Full textThe present study is on the effects of household debt on wealth inequality in Canada from 1999 to 2012. It aims to contribute to the debate that is currently taking place between two camps, those who view rising household debt as the deterioration of household finances, and those who argue that the level of household debt remains serviceable. Recognizing household debt as a phenomenon situated at the intersection of the labour market and the financial market, we sought to determine its effects on household wealth at two levels of analysis: i) the wealth distribution; and ii) socioeconomic classes. This was accomplished notably by a detailed analysis of the two principal components of wealth (assets and debts), which were decomposed according to an original classification of financial categories. The study of household finances from a stratification perspective allows us to explain precisely what the principal explanation of household debt, the lifecycle hypothesis, cannot: the reasons why the rise in household debt between 1999 and 2012 was so spectacular. The study of household debt through the prism of social inequality allows us to highlight a fact that is rarely acknowledged: wealth inequality reflects important differences in borrowing capacities. The results show that the rise in household debt observed between 1999 and 2012, as remarkable as it was, did not lead to the deterioration of household finances, but it did lead to an increase in wealth inequality between socioeconomic classes. These results invite us to view credit as a facet of modern household savings, a leading factor of inequality and a form of social exclusion.

Full textLes droits militaires en France et au Canada. Étude sociologique sur leur évolution comparée depuis un siècle. Notre thèse porte sur l’évolution des garanties des droits individuels accordés aux justiciables du droit pénal militaire, en France et au Canada, et, plus largement, sur la transformation du statut social et juridique des militaires canadiens et français. Nous y montrons que, dans les deux traditions juridiques, l’évolution du droit pénal militaire est caractérisée par une tendance sensible au rapprochement entre le droit pénal militaire et le droit pénal général, que cette tendance est régulière en temps de paix depuis un siècle et qu’elle s’est accélérée depuis une trentaine d’années. La justice pénale militaire a longtemps été synonyme de législation particulière et de juridictions spéciales. Sa légitimité se fondait sur la spécificité du métier des armes, la discipline qu’exige son exercice, l’absolutisation du principe hiérarchique et l’indivision des droits de punir et de juger qu’elle consacrait. Aujourd’hui, bien que sa séparation d’avec le droit pénal général ne soit pas totalement effacée, le droit pénal militaire, en France et au Canada, tire sa légitimité de son adéquation aux principes qui commandent l’exercice général de la justice dans les sociétés occidentales contemporaines. Notre interprétation de cette transformation majeure reposera sur deux hypothèses. Leur portée dépasse les deux cas étudiés dans cette thèse qui apparaîtront ainsi comme des cas particuliers d’un phénomène général. La première rattache l’évolution du droit pénal militaire au statut social des militaires, à la transformation du métier des armes et aux processus de professionnalisation, de civilianisation et de banalisation du métier des armes. On la modulera en fonction des dynamiques de professionnalisation différentes à l’oeuvre dans les armées française et canadienne. La seconde hypothèse veut que la transformation des droits des militaires en matière pénale doive aussi son élan à long terme, au poids nouveau des droits de la « personne juridique » dans les sociétés occidentales contemporaines. Bien que la représentation moderne de la dignité de la personne humaine soit sans conteste son point d’ancrage, nous parlerons de « postmodernité juridique » pour caractériser le cadre à l’intérieur duquel la transformation du droit pénal militaire et du statut juridique des militaires prend place. On cherchera encore à montrer combien les chemins qui ont conduit à celle-ci sont différents en France et au Canada, en particulier du fait des rapports de subordination différents, sinon inverses, qui y existaient et y perdurent, entre pouvoir judiciaire et pouvoir législatif.
