Abstract:
The authors assume that the results of the 2019 elections in Poland to the European Parliament and the Sejm and the Senate influence not only the transformation of the country's party system and its socio-political development in the coming years, but also the place and importance of Poland's interstate relations with Ukraine in general and specific problems of large-scale Ukrainian labor migration to Poland in particular. The completion of the elections to the European Parliament of the 9th cadence actually gave rise to the election campaign to the Sejm and Senate of the Xth convocation. The predominant practice of most political parties has been to provide candidates of Ukrainian descent or immigrants from Ukraine (despite even a minimal number of them against the background of the Ukrainian national minority and newly naturalized citizens of the Republic of Poland) for the most part, starting places in the relevant regional party lists. Despite the noticeable growth of broad Ukrainian subjects since the fall of 2013, first in Polish foreign and then domestic politics, this has not, however, been reflected in a corresponding quantitative and qualitative conversion following the 2019 elections to the European Parliament and the Sejm and Senate of the Republic of Poland. The 2019 elections, among other things, draw attention not only to the place and role of the Ukrainian national minority in the political life of Poland, but also to indicate the political participation of Polish citizens from among the new migrants of the 1990s – 2010s, in view of the growing the extent of naturalization as Polish citizens of our country of origin, and the differences between different socially active environments of Polish citizens of Ukrainian descent. Internal processes among politically active Ukrainians in Poland who have the right to vote allow us to speak of a departure from the prevailing sympathies with the Civic Platform over the decades in favor of new left-wing political projects. 2019 marked the 30th anniversary of the restoration of the Senate in Poland. Over time its position and perception in the constitutional system has changed. From the acclaimed symbol of democratic transformation, the Senate has turned into a puzzling second chamber, with no real use. The rationale for its continued existence is becoming more and more questionable. In its current form, the Senate is an example of an unnecessary second chamber.

Abstract:
The article is focused on the problems of studying the constitutional and legal aspects of the functioning of the bicameral parliament in the Republic of Poland. The research is carried out with the aim of studying and scientific understanding of the practical implementation of certain aspects of bicameralism in Ukraine. The peculiarities of the legal status of the Sejm and the Senate as the chambers of political representation of the sovereign Polish nation have been analyzed. It has been emphasized that certain competencies of legislative power in the Polish power system are intended to compensate for the strong positions of the executive branch, due to the assignment of the President of the Republic of Poland to it. It has been noted that in the period after the restoration of the bicameral structure of the Polish Parliament in 1989, until 2010, the Sejm held the dominant position. It has been established that at the present stage of development, the Polish constitutional doctrine foresees an asymmetric bicameral parliament model with the preservation of the system’s equivalence of chambers. It has been noted that the result of the accession of the Republic of Poland to the European Union, the Sejm and the Senate had functional changes that covered almost all the powers of the national parliament, including, first of all, legislative and control functions, led to the appearance of elements of the “European” function of the parliament and transformed already existing commitment of both chambers. The peculiarities of the influence of the EU legal acts on the processes of national legislation in Poland have been revealed. The directions of transformation of the normative and controlling function of the Sejm and the Senate have been determined. The principles of functional separation of powers of the Sejm and the Senate in the light of the national and European legislation have been established. It has been concluded that during the process of implementation of acts of the European law in the national legal system of the Republic of Poland, the chambers of the parliament managed to expand their powers at the expense of the so-called “European competence of the Polish parliament”.

Alternative and Marginal Narrations in the Anniversary Resolutions of the Sejm and Senate of the Republic of Poland in 2009-2019. Example of Resolutions Commemorating the 70th and 80th Anniversaries of the Outbreak of the Second World War Historical anniversaries generate breakthroughs, mark systemic and political turns, and remind us of the events and characters from the past. The subject of the article are the anniversary resolutions of the Sejm and the Senate of the Republic of Poland, which I define as a tool for shaping the politics of memory and collective memory that are one of the forms of commemorating the past and serving the political authorities as means for its interpretation. I assume that the choice of anniversaries and historical figures that deserve to be commemorated is dictated by the ideological and political orientation of political parties and groups. In the above context, it is worth asking the question – referring to the title of the article – should the anniversary resolutions of the Sejm and the Senate of the Republic of Poland, their form, content, as well as way of proceeding and adopting them be considered as important and momentous narratives, or rather as alternative and marginal ones? The considerations will be illustrated with ex amples of resolutions adopted on the occasion of the 70th and 80th anniversaries of the outbreak of the Second World War.

