The constitutions of other countries such as in several Asian, African, and European countries as mentioned above have explicitly regulated and mentioned the protection of guarantees and personal rights or privacy rights of their citizens. while in Indonesia such as Saudi Arabia and Madagascar it does not explicitly mention anything about the right of privacy in their constitution. it can be concluded that the concept of personal data protection can be found in international and regional instruments such as the European Union Data Protection Directive, the European Union Data Protection Convention, and the OECD Guidelines.

Abstract The article discusses the concept of personal autonomy as a constitutional fundamental right protected by the Polish Constitution of 1997. Autonomy is not only a constitutional value of an unspecified character but also a right with its own specific normative content. Personal autonomy, also called the right to self-determination, is rooted in natural law. The scope of its constitutional protection is determined and – simultaneously – limited by constitutional standards of an absolute character such as human dignity, non-discrimination, and the like. Autonomy as a constitutional right may be subjected to further restrictions imposed by the legislator in accordance with the principle of proportionality. The legal status of an individual’s right to self determination is thus determined by all the prohibitions and orders resulting directly from the Constitution as well as sub-constitutional statutory provisions which respect the principle of proportionality requirements.

Abstract:
The Muslim population of South Africa follows a practice which may be referred to asMuslim personal law. Although section 15 of the Constitution of the Republic of South Africa 108 of 1996 recognises religious freedom and makes provision for the future recognition of other personal law systems, Muslim personal law is, at this stage, not formally recognised in terms of South African law. Since Muslim personal law receives no constitutional recognition the question may be asked whether the 1996 Constitution, and in particular the Bill of Rights as contained in chapter 2 of the 1996 Constitution, is applicable to "non-recognised" Muslim personal law. The answer to this question depends to a large extent on the meaning of "law" as contained in the 1996 Constitution.When the viewpoint of academic writers and the courts are evaluated it seems as if the meaning of law in South Africa is restricted to the common law, customary law and legislation. If such a viewpoint is to be followed, Muslim personal law is excluded from the scrutiny of the Bill of Rights. It is, however, inconceivable that there might be certain areas of "law" that are not subject to the scrutiny of the Bill of Rights. In this note it will be argued that Muslim personal law should be regarded as law in terms of the 1996 Constitution, or in the alternative, that Muslim personal law (or at least Muslim marriages) should be recognised in terms of section 15 of the 1996 Constitution.Due to the historical resemblance between South Africa and India the meaning of"law" as contained in the 1996 Constitution will be compared with the meaning of "law" as contained in the Constitution of India. Although the Constitution of India indirectly gives recognition to various personal laws in India, these personal laws are not subject to the provisions of the Constitution of India. Therefore, it would be argued that one should approach the Constitution of India with caution when its provisions are compared to those of the 1996 Constitution of South Africa.

The discourse on personal data protection has been developed for a long time, even before the advent of internet technology. In the Indonesian context, issues relating to the personal data protection have begun to develop in recent years, responding to the increasingly rapid development of digital technology. Currently the Personal Data Protection Bill is again included in the 2021 Priority National Legislation Program in response to the importance of regulations relating to personal data protection in Indonesia. The fundamental thing that often escapes the discourse on the personal data protection in Indonesia is related to how personal data is positioned in a constitutional perspective based on the 1945 Constitution of the Republic of Indonesia if personal data is considered as something that must be protected. This research specifically answered the questions: (a) how is the conceptual interpretation of personal data? (b) how is personal data positioned in the perspective of the Indonesian constitution? This research is a normative juridical research, conducted by analyzing secondary data obtained through literature review. The results of this research indicated that the conceptual interpretation of personal data is still a growing discourse. As for personal data in the perspective of the Indonesian constitution, it can be seen by looking at the legal-historical aspect in the discussion of the amendments to the 1945 Constitution, especially in Article 28G paragraph (1) of the 1945 Constitution of the Republic of Indonesia which is hypothesized as a reference for personal data protection.

