Full textAt first, the thesis analyzes the effect of migratory flows from poor to rich countries. Whereas the recent literature established that a brain drain could lead to a brain gain, this result is easily reversed. Then, the difference between temporary and permanent migration is studied from the point of view of the effects on the social and cultural assimilation of the immigrants. With a linear two-period model, one shows that, since immigrants convey their cultural values to their sons, the restrictive policies incentivate the creation of ethnic enclaves, and delay the assimilation. Secondly, the vote on immigration is studied. The majority of the results shows a polarization of the voters between free immigration and no immigration. The thesis shows why the vote leads to interior results. The development of the selective policies is interpreted like an entry barrier aiming at defending a qualified median voter

Full textThe aim of this thesis is to assess the meaning and effects of the american immigration policy since 1965: family reunification, which became the major goal, has in practice acquired unexpected volume. This makes us ponder over the extent and limits of the power of legislators over social phenomena, yet the first chapter shows that researchers have long favored the macro-economic approach of migration. In order to understand its family aspects, this thesis analyses the "human factor" and illustrates it bu tstimonies and ethnographic studies. A comparison of five ethnic groups (mexicans, filipinos, koreans, chinese and indians) puts into relief several general patterns and trends. After a chapter tracing the history of the reunification policy in the 1965-1990 period, a statistical analysis measures its effects. Full textThe various security policies operating within the framework of the Europeanisation of immigration policy concerning immigrants from the Southern shores of the Mediterranean basin are part of a global tendency. The member states tend to adapt two different policies : the safekeeping of national borders, which some consider as basic for their sovereignty or the willingness to Europeanise their foreign policy concerning the influx of immigrants. The creation of the Schengen states is a prime example of this dynamic. Although, its legal dimension is homogenous, its application is heterogenous. At the same time, it facilitates the exclusion of undesirable elements by means of an informal blacklist which the different consulates draw up in consultation with one another. The aim of this thesis is to analyse the difficulty in creating a common European foreign and immigration policy by examining the French case. Also evident is a desire to preserve privileged relationships often inherited from the colonial past, as is the case in Franco-Algerian relationships. However this entails a risk of bilateral initiatives ending in a diplomatic statemate at the European level. The French fears that immigration may import the Algerian crisis on to their territory serves to increase over reaction on the part of the authorities concerning internal movement of immigrants

Full textSince the end of the 90’s the arrival of isolated foreign minors in France (children without any legal representative) has been a phenomenon which tends to strengthen and which destabilizes the french authorities. Children are facing serious risks of economic and sexual exploitation, their presence seriously questions their protection: if the french laws are relatively detailed, are they really effective ? In other words, does the notion of ‘danger’, which is mentioned in article 375 of the Civil Code, or at least the way it is interpreted, guarantee real protection against exploitation and abuse ? This study aims at showing that they are more often regarded as aliens than considered as children who are in danger. Indeed, for some years the government has expressed its will to control the flow of migrants and it lead the government to favor its security policies to the detriment of the laws protecting children rights (notably, the law concerning the higher interest of children that is specified in the 3rd article of the International Convention of Children Rights). In spite of the extent of the resources meant to take care of the isolated foreign minors, we must admit that this issue highlights numerous gaps : if they reveal the ineffectiveness of the current solutions, these gaps especially reflect an inadequate consideration of children rights

Full textAfter a general introduction and a literature review, in a 2-country OLG model, this thesis considers a non yet studied case where each government chooses for his country theflow of migrants that maximizes the post-migration social welfare. Since decision flows are unilateral, it naturally follows the introduction of the concept of optimal two-sided-borders. In a simple OLG model à la Galor (1986) with 2 periods, 2 countries and an exogenous labor supply, Chapter 2 examines the differences in optimal migration flows when countrydiffers in time preferences. With or without costly borders, optimal flows that lead the economy to the Golden Rule differ, so that one country closes its borders before the otherone. A world social planner would make an opposite migration policy compared with the country-specific social planner. Chapter 3 develops an OLG model where young train and get the return to education next period, adult and old endogenously work. The optimal migration rates leading to the social optimum of each country differ. These asymmetries generate incentives for illegal migration, hence wages and interest rates do not equalize in the post-migration equilibrium. Chapter 4 extends the previous by introducing a pension system. If by the law, only adults are allowed to migrate, then the receiving country want to attract more migrants than the departure country would let go. The individual choice of migration depends more on the children education than on the retirement benefit choice. This result is not in line with the existing literature. The Welfare State is not the first reason for which migrants leave their country

