Abstract:
This is a polemical essay that enters into broad dialogue with the contemporary literature concerning the dynamic of power. It refers to the appropriate material and results from the research of different theories. It proposes the constitutive position of the power in the international situation. In contrast to some current theories, we emphasize the importance of the politicoeconomical approach, denoting that only the methodology based on the logics of political economy can explain the dynamics of power in the international context. The main thread of this essay is that the international constellation is not a neutral environment, but a framework that is deeply determined by the power-relations. The central idea is that these relations should be explicated by the complex relationships between freedom and order. We analyze the interaction between the politics and economy as the constitutive feature of the structure of international context. This essay is divided into three sections. First, we are treating the meaning of order in an international context, in respect to the political-economic aspects of late capitalism. The notion of this order has a great importance in the economic reflections. The dynamic of the interconnectedness of global capitalism is examined considering the systematic aspects of power. After that we are analyzing different, and selected, aspects of the international sphere including: the spatiality of the world order, that is, the spatial aspects of the international dynamics in the context of globalization, the convergence or divergence between the capitalist and territorial logic, the ?legaleconomic nexus? in international ?chain?, the processes of the modification of the forms of competition within recent globalization, and the political-economic conflicts in relation to the regime of economic measurement. Starting with these considerations we explain the current debates on ?demondialization?, or the combination between neomercantilist and neoliberal policies.

Abstract:
This article looks at one important aspect of globalization in the Arab World, namely the provision of international finance by the US, the International Monetary Fund (IMF), and the World Bank in support of economic liberalization programs. This flow of international finance has been partly determined by geopolitical factors and in some countries has resulted in a decline in state provision of social welfare, increased poverty, and increased inequality. Not only has this form of globalization been increasingly challenged by Islamist groups, but many such groups have moved in to provide social capital and fill the welfare gap created by the gradual withdrawal of the state from socio-economic affairs. Globalization has thus strengthened the hand of political Islam and undermined the political legitimacy of incumbent regimes.

Abstract:
Political security is very often considered through the prism of individual states. In the scholar literature in-depth analyses of this kind of security are rarely encountered in the context of international entities that these countries integrate. The purpose of this article is to draw attention to key aspects of political security in the European Union (EU) Member States. The EU as a supranational organisation, gathering Member States first, ensures the stability of the EU as a whole, and secondly, it ensures that Member States respect common values and principles. Additionally, the EU institutions focus on ensuring the proper functioning of the Eurozone (also called officially “euro area” in EU regulations). Actions that may have a negative impact on the level of the EU’s political security include the boycott of establishing new institutions conducive to the peaceful coexistence and development of states. These threats seem to have a significant impact on the situation in the EU in the face of the proposed (and not accepted by Member States not belonging to the Eurogroup) Eurozone reforms concerning, inter alia, appointment of the Minister of Economy and Finance and the creation of a new institution - the European Monetary Fund.

Scholars are beginning to consider how state campaign finance regulation influences political behavior and elections, but they lack the systematic measure of these regulations needed to do so. This article describes a simple measure of state campaign finance regulation stringency that is based on state statutes in 2002. Further, this article explains the construction of the measure and assesses its validity and reliability. The index generally confirms qualitative assessments of state campaign finance regulation, and it is correlated with measures of related aspects of state campaign finance regulation, campaign spending, and fundraising.

Abstract This article addresses the legal aspects of the financing of adaptation to climate change, with special consideration given to one of the climate funds – the Adaptation Fund (AF). In the complex structure of climate finance, the AF attracts attention as it differs from other funds in several aspects. As an exception from other United Nations (UNs) climate funds, AF has not been recognised as an operating entity of the Financial Mechanism of the Convention. AF is also an unprecedented example under the Convention of a fund serving in parallel two decision-making bodies (CMP and CMA) under two agreements (Kyoto Protocol and Paris Agreement) ratified by non-overlapping sets of parties; with a Fund Board elected by both bodies collectively. AFs funding source is specific, it was designed to be financed from shares of the proceeds of sales of certified emission reduction units (CERs) generated by Clean Development Mechanism (CDM) projects but since 2012 there is a limited possibility of offsetting the emissions with CERs under the EU emissions trading system (ETS). For several years Parties were unable to agree the operating principles and procedures of a new mechanism established in article 6(4) of the Paris Agreement, which will resemble CDM, and would constitute a source of funding for the AF. Once this source of funding is available, the AF would cease to serve the Kyoto Protocol. Despite the above problems, AF was seen as a good example of how future climate funding can be designed. We examine the evolution of the above legal problems, including the most recent decisions and conclusions adopted during Conference of Parties (COP)25 in Madrid.

