For, it is proved to be impossible to produce critical knowledge on police transformation without developing a theoretical framework on the nature of the modern police and the tensions embedded in it. Hence, before analyzing the neoliberal period, the thesis attempts to develop a class-based theoretical framework on the formation of the modern police in the 19th century, and concludes that the modern police apparatus has been shaped by a specific political division of labour between the state power and the class power. The form of the police is defined according to by which of these powers it is determined more, a process which has been constituted since the 19th century by a transnational collective agency that includes various fractions of the ruling classes as well as police chiefs and police intellectuals. It is the historical materialist method that provides the theoretical toolset to make sense of the transformation taking place in the police. Having analyzed the neoliberal police reform by the help of this theoretical toolset, the thesis maintains that in the neoliberal era the police apparatuses have been reintroduced to the political sphere as &ldquo
anti-statist non-state&rdquo
actors, and started making transformative interventions in the modern political field. The police restructured as a non-state actor has been dissolving the modern political field through various strategies. The thesis specifies these strategies on the basis of the police transformation process in Turkey. The police apparatus in Turkey has been constructing itself even as a &ldquo
civil society&rdquo
organization, and redefining the processes of legitimation, and mass participation of people in politics &ndash
which are necessary aspects modern political field- through its new police ideology. The main argument of the thesis is that this process as a whole is one that restores the class power of the capitalists over the police.

Full textThe contemporary proliferation of monitoring techniques in people's everyday lives tends to assert the widespread belief that the institutional necessity of accumulating knowledge about populations is a contemporary phenomenon. This pre-notion can be quickly deconstructed by recourse of the historical study, the work carried out during this thesis in the Prefecture funds of the Archives départementales de Seine-Maritime, supplemented by the consultation of the "fonds de Moscou" enables me to register this research within a constructivist step of the analysis of the surveillance societies. The corpus, mainly composed of police spéciale files during the inter-war period, enables us to question the interdependence between the Foucaldian concept of a security space and public sphere, or rather of public spheres. As a result of a form of government of opinion, the proactive observation of public spheres which have developed on the margins of the bourgeois public sphere was a necessity in order to maintain the republican order in case of conflicts between these spheres – as was the case between the militants of the extreme right leagues and those who rallied behind the banner of anti-fascism. Another of the main aspects of this approach is the regulation of a public speech from the proletariat, instrumentalized by the main actors of the communist and trade union institutions. Individuals who are tracked according to their influence on the masses, their acts, speeches and propaganda whose resultd in terms of police judgment is to the preservation of the national community, by the designation of interior enemy, a stranger within society and likely to spread an illegitimate speech within the population

Full textThis PhD investigates an apparatus that attracted considerable criticism in the late 2000s for being overused and failing to ensure enough rights: garde à vue, which roughly translates as police custody. Far from being only an investigative act, as its legal definition goes, garde à vue increasingly operates as a key instrument for the police and political management of petty crime. To meet the EU’s demands, however, the French government was forced to reform the system in April 2011. Suspects now have the right to receive a lawyer’s assistance during their entire interrogation. The reform of garde à vue reflects a tension between the intensifying repression of specific populations and the recognition of new rights granted to them. Drawing on the study of debates, ethnographic material and a questionnaire, this research examines the implementation and the effects of this paradoxical reform on the police institution.The reform of garde à vue cannot be approached simply as a public policy shift. Beyond that, it constitutes a key juncture in the transformations of the relationships between the State and citizens resulting from the introduction of lawyers during the interrogations. Effects of the lawyer’s presence vary according to the uses of garde à vue (from a measure of restraint to an investigative act), which relate to the position of agents and departments in the hierarchy of police prestige, and the social properties of suspects, members of the police and lawyers. The interactions between these protagonists may be characterized by configurations of alliance, conflict or competition depending on the above variables. Through the situated, embodied analysis of these configurations of interrogation, I show that a distinct use of garde à vue corresponds to each type of population. The focus on police custody ultimately yields broader insights into justice and the State’s management of illegalisms in the making

Full textPlus largement, la thèse interroge la pertinence du postulat qui veut que les politiques migratoires conçues et mises en oeuvre par les pouvoirs publics, au cours des Golden Sixties, aient considéré les travailleurs migrants comme une main-d’oeuvre d’appoint temporaire.
La première partie de la thèse, qui porte sur la genèse de la politique d’immigration belge entre 1830 et 1960, recadre l’histoire de l’immigration turque dans l’industrie houillère belge et des politiques mises en oeuvre à son intention dans le contexte du double processus d’étatisation et de nationalisation des politiques migratoires au cours des XIXe et XXe siècles.
La seconde partie retrace la configuration des chaînes d’interdépendances qui relient les trajectoires migratoires des travailleurs migrants turcs recrutés par l’industrie charbonnière belge dans les années 1960 et 1970 aux dispositifs générés, séparément ou conjointement, par l’Etat belge, l’Etat turc, l’industrie charbonnière, les organisations syndicales et les services, associations et autres collectifs d’accueil et d’aide aux migrants pour organiser, stabiliser et intégrer cette immigration turque dans les régions minières du pays.
La troisième partie interroge le devenir de cette immigration turque au moment où les fermetures de charbonnages se succèdent et que de nouveaux besoins en main-d’oeuvre se font sentir dans les dernières sociétés charbonnières encore en activité. Elle esquisse en parallèle le processus d’étatisation des politiques d’intégration jusque-là principalement prises en charge par les modes de gestion paternalistes de l’industrie charbonnière.
Cette thèse aborde également, mais dans une moindre mesure, l’immigration originaire de Turquie avant 1960 et l’immigration turque qui se développe au cours des années 1960 et 1970, en marge de celle organisée en faveur de l’industrie charbonnière, à destination d’autres régions et secteurs d’activité du pays (Bruxelles, Anvers, Gand, Ardennes, etc.).
Son angle d’approche dépasse par ailleurs la seule immigration turque en Belgique et la seule politique migratoire belge. Elle s’intéresse ainsi, à travers des analyses comparées, au cas de l’immigration marocaine, qui lui est contemporain, ou encore à la politique migratoire néerlandaise, à l’origine d’un phénomène de désertion massive de l’industrie houillère belge par les ouvriers mineurs turcs.
