Abstract:
Collaboration between different business enterprises has become a must in our days of financial, technical and commercial complexity. It is highly encouraged by governments and businessmen. The traditional legal techniques known and frequently used in Canada appear however to be inadequate in some cases. The French legislator has innovated in the field by creating, in 1967, the legal framework of the Groupement d'intérêt économique (G.I.E.) The G.I.E. is an institution that has the separate legal entity of the corporation while maintaining the joint, several and illimited liability of the partners. The G.I.E. is all the way neutral. It is not aimed to generate direct profits for itself or the partners but allows the involved partners to have a better overall performance. Since 1967, over 9000 G.I.E. have been created in France to cover fields as different as the Airbus joint venture, communal maintenance services, research publicity or marketing department, buying or export offices, etc. This article, written by a leading academic, discusses the different legal aspect of the G.I.E. and explains the pros and cons of the institution.

Abstract:
The article attempts to evaluate the balance of United Nations accomplishments in the field of peace and security since 1945. The first part deals with the elements one has to take into consideration to properly evaluate such performance. These are what the Organization ought to do (its objectives), what it could do (its means) and what it has done (the kinds of activities). In the second part, each one of these elements is examined. About the objectives, the article distinguishes between manifest and latent objectives and it argues that the first ones have not changed when the second ones have much changed. About the means, the article analyzes the powers given the UN and the way its principal organs exercise them. It traces the evolution of the roles of the Security Council, the General Assembly, the Secretary general and the International Court of Justice. Concerning the kinds of activities, the article uses a typology developed by H.K. Jacobson to argue that the main function of the UN is a "verbal" or informational one, that the normative function especially in its collective legitimization aspect is the second most important, that the rule supervisory function accounts or few activities, and, that the operational function is more developed than it may appear. The article concludes that the balance is a positive one pointing to the flexibility, the adaptability and the continued usefulness of the UN.

Abstract:
Context: Neurocognitive test scores are often considered an important aspect of concussion management. To best use these data, clinicians must understand potential factors that may influence baseline performance on these tests. Objective: To determine preexisting factors that may influence performance on the Immediate Post-Concussion Assessment and Cognitive Test (ImPACT). Design: Cross-sectional study. Setting: Research laboratory. Patients or Other Participants: A total of 486 National Collegiate Athletic Association Division I collegiate student-athletes. Main Outcome Measure(s): To determine neurocognitive functioning and total symptom score at baseline, ImPACT was administered. Outcomes were verbal memory, visual memory, visual motor speed, reaction time, and total symptom score. A self-report demographic section at the beginning of ImPACT was used to gather information concerning previous treatment for headaches, migraines, and psychiatric conditions; diagnosis of attention-deficit/hyperactivity disorder; and exposure to previous strenuous exercise. We conducted multivariate analyses of variance to determine if the ImPACT composite and total symptom scores differed according to preexisting factors (P < .0083). Results: Sex showed an effect on verbal memory (P = .001), visual motor speed (P < .001), and reaction time (P = .006), with women performing better than men. A previous diagnosis of attention-deficit/hyperactivity disorder affected visual motor speed (P = .008). Previous treatment for headaches (P < .001), migraines (P = .001), a psychiatric condition (P < .001), or a diagnosis of attention-deficit/hyperactivity disorder (P < .001) all showed effects on the total symptom score. Strenuous exercise did not affect neurocogntive performance or total symptom score. Conclusions: Based on our findings and the previous literature, we suggest that many preexisting factors influence baseline neurocognitive data. Baseline testing is an important aspect of concussion management. Sports medicine professionals should be cognizant of these factors when developing concussion-management protocols.