Abstract:
The article identifies basic models of Islamic finance industry and provides a critical assessment (compared to conventional finance) оf mechanism of their functioning. Despite having obvious positive aspects, such as limitation of speculative or risky securitization, focusing on financing the real sector of economy and encouraging the direct interrelationship between financial and productive sectors, in our view, the mechanism of Islamic economics in some ways is at variance with a number of fundamental principles of effective economic activity. Objective factors (demographic, political, economic) cause an increase of role and influence of the industry over regional financial markets and international finance and determine the relevance of further research in this area. Today, Islamic finance comprises such commercial areas as capital markets, asset management and insurance. They represent all segments of modern financial market – commercial banking, operations with equity and venture capital, trade financing, insurance and even financial hedging. Only a small share of Muslims’ financial relations is provided in accordance with Islamic law. Under conditions of introducing the convenient, liquid and standardized financial instruments and further improvement of regulation for financial markets, redistribution of resources in favor of Islamic financial markets, as well as rapid growth of their share in international finance are expected.

AbstractThis article introduces a special issue ofBusiness and PoliticsonProperty Rights, Financial Risk, and the Politics of a Networked Global Financial System. We introduce aspects of the articles in the issue and situate them within existing literatures in financial economics, public policy, political economy, regulation and governance, and network science. We do this through examining four key contributions in the special issue. First, we show that common conceptualizations of property rights in financial markets ignore the multidimensional nature of financial goods; examples of all goods types can be found in modern finance, and this fact has important implications for the politics and regulation of these markets. Second, we argue that models of financial actors as independent, atomistic agents neglect the relational nature of financial markets, and argue that theory and methodology from network science, financial economics and political economy provide useful ways to analyze these interdependent systems. Third, we discuss how the relational nature of risk leads to hierarchical patterns of financial interdependence, which bequeaths substantial amounts of power—within both market and political systems—to those actors that occupy core positions within the structure of interdependence. Fourth, we integrate ideas from papers in this special issue and related literature with concepts from the Ostrom School of political economy to consider how monitoring, self-governance, and polycentric applications might improve financial market governance. This issue's papers thus constitute one of the first combined attempts to bring the Ostrom School into substantive conversation with financial market governance and risk analysis through comparative and international political economy disciplines.

This article explains the problem of adjustment to the challenges of globalization in terms of the logic underpinning four distinct policy constraints, or trilemmas, and their interrelationship, and in particular the disturbances that arise from capital flows. The analysis of a policy trilemma was developed first as a diagnosis of exchange rate problems (the incompatibility of free capital flows with monetary policy autonomy and a fixed exchange rate regime); but the approach can be extended. The second trilemma we describe is the incompatibility between financial stability, capital mobility and national policy choice over exchange rates. The third example extends the analysis to politics, and looks at the strains in reconciling democratic politics with monetary autonomy and capital movements. Finally, we examine the security aspect and look at the interactions of democracy with capital flows and international order. The trilemmas, in short, depict the way that domestic monetary, financial, economic and political systems are interconnected with the international order, or the impossible policy choices at the heart of globalization. Frequently, the trilemmas conjure up countervailing anti-globalization tendencies and trends.

The assessment of benefits and costs in determining national and international aviation policy by the developing countries differs markedly from that used for advanced countries.
The treatment of the subject matter begins in Chapter I with an overview of the aviation industry and its financing Historical Review. Chapter II deals with the problem of recognition of title and security rights in aircraft under international law. Chapter III contains a detailed consideration of the types of commonly used security instruments in aircraft financing. Chapter IV sets out an overview of financing in developing countries, Chapter V contains a study of the various problems facing the asset financing of aircraft in the Third World and possible solutions.
In the last three chapters, emphasis will be placed on regional aviation issues.