Abstract:
The article’s goal is to present the consequences of Polish membership in the European Union (EU) for the functioning of the Polish Sejm and Senate at the national and international level. Polish accession to the European Union resulted in changes to the scope of competences of certain organs of the Republic of Poland. This was related to the transfer of specific state competences to an international organization and it applied, in particular, to the Polish Parliament (the Sejm and Senate) which has lost its primary role as legislator of laws applicable in Poland. In order to avoid the marginalization of national parliaments in the EU decision-making process, appropriate legal measures have been introduced at the national and international level. Additionally, after the Treaty of Lisbon entered into force, national parliaments have received new competences which allowed them to exist on the forum of the European Union. The article puts forward the thesis that the Polish Sejm and Senate have lost their position as main legislative bodies at the national level but, at the same time, they have acquired a new European function which can neither be qualified as traditionally understood legislative nor controlling functions.

Abstract:
German-Polish Relations in the Sejm and Senate Debate The paper concerns the position of Polish MPs and senators on shaping the principles of German-Polish cooperation in a situation in which Poland regains full sovereignty in foreign policy. The position of Polish deputies was analysed on the basis of stenographic reports from plenary sessions of the Sejm and Senate concerning the preparation and ratification of treaties with Germany on confirming the border and on good neighbourhood. In particular, it was a question of examining whether MPs and senators supported the concept of a G erman-Polish community of interest, which was defined and presented in the Sejm by Foreign Minister Krzysztof Skubiszewski. During the ratification debate, supporters of both treaties pointed out that they enabled Poland to leave the Eastern Bloc, making Poland independent of the support of the USSR for the western border. They also provided an opportunity for German support on Poland’s way to the European Communities. MPs and senators understood that it was possible to build a G erman-Polish community of interest on the basis of supporting and expanding the integration process and thus completely change Poland’s geopolitical situation. This did not mean that the solutions adopted in the treaty on good neighbourhood, especially with regard to compensation, the status of Poles in Germany and the German minority in Poland, were fully accepted.

Abstract:
The aim of the present paper is to analyze the legal basis of the referendum ordered by the President in Poland and demonstrate how this institution is utilized in political practice. The article assumes and proves that the fundamental condition for ordering of referendum by the President, both in legal and political terms, is the consent of the Senate. In the end this consent is determined by the distribution of political forces in the chamber. Furthermore a thesis was adopted on the political character of presidential initiatives regarding the ordering of referenda.

AbstractIn the LM case, the CJEU was called to decide on whether systemic rule of law deficiencies in Poland could lead to the suspension of EU cooperation based on mutual trust, in particular under the European Arrest Warrant system. Building on its earlier decision in Aranyosi, the Court concluded that EAWs may be suspended only after the executing authority conducts a general analysis of the situation in the country concerned and an individual assessment of the specific situation of the applicant. For some, the decision was a disappointing one, as the Court failed to take a clear stance on the Polish constitutional crisis. This chapter argues, on the other hand, that the Court reached a balanced decision: while it is true that it confirmed the strict Aranyosi test, it also sent some key messages on the crucial importance of the rule of law and judicial independence for the EU and underlined the red lines of European constitutionalism. Furthermore, a different line of cases that originated from the groundbreaking decision of the Court in the ‘Portuguese judges’ case seems much more promising for the protection of EU values. Thus, rather than a constitutional moment for the Union, LM was ultimately an intermezzo between the two main acts of the rule of law play before the Court of Justice.