Purpose:To determine the discriminators as variables to select the under-16 national-team players and to examine the influence of biological age on physical/technical parameters among young basketball players.Methods:Thirty-four under-15 male basketball players performed several anthropometrical (height, wingspan, body mass, and fingers length) and physical (jumping, sprinting, throwing, flexibility, change-of-direction speed, and aerobic fitness) tests during the under-15 male national-team training camp. Maturity offset, lower-limb asymmetry index, and power outputs for jumping and sprinting were also computed. In addition, game performance was taken into consideration using game-related statistics (assists, turnovers, steals, rebounds, blocks, and points) of 5 games of during the previous regional tournament (April 2016). Cluster analysis was used to analyze the between-maturation status (prepubertal, pubertal, and postpubertal) differences in physical parameters.Results:The postpubertals showed a significantly better performance in power outputs (jumping and sprinting), throwing abilities, and blocks, whereas prepubertal performed significantly better in aerobic fitness and assists. Receiver-operating-characteristic curve confirmed maturational status (area under the curve [AUC] = 0.804;P < .05) and training experience (AUC = 0.789;P < .05) as the most important attributes in predicting under-16 national-team selection. Players with more than 5.5 years of training experience and less than 1.4 y to the age at peak height velocity were most likely to be selected.Conclusion:Maturational status seems to be a key variable that increases the probability of selection for the Portuguese under-16 national team.

Mouth guards protect against orofacial and dental injuries in sports. However, special fitted dental splints have been claimed to improve strength and speed and, therefore, to enhance athletic performance.Purpose:To test the effects of a neuromuscular fitted dental splint in comparison with a habitual verticalizing splint and a no-splint condition on cycling sprint performance in the Wingate Anaerobic Test (WAnT).Methods:Twenty-three men (26.0 ± 2.0 y, 1.82 ± 0.06 m, 79.4 ± 7.7 kg) performed 3 WAnTs, 1 with the neuromuscular fitted splint, 1 with a habitual verticalized dental splint of the same height and material, and 1 under control conditions without any mouth guard, in randomized order separated by 1 wk.Results:No differences between any splint conditions were found in any aspect of WAnT performance (time to peak power, peak power, minimum power, power drop, and average power). Moderate to nearly perfect correlations between all splint conditions in all WAnT outcomes with coefficients of variation between 1.3% and 6.6% were found.Conclusions:Irrespective of habitual verticalization or myocentric positioning, dental splints have no effects on any aspect of WAnT performance. Results are comparable to those of test–retest experiments.

Cette thèse est une compilation de trois études illustrant, à travers la relation entre performance et salaire, chacune des deux facettes de l'économie du sport. La première facette considère le sport comme un objet d'étude en lui-même (Chap 3). La seconde facette considère le sport comme un laboratoire permettant de tester des théories économiques (Chap. 1 et 2). Le chap. 1 traite du lien entre la concentration des salaires au sein d'une organisation et sa performance. Nous proposons une modélisation de tournoi où la probabilité de victoire d'une équipe dépend notamment de la concentration de ses salaires. La relation étudiée peut être positive ou négative suivant la valeur prise par un paramètre. Nous estimons ensuite la valeur de ce paramètre pour un échantillon de matchs de baseball américain. Nos résultats indiquent que la concentration nuit à la performance. Le chap. 2 questionne la linéarité de la relation entre concentration des salaires et performance. Nous répliquons les spécifications paramétriques habituellement utilisées en adaptant l'échelle du cadre d'estimation (même échantillon que dans le Chap. 1). Puis, les comparons avec des estimations semi-paramétriques laissant la relation s'établir librement. Nous démontrons alors la non linéarité de la relation. Le chap. 3 évalue, à l'aide d'une analyse en enveloppement des données, l'efficience des clubs de football professionnels Français de première division (L1) entre 2005 et 2009. Nous construisons de plus des indices de Malmquist avec les performances des clubs à chaque saison afin d'en connaitre l'évolution. Les clubs de L1 sont globalement efficients mais la performance moyenne décroit sur la période
This dissertation compile three studies aiming at illustrate both aspects of sports economics through the relation between performance and salary. The first aspect considers sport as an object of study (Chap. 3). The second one is about the utilization of sport as a laboratory where economical theories can be tested (Chap. 1 et 2). Chapter 1 study the relation between the intra-organization wage concentration and its performance. We propose to model a tournament where a team probability of victory is function (among others) of the wage concentration. The relation can be positive or negative depending of a parameter value. We then estimate this parameter value for a sample of American baseball matches. Our results show that wage concentration decreases the performance. Chapter 2 question the linearity of the wage concentration / performance relation. We replicate the parametric specifications usually employed with some modifications regarding to the estimations framework scale (same sample as in Chap. 1). Then, we compare these results with some semi-parametrical estimations which allow the relation to be established freely. We are thus able to demonstrate the relation non linearity. Chapter 3 evaluates the French first division football clubs efficiency between 2005 and 2009, with a Data Envelopment Analysis (DEA). In addition, we compute Malmquist indexes from clubs performances of each season in order to know the efficiency evolution. French clubs are globally efficient but the average performance has been decreasing over the studied period

