterna, Moderaterna and Sverigedemokrtaerna? In order to carry out a good analysis, the basic question is divided into three sub-questions: • What are the similarities in the view of the role of civil society in social development between the political parties? • Are there any clear contradictions between the political parties on the question of the role of civil society in social development and how can these be understood? • How can the picture that appears in the analysis of the political parties' view of the role of civil society in social development give us a better picture of the more general view of civil society in Sweden? The thesis analysis is carried out as an idea analysis and is based on four ideal types which are compiled in an analysis scheme. The three political parties are selected on the basis of "most different systems design". The analyzed parties differ in ideological origin and in the party's own history and growth. The essay's analysis shows that the views of the analyzed political parties on civil society differ in most respects. The Social Democrats and Moderate politics agree on several of the ideal types used in the essay, while the Swedish Democrats' policies fail from all ideal types. The parties 'views on the role of civil society in society have clear sayings, ties with the parties' ideological origins. The large differences in the parties' politics regarding civil society can explain the many contradictory roles that civil society in Sweden is expected to take on.

Certos aspectos da vida institucional de uma república constitucional contemporânea podem ser compreendidos à luz de três conceitos extraídos de Sobre a Questão Judaica (1844) e da Introdução da Crítica da Filosofia do Direito de Hegel (1843), ambos os textos de Karl Marx: a separação entre a sociedade civil e o Estado político, o isolamento do cidadão na sociedade civil e a distinção entre revolução social e revolução política. Nossa agenda de pesquisas mostra que os três conceitos se integram nas instituições sociais e políticas que emergem das revoluções burguesas, especialmente a Revolução Francesa. Procuramos delinear o perfil dessas instituições fora do lugar-comum frequente nos discursos liberais de que o Estado é uma espécie de peso morto para a sociedade carregar. Dado esse objetivo, não seria possível elaborar esta dissertação nos limites da leitura estritamente imanente das obras da bibliografia de referência (a Filosofia do Direito de Hegel e as obras acima indicadas), já que o que se pretende é exatamente mostrar que as ideias organizadoras da crítica marxiana da política ainda nos servem para compreender o político e o social da nossa contemporaneidade, neste caso, a brasileira. Daí pormos em destaque amplas questões da nossa atualidade (do golpe de 1964 até hoje) como i) os militares, ditos por Hegel a classe da universalidade, ocupando o espaço do governo que na democracia burguesa as agremiações partidárias ocupam e ii) a Previdência Social como uma instituição que ameniza o isolamento do cidadão imerso na sociedade civil, ao menos no final da sua vida. E, fazendo isso, a previdência social revela-se também parte orgânica da esfera do político, nos termos das obras da bibliografia de referência.<br>Certain aspects of the institutional life in a contemporary constitutional republic can be understood in light of three concepts taken from On the Jewish Question (1844) and the Introduction of the Critique of Hegel´s Philosophy of Right (1843), both texts from Karl Marx: the separation between civil society and political state, the isolation of citizens in civil society and the distinction between social revolution and political revolution. Our research agenda shows that these three concepts are integrated in social and political institutions which emerge from the bourgeois revolutions, especially the French Revolution. We seek to define the profile of these institutions out of the commonplace often present in liberal speeches, according to which the state would be a sort of heavy burden that society should bear. Given this aim, it would not be possible to write this dissertation under the limits of a strictly immanent reading of the reference bibliography (Hegel´s Philosophy of Right and the works mentioned above), since our intention is to show that the organizing ideas of the Marxian critique of politics still fit to understand the political and the social issues of our contemporary world, of Brazil, for example. That´s why we put emphasis on broad issues of our times (from the 1964´s coup until today) such as: i) the military, called by Hegel the universality class, occupying the ontologically political space that party institutions occupy in the bourgeois democracy and ii) Social Security as an institution that alleviates the isolation of a citizen immersed in civil society, at least at the end of his life. And, by doing so, the social security system reveals itself as an organic part of the political sphere, in terms of the reference bibliography.

