Esta dissertação aborda a (re)construção dos direitos territoriais indígenas no cenário jurídico brasileiro, partindo de fatos histórico-jurídicos da América Latina, que tornou-se o palco da colonização/conquista europeia a partir do final do século XV e início do século XVI. A chegada do europeu conquistador teve várias dimensões, mas nesta dissertação é analisada a expulsão dos povos indígenas dos seus territórios originais e a constituição da outra face da Modernidade, cuja qual fundamentou-se na colonização e conquista das terras e povos latino-americanos. A Modernidade subalternizou os povos nativos da América Latina, embora desde o início da colonização tenha havido a previsão nas legislações da colônia brasileira de que os indígenas eram os donos naturais de suas terras originais. Avanços e retrocessos marcaram a história legislativa e constitucional brasileira quanto à causa territorial, em essencial, a indígena. A mudança na relação do Estado brasileiro com os indígenas ocorreu de forma significativa na efetivação da proteção das terras nos anos 90, com o processo de democratização do Brasil. Assim, a presente dissertação preocupa-se em analisar a relação que os indígenas possuem com as suas terras tradicionais e a relevância que a proteção dos direitos originários sobre as terras tradicionalmente ocupadas apresenta para a preservação das suas culturas. Objetiva-se analisar em que medida o respeito aos direitos territoriais indígenas serve para a preservação das culturas e dos modos de vida destes povos. Esta análise transcende os limites da disciplina jurídica, recorrendo a outras áreas do conhecimento. Os diferentes caminhos percorridos pela pesquisa tiveram a preocupação de buscar elementos para a compreensão do que são os novos direitos territoriais indígenas no Brasil, quais as características destes direitos, como o ordenamento jurídico brasileiro reage diante destes direitos e qual a percepção dos povos indígenas quanto a este assunto. Neste cenário, a discussão sobre o direito, a terra e o território, tanto a partir do exemplo de etnias regionais (Guarani, Kaingang e Charrua) como de decisões internacionais de direitos humanos, foi fundamental para o desenvolvimento desta dissertação.
This dissertation discusses the (re)construction of indigenous land rights in the Brazilian legal scenario, from historical and legal facts of Latin America, which became the stage of European colonization/conquest from the late fifteenth and early sixteenth century. The arrival of European conqueror had several dimensions, but in this dissertation analyzes the expulsion of indigenous peoples from their original territories and the establishment of the other face of Modernity, whose which was based on conquest and colonization of the lands and peoples of Latin America. The Modernity slaughtered the native peoples of Latin America, although since the beginning of colonization has been forecast by the laws of the Brazilian colony that the Indians were the natural owners of their homelands. Advances and setbacks marked the legislative and constitutional history as the Brazilian territorial question, in essence, the indigenous. The change in the relationship of the Brazilian state with the Indians occurred significantly through the effective protection of land in the 90s, with the democratization process of Brazil. Thus, this dissertation is concerned with analyzing the relationship that indigenous people have with their traditional lands and the relevance that the protection of the original rights to the lands traditionally occupied presents for the preservation of their cultures. The objective is to analyze the extent to which the respect for indigenous land rights serves to preserve the cultures and ways of life of these people. This analysis transcended the boundaries of legal discipline, using other areas of knowledge. The different paths taken by this research were concerned to seek elements for understanding which are new indigenous territorial rights in Brazil, which are the features these rights, such as the Brazilian legal system reacts to these rights and what is the perception of indigenous peoples as this matter. In this scenario, the discussion about the right, the land and the territory, both from the example of regional ethnic groups (Guarani, Kaingang and Charrua) as decisions of international human rights was essential to the development of this dissertation.

