This chapter discusses the rights of low-income persons, including those who “look poor” or homeless, to travel, to become members of a community, and to use public spaces, such as streets, parks, libraries, and post offices. Many localities have adopted “quality of life” regulations that restrict and even criminalize acts that are innocent when done in the privacy of one’s home, such as sleeping or eating, but become illegal when done in public. The chapter sets out the constitutional right to travel from state to state and within a state, and describes the practical and legal barriers that exist to the actualization of that right, such as the absence of public transportation or not having money to buy a car. Attention is given to the constitutional status of residency requirements and how they impact efforts to obtain better housing and schooling. It explores permissible limits on rights to use public spaces, and protections that may be invoked in many typical encounters with the police, such as demands for identification cards or the seizure of possessions temporarily left in a park. Practical advice is given about library services and mail delivery, as well as how to get licenses for commercial activities that make use of public spaces, including street vending.

This chapter explores the disloyalty allegations against the Keyserlings. Over the long course of their loyalty investigations, the Keyserlings portrayed themselves as having been political centrists during the 1930s, when in fact they had been decidedly on the left. The Keyserlings are remembered as loyal Johnson Democrats who favored Cold War military spending, backed U.S. policy in Vietnam, and argued that poverty could be eliminated through economic growth rather than redistribution. Before coming under investigation, however, they were socialists. Faced with a relentless stream of disloyalty allegations that began in the 1940s and climaxed in 1952, they were forced to modify their political rhetoric and moderate their policy proposals. They also denied they ever had held leftist views. Conservatives may have lost the battle to exclude the Keyserlings from public influence, but by narrowing the range of permissible debate, they won the war.

This chapter discusses the main streams of contract philosophy in order to elucidate the extent to which boilerplate is a permissible means of creating contractual obligation. In particular, it considers the deep embeddedness—the ineradicability—of the notion of voluntariness. It also compares and contrasts the economic efficiency theory of contract with the various theories based more directly on freedom of the will. The chapter first provides an overview of contract theory, focusing on autonomy (rights) and welfare theories, reliance theory, and equivalence of exchange theory. It then describes the basic premises of the economic theory of law, the role of incentives in maximizing social welfare, contract law, and property and liability rules. It shows that the existing philosophical theories of contract depend on the core notions of voluntariness, freedom of choice, or consent, thus making it difficult to incorporate boilerplate into the theories of contract.

This chapter considers the Latin American debt crisis of the 1980s. Unlike the 1930s, when debt moratoriums were widespread, the debt crisis of the 1980s was marked by a striking absence of unilateral default. With payment suspensions effectively ruled out as a permissible policy response, debtors and creditors engaged in a concerted effort to reschedule the amortization of principal, refinance maturing obligations and prevent an interruption of interest service at all costs. The chapter shows how the highly concentrated and interlocked nature of syndicated lending contributed to the emergence of a coherent international creditors' cartel that was capable of effectively coordinating collective action among the major Wall Street banks, keeping the debtors in the lending game by rolling over maturing obligations while simultaneously imposing strict market discipline on the borrowing governments through the credible threat of a refusal of further credit in the event of noncompliance.

Abstract A method for calculating a component’s design survivability by incorporating finite element analysis and probabilistic material properties was developed. The method evaluates design parameters through direct comparisons of component survivability expressed in terms of Weibull parameters. The analysis was applied to a rotating disk with mounting bolt holes. The highest probability of failure occurred at, or near, the maximum shear stress region of the bolt holes.