Freedom is central to most constitutions. In the constitutional context, freedom usually means both personal freedom and political freedom. Personal freedom can be described as the right to decide for oneself the terms of one's life, both individually and communally. It is what Frank Michelman calls self-rule: it "demands the people's determination for themselves of the norms that are to govern their social life".3 Political freedom, on the other hand, implies the protection against arbitrary government power. This is what Michelman calls law-rule. In most constitutional dispensations both these types of freedom are implicated and the South African constitution is no exception.4 But, it is ironic that in most constitutional democracies these two types of freedom are also frequently in conflict with one another. In fact, it is not far-fetched to suggest that they are conceptually contradictory.

It has been more than 25 years since the Interim Constitution came into effect and a Bill of Rights was introduced. Yet Muslim Personal Law ( still has no lega l recognition in South Africa. This the sis investigates how this causes serious problems for Muslim women who suffer grave injustices upo n divorce due to the non recognition and non regulati on of Muslim marriages It highlights t he State refus al to enact legislation despite the dicta and obiter comments from the courts spanning more than two decad es enjoining the state to effect legislation to achieve this purpose. South African law is still fundamentally lacking in the recognition of the rights of parties to marriages contracted only in terms of M PL . For couples married in accordance with civil law, marriages and divorces are dealt with under the relevant statutes, namely the Marriage Act 25 of 1961, t he Civil Union Act 17 of 2006 and the Divorce Act 70 of 1979. No provision has been made in statu tor y law for MP L . Previously the courts have held that this was due to the potentially polygyn ous nature of Muslim marriages. Muslim m arriages are inadequately regulated resulting in serious hardships to Muslim women and children. This thesis furthermore inve stigate s the need to recognize MPL .

Centrée sur la thématique de la « fureur héroïque » développée dans le dernier ouvrage écrit en langue italienne par Giordano Bruno, De gli eroici furori (1585), cette recherche explore une double problématique suivant deux perspectives. D’une part, du point de vue historique, quels sont les schèmes philosophiques qui peuvent être considérés comme des conditions de possibilité de l’émergence de la figure du Furioso, le philosophe-poète dont les poèmes et leur commentaire philosophique nous font suivre l’itinéraire affectif et cognitif dans sa poursuite d’une union naturelle et rationnelle avec le principe infini du réel ? Suivant une méthode archéologique, il s’agit de retrouver dans les strates de la culture philosophique des traces précises et exemplaires de la mise en place, de la transmission et de la transformation de ces schèmes fondamentaux chez des auteurs de l’Antiquité, du Moyen Âge ou de la Renaissance. Focused on the theme of the “heroic frenzy” developed in Giordano Bruno’s last opus written in Italian language, De gli eroici furori (1585), this work explores a double issue from two perspectives. On the one hand, from an historical point of view, what are the philosophical schemes that may be considered as conditions of possibility for the emergence of the Furioso’s figure, the philosopher-poet whose poems and their commentary lead through a path of affects and knowledge in his own intellectual pursuit of a natural and rational bonding with the infinite principle of reality? Following an archeological method, specific and exemplary traces of these fundamental schemes are found within layers of philosophical culture, throughout works of authors of Antiquity, Middle Ages or Renaissance who set, relayed and modified them. On the other hand, from a conceptual point of view, the process of the Furioso’s psychological experience is studied. His both noetic and loving encounter with the Principle is never completely fulfilled because of the disproportion between “the subject” and “the object”. Nevertheless, it is presented as a dissolution of self by ending the distinction between the subject and the object. How does this experience paradoxically implements a constitution of self?

The common law duties have been preserved by the partial codification of the duties of directors in terms of the Companies Act of 2008 (‘2008 Act’). One such duty is the duty to disclose personal financial interest in terms of s 75 of the 2008 Act. The need for directors to disclose personal financial interest has become more necessary than ever before in South African companies, particularly State-Owned Companies (‘SOCs’), due to their role in the South African economy. The injury caused by the breach of this duty is not only to the company, but more harm is caused to the economy and the beneficiaries who are the recipients of services rendered by SOCs. There has been a plethora of media reports of poor corporate governance in SOCs which is attributed to conflict of interest due to failure of directors to disclose their personal financial interests in proposed transactions or approved agreements.