Première activité économique au monde, le secteur touristique souffre dans sa globalité d’une forte accentuation de la concurrence et les destinations de sports d’hiver sont particulièrement touchées (baisse de la fréquentation, aléas climatiques, etc. ). Au niveau français, l’importance économique du tourisme d’hiver et les difficultés auxquelles il est confronté interpellent la compétitivité des destinations « neiges » et appellent aux analyses en termes de performance, qui, dans notre économie contemporaine est une problématique centrale pour les praticiens de la gestion. Dans ce contexte, le besoin d’adopter des stratégies appropriées devient l’enjeu majeur des professionnels du tourisme qui cherchent à maintenir un avantage compétitif. Ainsi, l’optimalité des choix managériaux et stratégiques est indispensable. Face à ces questions fondamentales, se pose également celle de repenser les critères d’évaluation de la performance des stations. L’un des enjeux de ce travail doctoral consiste à valoriser l’utilisation de méthodes quantitatives de benchmarking (notamment la méthode des frontières efficientes non-paramétriques) afin de traiter diverses problématiques dans le domaine des Sciences de Gestion. Au-delà de la simple mesure de performance des unités productives évaluées, le gestionnaire s'intéresse plus fondamentalement à l'explication de ces performances et pointe du doigt les problèmes liés à la qualité de l’organisation interne et aux choix stratégiques. Tourism is one of the first economic activities in the world but this sector faces an intense competition and ski resorts destinations are particularly affected (attendance decrease, climate change, etc. ). In this context, French ski resorts destinations’ performance is questioned and the need to adopt appropriate strategies constitutes an important challenge for tourism decision-makers. In order to maintain their competitive advantage, destination’ managers need to drive optimal strategic and managerial choices. The need to adopt new criteria to evaluate ski resorts’ performance becomes an important issue. One of the challenges of this doctoral thesis is to promote the use of benchmarking quantitative methods (as the non-parametric efficient frontier methods) to address various issues in the field of Management Sciences. Beyond the performance measurement of decision making units, it is also important to explain these performances to highlight problems about organizational quality and strategic choices. The aim of this thesis is also to provide guidelines for both mountain professional decision-makers and policy makers (at the local or national level) to ensure the development and the attractiveness of ski resorts destination

Cette thèse s'intéresse à un thème encore très peu étudié en économie : la relation entre le secteur économique et le secteur sportif dans les pays est européens avant et pendant la période de transition systémique. Dans notre travail, nous analysons, tout d'abord, l'existence d'un lien entre les ressources économiques et humaines disponibles -le PIS par habitant et la population et les performances olympiques dans les pays est-européens. Nous analysons ensuite dans quelle mesure, avant 1989, les instances publiques contribuent au financement de l'activité sportive et de quelle façon l'Etat incite à la pratique sportive. La collecte des données renseignant la pratique sportive et le financement du sport en Europe de l'Est et, à titre comparatif, en Europe de l'Ouest, nous permet d'analyser l'évolution de ces deux variables entre 1976 et 2004. Nous montrons comment ces deux facteurs ont influencé les performances olympiques durant cette période. Nous étudions ensuite les transformations des institutions sportives depuis 1990. Nous construisons plusieurs indicateurs de réformes et montrons que ces transformations peuvent en partie expliquer l'évolution de la pratique sportive et du financement du sport par l'Etat. Les interactions entre les variables étudiées dans cette thèse sont exposées dans un cadre conceptuel. Notre raisonnement est alors illustré au travers de l'étude d'un pays particulier, la République tchèque.

