Grosse Ruse-Khan, Henning. The Systemic Character of International Law. Oxford University Press, 2017. http://dx.doi.org/10.1093/oso/9780199663392.003.0002.

Full text
Abstract:
This chapter examines various conflict resolution approaches. The question of how the heterogeneous and pluralistic character of international law as a whole and the resulting overlaps, linkages, and tensions amongst different rules and rule-systems can be addressed depends much on how international law as such is perceived and understood. This chapter thus examines several distinct approaches to this issue in order to develop a functional method for the purpose of analysing legal relationships. It first discusses the International Law Commission (ILC) approach, which provides a set of general legal techniques to resolve overlaps, tensions, and conflicts between rules on an ad hoc basis as they arise. The chapter then criticises this approach and speculates on the possibility of a minimalist approach to an international legal system. Next, it analyses the societal differentiation and systems-theory, and finally examines a functional approach in search for relationships between legal rules.

Abstract:
This chapter outlines key ideas associated with ethical biocentrism. It distinguishes between forms of ethical biocentrism in terms of whether they adopt an egalitarian or inegalitarian approach to value; whether they are value monistic or pluralistic; and whether they adopt virtue, consequentialist, or deontological approaches to ethical theory. Drawing in particular on the work of Robin Attfield and Paul Taylor, the chapter then explores how different forms of ethical biocentrism interpret and respond to anthropogenic climate change. Biocentric ethicists have moved beyond many people’s intuitive sense that “life matters” to construct complex, diverse ethical systems that focus on the value of living individuals. These ethical systems must develop still further to respond coherently to growing human environmental impacts.

Balboni, Michael J., and Tracy A. Balboni. Defining Religion and Spirituality. Edited by Michael J. Balboni and Tracy A. Balboni. Oxford University Press, 2018. http://dx.doi.org/10.1093/med/9780199325764.003.0008.

Full text
Abstract:
This chapter notes two general approaches, the substantive and functional, in how spirituality and religion may be conceptualized. A functional understanding is less focused on the specific content that comprises religion, such as the superhuman or the gods, and instead concentrates on the ultimate concern or greatest love of said religion. Within this functional approach, spirituality and religion are closely related but not identical. Spirituality refers to the immaterial connection between the lover and the object chiefly loved. Religion concerns the external structures that support and enable an ultimate concern or greatest love. Both conceptual approaches hold scholarly legitimacy, but functional understandings, unlike substantive definitions, open innovative ways within an increasingly pluralistic society to interpret the relationship of spirituality and religion within medicine, so that traditional “religious,” “spiritual but not religious,” and deeply “secular” persons may uncover shared values and common ground in the care of the sick.

Sandler, Ronald. Environmental Virtue Ethics. Edited by Stephen M. Gardiner and Allen Thompson. Oxford University Press, 2016. http://dx.doi.org/10.1093/oxfordhb/9780199941339.013.20.

Full text
Abstract:
It is uncontroversial that character ethics are indispensible to environmental ethics. What is contested is whether virtue ethics, understood as a distinctive type of normative theory, could provide a viable environmental ethic. In response to this concern, this chapter (1) explicates what is distinctive about a virtue ethics approach to normativity within environmental ethics—that is, that how things matter (moral status) is explicated through the virtues; (2) demonstrates that a virtue ethics normative framework can accommodate whatever is the correct account of the value of nonhuman nature; (3) argues that a pluralistic approach to moral status, such as virtue ethics’, is indispensible to environmental ethics; (4) articulates a plausible virtue ethics principle of right action and decision making. Virtue ethics should be regarded as a viable approach to environmental ethics, and it should be considered alongside other, more familiar, approaches such as deontology and consequentialism.

Allen, James P., Mark A. Collier, and Andréas Stauder, eds. Coping with Obscurity. Lockwood Press, 2016. http://dx.doi.org/10.5913/2016420.

Full text
Abstract:
Coping with Obscurity publishes the papers discussed at the Brown University Workshop on Earlier Egyptian grammar in March, 2013. The workshop united ten scholars of differing viewpoints dealing with the central question of how to judge and interpret the grammatical value of the written evidence preserved in texts of the Old and Middle Kingdoms (ca. 2350–1650 BC). The nine papers in the volume present orthographic, lexical, morphological, and syntactic approaches to the data and represent a significant step toward a new, pluralistic understanding of earlier Egyptian grammar.