ENGLISH ABSTRACT: Mozambique managed to attract a lot of foreign direct investment despite it being one of the poorest countries in the world and after it has been through a devastating 17 year civil war. GOP per capita in 1995 was about US$ 144 which was one of the lowest in the world. The country was faced with enormous challenges and risks in terms of both country and political risk. Major risks were associated with investment in that country because of prolonged civil war with no record of macro-economic stability. Despite these huge challenges, Mozambique managed to attract a lot of investment with Mozal 1 being the first big project post civil war. This paper analyses and quantifies where Mozambique was before and after mega projects. This is done by looking at where Mozambique was before Mozal 1 being the first mega project in the country post civil war. The analysis is in terms of political risk as it relates to cross border transactions with specific reference to a number of political risk indicators as suggested by Brink (2004) that prevailed and how the projects were structured to minimize risk. A political risk rating is developed for 1995 and 2005 using the Brink model to check if the project did improve the country's economic health.
AFRIKAANSE OPSOMMING: Mosambiek het daarin geslaag om grootskaalse direkte buitelandse investering te lok ten spyte van sy status as een van die wereld se armste lande en die verwoestende burgeroorlog wat 17 jaar geduur het. Die BBP per capita was ongeveer US$ 144 in 1995, wat dit een van die laagstes in die wereld gemaak het. Die land het enorme uitdagings en risiko's in die gesig gestaar in terme van die land en die politiek. Die hoofrisiko's het met investering verband gehou vanwee die langdurige burgeroorlog en geen makro-ekonomiese stabiliteit in die land se verlede nie. Ondanks hierdie reuse uitdagings het Mosambiek daarin geslaag om baie investering te lok, waarvan Mozal 1 die eerste megaprojek na die burgeroorlog was. Hierdie tesis analiseer en kwantifiseer Mosambiek se posisie voor en na megaprojekte. Dit is gedoen deur te kyk na hoe Mosambiek daar uitgesien het voor Mozal 1. Die analise is in terme van die verband tussen politieke risiko en oorgrenstransaksies gedoen. Daar word spesifiek verwys na 'n aantal aanwysers van politieke risiko, soos voorgestel deur Brink (2004), wat geheers het en hoe projekte gestruktureer is om risiko te verminder. 'n Gradering van politieke risiko is vir 1995 en 2005 aan die hand van Brink se model ontwikkel om te kontroleer of die projek die land se ekonomiese gesondheid verbeter het.

Abstract:
This dissertation examines how the change in the international economy away from manufacturing to finance has affected African development. The dominance of financial liberalization is obvious to most observers; however, discourse on the development of African economies since 1980 generally focuses on the primary lending institutions (the IMF and World Bank). This dissertation is really an attempt to create a narrative about the rejection of alternative forms of development and subsequent implementation of rieoliberal policies. African countries rushing pell-mell to privatize, democratize, and implement all things neoliberal, crystallizes the sterile nature of alternatives to financial liberalization. Much of the discussion surrounding strategies for development remain grounded in previous notions of how countries develop, the stages of development, and generally how countries can develop their infrastructure. While all of these have salience, it does not quite capture the essence of how the world has been transformed. It is no longer possible or sensible to discuss African development without understanding the role of international finance capital. Development cannot simply be understood by bargaining with foreign companies and attracting FDI. To be sure, that is not the only aspect of development but one that was heavily emphasized just fifteen to twenty years ago. The present global economic recession provides a perfect example of how important international finance capital, in this case derivatives, are so important to the international economy. Now we must understand derivatives and how this financial tool became so dominant in the international market economy.

We introduce the topic of this Special Issue on the "Role of Financial and Legal Institutions in International Governance", with a particular emphasis on a notion of "international mobility of corporate governance". Our discussion places the Special Issue at the intersection of law, finance, and international business, with a focus on the contexts of foreign investors and directors. Country-level legal and regulatory institutions facilitate foreign ownership, foreign directors, raising external financial capital, and international M&A activity. The interplay between the impact of foreign ownership and foreign directors on firm governance and performance depends on international differences in formal/regulatory institutions. In addition to legal conditions, informal institutions such as political connections also shape the economic value of foreign ownership and foreign directors. We highlight key papers in the literature, provide an overview of the new papers in this Special Issue, and offer suggestions for future research.

The aim of this thesis is to analyse the Hague Convention on the Civil Aspects of International Child Abduction and to determine how well the instrument has in fact responded to the problem of international child abductions and how it may, if necessary, be improved. The thesis has sought to include all relevant material published in England, Scotland, France and the United States of America up to 1 August 1997, although where possible reference has been made to more recent case law. The thesis commences with a review of the sociological aspects of the phenomenon. The pre-Convention situation is then assessed and attention drawn to the difficulties inherent in resolving international custody disputes. The evolution of the 1980 Convention is sketched with attention being drawn to how the Special Commission adopted the 'summary return mechanism' rather than traditional private international law remedies. Each of the key articles and concepts in the Convention is analysed in turn with detailed consideration given to the relevant case law. Particular attention is paid throughout to the change in profile of the average abductor from a father with access rights to a primary carer mother, and to the effect this has had on the Convention. The conclusion considers whether the summary return mechanism is still the most appropriate way in which to respond to wrongful removals and retentions.