L’histoire de l’institutionnalisation du rugby en France a entraîné ce sport vers l’établissement d’un ensemble de règles permettant de définir, et donc de rendre possible, la pratique. Ces règles portent essentiellement sur le jeu, l’établissement d’un classement mais aussi les statuts des clubs, ainsi que leurs interactions. L’institutionnalisation du rugby s’est effectuée au gré d’importantes mutations que sont, la création de fédérations mais aussi, et depuis 1995, le passage au professionnalisme. Après un siècle à s’être fermement opposée à l’idée que le rugby puisse basculer dans l’ère d’une pratique associée à la profession, les institutions en place ont finalement cédé face à la pression grandissante des acteurs (médias, sponsors et joueurs) en demande de « professionnalisation ». L’enjeu d’une telle mutation est que le rugby puisse enfin être considéré comme activité économique à part entière. La professionnalisation a entraîné les acteurs à ne plus considérer l’activité sportif « rugby » de la même manière. Autrefois profondément ancré dans l’amateurisme, le rugby est aujourd’hui devenu un support essentiel à la « production spectacle » rémunératrice. Les structures sportives se sont adaptées au professionnalisme en adaptant leurs statuts mais aussi et surtout en définissant leur nouveau « business model ». Dans le cadre de l’analyse de la stratégie des clubs, la maximisation de la performance sportive, impactant l’institution du classement auquel se rattache le club, est un élément clé. Les clubs, dans un souci d’optimisation de leur business model, ont progressivement intégré l’utilisation des outils technologiques et l’exploitation des données qui en découlent. The history and institutionalisation of rugby in France has led to the establishment of a set of rules that make it possible to define, and thus make possible, the practice of rugby. These rules focus on the game, the establishment of a ranking, but also on the status of clubs and their interaction. The institutionalisation of rugby has made it possible for major changes in the way rugby is played, with the creation of federations and the transition into professionalism in 1995. After a century of resolute opposition to the idea that rugby could shift into an era of professional practice, the institutions in place finally accepted the need to change from the growing pressure from players (media, sponsors and players) to professionalise. The challenge of such a change is that rugby can finally be considered as an economic activity in its own right. Professionalisation has led to players no longer considering "rugby" in the same way. Formerly deeply rooted in amateurism, rugby has now become an essential support for a profitable entertainment product. The sports structures have adapted to professionalism by adapting their statutes but also, above all else, by defining their new business model. In analysing club strategy, maximizing sports performance is a key element, impacting the ranking institution to which the club belongs. The clubs, in an effort to optimize their business model, have gradually integrated the use of technological tools and the exploitation of the resulting data. Bien qu'il n'existe pas un statut fiscal et social du sportif, il ressort de la legislation, jurisprudence, et des instructions fiscales et sociales, une definition du sportif : celui qui participe a une competition organisee avec l'accord d'une federation deleguee ou agree. Le caractere professionnel de l'activite est determine en dehors de toutes qualifications federales. La competition suppose la mesure d'un effort physique. La meilleure mesure produit les revenus les plus importants. Parallelement, les competitions sportives sont organisees dans de nombreux pays suivant les memes modalites. Ainsi, la source du revenu sportif est limitee au plan temporel mais multiple au plan geographique. Si la mobilite des sportifs est prise en compte dans le domaine du droit fiscal international, par contre la faible duree d'activite du sportif est ignoree. Depuis, l'arret bosman en 1995, les clubs nationaux participant aux competitions les plus populaires, doivent faire face a une concurrence accrue en europe alors que les mecanismes de protection sociale et le traitement fiscal des revenus du travail ne sont pas harmonises. Cela implique a terme, la creation d'un regime de faveur pour les sportifs les mieux remuneres.