When biological information about an individual is produced in healthcare or research settings, ethical questions may arise about whether the individual herself should be able to access it. This thesis argues that the individual’s identity-related interests warrant serious attention in framing and addressing these questions. Identity interests are largely neglected in bioethical, policy and legal debates about information access – except where information about genetic parentage is concerned. Even there, the relationship between information and identity, and the interests involved, remain unclear. This thesis seeks to fill this conceptual gap and challenge this exceptionalism. It does so by developing a normative account of the roles that a wide range of information about our health, bodies and biological relationships – ‘personal bioinformation’ – can play in the construction of our self-conceptions. This account is developed in two steps. First, building on existing philosophical theories of narrative self-constitution, this thesis proposes that personal bioinformation has a critical role to play in the construction of identity narratives that remain coherent and support us in navigating our embodied experiences. Secondly, drawing on empirical literature reporting individuals’ attitudes to receiving three categories of personal bioinformation (about donor conception, genetic disease susceptibility, and neuroimaging-based psychiatric diagnoses), the thesis seeks to illustrate, demonstrate the plausibility of, and to refine this theoretically-based proposition. From these foundations, it is argued that we can have strong identity-related interests in whether and how we are able to access bioinformation about ourselves. The practical implications of this conclusion are then explored. It is argued that identity interests are not reducible to other interests (for example, in health protection) commonly weighed in information disclosure decisions. They, therefore, warrant attention in their own right. An ethical framework is developed to guide delivery of this. This framework sets out the ethical responsibilities of those who hold bioinformation about us to respond to our identity interests in information disclosure practices and policies. The framework is informed by indications from the illustrative examples that our interests engaged as much by how bioinformation is communicated as whether it is disclosed. Moreover, these interests are not uniformly engaged by all bioinformation in all circumstances and there is potential for identity detriment as well as benefit. The ethical framework highlights the opportunities for and challenges of responding to identity interests and the scope and limits of potential disclosers’ responsibilities to do so. It also makes recommendations as to the principles and characteristics of identity-supporting disclosure practices.

The role of taxation in gender inequality is something that is perhaps not considered earnestly enough. Both in South Africa and within the context of global initiatives such as the Convention for the Elimination of All Forms of Discrimination Against Women (CEDAW) and the Sustainable Development Goals (SDG) which are aimed at eradicating all forms of gender-based discrimination, the importance of understanding the gender consequences of tax policy, whether intended or not, should not be underestimated. This study seeks to identify whether or not there are any instances where South Africa’s personal income tax laws have an effect which is potentially inconsistent with both the Constitutional right to equality between genders and international gender equality agreements to which South Africa is bound, namely the CEDAW and the SDG. In doing so, determine whether South Africa’s personal income tax legislation should become a focal point in this regard and be one of the pillars that could further be used as a means to uphold and further the cause of substantive gender equity.

The childhood has being highlighted by the great concern about the several contexts in which children are inserted, amongst them, commercial sexual exploitation (CSE). The experience of this violence process brings implications to the person constitution. Thus, this research aimed to understand how commercial sexual exploited adolescents to signify the childhood. Participated of this research four female adolescents that had been assisted by Programa de enfrentamento ao Abuso e Explora??o Sexual de Crian?as e Adolescentes (Sentinela) , with ages between 12 and 17 years. The corpus was composed by the combination of the semi-structured interview and other procedures, like childish stories, draws and photography. Moreover, we used another instruments to constitute the corpus, like the documental research and we proposed the construction of a life story book of each participant. The corpus was analyzed through the Thematic Content Analysis. Five thematic axes emerged from the participants discourse and theoretical perspective: dynamical of family, scholar process, ludic behavior, conception of childhood and insertion on CSE process. The participants presented a conception about childhood as been a preparation and education phase to ingress in adult life. In other words, while children do not grown up, they go to the school, plays, lives with family, are happy and do not have any responsibilities. Nevertheless, the life experience of these girls was implicated by negligence, sexual abuse, child labor, institutionalization and, evidently, the commercial sexual exploitation. Understanding that the childhood experienced by adolescent, as well as, her insertion on CSECA, constitutes her, while person, we investigated how the interrelation expresses it on participants future perspectives. Their goals are defined based on family constitution and professional improvement, although feelings of disillusion and pessimism had been showed up in some moments. According these results, we pointed to the necessity of the effective proposals that promote real improvement of adolescents life quality, through, in which they could to create alternatives to get over the several risks in which they are exposed, mainly, the CSECA condition