Abstract:
Real or ostensible democratization? A few remarks on the evolution of the composition of the Senate in the constitutional debate of the Legislative Sejm The article is an attempt to answer the question if the process of democratization of the upper house of parliament in subsequent drafts of constitution prepared by the parliamentary Constitutional Commission (in years 1920–1921) was real or was it only an ostensible movement. In fact during the constitutional efforts initial concept of creating the Senate through nomination was changed in favor of the idea of the democratic elections to the upper house of parlia-ment. That regulation was also finally implemented in the March Constitution of Poland. In opinion of the adherents of bicameralism those changes were the results of a compromise with the political opponents that was made to implement the Senate to the constitution. On the other hand, the adherents of monocameralism were convinced that every upper house of parliament is reactionary and that the all new concepts of the Senate were only an ostensible democratization. The attempt to resolve the question that was given in the title based on the analysis of the most important speeches in the constitutional de-bate. The paper was prepared mainly using the parliamentary sources which are the documents and stenographic records of the Legislative Sejm. Also, basic literature was an important support.

Abstract:
This chapter addresses Shlomo Netzer's The Struggle of Polish Jewry for Civil and National Minority Rights (1918–1922) (1980). In this richly documented study, Shlomo Netzer surveys the formative period of Jewish politics in inter-war Poland. The period under consideration witnessed not only the recovery of Polish independence, but also the elections for the Constituent Sejm, the crystallization of the Polish parliament and constitution, the signing of the Minorities Treaties, the protracted struggle over the borders of the Polish state, the Polish-Soviet war, and the 1922 elections to the Sejm and Senate. All these events influenced the form and direction of Jewish political activity during this critical time, and in his internally directed study, Netzer is careful to keep the historical background in view and avoid becoming lost in the labyrinth of inter-party polemics and editorial broadsides. After a useful short introduction on the history of independent Jewish politics under the various partition regimes, the author chronicles the struggle of Jewish elected representatives to secure civil and national rights for Polish Jewry, a struggle which to some extent has been described elsewhere, if not in such detail.

In Poland, the teachers that teach a second language frequently are philologists who do not have any didactic or pedagogical training. This issue initially exposes that teaching practices are part of individual experiences or even “self-taught” training. Significantly, of approximately 10 universities that teach Spanish as a foreign language, none in the curriculum has subjects dedicated to the methods and their didactic applications, forms of evaluation, etc. In this sense, the author analyzes different proposals of the theory of the curriculum in studies of philology and discusses why in Poland studies in a second language do not include these topics.

This chapter focuses on those Jews who used false Aryan identification papers during the Nazi occupation of Poland. Many towns and cities in occupied Poland were divided into crowded ghettos of displaced Jews and the more fortunate Aryan districts. When it became obvious what was to happen to the ghetto inhabitants, Jews began to flee to Aryan districts. Some Poles provided security and housing to both known and unknown Jews. While some Polish Jews survived on forged documents, others remained in hiding without identification papers, unable to leave their hiding-places. Using Aryan documents successfully meant assuming another identity. Assuming a false identity strongly influences one's own sense of identity, which is necessary for retaining one's sense of individuality, continuity, and mental fitness. As such, the use of false Aryan documents created many complicated psychological problems.

Abstract:
This chapter investigates the basic characteristics of the Jewish experience in Poland. For much of its history, the Polish-Jewish community was the largest in the world. It is generally asserted that there was dramatic growth in Jewish numbers during the 16th century, but it is also known that the proportion of Jews in the towns of Poland–Lithuania increased dramatically during a 150-year period beginning in the late 17th century and continuing through the 18th century. In this case, there was relative security in numbers. More than security, there was a sense of rootedness and permanence about this community. Another basic characteristic of the historical experience of Polish Jewry is the Ashkenazic character of that community. Beginning with medieval Ashkenazic forms, the Jews of the Polish Commonwealth developed the most ramified and durable of the autonomous institutions of Ashkenazic Jewry.

Abstract:
This chapter looks at the author's letter to his father. In the letter, the author reveals his point of view on certain fundamental problems. He concludes that Poles are not yet up to independence and sovereignty and that Jews have nothing in, and must not return to, Poland. Governing a state is a certain art, requiring such characteristics as, above all, organizational ability, ability to compromise, and a sense of realism. All of these traits are lacking, not only among the mass of the author's fellow countrymen but also among the so-called intelligentsia. The political life of the Polish emigrant community on England's soil, the government's foreign ‘policy’, and the relations in the army all confirm his conviction that it is much worse with these people, and thus with Poland, than he had thought. The author then discusses Polish–Soviet relations.