The Military Laws in France and Canada. A Sociological Study on their Compared Evolution over a Century. Our thesis focuses on the evolution of the guarantees of individual rights granted to litigants of military criminal law, in France and Canada, and, more broadly, on the transformation of social and legal status of French and Canadian troops. We show that, in both legal traditions, the evolution of military criminal law is characterized by a sensitive trend connection between the military criminal law and criminal law in general, this trend is regular in peacetime for a century and it has accelerated over the past thirty years. The military criminal justice system has long been synonymous with special legislation and special courts. Its legitimacy was based on the specificity of the military profession, the discipline required by pursuit, the hierarchical principle of absolutism and undivided rights to punish and judge that it was spending. Today, although its separation from the general criminal law is not completely erased, the military criminal law, in France and Canada, derives its legitimacy from its adaptation to the principles that control the exercise of justice in general contemporary western societies. Our interpretation of this major transformation is based on two assumptions. Their scope beyond the two cases studied in this and which appear as special cases of a general phenomenon. The first relates to the evolution of military criminal law to the social status of military transformation, to the military professionalization process and trivializing of the military profession. We modulate the dynamics based on different professional in action in the French and Canadian armies. The second assumption is that the transformation of the rights of the military criminal law must also its long term momentum to the weight of the new rights of the “legal person” in the contemporary societies. Although the modern representation of the dignity of the human person is undoubtedly its anchor point, we will talk about “legal postmodernity” to characterize the context within which the transformation of military criminal law and the legal status of military take place. We still seek to show how the paths that led to it are different in France and Canada, particularly because of different reporting relationships, if not reverse, that there existed and survived there, between the judicial power and the legislative power.

Full textConstatant l’actuelle internationalisation enthousiaste de la négociation de plaidoyer et craignant ses conséquences possibles sur les impératifs de justice qualitative, l’auteur propose de remettre en question l’opportunité du recours à cette pratique en étudiant l’adéquation des discours relatifs à la négociation de plaidoyer avec leur mise en oeuvre, c’est-à-dire la mesure dans laquelle les espoirs et appréhensions attachés au recours à la négociation de plaidoyer s’avèrent fondés. L’auteur adopte d’abord une approche historique dans le cadre de laquelle il étudie l’évolution des discours qui encadrent l’introduction de la négociation de plaidoyer par la pratique aux États-Unis et au Canada et par initiative législative en France. L’étude de l’opposition initiale des acteurs anglo-saxons à la négociation de plaidoyer, de leur acceptation progressive de cette pratique et de l’introduction des formes françaises de négociation de plaidoyer que sont la composition pénale et la comparution sur reconnaissance préalable de culpabilité révèlent les principaux espoirs et appréhensions attachés au recours à la négociation de plaidoyer. D’aucuns vantent ses avantages en matière d’efficience et de répression, alors que d’autres craignent qu’elle contrevienne aux principes fondamentaux de justice pénale, induise des plaidoyers de culpabilité non volontaires et produise une justice aléatoire. Empruntant une approche sociologique, l’auteur entreprend ensuite d’étudier la littérature disponible afin d’évaluer la mesure dans laquelle les modèles américain, canadien et français de négociation de plaidoyer réalisent une mise en balance équilibrée des impératifs d’efficience et de justice qualitative. Les données disponibles permettent de constater l’existence d’un grave déséquilibre aux États-Unis et d’un fragile équilibre en France, bien qu’elles s’avèrent insuffisantes pour dresser un portrait de la situation canadienne. L’auteur en conclut que l’ampleur des enjeux et la faiblesse de l’adéquation entre les discours relatifs à la négociation de plaidoyer et leur mise en oeuvre commandent non pas enthousiasme mais prudence dans le recours à cette dangereuse pratique.
Noticing the current enthusiastic internationalization of plea bargaining and fearing its possible consequences on the imperatives of qualitative justice, the author proposes to question the appropriateness of the use of this practice by examining the extent to which the discourses related to plea bargaining match with the implementation of this practice, that is, the extent to which the hopes and apprehensions attached to the use of plea bargaining are founded. The author first adopts a historical approach when studying the discourses surrounding the de facto emergence of plea bargaining in the United States and in Canada and the legislative introduction of plea bargaining in France. The study of the initial opposition of Anglo-Saxon actors to the use of plea bargaining, of their gradual acceptance of this practice and of the introduction of French forms of plea bargaining known as composition pénale and comparution sur reconnaissance préalable de culpabilité reveal the main hopes and apprehensions attached to the use of plea bargaining. Some commend its greater efficiency and repression, while others fear that it contravenes the basic principles of criminal justice, that it induces unwilling guilty pleas and that it introduces greater randomness in case disposal and punishment. Using a sociological approach, the author then proceeds to study the available literature in order to assess the extent to which the American, Canadian and French models of plea bargaining balance the imperatives of efficiency and qualitative justice. The available data show that there is a serious imbalance in the United States and a fragile balance in France, although the data is insufficient to paint a picture of the Canadian situation. The author concludes that the magnitude of the stakes and of the distance between the discourses related to plea bargaining and the implementation of the different models do not command enthusiasm but caution in the use of this dangerous practice.