A viv?ncia de tal processo de viol?ncia traz implica??es para a constitui??o do sujeito. Nesse sentido, esta pesquisa objetivou compreender como adolescentes em situa??o de explora??o sexual comercial significam a inf?ncia. The enunciation of personal deixis is a point of tension between language and the subject, highlighting the movements of the emergence of subjectivity in discourse. In language acquisition, deictic designation furthers our understanding of the initial process of subjectivity experienced by the infans, while allowing us to glimpse the different mechanism as to initiate the subject in language. On this assumption, we must consider how perceptive the subject is of the process of subjective constitution that he/she is passing through, by the linguistic marks of their registration statement (personal deixis), when invoking the formal apparatus of enunciation (BENVENISTE, 1989, p. 81-84), makes the use of language and its reversibility proper in a situation of enunciative interaction with others. Our goal is therefore to investigate the relationship between language acquisition and the formation of the subject, as proposed by Benveniste (1988 and 1989), by observing the appearance and operation of personal deixis in enunciative productions of the baby in situation of interaction with the mother. To do so, we will take longitudinal data from three mother-infant dyads (12 to 32 months of age), in naturalistic situation of interaction. The results show that, when considering the different movements of the mechanism of personal deixis in children's language, we can see the various subjective shifts in which the child passes: at first, the child seeks a place for himself in the enunciative structure; then comes to the game of reversible deictic personal, and finally enters the logic of the mechanism of personal deixis. In this sense, the use of personal deictic has as a property to express, in the particular circumstances of living / being of each subject in the language, the regularities of enunciative distinct movements contained in the initial stages of language acquisition.
A enunciação da dêixis pessoal constitui um ponto de tensão entre a linguagem e o sujeito, pois evidencia os movimentos de instalação da subjetividade no discurso. Na aquisição da linguagem, a designação dêitica possibilita a compreensão do processo inicial de subjetivação por que passa o infans, ao mesmo tempo em que nos permite vislumbrar os diferentes mecanismos enunciativos de instauração do sujeito na linguagem. Partindo desta premissa, cabe-nos analisar de que modo o sujeito dá a conhecer o processo de constituição subjetiva por que está passando, por meio das marcas lingüísticas de sua inscrição no enunciado (dêixis pessoal), quando, valendo-se do aparelho formal da enunciação (BENVENISTE, 1989, p. 81-84), torna próprio o uso da língua e sua reversibilidade em situação de interação enunciativa com o outro. Nosso objetivo é, portanto, investigar a relação entre a aquisição da linguagem e o processo de constituição do sujeito, tal como proposto por Benveniste (1988 e 1989), através da observação do aparecimento e do funcionamento da dêixis pessoal nas produções enunciativas do bebê em situação de interação com a mãe. Para isso, iremos nos valer de dados longitudinais de três díades mãe-bebê (de 12 a 32 meses de idade), em situação naturalística de interação. Os resultados mostram que, ao analisar os diferentes movimentos do mecanismo da dêixis pessoal na linguagem infantil, podemos perceber os diversos deslocamentos subjetivos pelos quais a criança passa: a princípio, busca um lugar para si na estrutura enunciativa; em seguida esbarra no jogo reversível dos dêiticos pessoais; por fim, adentra na lógica do mecanismo da dêixis pessoal. Nesse sentido, o uso dos dêiticos pessoais tem a propriedade de explicitar, dentro das singularidades do estar/ser de cada sujeito na língua, as regularidades de movimentos enunciativos distintos e constantes na fase inicial de aquisição da linguagem.

