Abstract:
The textbook contains a systematic presentation of the main institutions of banking law in accordance with the academic discipline "Banking Law", taught at the Department of Banking Law of the Moscow State Law University named after O. E. Kutafin (MSLA). It examines the banking system of the Russian Federation and its structure; the features of credit institutions as subjects of banking law; the legal basis of the national payment system, its relationship with the banking system of Russia; the legal regulation of the deposit insurance system; legislation on bank accounts; the main types of bank loans; currency transactions carried out with the participation of authorized banks, and operations of credit institutions in the securities market. Attention is paid to the ratio of electronic money with electronic means of payment, the mechanism of non-cash payments and the procedure for implementing the institute of payment clearing. The proposed diagrams and tables facilitate the assimilation of the most difficult questions.

This commentary analyses Article 6.1.8 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning payment by funds transfer. According to Art 6.1.8, payment may be made by a transfer to any of the financial institutions in which the obligee has an account. In case of payment by a transfer, the obligor's obligation is discharged when the transfer to the obligee's financial institution becomes effective. From the moment the funds transfer to the obligee's financial institution becomes effective, the obligation becomes extinct and the obligor's liability for loss or delay ends. This commentary discusses place of performance for fund transfers,, time when the obligation is discharged, timely performance, countermand, and delay or loss in the process of transferring funds.

The United Nations Compensation Commission (UNCC), along with the United Nations Compensation Fund, was established by Security Council Resolution 692 (1991), acting under Chapter VII of the UN Charter. The UNCC is a very particular institution, one designed specifically to meet the realities of the situation arising out of Iraq’s invasion and occupation of Kuwait. As the Security Council had already determined Iraq’s liability, the role of the Commission related primarily to the verification of claims and making assessments as to compensation. This chapter discusses the UNCC’s establishment; its structure; categories of claims, all resulting from Iraq’s invasion and occupation of Kuwait from 2 August 1990 to 2 March 1991; payment to the Fund; and payment of claims.