Full textNoting the unequal distribution of the right to international mobility in the contemporary world, this thesis questions racial bias in migration policies. Based on a study of the ways in which the national political subject is constructed from its constituent others, race is depicted as a structuring principle in national building processes. The racial tension between the citizen and the alien is the guiding theme of my work. I identify the figure of the alien-migrant as the national’s Other, and try to rethink the categories of political belonging through the racial exclusion from which they proceed. By placing national formation in its colonial context, I study how race has been constituted as a determining category in the granting of political rights. If the colonial genealogy of the governance of international mobility shows that free movement has been constructed as a racial privilege, this colonial order remains the underlying one in the contemporary distribution of the right to mobility as shown by the comparative study of passports and the examination of a number of contemporary migration policies. A phenomenological approach to the border completes the institutional analysis by proposing a study of material borders as systems of constraint exerted directly on bodies. The experience of the racialized body reinforces the hypothesis of the consubstantial racialization of national borders

Full textThroughout this thesis, our interest will be drawn to the evolution of the migration system between Latin America and Spain from the end of the 19th century until the economic crisis that took place in 2008. Our starting hypothesis is that the latter makes us reconsider the theory of the « cultural proximity » according to which the language, cultural and religious communities with the Spanish, would make the integration of the Latin-Americans easier than the other migrant communities. After the migration boom in the 2000’s, the crisis figures seem to reveal a change of migration cycle as well as a recomposition of the migratory flows on the basis of an ongoing « Dis-Latin-Americanization» process. What about the real facts ? Is that process irreversible ? We are going to answer these questions by studying the way Latin-Americans are affected by that crisis in two Autonomous Communities, the migratory traditions of which are different : Aragon and Catalonia

Full textExpulsion or deportation constituted a privileged punishment prior to the modern prison, whose advantage was the definite exclusion of the individual without having to deal with his body. This punishment reappears as a new strategy of social control and of surplus world population management, particularly regarding foreigners in developed countries. The French model of expulsion of foreigners was based on an administrative device presented as a hygienic and tidy system, symbolized by the administrative retention centers. By means of a six-month-ethnographic study carried out at two retention centers near Paris, we analyze this topic with an empirical inductive approach, in which the characteristics and functioning of the displayed instruments are studied, mainly, the confinement of foreigners in administrative retention centers, so as to understand the impact of migratory control practices and policies on both the individuals and on the construction of the French society. In addition, we analyze forced return as an extension of the penal system whose informal objectives transcend effective deportation and aim to establish a device for the control of the migrant population in general

Full textIn recent years, in the European Union, migration of workers has increased considerably due to the opening of the Schengen area. Subsequently, many families are leaving Romania to work and live in Spain. The region of Castellón registers surprising numbers: 10% of the population is Romanian. Through what processes have these migration waves been built? The thesis proposes a reflection on family and individual modes of insertion of Romanians in the province of Castellón. The development of religious and family networks explains the continued growth of migrant flow from Romania to Spain. The notion of the path of migration allows observation of the complexity of the situation of migrants. Real territorial integration strategies can be analyzed. The entry integration of Romania into the European Union imposes a rethinking and a reinterpretation of the migration process. New concepts such as concurrency, glocalization, transnationalism allows for a reinterpretation of migration networks. The strategies adopted by families to ensure their survival are continually updated, as imposed by the current economic crisis in Spain

