Abstract:
This chapter presents a compressed account of the Four Years' Diet of 1788–1792 and its background. Poland is first exhibited as a land of aristocracy triumphant. The question is then asked whether the Polish Revolution of 1791 was a revolution at all, and if so in what sense; and what observers in other countries—such as Burke in England, the revolutionaries in France, and the rulers of Prussia and Russia—thought that they learned from it. Jean-Jacques Rousseau drew lessons from Poland in 1771. With the country dissolving in civil war, subverted by Russia, and sinking into the First Partition, the author of the Social Contract, at the request of certain Polish patriots, offered his diagnosis of their situation. For Rousseau, the trouble with Poland was that it had no consistance, no staying power to resist pressure and infiltration from outside. What it needed was character, a character of its own, resting on the collective consciousness or will of its people.

Bell, David A. Global Conceptual Legacies. Edited by David Andress. Oxford University Press, 2014. http://dx.doi.org/10.1093/oxfordhb/9780199639748.013.037.

Abstract:
Two hundred and twenty-five years after 1789, the French Revolution is no longer invoked with great frequency in world politics. Few contemporary moments take its events as a script to follow. Nonetheless, many of its conceptual legacies remain strong. This article traces these legacies in six broad conceptual fields: nationalism, republicanism, human rights, war and peace, political ideology and ‘revolution’ itself. In each case, it makes clear that the concepts have not been transmitted down to the present unchanged. For instance, the linkage between human rights and citizenship in a particular polity, which the revolutionaries affirmed in their Declaration of the Rights of Man and Citizen, has given way to a widely shared idea that rights act as a limit on sovereign authority. The article closes by observing that the Revolution’s most powerful legacy may be the concept of ‘revolutionary’ change itself, and its status as a synecdoche for ‘modernity’ in general.

Paul, Torremans. Part I Introduction, 2 Historical Development and Current Theories. Oxford University Press, 2017. http://dx.doi.org/10.1093/law/9780199678983.003.0002.

Abstract:
This chapter provides an overview of the historical development of private international law as well as current theories on the subject. It first traces the early history and later development of private international law in England before discussing the varied approaches to private international law in the twentieth and early twenty-first centuries. In particular, it considers the theory of vested or acquired rights, local law theory, and the American revolution. Two general approaches common to most of the ‘revolutionaries’ are highlighted: the first is rule selection or jurisdiction selection, and the second is true and false conflicts. There are several rule-selection techniques such as governmental interest analysis approach, the comparative impairment approach, principles of preference, interpretation of forum policy, and choice of law factors. The chapter also examines the Europeanisation of private international law and concludes with an assessment of the theoretical or doctrinal basis of English private international law.