Le début des années 70 marque en France le déclenchement d'un processus complexe mêlant dialectiquement la massification et la diversification des pratiques sportives. Simultanément l'économie du sport se voit confier des missions allant de l'évaluation de l'impact économique des phénomènes sportifs à l'identification des déterminants économiques de la pratique sportive. L'approche socio-économique montre que le système sportif connait: - une évolution dimensionnelle : le croisement de multiples indicateurs a permis d'évaluer le développement des effectifs pratiquants, des effets consommatoires, des spectacles sportifs et des flux financiers. - une évolution structurelle : sous l'influence de variables sociales, économiques et organisationnelles, le système sportif s'est développé selon une logique différenciatrice, sinon inégalitaire. Les Jeux olympiques sont devenus la plus importante propriété sportive au monde générant, depuis 1984, des revenus de marketing de plus de 15 milliards de dollars américains. Avec de tels intérêts économiques en jeu, l'ambush marketing représente une sérieuse menace pour le Mouvement olympique. Le but de cette étude était de chercher à vérifier les perceptions des consommateurs et les préoccupations des sponsors et du sponsorisé face à l'ambush marketing lors des Jeux olympiques de l'an 2000. Nous avons utilisé une combinaison de techniques quantitatives et qualitatives pour la collecte des données. D'abord, un outil de sondage à quarante cinq items fut développé et utilisé auprès d'un nombre total de 2435 consommateurs répondants au Canada et aux Etats-Unis. Des questions scientifiques axées sur sept sujets clés furent posées et les réponses colligées dans cette étude à variables aléatoires multiples. The Olympic property has generated more than US 15 billion dollars in marketing revenues since 1984. With such economic interests at stakes, ambush marketing has become a serious threat to the Olympic Movement. This study sought to ascertain consumer perceptions and sponsor/sponsee concerns of ambush marketing of the 2000 Olympic Games. A combination of quantitative and qualitative techniques was used to collect data. First, a forty-five-item survey instrument was developed and administered to a total of 2435 consumer respondents in Canada and in the United States. Scientific questions centered around seven key issues were asked and answered in this multi-variate study. Second, a comprehensive Delphi study was concurrently undertaken to glean managerial insights into the sport management of the IOC property from 24 sport marketing experts. Une analyse positive (partie 1) se propose, tout d'abord, d'étudier de quelle manière les déterminants de l'équilibre compétitif peuvent résider dans l'organisation sportive des compétitions (chapitre 1). A ce titre, les formules de championnats sont appréciées selon les probabilités de victoires des équipes engagées pour déterminer le degré d'incertitude de la compétition. La construction d'un indicateur composite de la force des équipes est proposée (chapitre 2) sur la base de variables économiques (budget, masse salariale, subvention publique. . . ) Mais aussi sportives (pourcentage de victoires du club ou coach, participation aux compétitions européennes). Une analyse en composante principale permet de sélectionner les données les plus représentatives une analyse normative (partie 2) s'attache ensuite à isoler, à l'aide de l'outil économétrique (modèle logit), les variables qu'une régulation réussie doit prendre en compte (chapitre 1) tout en veillant au respect des règles institutionnelles qui contraignent l'organisation des compétitions sportives, notamment en matière de droit de la concurrence (chapitre 2).

C’est pourquoi, on qualifie désormais d’industrie du sport les relations économiques qui traversent le système sportif au sein duquel le supporteur devient un consommateur, le club une marque, le sportif un professionnel, le sport une marchandise. Trois dynamiques économiques structurent le sport professionnel contemporain (le travail, le spectacle, la mondialisation) et ouvrent de nombreux marchés. Pour appréhender le sport, qui constitue à la fois un secteur économique et un domaine d’analyse conomique, il convient de croiser l’économie du sport avec les instruments de la science économique. Over the last twenty years, the restructuring of top-level sport around the principles and mechanisms of the global market has been on an unprecedented scale. That is why we now describe the economic relationships that govern the sports system as the sports industry, in which the supporter has become a consumer, the club a brand, the sportsman a professional and sport itself a commodity. There are three economic dynamics that structure contemporary professional sport (labour, spectacle and lobalisation) and which open up market markets. In order to understand sport, which is made up of both an economic sector and a field of economic analysis, it is necessary to link sports economics to economics instruments. We have, for example, therefore studied the following: wage ratio and generating Superstar revenue in these celebrity markets; homo oeconomicus v homo sportivus for drug use; the two markets of televised sport and welfare economics; sporting and market globalisation and its informal economy; the interactions between economic development and sporting performance; the organisational models of team sports; and the concept of sport as a global public good