Full textNearly three million Senegalese population out of twelve million just over, live abroad. Before directed to the former French colonies in Africa and France, for geographical historical and linguistic reasons, Senegalese migration field has become multipolar by the new opportunities offered by the others countries. The Senegalese emigration’s movement has been widened to Arabia and eastern Europe. But the trends show a growing portion of new candidates choose Southern Europe and North America. The profile of Senegalese emigrant to the U.S. is very different at many ways that the migration category in France. Starting in the early 1980s, the emigration of Senegalese in the United States outnumbers that one in France due to the economic and organizational dynamism and better incentive structure. The United States offers more opportunities and fewer constraints for the cultural and economic development to migrants. Women occupy a substantial place in this migration, they are younger and often single at the time of their arrival on American territory. In France, the Senegalese emigration is older but is facing more constraints on the economic, administrative and cultural aspects. Over 70% of the Senegalese France engaged in low skilled, paid jobs and save less than their counterparts located in the United States. Thus, for better success and more coming to their families support in Senegal, many Senegalese, rather that France, choose the United States where they mostly work in commercial activities. The family and economic reasons do not only explain, the emigration of Senegalese because they are not the sole poorest who leave. For these reasons there is "new logic", migration-related globalization. These departures have consequences on Regions starting with the most visible are the remittances from migrants and investment, more or less supervised by state or private structures working with inclusive approach

Full textAdvances in information and transportation technology support transnational terrorist action and require a state response which takes into account the transnational terrorist movement. This response resulted in, for the United States and Spain, immigration and asylum measures that are part of counter‐terrorism strategies. American migratory and asylum measures to combat terrorism are consistent with American migratory tradition and foreign policy, while Spanish measures are consistent with international law, though in conformity with European law. The international doctrine has also justified the adoption of these measures on the basis of social contract and sovereign exceptionalism theories. However, the adoption of migratory and asylum measures to combat terrorism is part of a process of criminalization of migratory law also known as crimmigration. The migratory and asylum measures undertaken to combat terrorism have not been effective in eradicating terrorism, despite their continuous presence during migration control and treatment of asylum‐seekers, though they are valuable instruments for action against illegal migration and preserving cultural "stability". In fact, they are part of a surveillance system of alien people. The construction of this system implies the creation of an "Enemy" migratory and asylum law that considers the alien as a risk to security and consequently gives the alien an exceptional treatment which results in the loss of its legal personality. This "Enemy" migratory and asylum law enables the State to symbolically achieve its goals and obtain a new source of legitimacy

Full textIn France and in Italy, AIDS and hepatitis B profoundly affect migrants from sub-Saharan Africa, particularly those living under precarious political, social, and economic conditions. Since 2010, when the AIDS epidemic had normalized in Western countries, in France and Italy there has been increasing interest in public policies regarding hepatitis B, which is associated more and more with HIV, and disease control strategies for migrant populations. Despite this, following a recent tightening of migration policies, difficulties with accessing healthcare and with asserting one’s rights have increased for migrants living with these two infections in France or in Italy. Building on the intersection of the policy trajectories for these two infections and their use in the area of migration policies, this thesis presents an analysis of the way the treatment of AIDS and hepatitis B currently in effect in France and in Italy for newly arrived migrants from sub-Saharan Africa contributes to the development of new forms of inequality. The analysis is comparative and associated with a microsocial and ethnographic study of the everyday treatments for migrant patients afflicted with AIDS and hepatitis B that are provided by two entities that take care of newly arrived migrants in Paris and in Rome (Comede in Paris, Samifo in Rome), and a macrosocial study of the translation of policy developments in regard to the health of migrants and the fight against AIDS and hepatitis B at the international level and at the national level in France and Italy

