In connection with the growing role of the information space, the emergence of new security threats, and the transformation of the institution of human rights, it became necessary, through the prism of the traditional understanding of the category of “dignity” and “right to dignity” in the humanities, to highlight current problems of legal regulation of the right to dignity, to its protection and protection, as well as identify current trends in the legal protection of personal dignity. Dignity is a complex category in the institution of individual rights, which is a direct expression of human value, the core, source and meaning of all fundamental rights, as well as a qualitatively necessary component of their implementation and protection. Abstract:
In this article, the author discloses the legal nature and content of the author’s personal non-property rights. An important conclusion is made that all personal non-property rights of the author can be divided into general and special. The general personal non-property rights of the author are inherent to the authors of any works, while the special personal non-property rights of the author are characteristic only of the authors of certain works. The scientific article examines the legal nature and content of the general personal non-property rights of the author of works, which include the right of authorship, the right to the author’s name, and the right to inviolability of the work. The author does not support the position expressed in science regarding the attribution of the right to publish a work (the release of a work to the world) to the personal non-propertyrights of the author, since both according to the position of the legislator and by its very nature this right is property. General personal non-property rights of the author are defined. The right of authorship is a legally guaranteed possibility of a person to be considered the author of a work and the possibility of recognition of this fact by other persons. The right to anauthor’s name is a legally guaranteed opportunity for the author of a work to use or prohibit the use of his work under his own name (autonym), under a fictitious name (pseudonym) or without specifying a name (anonymous). The right to the inviolabilityof a work is a legally guaranteed possibility to prohibit making changes to the content of the work, its name, which may violate the integrity of the work, lead to its distortion or distortion in any use of the work without the consent of the author.The rights that protect the connection between the author’s personality and his work are personal non-property rights of the author. These rights have no monetary value, they are inherent in the fact of authorship and are absolute. The system of personal non-property rights of the author includes the right of authorship, the right to the author’s name and the right to inviolability of the work. The specified rights are general, as they belong to the author of any work. The current legislation of Ukraine allocates other personal non-property rights of the author, but they are characteristic of authors of works of fifine art, works of architecture, and therefore have a special character. The value of the author’s personal non-property rights is extremely high, as they are of a legal nature and contribute to the protection of the author’s honor and reputation. Legislation in the field of personal non-property rights of the author to works must be agreed among themselves (regarding the possibility of transferring personal non-property rights to other persons, which is provided for by the Central Committee of Ukraine and prohibited by the Law of Ukraine “On Copyright and Related Rights”) and developed in the direction of securing for authors other general personal rights non-property rights to works (the right to secretize a work, the right to withdraw a work, etc.), which can act as independent objects of scientific research. Securing these rights will expand the protection of the author’sinterests in preserving his creative identity. The author’s provisions are illustrated by examples from judicial practice and legal positions of the Supreme Court.

Contemporary Chinese rights of personality law are in a period of perfection. The Personal Rights section of the Civil Code provides the ideological basis of law for other legislation on the rights of personality in China, and the newly released Personal Information Protection Law provides relevant provisions for the privacy issues involved in personal information. The legislation related to personality rights in China should respond to the needs of people’s personality rights in the Internet era and introduce laws to some rights that have emerged with the development of the Internet. In other words, based on confirming the general personality rights and personal information protection, we should protect the emerging rights such as “the right to be forgotten”. In this regard, based on the existing judicial and legislative practices, it is necessary to argue that the right to be forgotten is an independent form of right and to explore the legislative way forward for the right to be forgotten, to contribute to the effective protection of personality rights and personal information.

Abstract:
The text deals with the complementarity of information rights with respect to the active electoral right, using the example of the right of access to public information and the right to protection of personal data. These two information rights well reflect the most relevant aspects of an individual’s information status. At the same time, these rights interestingly interact with the exercise of the active electoral right. The article explains the concept of “information rights” and the concept of the sovereignty of the people, and identifies the obligations incumbent on public authorities to ensure the exercise of information rights and the active electoral right. From the analyses carried out, there are strong interactions between the right of access to public information and the active electoral right. The situation is different in the case of the right to protection of personal data. The analysis makes it possible to claim that the relationship between the right of access to public information and the active electoral right as political rights is more intense due to the goals set for them. The right to protection of personal data belongs to personal rights. Its exercise involves complying with a number of procedures for processing personal data and securing personal data in technical and organizational terms. Procedures defining the principles of personal data processing are currently described primarily in the General Data Protection Regulation (GDPR). The joint application of the Election Code and personal data protection procedures is not easy, and the Polish regulation in this regard is sometimes unclear and insufficient.