Magister Legum - LLM<br>South Africa, among others, has adopted, and is bound by, the so-called 'rule in Hollington‘ that originated in England in 1943 in Hollington v Hewthorn (hereinafter the 'Hollington case‘). The issue, among others, that the English Appeal Court had to determine in this case was whether a judgement of a criminal court could be used in subsequent civil proceedings to prove the liability of either of the litigants. The Court reached the conclusion that a judgement of a criminal court is just an irrelevant and inadmissible opinion in later civil proceedings. The court adopted the view that had a criminal conviction been admissible evidence in civil proceedings, it would lead to a situation where the defendant would end up challenging the propriety of those convictions. In the light of that, the courts would be faced with a duty to retry the criminal case in the midst of the civil proceedings. Section 17 of the Civil Proceedings Evidence Act (CPEA) provides that a conviction or an acquittal can be proved by the production of a document dully certified by the relevant court that acquitted or convicted the person in question. Furthermore, section 18 of the Supreme Court Act (SuCA) now section 34 of the Superior Courts Act (SupCA) provides that whenever a judgement, among other things, of a court needs to be proved or referred to in any manner a duly certified copy thereof will serve as prima facie evidence thereof. These sections militate against the rule in Hollington in that they allow, or at least should be interpreted in a manner that accords with the allowance of, the admissibility of conviction evidence in later civil law suits.

L’idée centrale de notre paradigme juridique est qu’une peine juste devrait être celle qui régénère les liens sociaux blessés par le crime. Si l’édifice de la justice des hommes a connu de nombreuses transformations, les éclairages historiques et philosophiques demeurent indispensables pour étudier la délicate question du sens de la peine. Les sciences criminelles doivent ainsi prendre en compte les intérêts de la société, de l’auteur de l’infraction ainsi que ceux de la victime. En ce sens, la loi du 15 août 2014 relative à l’individualisation des peines et renforçant l’efficacité des sanctions pénales prévoit, pour la première fois en droit positif, un texte consacré à la justice restaurative. L’objet de celle-ci consiste à permettre de restaurer le lien social rompu par la commission d’une infraction en offrant la possibilité à l’auteur des faits de rencontrer la victime. Réparer le préjudice causé à la victime, réinsérer l’auteur de l’infraction dans la société, rétablir la paix sociale et prévenir la récidive : tels sont les objectifs de la justice restaurative. L’étude particulière de l’article 10-1 du Code de procédure pénale soulève pour autant deux questions essentielles : La justice restaurative est-elle envisageable dans le cadre de toute procédure pénale ? La justice restaurative peut-elle trouver sa place à tous les stades de la procédure ? Pour permettre à la réflexion théorique de se nourrir des réalités concrètes, il convient de s’interroger sur les règles de procédure qui pourraient permettre d’encadrer rigoureusement la justice restaurative afin que, débarrassée de l’image utopique dont elle pourrait être affublée, elle puisse devenir un mécanisme juridique efficace<br>The core idea of our legal paradigm is that a fair sentence should be one that regenerates the social links wounded by crime. If the justice built by men has known many transformations, the historical and philosophical enlightenings remain essential to study the tricky question of the « sentence’s meaning ». Thus criminal sciences must take into account the interests of the society, of the offender as much as the victim’s. In this sense, the law of August 15, 2014 on the sentences’ individualization and reinforcing the penal sanctions’ efficiency, provides, for the first time in substantive law, a text dedicated to restorative justice. The purpose of this law consists in allowing to restore the social link broken by the commission of an offense by offering the offender the opportunity to meet the victim. To repair prejudice caused to victims, to reintegrate offenders in the society, to restore social peace and to prevent recidivism : those are the restorative objectives of justice. The particular study of article 10-1 of the Code of criminal proceedings raises two essential issues : is restorative justice possible in any criminal proceedings ? Can restorative justice find its place at each and every stage of the procedure ? In order to allow the theoretical reflexion to feed from practical realities, questions must be asked about the proceedings rules which could help producing a strict framework for restorative justice so that, freed from the utopian image from which restorative justice could be burdened with, it may become an efficient legal mechanism

A doutrina acadêmica pouco cuida do estudo da atuação do advogado no processo civil, especialmente porque o tema produz imediata associação à deontologia da profissão forense ou, alternativamente, a discussão sobre os honorários advocatícios. O presente trabalho foge dessa associação e busca analisar os aspectos da atuação do advogado no processo civil como personagem ativo da condução do processo. Se há pouco tempo lutava-se pela atuação e dinamismo do juiz para o alcance de uma melhor justiça e se, por meio das diversas reformas processuais, buscou-se o aumento da celeridade processual, agora é o momento da valorização do advogado para o aprimoramento desses dois aspectos. O estudo tem por objetivo demonstrar que a valorização da advocacia como entidade indispensável à realização da justiça pode efetivamente contribuir para a melhora do processo civil, fornecendo esteio para obtenção da tão desejada justiça justa e rápida. A tese se divide em três partes: inicialmente há uma releitura dos institutos fundamentais do processo que, sem repetir informações de conhecimento notório, demonstra a possibilidade de realce da ação e da defesa institutos nos quais a participação do advogado se destaca sem, contudo, retirar a jurisdição do centro da teoria processual. Na segunda parte, o termo condução é analisado com viés ampliativo, assentando o entendimento de que, de fato, não cabe somente ao juiz a direção do processo, pois se levada esta idéia ao extremo, somente haveria condução pelo juiz nos sistemas em que vigorasse o case management. Por fim, na última parte, o papel do advogado é colocado em pauta e, durante a exposição, são feitas propostas para o aprimoramento do nosso sistema processual civil. Ainda que algumas das propostas possam ser factíveis apenas quando nosso sistema e nossa sociedade alcançarem um maior grau de maturidade, todas elas partem de pressupostos que podem ser colocados em prática de imediato.