The current Chinese Patent Law permits parallel import, but its theoretical basis is disputed. Neither theprinciple of domestic exhaustion of rights nor the principle of international exhaustion of rights can be used as thetheoretical basis to support parallel import. Chinese legislation can set aside the traditional dispute between the principleof exhaustion of rights and the principle of territoriality, support parallel import in principle, and make exceptions in whichparallel import can be prohibited if the parallel importer violates the contract or authorization agreement or conductsunfair

Limited availability of medicines is a serious problem in fulfilling the public's right to health. The monopoly of patented medicines by patent-holding pharmaceutical companies has resulted in generic pharmaceutical companies not being able to access information about patented medicines even though the patent has expired. This certainly hinders the immediate circulation of generic versions after the patent expires. Generic medicines are important because they are easier to access, more widely available, and cheaper than patented versions of medicines. To overcome this problem, a legal means ca

This is an update to a paper that appeared in the very first issue of the Journal of Generic Medicines in October 2003. Over the past few years, pharmaceutical manufacturers have started to diversify their portfolios to include generic medicines as a way to maximise their investment in patented drugs. With this dynamic as context, understanding the development and construction of a generic name may be helpful both to the manufacturer of patented drugs who wants to support the perception of distinctiveness among competition, as well as to the generics marketer who wants to leverage the legacy o

AbstractLinking patent protection to generics’ regulatory approvals is a heated topic of discussions and a friction point among countries proposing higher protection for patented drugs. Patent linkage has been pushed through bilateral and regional agreements outside of the WTO system. It is widely understood that patent linkage is implemented to delay the market entry of generic medicines. It is argued here that developing countries are not obliged to take up TRIPs plus patent-linkage obligations.A list of approved drugs and their therapeutic equivalence can be published by every country. Abstract:
The global debate on balancing incentives for innovation in the pharmaceutical industry and facilitating competition for greater access to affordable medicines and vaccines has intensified in the aftermath of the Covid-19 pandemic. Drug discovery and vaccine development are expensive processes involving significant research and development (R&D) costs. And while the economic fundamentals of incentivising innovation for the pharmaceutical industry are traditionally linked to patenting, several scholars have highlighted the inefficiencies and greater appropriation of the returns from R&D