In this scientific paper, an analysis of the ways of realization and protecting personal rights and author's rights on the Internet has been done. During the research and development of the scientific paper, the methods of analysis and the inductive-deductive method were used. The rapid spread of digital communication technology has caused profound social changes and disturbances. Thanks to their rapid and unpredictable development at the global level, certain phenomena that were unthinkable in the past are common today and pose a great challenge for individuals and companies, as well as for countries. The emergence of the Internet and digital technology has also changed the way personal rights and author's rights are achieved and violated. The author came to the conclusion that the age of digital technology and the Internet has a strong impact on personal rights and author's rights, as well as on the already established legal framework for their protection, both locally and internationally.

Abstract:
The thesis is concerned with Digital Rights Management (DRM), and in particular with DRM for networks of devices owned by a single individual. This thesis focuses on the problem of preventing illegal copying of digital assets without jeopardising the right of legitimate licence holders to transfer content between their own devices, which collectively make up what we refer to as an authorised domain. An ideal list of DRM requirements is specified, which takes into account the points of view of users, content providers and copyright law. An approach is then developed for assessing DRM systems based on the defined DRM requirements; the most widely discussed DRM schemes are then analysed and assessed, where the main focus is on schemes which address the concept of an authorised domain. Based on this analysis we isolate the issues underlying the content piracy problem, and then provide a generic framework for a DRM system addressing the identified content piracy issues. The defined generic framework has been designed to avoid the weaknesses found in other schemes. The main contributions of this thesis include developing four new approaches that can be used to implement the proposed generic framework for managing an authorised domain. The four novel solutions all involve secure means for creating, managing and using a secure domain, which consists of all devices owned by a single owner. The schemes allow secure content sharing between devices in a domain, and prevent the illegal copying of content to devices outside the domain. In addition, each solution incorporates a method for binding a domain to a single owner, ensuring that only a single consumer owns and manages a domain. This enables binding of content licences to a single owner, thereby limiting illicit content proliferation. In the first solution, domain owners are authenticated using two-factor authentication, which involves 'something the domain owner has', Le. a master control device that controls and manages consumers domains, and binds devices joining a domain to itself, and 'something the domain owner is or knows', i.e. a biometric or password/PIN authentication mechanism that is implemented by the master control device. In the second solution, domain owners are authenticated using their payment cards, building on existing electronic payment systems by ensuring that the name and the date of birth of a domain creator are the same for all devices joining a domain. In addition, this solution helps to protect consumers' privacy; unlike in existing electronic payment systems, payment card details are not exposed to third parties. The third solution involves the use of a domain-specific mobile phone and the mobil~ phone network operator to authenticate a domain owner before devices can join a domain. The fourth solution involves the use of location-based services, ensuring that devices joining a consumer domain are located in physical proximity to the addresses registered for this domain. This restricts domain membership to devices in predefined geographical locations, helping to ensure that a single consumer owns and manages each domain.

Abstract:
This thesis explores the ways in which Islamic law and human rights interact within the work of women’s rights non-governmental organizations (NGOs) that advocate the reform of the Egyptian Personal Status Law (PSL) in the period between 2006 and 2010. The thesis shows the relevance of the human rights framework as well as the flexibility of Islamic legal discourse in the work of the NGOs. Drawing on both Islamic law and human rights enabled NGOs to develop a more gender-sensitive religious discourse, which supported their PSL reform demands. However the interaction between these two frameworks was largely affected by several important factors, which sometimes led NGOs to dilute some of their demands. These factors included the implications of the change in the form of Shari‘a as codified law under the modern nation-state; the Egyptian political context both internally and externally; the common local perception that human rights are a Western production and an extension of Western colonialism; the dominant religious but patriarchal discourse governing the PSL; the implications of activism through the NGO structure; and the personal religiosity of individual activists. The thesis explores NGOs’ PSL reform demands in depth bearing in mind these factors. It investigates NGOs’ discourse and shows its strengths and weaknesses. It shows that the interaction between Islamic law and human rights within NGOs’ work in this particular Egyptian context produced reform demands that were innovative and practically appealing on one hand, but epistemologically problematic in some instances, on another.