<br>The study of the lawyers´ role in civil proceedings is poorly taken by the academic doctrine, especially because the matter in discussion is often associated to the ethics of the profession or, alternatively, to a discussion of the lawyers´ fees. The present study disregards this association and tries to examine aspects of the lawyers´ role in civil process as an active character on the procedure management. Few years ago, the academic studies spent relevant time searching for the amplification on the performance and dynamism of the judge to reach a better justice and, after some changes on the procedure laws with the purposes of accelerating the procedures phases, now is the time for a recovery of the advocacy as a profession, based on which we will be able to improve these two aspects. The purpose of the present study is to demonstrate the enhancement of advocacy, as a vital corporation to achieve justice, and how it can effectively contribute on the improvement of the civil procedure itself, providing grounds for the much desired fair and quick justice achievement. The thesis is divided into three parts: first, there is a reassessment of the fundamental institutes of the process which, without repeating well-known information, demonstrates the ability to highlight the action and the defense - in which the participation of the lawyer stands out - without, however, withdrawing the jurisdiction from the center of the procedural theory. In the second part, the term management (condução) is analyzed with enlarged bias, with the understanding that, in fact, the judge is not the only one responsible for leading the process. The reasoning is that, if this idea is led to the extreme, only in the systems where the case management exists the judge will be able to exclusively lead the process. Finally, the last part, the role of the lawyer is put in the agenda, and during the explanation, proposals are made to improve our system of civil procedure. While some of the proposals may be feasible only when our system and our society achieve a greater degree of maturity, they all start from assumptions that may be put into practice immediately.

A cláusula de limitação de responsabilidade é a estipulação pela qual as partes de um contrato decidem estabelecer um limite ao efeito indenizatório da responsabilidade, seja por meio da escolhe de um valor máximo, seja por meio da alteração das regras supletivas do regime legal. No Brasil, essa cláusula não possui previsão legal específica, porém, em razão de sua frequência na prática, faz-se necessário o estabelecimento de critérios para a determinação da extensão e dos limites que devem ser observados para que sejam válidas e produzam os efeitos buscados pelos contraentes. Este trabalho exclui da análise os contratos de adesão e os contratos firmados no âmbito das relações de consumo. Também, não se analisa a cláusula de afastamento integral da responsabilidade (a chamada cláusula de exoneração da responsabilidade). A fim de determinar tais critérios, partiu-se dos limites impostos à autonomia privada em geral – ordem pública e normas cogentes – e dos critérios citados pela doutrina e pela jurisprudência, específicos à cláusula limitativa, quais sejam, o dolo, a culpa grave e o inadimplemento da obrigação principal. Assim, com o objetivo de tornar cada mais clara a incidência de cada uma dessas balizas e, em especial, afastando-se a invalidade/ineficácia automática da cláusula em casos de inadimplemento da obrigação principal, buscou-se delinear como a cláusula interage com a regulação contratual de interesses e com a apuração do montante indenizatório, por meio da análise da composição da indenização.<br>The limitation of liability clause is the stipulation by which the parties to a contract decide to establish a limit to the indemnifying effect of liability, either by choosing a maximum amount or by changing the rules of the legal regime. In Brazil, this clause does not have specific legal provisions, but because of its frequency in practice, it is necessary to establish the criteria for determining the extent and limits that should be observed for it to be valid and produce the effects sought by the parties. This study excludes from the analysis the adhesion contracts and the contracts signed in the scope of consumer relationships. Neither the exclusion of liability clause is analyzed. In order to determine such criteria, this dissertation starts from the limits imposed on party autonomy in general – public order and cogent norms - and proceeds to the criteria mentioned by doctrine and case law, specific to the limitation clause, namely, willful misconduct and the default of the fundamental term. Thus, to clarify the incidence of each of these limits and, in particular, to remove the automatic invalidity/ineffectiveness of the clause in cases of default of the fundamental term of a contract, this work delineates how the clause interacts with the contractual regulation of interests and with the determination of the indemnity amount, through the analysis of the composition of the indemnification.