Full textThis thesis questions the geography of cosmopolitanism, through the study of narratives, practices and representations around Saint Lawrence boulevard in Montreal. The street represents a divide between the “two solitudes” – the French-speaking and the English-speaking areas -, but also a bond, a passage and melting place, where immigrants settled during the 20th century. This research is based on field studies - combining observation and interviews. It also relies on studies of planning documents, reports and literature. In this former immigration corridor, three aspects of cosmopolitanism are converging, competing and sometimes overlapping: a political and identity-led cosmopolitanism, a consumerist cosmopolitanism, and a day-to-day experienced cosmopolitanism. Several scales of power operate on the boulevard (districts, municipality, provincial and federal government) so that one can read in diversity policies and heritage designations. The boulevard is also a lever for branding strategies: while “ethnic” neighborhoods clearly highlight the assets of cosmopolitanism, public and private real estate developers keep a low profile on that front in the Quartier des Spectacles. At any rate, these neighborhoods are not only about communication and branding: they are also daily experiences, commuting and hustle for cultural communities and many other inhabitants. The boulevard is therefore a space of urban experiences, that gives birth to a form of everyday cosmopolitanism, which is underpinned by venues, atmospheres and time specificities. This notably materializes through key people and special venues in time, such as festivals or walking tours

Full textThis thesis sheds new light on the growing role of First Nations in sustainable forest management. Through a qualitative and longitudinal approach, this thesis examines the evolution of collaboration between the indigenous Nehirowisiwok (Atikamekw Nation) and Quebec’ industrial and governmental actors in forest planning on Nitaskinan during the period 1990 to 2013. It aims to better understand the factors and conditions that influenced the evolution of collaborative forest governance. This thesis also aims to identify and characterize interrelations between the collaboration processes analyzed and others processes to determine how these relationships have influenced the development of collaborative efforts in time and space. During the study period, the Nehirowisiwok engaged in a myriad of approaches and initiatives related to forest planning. This study examines three distinct processes that took place at key stages during the period, analysing critical dimensions of each process. The results show that collaborative efforts were greatly influenced by a changing environment, particularly the revision of the forestry regime in the late 1990s, the Haïda and Taku River judgements in 2004 and the adoption of a new forestry regime in 2010. Importantly, although collaborative processes are distinct, the dimensions of these processes are intertwined. Changes in, or caused by, one process can have a “domino effect” on dimensions of the other collaborative processes. Finally, although most previous authors agree that collaboration is an emergent and dynamic process in time, the results indicate that these changes may be partial, rather than complete. This research highlights the interactions between the conditions for collaboration and the effects of this collaboration in the context of forest planning. Indeed, without the learning arising from previous collaborations, collaboration tends to deliver unsatisfactory results. This mostly happens when actors do not have a prior history of collaboration. Consequently, in order to obtain satisfactory and immediate benefits for all stakeholders (including the Nehirowisiwok), the actors had to develop new skills, learn the forestry vocabulary, become familiar with the concerns of the Other and refine and develop new tools and instruments. Particularly importantly, they need to build a new common approach in which they can trust each other. In short, the actors do not collaborate overnight; they must first learn to cooperate before they can collaborate effectively. The results also helped develop an empirical classification of links between collaborative processes. Five general sets of interrelations were observed: genealogical, duplication, opposition, complementarity and influence. These links show that collaborative process does not exist in isolation and can have significant effects on their environment and other processes. Moreover, they demonstrate that collaborative processes do not simply add to, supplement or replace existing processes, as is often portrayed in the literature. Finally, based on the findings of this study, new questions arise. Have other First Nations in Quebec experienced an evolution in collaborative forest planning, in the same way as the Nehirowisiwok? What are the factors and conditions that explain the differences and similarities observed? It would also be interesting to examine how collaboration has evolved in other areas of forest governance, such as the allocation of timber supply, the development of new forest policy, land use planning, or forest fire management. Finally, it seems more relevant than ever to consider how and when it is still possible to articulate collaboration to other governance mechanisms in order to take full advantage of its potential for sustainable and equitable governance of Nitaskinan.