Full textBearing in mind the political sensitivity of migration flows in general, and the debates brought about by migration relations among European states in particular, this research is designed to fill a gap in the existing knowledge of European regionalism. Historians have indeed not yet fully explained the formation of the European migration regime. A variety of rules, written or not, relating to residence, the crossing of borders, and the provision of social security for migrants define this regime, which covers both intra-European migration flows and flows between Europe and the rest of the world. In order to produce a better understanding of the nature of the regime and the underlying political strategies that are related to it, this research was mainly based on the archives of the most powerful immigration states, the FRG and France, and of those of the EU Council of Ministers, the central institution in the definition of the European order, where states display their preferences and bargaining power. The regime corresponds to the preferences of the FRG, which was eager to stabilize Western Europe in the context of the Cold War, and which then worked to diplomatically unify West Europeans in preparation for the collapse of the Soviet order. An open migration regime in Europe also favoured the penetration of foreign markets by German firms. Its large labour demand enabled the FRG to support this regime, although the regime evolved to favour more skilled movements. The study involves the development of a new theory of open migration regimes that specifies the most favourable economic and demographic conditions, and which outlines the factors that encourage a state to support such a regime

The research outlines how camps designed for people in migration were implemented through European union pre-adhesion incentives or funding. Through a geographical approach, the dispositif is analysed from the 2000s to the time period of the so called migratory "crisis" (2015-2016), in order to scrutinize its forms, fonctions and dynamics. At the individual level, the analysis questions the effects of this way of dealing with otherness in local societies. To this end, the cartographic project pays attention to the personal migratory journeys. Based on a social ant holistic geography and on the Croatian case-study, the conclusions of the research interrogate restrictive immigration and asylum policies in Europe

Full textThis dissertation examines Morocco-EU negotiations on migrations since 1999, and specifically since 2003, when both partners started negotiating a readmission agreement. The purpose of such an agreement is to make it easier to deport undocumented migrants. Using a postcolonial approach, this work questions existing analyses of the EU’s external policy and their Eurocentric tendencies. The objective is to pluralize the subjects of international negotiations. The first step towards this objective is to study the historical and institutional complexity of Moroccan as well as European actors. A second important step is to offer a sociological analysis of resistance practices of Moroccan actors to pressures from the EU and European countries. I demonstrate in this work that negotiations, far from being limited to the realm of high politics, are part of the day-to-day practices of administrative actors who are engaged in national and international competition. It through the analysis of everyday contestations that one can understand the agency of Moroccan actors and the ways in which they constantly question the asymmetry of their relationships with European countries

Full textLe Régime d’Asile Européen Commun (RAEC) est souvent critiqué pour la vision sécuritaire de l’asile qu’il incarne. Il est vrai que son histoire reste marquée par la volonté des Etats-Membres de contrôler la mobilité humaine sur le sol européen. Toutefois, bien que les récents durcissements des politiques communautaires semblent confirmer cette sécuritisation du droit d’asile, ceux-ci contrastent avec l’affirmation croissante de la nécessité de « mainstreamer » le principe d’égalité au sein du droit européen. Prenant cette contradiction pour point de départ, cette thèse examine la manière dont un enjeu controversé au sein du champ de l’égalité – les droits LGBTI – fut incorporé au sein d’un mécanisme de coopération lui-même conflictuel pour les Etats-Membres, le RAEC. Elle répond à la question suivante : en quoi le débat européen sur l’asile LGBTI interroge-t-il le rôle joué par la politisation dans la redéfinition des politiques d’égalité en Europe ? A partir d’une enquête qualitative, cette thèse montre que si le RAEC fut un espace-clé de l’approfondissement de l’égalité LGBTI en Europe, ce fut au prix de la construction des droits LGBTI et des droits des migrants comme deux enjeux distincts. Cette division, toutefois, prend sa source non pas dans une instrumentalisation homonationaliste, mais plutôt dans les dispositifs dépolitisants de gouvernance et de triage des populations qui prédominent désormais au sein des politiques européennes, dépolitisant les exclusions et fragmentant les causes. Face à cette logique individualisante, seule la repolitisation du débat permettra d’inventer de nouvelles formes de politiques d’égalité porteuses d’émancipation collective.