Tal instituto faz parte das Tutelas Provisórias, aquelas analisadas a partir de um juízo sumário a fim de se conceder maior eficiência ao processo durante o seu curso. Num primeiro momento necessário um estudo sobre o panorama geral das tutelas provisórias, dando um enfoque na de urgência, a qual demanda a presença dos requisitos da probabilidade do direito e do perigo de dano ou risco ao resultado útil do processo, de forma cumulativa. Feita essa abordagem, concentrar-se-á o estudo nos casos explícitos de tutela da evidência, presentes no rol do art. 311 do Código Processual Civil, estabelecendo-se, ainda, as premissas para a suas diferenças em relação à tutela de urgência, principalmente no tocante à ausência de demonstração do periculum in mora. Por fim, um estudo acerca de hipóteses de tutela evidente fora do rol do art. 311, e até mesmo do CPC/2015 necessita ser feito, pois a legislação processual preconiza algumas situações “especiais” de evidência, em que se concede tutelas, e até mesmo liminares, somente com o fumus boni iuris. The unreasonable length of Italian civil proceedings goes on filling pages of newspapers and magazines. According to some authoritative views, the inefficiency of the civil justice system helps explain why the Italian model legislation on civil proceedings, as well as its academic research, are not as influential on the European scene as they were in the past. It is interesting to note that an opposed thesis has pointed out that the Italian procedurallaw and recent researches in civil proceedings lack a clear, up-to-date, principle-oriented and comprehensive approach towards problems and challenges that contemporary civil justice systems face today. Such an outdated and overly complicated approach might contribute to the inefficiency of the Italian civiljustice system. The Italian Law Journal, which aims to both spread knowledge (and criticism) of the Italian legal system and foster international debate among lawyers of different traditions, may be an appropriate venue for deepening our understanding of the current performance of the Italian civil justice system. Itmay, in particular, assist in ascertaining the major causes of the inefficiencies, with a view to assessing (in a subsequent article) if the prevailing way of thinking of legal scholars may, in the end, exacerbate the relevant problems.<br>La longitud poco razonable de los procesos civiles italianos continúa llenando páginas de periódicos y revistas. De acuerdo con algunas opiniones autorizadas, la ineficiencia del sistema de justicia civil ayuda a explicar el motivo por el cual el modelo italiano de legislación en materia de procedimiento civil, así como su investigación académica, no sean tan influyentes en la escena europea como lo fueron en el pasado. Es interesante notar que una tesis opuesta ha señalado que el derecho procesal italiano y las investigaciones recientes sobre el proceso civil carecen de un enfoque claro, integral, actualizado y orientado por principios sobre los problemas y desafíos que el sistema de justicia civil afronta actualmente. Tal enfoque anticuado y demasiado complicado podría contribuir a la ineficiencia del sistema de justicia civil italiano. El Italian Law Journal, cuyo objetivo es la difusión de conocimiento (y crítica) del sistema legal italiano y la promoción del debate internacional entre abogados de distintas tradiciones, puede ser un modo apropiado para profundizar nuestra comprensión del desempeño actual del sistema de justicia civil italiano. Puede, en particular, ayudar a determinar las principales causas de las ineficiencias con el fin de evaluar (en un artículo posterior) si la forma predominante de pensamiento de los estudiosos del derecho posiblemente, al final, exacerba problemas relevantes.