A prostituição é uma problemática existente desde a Antiguidade nas mais diversas sociedades, sendo um fenômeno predominantemente urbano, mesmo que não se assemelhe com a forma na qual a prostituição é exercida atualmente. Verifica-se que seu crescimento tem se aliado sobremaneira ao crescimento urbano das cidades, criando assim verdadeiros territórios da prostituição. Cada um desses territórios possuem peculiaridades que os definem, contudo a característica comum entre eles é o poder, considerando o fato de que o exercício do mesmo é fundamental para a manutenção, expansão, bem como para a conquista de novos territórios, ou seja, para o aumento das áreas de influência nas malhas urbanas da atualidade, entre as diversas territorialidades, sobrepostas umas às outras. Essas dinâmicas espaciais também estão inseridas na cidade de Campina Grande – PB, principalmente no Centro, bairro escolhido como foco desta pesquisa, onde as mesmas têm resistido sobremaneira no tempo/espaço. Portanto, para que possamos analisar estes territórios flutuantes, o presente trabalho será realizado através de pesquisa bibliográfica, utilizando-se da abordagem dos conceitos de território, poder, medo e segregação socioespacial, além de bibliografias históricas do município de Campina Grande que remetem a problemática da prostituição e suas relocações espaço-temporais, isto é, fontes históricas que nos forneceram relatos acerca da história da prostituição na cidade que nos levam ao início do século passado. A pesquisa in loco colaborou sobremaneira para a interpretação das áreas de prostituição e das demais territorialidades que atuam conjuntamente. Imagens e mapas dos territórios em questão, bem como estudos empíricos corroboram para que possamos ter uma melhor compreensão de como se dá o processo de expansão e recuo dos territórios da prostituição. Esta pesquisa elaborou-se com enfoque na formação dos territórios da prostituição e seus enclaves na área central do município de Campina Grande – PB.
Prostitution is an existing problem since ancient times in many societies, it‟s being a predominantly urban phenomenon, even if it does not resemble with the way prostitution is currently exercised nowadays. It appears that this growth has greatly with the urban growth of cities, thus creating real territories of prostitution. Each of these territories have peculiarities that define it, but the common feature among them is the power, considering the fact that the exercise of this is essential for the maintenance, expansion and for the conquest of new territories, meaning, the increase in the areas of influence in urban networks of nowadays, among the various territoriality, overlapping each other. These spatial dynamics are also inserted in the city of Campina Grande – PB, mainly in the downtown, neighborhood chosen as focus of this research, where they have exists greatly in timespace. Therefore, so that we can analyze these fluctuating territories, this work will be done through bibliography, using approach of the territory of concepts, power, fear and socio-spatial segregation, in addition to historical bibliographies of Campina Grande referring the prostitution issue and its relocation timeline, that is, historical sources that provided us stories about the history of prostitution in the city that take us to the beginning of the last century. The search on site greatly contributed to the interpretation of the areas of prostitution and other territorialities working together. Images and maps of the territories in examinations as well as empirical studies support us that we can have a better understanding of how is the process of expansion and retreat of prostitution territories. This research was elaborated with a focus on elaborating the territories of prostitution and its enclaves in the downtown area of Campina Grande - PB.

The incorporation of the territorial approach as the basis of rural development policies led to, among other advances, the break with centered vertical tradition of development strategies, and the consequent importance of local initiatives and actors. This approach accepts the social management and its principles of inclusion, concerning the incorporation of the players excluded from decision-making process, and pluralism, regards to the multiplicity of actors in decision-making about public policy. In Brazil, the territorial approach is embraced by the Programa de Desenvolvimento Sustentável dos Territórios Rurais and its successor, the Programa Territórios da Cidadania. However, the trajectory of rural development policies is eminently rural for it focuses on organizations linked to family farming and excludes organizations representing employees, despite the principles ported by social management and the adoption of a territorial approach, that should involve the mobilization of social dynamics present in the territories. Thus, considering the significance of business participation for the success of such policies, this work examines the possibilities of including representatives of entrepreneurs to pluralism within the Programa Territórios da Cidadania. In this case study we chose to understand the dynamics of the Program in the North Region of Rio de Janeiro State, where representatives of civil society, businessmen, SEBRAE and members of the Ministério do Desenvolvimento Agrário were interviewed. The study was supplemented by documentary analysis, and treated by analysis of content with combined graph developed based on the habermasian concept of deliberative citizenship. The results reveal that business representatives are not included in the territorial collegiate North-RJ, and neither know the Programa Territórios da Cidadania. The civil society groups, who consider the collegiate as a Family Farming Forum, reject indistinctly the inclusion of entrepreneurs because of socio-political differences, compounded by the political history of the region. Pluralism is also encumbered by the processes used in the formation of the territory, in the composition of the collegiate body and in the preparation and evaluation of projects. The business representatives, in turn, are already included in other instances of social participation, such as municipal councils of public policies, and accept the dynamics that governs these spaces lined on substantive rationality. Its insertion can be facilitated by SEBRAE/RJ, which has a good reputation among entrepreneurs and has also fostered the articulation of territorial actors. Despite the possibilities for inclusion, the actual model of social management is not capable of promoting the social concertation of the dynamic forces for the development of the North region of Rio de Janeiro State.