Abstract:
At the end of World War II, the United States emerged as a world leader, putting into place international institutions based on its own liberal economic philosophy. Since then, the world has witnessed an increasing interconnectedness among states, with economic relationships continually blurring the distinction between domestic and international, as well as between state and societal forces. Much of the world associates this increased interconnectedness with human suffering around the globe. This dissertation seeks to test the effects of economic globalization on personal integrity violations within a state, on the whole. Specifically, I examine three aspects associated with globalization, trade openness, investment and IMF funding within a state. Liberal economic theory suggests that economic relationships should foster positive gains. Particularly, economic relationships engender economic prosperity, diffusion of norms and idea, as well as the growth of a middle class which increasingly demands respect for its political and civil rights. Consistent with the liberal paradigm, I find that open trade and investment lead to improved personal integrity rights. In addition, investment which originates from the hegemon is especially likely to increase a state's respect for personal integrity rights. Conversely, IMF funding is likely to provoke protests from people in recipient countries, which often leads to increased repression by the state. To the extent that the IMF chooses to place importance on human rights, future attention should be paid to the practices of recipient countries. Overall, this dissertation suggests overall support for the liberal paradigm, that open economic policies are most likely to lead to improved levels of personal integrity rights.

Abstract:
Advance directives are instructions given by patients – or potential patients – specifying what actions ought to be taken for their health in the event that they are no longer capable to make decisions due to illness or incapacity. Over the last decades, there has been a rising tide in favour of advance directives: not only is the use of such directives recommended by most medical and advisory bodies, they are also gaining increasing legal recognition in many parts of the world. This book, however, takes as its point of departure one of the most commonly discussed medical-ethical arguments against granting advance directives moral force: the Objection from Personal Identity. The adherers of this objection basically asserts that when there is lacking psychological continuity between the person who formulated the advance directive and the later patient to whom it supposedly applies, this seriously threatens the directive’s moral authority. And, further, that this is so because lacking sufficient psychological continuity implies that the author of the advance directive is numerically distinct from the later patient. Although this argument has some initial appeal, most philosophers in the advance directives debate maintain that the Objection from Personal Identity fails, but suggest different reasons as to why. Whereas some argue that the objection has no force because it rests on faulty beliefs about personal identity, others argue that we ought to grant advance directives moral authority even if the author and the later patient are numerically distinct beings. This book investigates some of the most influential of these arguments and reaches the conclusion that the Objection from Personal Identity has more to it than is usually recognized in the medical-ethical debate. Lacking sufficient psychological continuity between author and later patient, it is concluded, does threaten the moral authority of the advance directive.

As modern technology continues to affect civilization, the issue of electronic rights grows in a global conversation. The right to be forgotten is a data protection regulation specific to the European Union but its consequences are creating an international stir in the fields of mass communication and law. Freedom of expression and privacy rights are both founding values of the United States which are protected by constitutional amendments written before the internet also changed those fields. In a study that analyzes the legal process of when these two fundamental values collide, this research offers insight into both personal and judicial views of informational priority. This thesis conducts a legal analysis of cases that cite the infamous precedents of Melvin v. Reid and Sidis v. F-R Pub. Corp., to examine the factors on which U.S. courts of law determinewhether freedom or privacy rules.

Safety and health is a basic human need and when not met, exacts costs that prevent societies from realizing development goals. Injury is increasing as a leading cause of death and disability. As the result of advances in public health knowledge and safety engineering technology, accidents and other injury events are often preventable. Injuries result from identifiable determinants and conditions that create exposure to identifiable hazards. By controlling hazards, the toll of injury can be reduced.
International trade and investment can create conditions that increase or diminish the global injury burden. International institutions and national governments face the question of how to protect safety and health rights and reduce the injury burden in a world of increasingly global business activity. International institutions do not yet provide comprehensive regulation for exported harms. In common law nations, liability through formal law plays an important role in regulating conditions that can lead to injury. In such nations, private law can play an important role in filling segments of the regulatory gap relating to exported harms.