ENGLISH ABSTRACT: The development of the global biotechnology industry largely coincided with the development of the US biotechnology industry. This resulted in this industry's oligopolistic and centralised nature where only a few multinational chemical and pharmaceutical companies control most biotechnology processes and production of commodities emanating from these processes. The governance of biotechnology has, until recently, been dominated by state actors who have endeavoured to secure national interests, including those of large multinational corporations (MNCs) based within their boundaries. The technological ability of developed states to exploit and use unevenly distributed resources to their advantage means that an uneven relationship exists between these and poor developing countries. This has been highlighted by differences in public opinion about the role and application of biotechnology in society. While some opinions favour the use and application of biotechnology to enhance food supplies and boost production levels and trade, other opinions caution against the possible hazards that genetically manipulated organisms (GMOs) hold for the environment and human existence. The commercialisation of biotechnology has resulted in the exponential growth of genetically manipulated crops in especially the United States and countries like Argentina and Canada. These countries produce large surpluses of staple grains such as corn and soya and try to sell these to countries with food supply problems. The clash in commercial interests stemming from developed countries' insistence on the protection of intellectual property rights (IPR) on genetically manipulated (GM) seeds has caused considerable conflict with poor farmers who will not be able to sustain their livelihoods if they cannot save seeds for future harvests. This is one aspect of the problems surrounding the protection of knowledge products that is exacerbated by the scientific uncertainty pertaining to the risk involved with biotechnology. While some observers agitate for precaution with the use of GMOs, others feel that a lack of scientific proof of harm is sufficient grounds for proceeding with developments in biotechnology. Conversely, there are some that feel that biotechnology is market driven instead of human needs driven, ultimately resulting in developing countries receiving very little benefit from it. The Cartagena Protocol on biosafety was drafted to address some of the difficulties involved with the transboundary movement of GMOs. Although it holds very specific advantages for developing countries, as a regulatory framework it is limited in its scope and application. Developing countries are limited in their policy options to address their need to protect biodiversity and secure their food supply. This means that considerable challenges and constraints await these countries in utilising global governance of public goods and building their human and technological capacities.
AFRIKAANSE OPSOMMING: Die ontwikkeling van die globale biotegnologie-industrie het grootliks saamgeval met die ontwikkeling van die Verenigde State se biotegnologie-industrie. Dit het aanleiding gegee tot hierdie industrie se oligopolistiese en gesentraliseerde aard waar slegs enkele multinasionale chemiese en farmaseutiese maatskappye die meeste biotegnologie prosesse en die vervaardiging van kommoditeite uit daardie prosesse beheer. Die regering van biotegnologie was tot onlangs oorheers deur staatsakteurs wie gepoog het om nasionale belange te beskerm, insluitend die belange van multinasionale korporasies (MNK) wat vanuit hulle grondgebied funksioneer. Die tegnologiese vermoë van ontwikkelde state om oneweredig verspreide hulpbronne tot eie gewin te benut beteken dat 'n ongelyke verhouding bestaan tussen hierdie en arm ontwikkelende state. Abstract:
In multi-party democratic systems, where there is no absolute majority, the political parties are forced to cooperate. The cooperation is built on negotiations that result in several side effects including also concessions and compromises in the program. This analysis focused on the fulfillment of the coalition party promises in the Czech Republic, specifically on Prime Minister Bohuslav Sobotka´s government. The input data of the research consisted of a prepared set of testable political promises from the pre-election programs of selected political parties. The promises were compared with the contents of the coalition agreement, the government’s policy statement. It was found that coalition political parties selected by the government within the framework of coalition cooperation managed to enforce approximately 36 % of their election promises. At the program level, 24 % of promises were enforced. In areas that increase the personal budget of voters, government political parties have pushed 76 % of promises. Regardless of their cooperation, they made approx. 52 % of the election promises during the parliamentary term. The dominant party of the government was the CSSD.

Total Official Support for Sustainable Development, or TOSSD, is a new statistical metric that has been in the making for almost 10 years. It is meant to capture a broad range of global flows of public money in support of sustainable development. These include aid, loans on non-concessional terms, and public funds aimed at mobilising private finance for development. Metrics matter. It is essential to track the resources that the international community is allocating to turn the ambitions of Agenda 2030 and its Sustainable Development Goals (SDGs) into reality. Without such data, it is impossible to determine whether there is progress. ActionAid, AidWatch Canada and Oxfam International are publishing this discussion paper to shed light on how TOSSD works in practice as well as on its ambitions, shortcomings and the contending political perspectives on this new metric. The paper emphasizes that TOSSD could significantly shape the future of development finance.

