Full textIn the middle of the nineteenth century the French pharmacists have the feeling their drug’s monopoly is threatened. They are more and more dependent towards other professions as druggists, herbalists. The Pharmacie centrale de France is a purchase co-operative between pharmacists founded by a Parisian pharmacist François-Louis-Marie Dorvault in october 1852. The PCF tries to achieve corporatist and industrial’s goals and allows us to understand the links between industry and the drugstore sector. Historians have already widely shown that the contemporary pharmaceutical industry derived from the pharmacy of the XIXth century. Too often however, we reduce this transition to individual actors. The social historians have often set the big company over against shopkeepers, the emergence of the first meaning the decline of the second. The case of the Pharmacie centrale de France is original on that account, which allows us to study an industrial co-operative between pharmacists. This transition to industry is perceived in a positive and necessary way by these co-operators. For someone like Dorvault, the Pharmacie centrale de France will strengthen the pharmacy in its commercial and scientific functions. The purpose of the co-operative is not to supplant the pharmacist but to sustain him, allowing him to prepare and to sell better medications bought at a lower cost. PCF’s capital never stops increasing during the period. From one million in 1852 the capital reaches 8 millions in 1878. The PCF is also a commercial success. Sales are estimated around 400 000 F in 1853 and 8 millions in 1878. The power of the company becomes incarnated through buildings (factories of Paris and Saint-Denis) and branches network. The PCF unfolds professional, social and scientific projects like the creation of a newspaper, the Union Pharmaceutique, in 1860; the scheme of a pharmacist’s pension fund between 1854 and 1859; the scheme of a drugstore’s insurance in 1863 and 1864; or the organization of scientific concourses. The market’s complexity, the growth of big company, the profitability’s imperatives, the fierce competition between wholesalers induce however the Pharmacie centrale to break gradually with this line. The pharmacy, while strengthening its sale’s monopoly, sees the foundations of this monopoly disappear, particularly the election (the choice of the natural elements entering the composition of the medicine) and the preparation of products. Control procedures, manufacturing, distribution are henceforth centralized by big companies as the Pharmacie centrale de France. The PCF accelerate the transformation of pharmacist’s work and the transition from preparation to sale only. In consequence, the PCF played a part in the redefinition of pharmacist’s professional identity: a commercial activity articulated around a degree. Full textIn exchange for a drug retail distribution monopoly, which is consented to them in the interest of public health, chemists are subjected to many obligations. In particular, these obligations consist of qualifications requirements for people working in chemists' shops. They concern, first of all, chemists whose long and high level university education is a guarantee of competence and the quality of the pharmaceutical act (part i). They also apply to other members of the chemist's staff. Only certificied assistants can carry out preparation and distribution operations, under the chemist's supervision (part ii). This is the principle of "personal exercise" which required the chemist, when he doesn't carry out these operations himself, to carefully supervise them. Then, in virtue of this principle, a chemist must be present in the chemist's shop to ensure that a member of a medical profession is always available (part iii)

Full textApproaching the comparative legal framework of circulation of drugs in morocco and france was justified by the gap, existing since independence, between the evolution of the moroccan all-branch pharmaceutical sector through the private initiative, and the stagnation of the legislation in force. Our work, comprises two parts, the first is entitled the fundamental concepts of the law of pharmacy and drugs, the second is entitled the circulation of medicine in morocco. After an appreciation, we noticed the absence of test cases and took down about the laws in force that are out of date and often usuitable. Aware of this fact, mainly face to the easing of restrictions on the external trade up to the year two thousand, regarding the project of partnership of morocco with the european union, and considering the permanent revolution of the medical and pharmaceutical practice, the professional staff of the pharmaceutical sector, in collaboration with the public health ministry, elaborated within the framework of a revision and a recasting of the existing laws, a series of bills, which are presently in awaiting approval. A code of pharmacy comprising, in a structured and cordinated manner, the whole laws which are adopted seems to be necessary. But the most important thing is to look after the implementation of this pharmaceutical legislation by all the professionals

Full textThe 18th century witnessed the rebirth of pharmaceutical art in France; the progress of chemistry allowed to isolate numerous active ingredients. The development of industrial pharmacy only occurred in the 20th century. Ever since, scientific research has never ceased to create new pharmaceutical specialties that are more and more competitive, complex and dangerous if they are not manufactured and commercialized in adequate conditions. The traditional practice, oriented toward the preparation of medicines at the request of patients, has gradually been replaced by new manufacturing and commercialization techniques. Hence, the civil, penal or disciplinary liability of pharmacists has shifted from the error in the preparation of a formula to a mistake during the distribution of medicinal specialties. The pharmacist has a protective role and is subject to an increasing burden of health safety requirements: Quality control of the prescription before the dispensation to the patient, perfect knowledge of medicinal products. The quality of new medicinal practices will not be achieved if the pharmaceutical act does not take into account the optimization of treatments by efficient interventions with the prescribers

Full textUnder the Old System, the exercise of the pharmacy is fixed by the society's general rules related to the other trades. The apothecary practice his trade within the corporative framework whom allowing him to profit from an exclusive right of drug's sales, which, remainder, is confirmed by the authorities. However, he undergoes a competition on behalf of other people exerting pharmacy in a derogatory or lawful way by diverting the texts of laws. This faintness is explained on the one hand why the apothecary's activity is much vaster than nowadays. He exerts parallel to his principal activity, an additional activity of grocer from the pharmacy and to recognize with the latter its erudite character. In addition, medical science's diffusion is not homogeneous in all the Kingdom of France. The apothecary, like the doctor, is especially concentrated in the cities while the campaigns are foresaken with the empirical ones and with the monks. It results from it from the abuses such as a reform is essential on the hand of 18th century. The declaration of 1777 bring a new era for the pharmaceutical profession