O presente trabalho tem por objetivo analisar o julgamento colegiado dos recursos nos Tribunais de segunda instância, à luz das razões teóricas subjacentes à colegialidade e das garantias fundamentais do processo. Após a exposição das finalidades com que, em abstrato, a lei processual institui um órgão judicial colegiado para o julgamento dos recursos (i) reforço da cognição judicial, (ii) garantia de independência dos julgadores e (iii) contenção do arbítrio individual , é feita a análise pormenorizada das sucessivas etapas de que se compõe o procedimento recursal ordinário da apelação, conforme a disciplina prevista nas leis federais e em disposições regimentais, como a distribuição dos recursos, o papel do relator, a figura do revisor, a pauta da sessão de julgamento, o regime da sustentação oral, a mecânica da deliberação colegiada, a atividade de redação do acórdão e a intimação das partes quanto ao teor da decisão, a fim de identificar os pontos em que o regime formal do julgamento dos recursos termina por revelar um descompasso com as premissas por que deveria se guiar. Em todo o trabalho, o marco teórico utilizado deita raízes na concepção democrática do direito processual civil, fundada na máxima eficácia das garantias fundamentais do processo previstas na Constituição Federal de 1988.<br>The present study aims to analyze the collegial judgment of appeals in the second instance Courts, from the viewpoint of the theoretical reasons underlying the collegiality and the fundamental guarantees of the parties in the civil litigation. After the exposure of the purposes for which, in the abstract, the procedural law establishes a judicial collegiate body for judging appeals (i) strengthening of judicial cognition, (ii) ensuring the independence of judges and (iii) restrainting individual will , it is made a detailed analysis of the successive steps that comprise the ordinary appellate procedure, according to the disciplines provided by federal laws and regimental rules, as the distribution of appeals, the role of the rapporteur, the figure of the reviewer, the agenda of the Court, the oral argument, the collegiate deliberation, the elaboration of the decisions text and the partiess notice about the content of the decision, in order to identify the points where the formal scheme of the appellate procedure reveals a dissonance with the assumptions by which should be guided. The study is guided by a democratic conception of civil procedural law, founded on maximum effectiveness of the fundamental guarantees of the parties in civil litigation as proclaimed by the Brazilian Federal Constitution of 1988.

L’office du juge quant au relevé des moyens de droit est régi par les dispositions des principes directeurs du procès civil et plus particulièrement par l’article 12 du code de procédure civile. Fruit de la réforme des années 1960 1970 qui visait à renforcer le rôle du juge, les ambiguïtés de sa rédaction n’ont que très difficilement permis au dessein des réformateurs de se réaliser. Après trente ans d’hésitation jurisprudentielle, l’assemblée plénière de la Cour de cassation a, en 2007, enfin fixé le principe selon lequel le juge n’a que la simple faculté de s’écarter du fondement juridique invoqué par les parties si celui-ci s’avère erroné. Cependant, les exceptions se multiplient en faveur de l’obligation sous l’influence de la jurisprudence de la Cour de justice de l’Union européenne. En outre, le contexte procédural est différent de celui dans lequel est né la réforme. Des bouleversements sont intervenus quant aux exigences attendues des parties au regard du droit (principe de concentration des moyens) et l’architecture et l’objet des voies de recours est en pleine mutation (appel ; pourvoi en cassation). Le déséquilibre est flagrant entre office du juge et rôle des parties. Fort de ce constat, c’est en tenant compte des possibilités de censure du juge défaillant que la thèse propose des pistes en vue d’un renforcement raisonnable de l’office du juge de nature à offrir une meilleure garantie de leurs droits aux justiciables<br>The function of the judge, as for raising pleas in law, is governed by civil trial’s leading principles, more specifically by article 12 of the French code of civil procedure. As a result of the 1960-1970 reform, which was intended to strengthen the role of the judge, the aim of the reformers has been difficult to achieve because of its writing ambiguities. After thirty years of a hesitant legal precedent, the Court of cassation in plenary assembly, in 2007, finally laid down the principle whereby the judge only has the ability to rule out the legal basis pleaded by the parties if it turns out to be incorrect. However, under the influence of the European Court of Justice case law, exceptions in favour of the obligation are increasing. Furthermore, the procedural context is different from the one in which the reform was passed. There have been upheavals regarding the requirements expected from the parties regarding the law (concentration of pleas’ principle) and the structure and purpose of legal remedies (appeal before the Court of appeal or the Court of cassation). The disparity between the function of the judge and the role of the parties is obvious. With this observation, by considering the censorship possibilities of the failing judge, this thesis proposes leads for a reasonable strengthening of the function of the judge to offer to the litigants a best guarantee of their rights