Notre projet de recherche est de comprendre, à l’intérieur de l’œuvre d’Édith Stein, le lien fondamental qui unit la structure de la personne humaine dans ses dimensions fondamentales (anthropologie) et l’éducation.Éduquer c’est être inévitablement renvoyé à la question : « Qu’est-ce que l’homme ? » dans la mesure où l'éducation engage « une certaine conception de l’homme, sa place dans le monde, ce à quoi il s’occupe, de même que dans les possibilités d’agir pratiquement sur l’homme et de le former. » Outre le fait qu'Edith Stein ne systématise pas sa conception de l'éducation, d'où la nécessité d'en reconstituer l'architecture d'ensemble, elle ne la fait pas dériver d'une anthropologie préalablement constituée. Notre hypothèse de recherche est que la personne humaine n'est pas une réalité déjà constituée dont une anthropologie statique rendrait compte, mais une réalité qui s'édifie au fil d'un processus de configuration qui « embrasse le corps, l’âme et l’esprit avec toutes leurs facultés » et dont la théorie steinienne de l’éducation examine les possibilités. A partir d'une analyse phénoménologique de la constitution de la personne nous examinerons ses possibilités de déploiement et sa finalité ultime comme une possibilité de sa liberté
Our purpose is to understand, on the basis of Edith Stein’s work, the link between the structure of human person and education. Educate is assuming the question : “What is human being ?” On the one hand, Stein does not organize systematically her conception of education, so that we must put in evidence the unity of that vision of education through her work. On the other hand, Stein refuses to derive education from a programmatic anthropology. Our hypothesis of research is : the human person is not a reality yet constituted but developing through a process which “embraces the body, the soul and the spirit”. On the basis of a phenomenological analysis of the constitution of the human person, we will examine the possibilities of her development and its ultimate finality as a possibility of her freedom

AbstractIn this paper, we discuss how phenomenology might cogently express the way painful experiences are layered with complex intersubjective meaning. In particular, we propose a critical conception of pain as an intricate multi-levelled phenomenon, deeply ingrained in the constitution of one’s sense of bodily self and emerging from a web of intercorporeal, social, cultural, and political relations. In the first section, we review and critique some conceptual accounts of pain. Then, we explore how pain is involved in complex ways with modalities of pleasure and displeasure, enacted personal meaning, and contexts of empathy or shame. We aim to show why a phenomenology of pain must acknowledge the richness and diversity of peculiar painful experiences. The second section then weaves these critical insights into Husserlian phenomenology of embodiment, sensation, and localisation. We introduce the distinction between Body-Object and Lived-Body to show how pain presents intersubjectively (e.g. from a patient to a clinician). Furthermore, we stress that, while pain seems to take a marginal position in Husserl’s whole corpus, its role is central in the transcendental constitution of the Lived-Body, interacting with the personal, interpersonal, and intersubjective levels of experiential constitution. Taking a critical-phenomenological perspective, we then concretely explore how some people may experience structural conditions which may make their experiences more or less painful.

The relevance of the topic is that the continuous and rapid increase in the role and volume of information in human life leads to the need to develop ways of protecting private information as a subject of personal property and personal value. Privacy is a natural human right and is enshrined in the European Convention on the Protection of Human Rights and Basic Freedoms, as well as in the Constitution of the Russian Federation. The regulation of the right to privacy is enshrined in the Russian Civil and Criminal Codes, which provide for legal liability for violations of this right. However, with regulations in place, the human element remains and often leads to leaks of private information, which destroys the personal value of the right. The article examines the concept of the right to privacy, its importance in the information society and human life, and the ways in which it can be protected. The aim of the study is to identify ways of protecting and complementing the right to privacy in the information society. The comparative legal analysis method allowed us to identify the mechanisms for the legal protection of the right to privacy. The case-analysis method enabled us to analyse Yandex’s data breach situation, while the content analysis method allowed us to make recommendations for protecting personal data. Main conclusions: the right to privacy as a personal value in the information society has not been sufficiently addressed in the scientific literature; self-protection as well as raising human legal awareness of information technology can be used as mechanisms to protect privacy.