The issues of bioeconomy in this paper are presented in a context of:  processes taking place between enterprises, consumers and the state,  challenges for qualitative and quantitative economic development. Referring to the above-mentioned model, it was stated that the bioeconomy should be the main direction of development as part of the smart specialization strategy for Małopolska. This will allow, among others development of functional value chains, increasing the added value of production and the possibility of sustainable management of natural resources. Attention was also paid to conditions of development that may constitute significant barriers in shaping the bio-profile of the economy on a regional basis:  environmental, in the sense of sustainable access to natural resources;  social, understood as the quality of social capital and access to a qualified workforce;  institutional, being the state's responsibility and related to the law, providing adequate infrastructure or adequate expenditures for R&D. It was noticed that Małopolska is characterized by a dual development model - on the one hand, we are dealing with sectors of modern technologies concentrated in the provincial city and some poviat cities. On the other hand, when we talk about the raw material sphere, one can talk about development destimulants, i.e. agrarian structure, the problem of fallowing land or the lack of a qualified workforce in rural areas.

In some countries nuclear waste facility siting programs include social and economic benefits, compensation, local empowerment and motivation measures and other incentives for the potential host community. This can generally be referred to as an ‘added value approach’. Demonstration of the safety of a repository is seen as a precondition of an added value approach. Recently much focus has been placed on studying and developing public participation approaches but less on the use of such incentive and community benefit packages, although they are becoming a more common element in many site selection strategies for nuclear waste management facilities. The primary objective of this paper is to report on an ongoing study of stakeholders’ opinions of the use of an added value approach in siting a radioactive waste facility in the Czech Republic, Poland and Slovenia. The paper argues that an added value approach should adapt to the interests and needs of stakeholders during different stages of a siting process. The main question posed in the study is as follows: What are the measures which should be included in ‘added value approach’ according to the stakeholders? The research data consists of stakeholders’ responses to a survey focusing on the use of added value (community benefits) and incentives in siting nuclear waste management facilities. The survey involved use of a questionnaire developed as part of the EU-funded IPPA* project in three countries: the Czech Republic, Poland and Slovenia. The target audiences for the questionnaires were the stakeholders represented in the national stakeholder groups established to discuss site selection for a nuclear waste repository in their country. A total of 105 questionnaires were sent to the stakeholders between November 2011 and January 2012. 44 questionnaires were returned, resulting in a total response rate of 41% (10/29 in the Czech Republic, 11/14 in Poland and in 23/64 in Slovenia).

Abstract:
In 2007, spent nuclear fuel (SNF) from the Nuclear Research Institute Rˇezˇ plc (NRI) was shipped to the Russian Federation for reprocessing. A large amount of SNF of Russian origin has been accumulated after 50 years of research reactor operation. The shipment was realized in the frame of the Russian Research Reactor Fuel Return (RRRFR) program under the US-Russian Global Threat Reduction Initiative (GTRI). SNF shipment from NRI to the Russian Federation represented a very complex and complicated technical, legal and contractual scope of work. The SNF shipment has been realized under specific conditions: 1. High capacity SˇKODA VPVR/M casks were used for transportation for the first time. 2. For the first time, high enriched uranium SNF from a research reactor has been sent to the Russian Federation from a European Union country under the appropriate intergovernmental agreements, legal regulations and conditions. NRI also participates in shipments of SNF from other countries within the framework of the RRRFR program. NRI participated in shipments of SNF from Bulgaria and Hungary in 2008, from Poland in 2009 and 2010, from Ukraine in 2010. Shipments from Belarus and Serbia are planned in 2010. The second shipment of the residue of high enriched SNF from NRI after changeover of the reactor operation to low enriched fuel will be implemented in 2013. The experiences gained during the SNF transportation are described in the paper together with the present and future NRI activities in support of the SNF shipment from other countries.