Based on the proposal by the European Council, more than 25 heads of state and the World Health Organization (WHO) support development of an international treaty on pandemics, that planned to be negotiated under the auspices of WHO, will be presented to the World Health Assembly in May 2021. Given that the treaty alone is not enough to ensure compliance, triggers for a high-level political response is required. To this end, to inform the design of a support system, we explored institutional mechanismsi with a mandate to review compliance with key international agreements in their signatory countries and conduct independent country investigations in a manner that manages sovereign considerations. Based on our review, there is no single global mechanism that could serve as a model in its own right. There is, however, potential to combine aspects of existing mechanisms to support a strong, enforceable treaty. These aspects include: • Periodic review - based on the model of human rights treaties, with independent experts as the authorized monitoring body to ensure the independence. If made obligatory, the review could support compliance with the treaty. • On-site investigations - based on the model by the Committee on Prevention of Torture according to which visits cannot be blocked by state parties. • Non-negotiable design principles - including accountability; independence; transparency and data sharing; speed; emphasis on capabilities; and incentives. • Technical support - WHO can provide countries with technical assistance, tools, monitoring, and assessment to enhance emergency preparedness and response.

The COVID-19 pandemic has created enormous challenges for national economies, livelihoods, and public services, including health systems. In January 2021, the World Health Organization proposed an international treaty on pandemics to strengthen the political commitment towards global pandemic preparedness, control, and response. The plan is to present a draft treaty to the World Health Assembly in May 2021. To inform the design of a support system for this treaty, we explored existing mechanisms for periodic reviews conducted either by peers or an external group as well as mechanisms for in-country investigations, conducted with or without country consent. Based on our review, we summarized key design principles requisite for review and investigation mechanisms and explain how these could be applied to pandemics preparedness, control, and response in global health. While there is no single global mechanism that could serve as a model in its own right, there is potential to combine aspects of existing mechanisms. A Universal Periodic Review design based on the model of human rights treaties with independent experts as the authorized monitoring body, if made obligatory, could support compliance with a new pandemic treaty. In terms of on-site investigations, the model by the Committee on Prevention of Torture could lend itself to treaty monitoring and outbreak investigations on short notice or unannounced. These mechanisms need to be put in place in accordance with several core interlinked design principles: compliance; accountability; independence; transparency and data sharing; speed; emphasis on capabilities; and incentives. The World Health Organization can incentivize and complement these efforts. It has an essential role in providing countries with technical support and tools to strengthen emergency preparedness and response capacities, including technical support for creating surveillance structures, integrating non-traditional data sources, creating data governance and data sharing standards, and conducting regular monitoring and assessment of preparedness and response capacities.

Abstract:
India has a unique and complex religious history, with faith and spirituality playing an important role in everyday life. Hinduism is the majority religion, and there are many minority religions. India also has a complicated class system and entrenched gender structures. Disability is another important identity. Many of these factors determine people’s experiences of social inclusion or exclusion. This paper explores how these intersecting identities influence the experience of inequality and marginalisation, with a particular focus on people with disabilities from minority religious backgrounds. A participatory qualitative methodology was employed in Chennai, to gather case studies that describe in-depth experiences of participants. Our findings show that many factors that make up a person’s identity intersect in India and impact how someone is included or excluded by society, with religious minority affiliation, caste, disability status, and gender all having the potential to add layers of marginalisation. These various identity factors, and how individuals and society react to them, impact on how people experience their social existence. Identity factors that form the basis for discrimination can be either visible or invisible, and discrimination may be explicit or implicit. Despite various legal and human rights frameworks at the national and international level that aim to prevent marginalisation, discrimination based on these factors is still prevalent in India. While some tokenistic interventions and schemes are in place to overcome marginalisation, such initiatives often only focus on one factor of identity, rather than considering intersecting factors. People with disabilities continue to experience exclusion in all aspects of their lives. Discrimination can exist both between, as well as within, religious communities, and is particularly prevalent in formal environments. Caste-based exclusion continues to be a major problem in India. The current socioeconomic environment and political climate can be seen to perpetuate marginalisation based on these factors. However, when people are included in society, regardless of belonging to a religious minority, having a disability, or being a certain caste, the impact on their life can be very positive.