Femicides have increased 1400% in the last seven years and one of every three women is subjected to violence. It is doubtful that in international law; Convention on the Elimination of All Forms of Discrimination against Women and Council of Europe Convention and in additional to this in national law; The 1982 Constitution and The Law to Protect Family and Prevent Violence Against Women can provide effective guarantee to protect the place of woman in Turkish Society or not? Despite all of the legislative regulations, the violence against women in Turkey increasingly goes on. For this reason it is crucial to evaluate the articles no 5th, 10th, 17th, 41st and 90th of Constitution which compose the legal basis for preventing violence against women. Republic of Turkey’s founding philosophy bases on equality of women and men, which means equal rights for every single citizen. To end this violence against women; can be achieve only through provide this equality legally and defacto, and also, apply social state’s principles in real life. Because in social states, struggling against this violence should be accepted as government’s policy. The state should be in cooperation with all women's organizations and provide training for related trade bodies.

"This theoretical study is part of a doctoral thesis and aims to investigate how the psychoanalytic thinking of Hélio Pellegrino - the Brazilian psychoanalyst, poet and writer - is structured and its ethical and political implications in the formation of psychoanalysis. We note the importance of thematic research, since there is no scientific publication that has as its object of study a systematic analysis of the author's psychoanalytic production. Furthermore, investigations of this kind contribute to the establishment of a reference bibliography on psychoanalysis in Brazil. That said, this research was developed and completed through a study of a large part of his psychoanalytic production, which is under the custody of the personal archives of the Museum of Brazilian Literature, at the Casa Rui Barbosa Foundation (FCRB). In this work, we outline some elements of the analysis found in his work, whose focus is on reflecting on the epistemological, conceptual and practical foundations of psychoanalytic theory. It has, as a constant concern, the analysis of the problems that structure Brazilian society, observed through his own reading of the Oedipus complex, the constitution of subjectivity and the social pact, in general, and in Brazil, in particular. As such, he discusses the explicit commitment of psychoanalysis in transforming the serious social problems faced by Brazil, which are related to the serious structural problems of international capitalism, and which are also reflected in the problems of the development of psychoanalytic institutions around the world."

Foreigner is a person who does not have any citizenship with the Republic of Turkey. According to the third paragraph of Article 35 of the Deed Law, the Council of Ministers/President of the Republic, in the interests of the country, is entitled to define, limit and prohibit, the limited real rights of the foreign real persons and foreign trade companies, in terms of country, person, geographical region, time, number, rate, type, quality, square measurement and amount. To entitle the Council of Ministers/President of the Republic to limit and prohibit the use of limited rights of the foreigners, may be contrary to Article 16 of the Constitution. The limited real rights are the usufruct rights (TCC 794), the right of residence (TCC 823), the right of construction (TCC 837) and the right of pledge and immovable load (TCC 839). It may be established the right of usufruct, right of construction and immovable load in favor of foreigners in Turkey who can acquire real estates. It may be established pledge rights without being subject to restrictions in favor of foreign real and legal persons.

We investigate the relation between existing fiscal rules and investments in the context of a fiscal crisis in Brazil. We analyze existing fiscal rules at national and subnational levels, their enforcement, and proposed alternatives. Using narrative analysis, case studies, interviews, empirical estimation, and model simulations, we conclude that public investment is not closely related to fiscal rules in Brazil but is mainly determined by fiscal conditions both at national and subnational (state) levels. It is the steady increase of personnel expenditures in real terms that underlies the fiscal deterioration of the last decade, despite the existence of fiscal rules devised to prevent it. We argue that a constitutional rule limiting subnationals personnel expenditures to 50 percent of net revenues, triggering adjustment measures when reaching 47.5 percent, would be an effective instrument for subnational fiscal management, opening fiscal space for increasing investments.