Although previous scholars have addressed the legislative parameters of the Equal Rights Amendment debate in non-ratifying states, analysis of amendment supporters’ rhetoric has been limited. Examining the public and private writings of activists, This thesis presents the argument that pro-ERA coalitions in Georgia addressed the concerns of their opponents and developed rhetoric that deemphasized connections to the radical women’s liberation movement and argued that the ERA would enact legal, rather than social, change. While the educational materials produced by pro-ERA coalitions presented a logical analysis of the amendment’s legal ramifications, the personal discourse of Georgia activists presented an emotional defense of the amendment that has often been overlooked in previous studies.

Abstract:
The role of taxation in gender inequality is something that is perhaps not considered earnestly enough. Both in South Africa and within the context of global initiatives such as the Convention for the Elimination of All Forms of Discrimination Against Women (CEDAW) and the Sustainable Development Goals (SDG) which are aimed at eradicating all forms of gender-based discrimination, the importance of understanding the gender consequences of tax policy, whether intended or not, should not be underestimated. This study seeks to identify whether or not there are any instances where South Africa’s personal income tax laws have an effect which is potentially inconsistent with both the Constitutional right to equality between genders and international gender equality agreements to which South Africa is bound, namely the CEDAW and the SDG. In doing so, determine whether South Africa’s personal income tax legislation should become a focal point in this regard and be one of the pillars that could further be used as a means to uphold and further the cause of substantive gender equity.

Personal rights related to the identification of the person are internationally recognised rights in the European Convention on Human Rights. Thus, the right to a name, the right to domicile and the right to marital status are expressly stipulated. According to the ECHR, all these rights are included in the right to respect for private life, which is also enshrined in the Constitution of the Republic of Moldova. The institution of personal identification is complex and important because of its very applicability in all branches of law, where the person is in a legal relationship and has rights and obligations. We believe that respect for these rights arises from the need for a legal order in all the situations in which a person finds himself in the course of his life.

Media disputes are special litigation proceedings in which the court must balance betweem various rights and the amount of compensation for non-pecuniary damage, assess whether the right to freedom of speech and citizens' right to information is restricted. Only an urgent procedure and an independent court that will resist the pressure of prosecutor in civil proceedings who are often public figures with great influence, and on the other hand the media with specific power over public opinion, ensure adequate protection of the most sensitive rights of citizens. This paper analyzes how the procedure for determining compensation for non-pecuniary damage is carried out according to the current Law on Public Information and Media. Current norms could ensure effective protection of citizens' personal rights in media disputes. The implementation of the Law is faulty. Uniform case law in determining the amount of compensation for non-pecuniary damage represents one of the factors of a fair trial. Unfortunately, the established amount of compensation does not fulfill its purpose. Violation of subjective rights is related to a person and the amount of damage must ensure personal satisfaction. It must be such that it influences the perpetrator, the media, to refrain from further infringement of rights. The law determined the reasons for violation of personal rights. They provide a legal basis for awarding damages in the event that the media abuses freedom of speech through unprofessional behavior. Case law must be a quality complement to legal norms in order to achieve the purpose of media disputes in realizing the balance of rights.

Since personal data is key information, that is, sets of information on the basis of which the privacy of each individual in society is preserved, the question of their protection is extremely important. It is necessary, therefore, to emphasize the need to devote ourselves to this topic in an appropriate way, precisely bearing in mind its complexity. In this regard, the author's attention will be focused primarily on normative and institutional mechanisms through which the protection of personal data is achieved, both in international legal frameworks and in the law of the Republic of Serbia. A special emphasis will be placed on describing the mechanisms of legal protection that have been established in selected countries in the surrounding area. In addition, the subject of the paper will be an analysis of the right to privacy, its definition, determination of the place, as well as the importance of the mentioned term in the legal order. In the aforementioned work, the determination of the position of human rights in the legal and social order, as well as the determination of their relationship with personal data and the right to privacy, will have a special place.