Conforme exposição de motivos do Código de Processo Civil de 2015, um dos fundamentos para sua elaboração foi a de proporcionar maior celeridade e efetividade ao processo. Para concretizar o objetivo almejado, foi adotado o termo tutela de evidência no artigo 311, ampliando as hipóteses de antecipação dos efeitos da tutela jurisdicional, sem, contudo, necessidade de comprovação da urgência. Portanto, o CPC/2015 apresenta um novo arcabouço para as tutelas provisórias, sendo imprescindível seu estudo pelos operadores do direito. Entretanto, a mudança legislativa não possui embasamento estatístico que a justifique. Assim, o presente trabalho tem como pretensão apresentar as premissas teóricas que fundamentaram a criação da tutela de evidência, enfrentando os temas relacionados com ênfase em análise empírica de processos judiciais, verificando se existe separação entre os conceitos encampados pela doutrina e pela prática jurídica.<br>According to the exposition of motives from the Civil Process Code of 2015, one of the fundamentals to its elaboration was to provide celerity and effectiveness to the process. To achieve the intended goal, it was adopted the evidence injunction on article 311, expanding the anticipation hypothesis of the judicial protection effects, without, however, need to prove the urgency. Therefore, the CPC/2015 presents a new framework to the provisory judicial protection, being indispensable its study by the operators of law. However, the legislative change does not possess statistical basement that justifies itself. Thereby, the present work has the pretension to present the theoretical premises that grounded the evidence injunction creation, facing the themes related to emphasis in empirical analysis of judicial processes, checking if there is separation between the concepts emplaced by the doctrine and by the juridical practice.

O objetivo central do presente trabalho é contribuir para o aprimoramento da aplicação da denunciação da lide, que é instituto valorizado, especialmente porque é modalidade de intervenção de terceiro que se ajusta aos princípios da economia e da celeridade processuais. Além disso, evita decisões contraditórias, facilita o cumprimento de provimentos jurisdicionais e vincula o terceiro à coisa julgada. O instituto já era aplicado no direito romano, mudando radicalmente seus contornos no direito germânico primitivo. As características da denunciação da lide nesses dois sistemas são marcantes e influenciaram as demais legislações. A depender da preferência que se lhe pretenda conferir, o instituto estará mais associado ao caráter de assistência, auxiliando o terceiro na defesa do denunciante, ou de efetividade do processo, resolvendo duas demandas por meio de uma única instrução processual e sentença e possibilitando o reembolso do denunciante no mesmo feito. Pretendeu-se, com esse trabalho, destacar a importância do instituto, que possui traços modernos no direito brasileiro, sendo tratado por disposições de direito processual, de direito material e de direito consumerista. Apesar dessas diversas previsões legais, ainda existem controvérsias e imprecisões, gerando relativa insegurança jurídica, que poderia ser afastada, porém o projeto do novo Código de Processo Civil não as resolveu e, para piorar, suprimiu diversos avanços, tornando o instituto praticamente um desdobramento do chamamento ao processo, em que pesem os requisitos para a aplicação deles serem tecnicamente distintos. A inegável importância histórica da denunciação da lide, sua relevante utilidade e sua riqueza são evidentes, consistindo a modalidade de intervenção de terceiro mais utilizada na prática, o que justifica o estudo detido nesse trabalho.<br>The main goal of this study is to contribute to the improvement of the valued institute of implead, specially because it is a kind of third intervention institute that adjusts itself to the procedure principles of economy and celerity. Furthermore, it avoids contradictory decisions, facilitates the enforcement of judicial decisions and attach a third party to the res judicata. The institute was applied in roman law and changed its basis in earlier german law. Implead characteristics in both mentioned systems were remarkable and had an effect in other legal systems. It can be approached for different angles, or as an institute close to the so called assistência existing in Brazilian law, by which the third party helps on defense of the impleader, or as an instrument to procedure effectiveness, solving two suits by only one proof production and only one decision, and enabling the refund to impleader on the same suit. The intention of this work was to highlight the institutes magnitude, that is found in a modern conception, on procedure, material or consumers Brazilian laws. Despite been provided by law, there are still controversies and inaccuracies, what leads to judicial insecurity, that could be avoided. However, Civil Procedure Codes Project did not solve them, as well has suppressed many advances, making the institute a kind of the so called chamamento ao processo, a kind of invitation to the suit, although their requirements be technically different. The undeniable historical relevance of implead, its utility and value are manifest, and it is the third party proceedings most used, justifying the detailed study in this work