Full textThis thesis uncovers the importance of often overlooked actors and transfer channels by adopting a longitudinal and multi-level perspective on international norm and policy transfer. It examines the role of international organisations in the development of asylum policies and practices in Ukraine since the adoption of the first Law on Refugees. It shows how the action of international and domestic non-governmental organisations is interlinked with and differs from the sector-specific conditionality exercised by the European Union. In this manner, it enriches the findings on transfer from research that has mostly focused on top-down processes and political elite actors. It investigates the interactions and relations between state and non-state actors of the “transfer chain”, revealing logics of dependence, delegation and control as well as processes of translation, support and resistance. Analysing the support and subtle forms of resistance to the legislative adoption of international norms at the Parliament, it demonstrates that adoption is shaped, to a large extent, by domestic politicians’ pursuit of recognition and incentives by international organisations. Moreover, non-state actors seek to influence state practices by adapting their strategies to domestic resistance and structural obstacles, utilising confrontational and harmony-seeking, formal and informal, top-down and horizontal strategies. While norm entrepreneurs try to trigger the formalisation of certain changes, the effects of the transfer attempts on state practices remain heterogeneous and unstable. This thesis thus adds to transfer scholars’ widespread findings regarding the weak application of norms

Full textThis thesis focuses on the migration control implemented at the Moroccan-Spanish border and its effects on the targeted persons. Highlighting the processes of “minoritisation” of Central and West African nationals who are candidates for Europe, this study, based on a multi-site ethnography conducted at local and micro-local levels, leads us to think about the social relations of gender and race at stake in existing migration regimes. It attempts to denaturalize the figures of the female and male “sub-Saharan migrant” to reveal the processes behind these racialized and gendered categories, anchored in a context of externalisation of European borders, and permanent negotiations between the EU, its Member States (here Spain) and their African allies (here Morocco) for the fight against so-called illegal immigration. It also tries to decipher and put into theoretical perspective the systemic violence that governs this militarized border situation, as well as the humanitarian actions and resistance that take place there. It then leads to the following question: how can we understand the tacit institutionalization of the use of deadly violence against those labelled as “Sub-Saharans” on the Moroccan-Spanish border? To answer, we must look at each side of the border, but also consider it as a whole; grasp the sexual division of labour in controlling mobility; compare the points of view of controllers and controlled persons and understand the past crystallized in the present: think about the coloniality of Spanish and European migration policies

Full textThis thesis presents an analysis of the intra-European mobility of European workers and citizens and of third country nationals (TCNs), focusing on the issues of building a European labor market. We are mainly interested in the opportunity of a link between intra-European mobility policies for workers and the European migration policy. The first part of the thesis is predominantly analytical. It characterizes the current situation of the European Union, its mobility patterns, its migration systems and regimes as well as the articulation with its national labor markets. The European situation is compared to the leading immigration countries outside EU. This analysis is conducted with an ongoing effort to go beyond the aggregate data, which may hide important national differences between Member States, and even marked divergences. Using this analysis, the second part is devoted to a critical review of the current European public policies for the promotion of intra-EU mobility of workers, leading to recommendations. The third part combines theoretical and empirical approaches for studying three dimensions of intra-EU mobility. In the first chapter, the study of the determinants of foreign recruitment reveals some specific features of the firms recruiting abroad, beyond the characteristics of the jobs. In the second chapter, we show that the current version of the European blue card cannot be efficient: one of the main reasons for this inefficiency is the lack of articulation with expanded rights for intra-European mobility of holding a blue card. Full textAfrican migration in Latin America is part of a process of reconfiguration of global migration. Paths unfold and recompose by the way of not only the history of migration policies, crises and economic opportunities but also by the groups and individuals stories. The rising complexity of the control procedures in the North, joint to the South globalization, results in bursting of destinations. By the 1990s, but especially since the 2000s, especially migrants from West Africa, weave the contours of a transatlantic migration South-South device. In Buenos Aires, the Africans try to be part of the territory in different ways. While the vast majority develops a street trading activity, driven mainly by the Murid Senegalese Community, others try to exploit a desire of Africanness, or maybe to find their way in football and in business. From these multiple origins, cosmopolitan links with the various segments of the host society population are born. These interactions, which can lead to negotiation processes, produce social and identity changes in ethnic, religious or gender dimensions