The protection of personal data currently represents one of the most debated issues, and a huge number of new reforms in this field have been enacted in the recent years, starting from the European Union's GDPR. The importance of data protection stems from the characteristics of the modern digital economy, where data plays a prominent economic role. Personal information must to be protected as they constitutes a fundamental rights of individuals, as it is recognised by the major charters of fundamental rights. Anyhow, the debate is almost always focused on the protection of personal data of people who are alive. But what happens to the data produced in the digital environment by deceased persons? The topic is at the intersection between data protection and inheritance law, as the control over these data can be ‘passed on’ the deceased person's heirs, especially regarding personal profiles on social media. On this point various solutions have been adopted in different legal systems, and this paper will try to analyse them under a comparative perspective, with the aim of understanding which could be a viable regulatory regime in this field.

Under the current legal paradigm, the rights to privacy and data protection provide natural persons with subjective rights to protect their private interests, such as related to human dignity, individual autonomy and personal freedom. In principle, when data processing is based on non-personal or aggregated data or when such data pro- cesses have an impact on societal, rather than individual interests, citizens cannot rely on these rights. Although this legal paradigm has worked well for decades, it is increasingly put under pressure because Big Data processes are typically based indis- criminate rather than targeted data collection, because the high volumes of data are processed on an aggregated rather than a personal level and because the policies and decisions based on the statistical correlations found through algorithmic analytics are mostly addressed at large groups or society as a whole rather than specific individuals. This means that large parts of the data-driven environment are currently left unregu- lated and that individuals are often unable to rely on their fundamental rights when addressing the more systemic effects of Big Data processes. This article will discuss how this tension might be relieved by turning to the notion ‘quality of life’, which has the potential of becoming the new standard for the European Court of Human Rights (ECtHR) when dealing with privacy related cases.

When we think on initiatives on access to and reuse of data, we must consider both the European Intellectual Property Law and the General Data Protection Regulation (GDPR). The first one provides a special intellectual property (IP) right – the sui generis right – for those makers that made a substantial investment when creating the database, whether it contains personal or non-personal data. That substantial investment can be made by just one person, but, in many cases, it is the result of the activities of many people and/or some undertakings processing and aggregating data. In the modern digital economy, data are being dubbed the ‘new oil’ and the sui generis right might be con- sidered a right to control any access to the database, thus having an undeniable relevance. Besides, there are still important inconsistences between IP Law and the GDPR, which must be removed by the European legislator. The genuine and free consent of the data subject for the use of his/her data must remain the first step of the legal analysis.

In what way and how can models for personalised support such as personal budgeting strengthen the implementation of the UN Convention on the Rights of Persons with Disabilities? Personal budgeting refers to a sum of money that is granted to the individual on the basis of an assessment of the need for service and calculation of a budget for this purpose. The individual can buy the service he needs for his budget. Personal budgeting is in use in social and health care in several countries. In the Nordic region, personal assistance is the main example of such solutions, but other models have also been tried and adopted in social and health care, such as systems of freedom of choice and increased opportunities for users to choose a provider. The report presents a number of personalised systems for support for people with disabilities that have been implemented in the Nordic countries and their experiences. The mapping was carried out jointly by the Nordic Welfare Center and the Finnish Institute for Health and Welfare (THL). The report will be considered when forming a proposal for a future reform of support and services for people with disabilities in Finland.

The Bangladesh government adopted the Domestic Violence (Prevention and Protection) Act in 2010. While the formulation and enactment of the Act was an achievement for the government and the coalition that championed it (the Citizens’ Initiative Against Domestic Violence, CIDV), its implementation has been weak. In Bangladesh, dominant social norms have led to stereotyping domestic violence as a trivial, personal matter, which has led to service providers delegitimising and deprioritising the issue. Combined with all the gender biases that operate within the judiciary and other government departments, this has resulted in an unsatisfactory use of the Act for women seeking redress from violence. This paper explores to what extent this lax implementation is due to the weak capacity of implementing agencies versus deliberate/intentional inaction in the form of backlash. It also examines how women’s rights organisations have articulated feminist voices in terms of agenda and framing and used collective agency to counter the pushback.