In the reality of the marketplace, a situation often arises where an economic surplus (rent) achieved by agricultural producers is partly taken over by related non-agricultural sectors. In this sense the category of economic rent embraces market failures related to such factors as price flexibility, and thus represents an effect of the misallocation of resources in the agricultural sector. The question therefore arises of whether there exists a developmental model of agriculture in which such market failures would be reduced. Apparently the only coherent response to this need is action taken under the paradigm of sustainable agriculture. This type of model for the sector’s functioning is supported by the objectives of the European Union’s Common Agricultural Policy (CAP), including through support for the supply of public goods in rural areas. This article addresses the question of whether CAP payments for public goods are a desirable systemic solution serving to reduce market failures. It is hypothesised that the financing of activity relating to the supply of public goods lessens the negative impact of the “market treadmill”, since it reduces the unexpected outflows of economic surplus away from farms, caused by agricultural prices. To verify the hypothesis, a panel regression analysis was performed on three sets: the EU-15 countries, the EU-12 countries, and – within Poland – subsectors of farms from six standard output classes. The analysis covered the years 2004–2012. The results of the computations provided confirmation of the hypothesis. It may be stated that an increase in the level of payments for public goods, as a percentage of total subsidies to agriculture, leads on average to a reduction in the drainage of economic rents through prices. It was also found that the financing of public goods under the CAP is more effective in reducing market failures in the EU-15 countries than in the EU-12.

Abstract:
Thin films of single crystal ferroelectric material are constrained by their substrate to a fixed state of macroscopic in-plane strain. Domain structures can form to minimize the overall energy of the system by matching the imposed strain conditions in an average sense. We study low-energy equilibrium states of ferroelectric thin films using the theory of domain compatibility. In a thin film with a given state of average strain, periodic laminate microstructures can be predicted or designed using compatibility theory and the condition that domain wall orientations parallel to the substrate are prohibited by the reduction to 2-dimensions. The theory is applied to [001], [011] and [111] oriented single crystal films of tetragonal ferroelectric materials. Compatible configurations are generated and the ability of such films to be poled by electric field is then explored.

Piezoelectric systems and structures have been used for decades in a variety of applications ranging from vibration control and sensing to morphing and energy harvesting. Conventional piezoelectric ceramics with uniform electrodes typically employ the 31-mode of piezoelectricity in bending, where the 3- and 1-directions are the directions of poling and strain, respectively. In order to employ the more effective 33-mode of piezoelectricity, Interdigitated Electrodes (IDEs) have been used recently in the design of the Macro-Fiber Composite (MFC). In this paper, an investigation into the two-way electroelastic coupling in bimorph cantilevers (in the sense of direct and converse piezoelectric effects) that employ IDEs for 33-mode operation is conducted. To this end, distributed-parameter electroelastic models are developed for the dynamic scenarios that involve two-way coupling, namely piezoelectric power generation and shunt damping as well as the problem of dynamic actuation. Various interdigitated MFC bimorph cantilevers are tested against the model under dynamic actuation, power generation, and shunt damping to identify their modal electromechanical coupling terms. Detailed investigations are conducted by decoupling the system dynamics to keep the direct and converse effects separately pronounced for parameter identification. Additionally, this work sheds light on the literature comparing the electrical power generation performances of 33-mode (interdigitated electrodes) and 31-mode (uniform electrodes) piezoelectric bimorphs of the same volume based on extensive experiments and distributed-parameter electroelastic modeling.

Abstract: The aim of presented paper is to grasp a sense in which Le Corbusier influenced his professional partners within ATBAT at 35 rue de Sèvres in Paris. On the example of Iannis Xenakis (Greek) and Jerzy Sołtan (Pole), which curriculum and experience will be superposed, authors wish to analyse a means in which the formation of Le Corbusier’s Collaborators induced a profoundly individualistic paths of both apprentices. Moreover it enabled both artists to develop autonomous views on creative activities, which still stayed in mutual compliance. That allows to speculate upon the forcefulness of approach towards passing skills that Le Corbusier applied in his Studio. With a parallel example of two pavilions for the World’s Fare Expo’58 in Brussels, it is presented how compatible, despite of being completely different in form, those two projects are. Resumen: El objetivo del articulo es comprender cómo Le Corbusier influenciado sus socios profesionales en ATBAT a los 35 rue de Sèvres en Paris.