A incorporação do enfoque territorial como fundamento para as políticas de desenvolvimento rural ocasionou, dentre outros avanços, no rompimento com a tradição vertical e centralizadora das estratégias de desenvolvimento, e na consequente valorização das iniciativas e dos atores locais. Tal abordagem acolhe a gestão social, e seus princípios da inclusão, relativo à incorporação dos atores excluídos do processo decisório, e do pluralismo, que diz respeito à multiplicidade de atores na tomada de decisões sobre as políticas públicas. No caso brasileiro, o enfoque territorial é encampado pelo Programa de Desenvolvimento Sustentável dos Territórios Rurais e pelo seu sucessor, o Programa Territórios da Cidadania. No entanto, a trajetória das políticas de desenvolvimento rural é francamente setorial, ao privilegiar as organizações vinculadas à agricultura familiar e excluir as organizações representantes dos empresários, apesar dos princípios portados pela gestão social e da adoção da abordagem territorial, que implicam na mobilização das forças sociais dinâmicas presentes nos territórios. Assim, considerada a importância da participação empresarial para o êxito das políticas dessa natureza, este trabalho analisa as possibilidades de inclusão das representações dos empresários para o pluralismo no âmbito do Programa Territórios da Cidadania. Para tanto, realizou-se um estudo de caso no Norte- RJ, no qual foram entrevistados representantes da sociedade civil, dos empresários, do SEBRAE e do Ministério do Desenvolvimento Agrário, cujas informações foram complementadas por análise documental, e tratadas por meio de análise de conteúdo com grade mista elaborada com base no conceito de cidadania deliberativa habermasiano. Os resultados relevam que as representações empresariais não estão inseridas no colegiado territorial do Norte-RJ, e tampouco conhecem o Programa Territórios da Cidadania. As entidades da sociedade civil, que consideram o colegiado como Fórum da Agricultura Familiar, rechaçam indistintamente a inclusão dos empresários por conta de diferenças sócio-políticas, agravadas pelo histórico da região. O pluralismo também é atravancado pelos processos de formação do território, de composição do colegiado e de elaboração e avaliação dos projetos. As representações empresariais, por seu turno, já estão inseridas em outras instâncias de participação social, como conselhos municipais de políticas públicas, e aceitam a dinâmica que rege estes espaços pautados na racionalidade substantiva. Sua inserção pode ser facilitada pelo SEBRAE/RJ que, além de gozar de prestígio dentre os empresários, tem fomentado a articulação dos atores territoriais. Não obstante as possibilidades para a inclusão, o modelo de gestão social em vigor não é capaz de promover a concertação social das forças dinâmicas em prol do desenvolvimento do território Norte-RJ. Full textModern State has been formed by unification process of its territorial sovereignty but this must be redefined today. Indeed, although all States have a tendency to preserve their unity, it appears that the territory on which the State intends to extend its sovereignty is the subject of various claims. This situation is particularly characterized for States deriving from colonization and for which, independence did not challenged the subordination of colonized peoples to colonizing peoples. By perpetuating a situation of domination largely condemned by International law, considering the right of peoples to self-determination, this partial decolonization raises question in State theory. This leads to oppose on the one hand, an European State model aspiring to territorial sovereignty and on the other hand, some indigenous peoples having a claim to the same territory, based on the original illegitimacy of the conquest from which these States have emerged. Thus, there habilitation of historical truth and the unanimous condemnation of colonization have restored indigenous peoples in their territorial rights. Thereby, the States’ right on territory cannot be exercised without considering the original privileges of first inhabitants. Consequently, such approach may dispute territorial sovereignty of these States because they no longer have an absolute and unconditional power over their territory, but only aconditioned authority by the respect of indigenous peoples’ rights, which is largely confirmed by the development of an international law of indigenous peoples. This situation, which appear in the Latin-America States derived of Hispanic colonization, and in some States derived British colonization – United States, Canada,Australia, New-Zealand –, may contribute to define a particular category of States, which represents the postcolonial State