In sport context, many contributions are involved in the perception of quality and satisfaction in sport services, but in regards to brand perception, such studies are much less common. Virtually no work is aimed at brand awareness of sports services. In the book chapter the authors expose a case study that analyze the users perception of the image of the service and is related to some performance indicators such as quality of service, satisfaction and future intentions. Data analysis is performed using structural equations and measurement scales adapted to sports facilities. The results of this study show that quality is explained by congruence with a high percentage of variance (76.6%), the latter concept being the aspect with the greatest predictive weight. Furthermore, future intentions are explained by attitudes towards the brand and quality, the latter being the element with greater predictive power.

This article describes the hypothesis that sport originated and developed with forms of axial performance. It is noted that the physical education tradition was formed and modernized according to the axial principles of development of each era. What determines the transition of society from one level of development to another? Among the many reasons, the most important are socio-cultural revolutions, such as agricultural, industrial and scientific information. That is, it is progress, certain evolutionary steps that affect the development of society as a whole. We propose to consider the concept of axial time for each era (a combination of axial and wave approaches), ie the axial principle and the impact of human civilization on the formation and formation of physical education and sports culture. D. Bell considers the "axial principle" of the division of civilization "axis of production" and the knowledge used. For example, for industrial society such a criterion is the use of machines for the production of goods, and for post-industrial - scientific and primarily theoretical knowledge (which is a strategic resource, the axial principle of society). According to our concept, the whole historical process can be divided into large stages. The change of each of them is a change of the basic qualitative characteristics of the corresponding step of the historical process. The concept of the principle of axial productivity is not only production, but also the formation of a new worldview, which can be such a basis that describes the great qualitative steps in the development of world history. The revolution in the worldview is an integral part of the historical process. With its help there are profound qualitative changes in socio-cultural life, in political and economic relations, the public consciousness changes. In these periods, socio-cultural relations, on the one hand, are approaching the leading productive forces, and on the other hand, they themselves create a new level, which gives impetus to generate new worldview principles. Worldview trends were the guiding factor first in the formation and then the transformation of the system of physical education, physical culture and sports. Each stage of such development was permeated with the spirit of the corresponding cultural and historical epoch. It is emphasized that compared to the sport of the last century, the sport of the XXI century will develop much faster and more powerfully, and its main task will be to take care of leisure and human health in the economic globalization of the information society.

Moisture management property is an important aspect of any fabric meant for active wear fabric, which decides the comfort level of that fabric specially used as active wear garments. Regular physical activity is important to maintain consistency in human health. To achieve comfort and functional support during various activities such as walking, stretching, jogging etc., athletes and sports persons use active wear clothing. A fabric’s moisture management performance is also influenced by its air and water vapour permeability. The moisture management finish (MMF) and Antimicrobial finish (AMF) have been used to increase moisture absorbency; improves wetting, wicking action and antimicrobial performance. In this study, influence of MMF and AMF finishes on the moisture management property of different knitted active wear fabrics had been carried out. For the study two different knit fabrics of 100% Polyester and 100% Nylon with three different GSM levels (100, 130 and 160) has been selected. Further two varieties of commercially available functional fabric finishes have been also taken for the study. The result shows that in case of finished fabric at certain concentration level, as the fabric GSM increases the value of Accumulative one-way transport index (OWTI) %, water vapour permeability but same time drying rate increases. The result shows that in case of finished fabric at certain concentration level, as the fabric GSM increases the value of accumulative one-way transport index (OWTI) %, water vapour permeability decreases but same time drying rate increases. The knitted fabrics of 100% Polyester and 100% Nylon composition follow the similar trend. Further with the increase of fabric finish concentration level, OWTI %, and water vapour permeability (WVP) factor decreases while the drying rate increases.