O trabalho trata dos direitos territoriais indígenas. Aborda-se o tema a partir dos novos direitos indígenas e do pluralismo jurídico, que traz à tona o paradigma da alteridade e da participação dos novos atores na produção de juridicidade. Parte-se da hipótese de que a falta de diálogo interdisciplinar entre o Direito e a Antropologia constitui-se em óbice à realização dos direitos territoriais indígenas. A análise é feita a partir de uma abordagem dedutiva, com ampla revisão bibliográfica e estudo de caso. Inicialmente desenvolve-se o estudo do percurso histórico e legislativo dos direitos indígenas, com atenção especial às conseqüências derivadas da perspectiva assimilacionista com relação aos direitos territoriais. Com a mudança para o paradigma da alteridade, a partir da atuação dos novos atores, verifica-se a necessidade do diálogo com a Antropologia, que faz a tradução do que pensam os povos indígenas sobre seu território. Na segunda seção desenvolve-se a análise do regime jurídico das terras indígenas e o do fundamento dos direitos territoriais, a originariedade dos povos indígenas. Do ponto de vista antropológico desenvolve-se as categorias das identidades étnicas e dos processos de territorialização e busca-se estabelecer uma ponte para uma fundamentação dos direitos indígenas com base no pluralismo jurídico e fundiário existente no Brasil. Ao final, empreende-se o estudo da demarcação da terra Guarani do Morro dos Cavalos, em Santa Catarina, analisando a concepção de direitos territoriais em diversos atores, com o intuito de verificar se a falta de visão interdisciplinar também ocorre no plano fático da demarcação. Ao final, reconhece-se que o isolamento do Direito na definição de terras indígenas é o primeiro obstáculo a ser superado para a realização dos direitos territoriais indígenas. This work focuses on indigenous territorial rights. The theme is based on the vision of the new indigenous rights and the legal pluralism that highlights the paradigm of otherness and the participation of the new actors in the production of legality. The hypotheses is that the lack of communication between Law and Anthropology constitutes an obstacle to the realization of indigenous territorial rights. Using literature and a case study, a deductive analysis has been formed. Firstly, the historical and legislative study is developed about the indigenous rights in order to seek the consequences of the integrationist perspective related to the indigenous territorial rights. As the paradigm of otherness has gained force, due to the new actors participation, the communication with Anthropology is necessary to translate how the indigenous people think their territory. At second session, the analysis of the law regime of indigenous territorial is developed and forms the foundation of indigenous territorial rights: originality of indigenous people. From the anthropological perspective the categories of ethnic identities and processes of territorialization are developed. In this way, a password key based on legal and fundiary pluralism in Brasil is established. At the end, the study case of regularization of Guarani land Morro dos Cavalos in Santa Catarina is developed in order to analyze the conception of indigenous territorial rights in several actors and verify if the lack of interdisciplinary also happens in the regularization land process. In conclusion the research realizes that the isolation of Law in the definition of indigenous lands is the first obstacle to overcome in order to bring indigenous territorial rights to reality.

Full textThe place subsidiarity might hold within the definition of the relationship between the State and local authorities is subject to intense academic discussion. For a long time, most academics seem to have thought of this concept as absolutely incompatible with French public law, based on the unitary form of the State, which confines the evolution of the State’s relationship with local authorities to decentralization, implying, by definition, an opposite movement than that of subsidiarity. This position has been seriously questioned by the consecration of a principle inspired by subsidiarity through the constitutional revision of 2003, which must be received as an invitation to a renewed reflection on the nature of French public law’s connection with this concept. Comparing the way law organizes relationships between the State and local authorities with the principle of subsidiarity implies the adoption of a particular position. The solution lies in an original use of subsidiarity, which, instead of being conceived in a normative manner, must be seen as a descriptive and analytical tool. The purpose is to let subsidiarity become a standard to which the evolution of the law will be confronted, rather than making it a guiding principle of the relationship between the State and local authorities. The aim is then to show that if, taken in a synchronic meaning focused solely on their definition by substantive law, certain traditional notions which govern the law of local authorities seem to oppose the development of subsidiarity, this impossibility can be countered, or at least seriously decreased, by the observation of movements these same notions experience in a diachronic perspective, thanks to which law’s irreducible tendency to take into account requirements inherent to the subsidiarity principle is revealed. This implies throwing the relationship between the State and local authorities in a conceptual approach which, even though it appears rather foreign to French substantive law’s normative structures, seems to characterize a latent and unconscious form of its evolution, in the observation of which academics could attempt to find new keys to describe substantive law which would allow to overcome the obstacles of its traditional analytical frames

One of the interests of this comparative work is to find, if possible, beyond similarities and differences, one or more principles comprehending situations that are different today, although very close in origin. The essay does not pretend so much to estimate the quality of territorial autonomy, but to refine the method to know it. The chosen problematic considers preferable to reveal how the general character of the conception of territorial administration of each of the jurisdictions studied, influence the autonomy of local authorities, instead of judging rashly the "quality" of this based on an approximation often quick and segmented. The comparison does not ask the similarity of the results, but the scenario. The result of the study leads to the following hypothesis: beyond or above the ocean and political regimes, the equality principle before the law originally marks the uniformity of the nation-state and remains the ultimate boundary of the territorial power: the limits cited against its extension, whatever they are (uniformity, unity, indivisibility, non-discrimination, etc.), ultimately translate to the contemporary period, in a renewed definition of the equality principle. In other words, in both States, considered the most unitarians in their respective continents, we have gone from a principle of equality as a prototypical element of the unitary state, characterized by territorial uniformity and regulation that determines the existence and boundaries of a regulatory territorial power, to a principle of equality embodied in elements of sovereignty (régaliens) authorizing the existence of various statutes of local authorities and the exercise of that power. The main contribution of the method lies, then, on the approach to study such autonomy, so that the method is applicable to any comparison between States (or the largest number of them). Wherever the problem is tackled, the following situation arises: the consideration of the elements of institutional order (Part 1 ), of the elements of functional order (Part 2 ) and the set in motion of the latter by the former, in a temporal and geographical framework (part 3 ) is inevitable. Since each part is made up of different " invariants ", it is possible to refine the knowledge of territorial autonomy, detailing these criteria more and better defined in turn. It is then a progressive method. More than a simple table listing, the construction of this framework was revealed necessary, and could not ignore an initial comparative presentation of the horizontal separation or division of power ( political regime- constitutional government -organization - and organization of judicial power) and the system of territorial administration ( decentralization and / or regionalization). Therefore, the influence of the most notorious and remarkable of decentralization " invariants " are studied: the notion of territorial collectivity; the absence of generic notion; the meaning of the notion of legals powers; the principle of free administration or its negation ; the modalities of transfer of material powers ; the recognition or not of a territorial regulatory power and amplitude ; the notion of general or assimilated power; the control of the regulatory acts of local authorities; protection (or guarantee) of territorial regulatory power . These elements as a whole are part of the three parts mentioned above

Este trabalho aborda o direito Guarani, com a sua principiologia, nuances no trato e subsunção das questões comunitárias. Como dirime os conflitos nos mais diversos campos do direito, em uma sociedade Guarani. Aborda a importância que a religião tradicional tem para esse direito nativo, do qual advém o juízo holístico. Discorre sobre os princípios gerais do direito Guarani: a solidariedade, reciprocidade e prevalência do interesse coletivo sobre o individual. Apesar de tratar de direito indígena, o enfoque se detém no direito de propriedade Guarani. Vale-se do aporte teórico sobre o pluralismo jurídico, para sustentá-lo como um sistema jurídico, embora pensado e legislado de forma diferente do Direito nacional. Ao final, adentra-se nos nefastos resultados da intervenção externa, sem os devidos cuidados antropológicos necessários a tais ações, que parte neste caso de quem tem a incumbência jurisdicional de defender o direito e interesse indígena. Explicita a dificuldade que se tem em trabalhar com direito de povos indígenas, devido à escassez de bibliografia tratando do assunto e porque cada povo indígena tem suas formas próprias de pensar e aplicar o direito.
This paper addresses the right Guarani, with its principles, nuances in conversation and subsumption of community issues. How to resolve conflicts in various fields of law, in a society Guarani. Discusses the importance that traditional religion has for the native law, which stems from the holistic mind. Discusses the principles of law Guarani: solidarity, reciprocity and prevalence of the collective interest of the individual. While dealing with indigenous law, the focus is on the right to hold property Guarani. The value is the theoretical framework of legal pluralism, to sustain it as a legal system, although thought and legislated differently than national law. In the end, enters on the adverse outcomes of external intervention, without due care anthropological necessary to such actions, departing in this case who is in charge of defending the legal right and interest indigenous. Explains the difficulty that has to work with right of indigenous peoples, to the limited literature that deals with it and because each indigenous people has its own ways of thinking and applying the law.