Full textThe analyses carried out in this doctoral thesis aim to highlight the forms of resistance and action taken by migrant and autochthonous anti-racist subjects dealing with the "migration issue". For this purpose, the research examines the dynamics that occur within the political mobilisations in a field that is defined both in terms of space and time: the city of Turin from 2009 until 2014. The study focuses on the practices of opposition, contestation, and claims-making, as well as the different expectations and the conflicting interpretative frameworks that drive such a plurality of subjectivities. Drawing on the tradition of socio-anthropological studies of social movements, the ethnographic study of migrants aims to render the interactions among the different actors involved as well as the emerging experiences and their assigned meanings. Mobilisations are characterised by a precarious state and lack of memory; by challenging the differential treatment of migrants, mobilisations generate multiple forms of politics, ranging from subversion to the construction of other spaces, passing through attempts of negotiation. By employing political mobilisations as the main perspective, it is hence possible to develop a comprehensive view of the migration phenomenon, whilst highlighting the specificity of the Italian case – characterized by a recent history, its geographical localisation, and its socio-economic context. Full textIn France there is a double movement, a permanent tension between the logic of foreigners' rights and that of human rights, which crystallizes on the health of non-nationals.Health is part of the special administrative police aiming at protecting the community from the risks induced by the arrival of sick foreigners. But there are other challenges besides the preservation of public health. The health of foreigners is used as a means of regulating migration flows and selecting individuals. However, the implementation of the so-called "chosen immigration" policy is governed by the fundamental rights gradually granted to foreigners.Health is also a right of foreigners residing in France to access the care necessary for their condition. This right is supported by the principles of equality and dignity, but also depends on their implementation by judges. The principle of equality thus leads to a categorisation of the right of access to healthcare according to the administrative situation of foreigners. This right also varies considerably and is sometimes limited to the sole benefit of vital and/or essential care. For migration but also financial considerations, judges choose to link it to the principle of dignity rather than to an autonomous right to health protection

Full textThis dissertation deals with the development of the Chinese countryside during the "reform and opening" era, and more specifically, with the consequences of the two main institutional remains of the collectivist period which have lasted despite, in rural areas, despite the general dynamic of liberalization of the Chine se economy: the collective ownership of land and the controls on internal migrations. These two characteristics of the Chinese development are the topics of very lively debates in the People's Republic, debates which rejoin general issues in developing countries, the ones of the definition of institutional arrangements over agricultural soils, and of the management of internal migration flows. It is shown that land rights insecurity acts as a constraint on rural households' migration decisions, but also that, symmetrically, the persistence of collective reallocations of land can manifest the interests, not only of village cadres, but also of villagers themselves. It is also shown that the constraints on the migration decisions of rural citizens, through the "household registration system" (hukou), which practically pre vents them from definitively settling down in urban areas, could explain part of the very high saving rate in China, and so hastens the development of the Chinese countryside

This research combines a sociology of immigration (which is partly a sociology of the receiving State and a sociology of popular classes) and a sociology of religion and its clerics. Its premise is that imams, as "migrant-cleric" experiment the two sides of domination (they dominate as clerics and are dominated as "immigrants"). Therefore, this study first analyzes the way these "organic" intellectuals of migration have managed to exercise a religious and community leadership with the establishment of several generations of Muslim migrants in France. Secondly, it tries to identify how these "migrant-clerics" have been gradually instituted as objects of public policy by the French State because of their supposed influence over the Muslim communities. Full textThe doctoral thesis deals with the challenges of the emigrant movement caused by the construction of large dams and reservoirs in China, by including certain aspects of Chinese history and the context of modernization of the 20th century. We will study this subject through a multidisciplinary methodology in social sciences, and focus the questions on some fundamental areas: politics, actors, community. We study these constitutive elements of reservoir immigration, which also comes under the Chinese concept of migration, the institutional processes of hydraulic governance, the modern nation state, and more broadly, the relationship between the state and society through institutional means: roots in traditional society, bureaucracy, sovietization, etc. We think that the movement linked to the construction of the dam in the Chinese context is a multi-subject / actor movement, mobilized mainly according to the dynamics of the state-society relationship. A field study on the Xin'an Jiang dam and reservoir, one of the three large dams "built independently by the Chinese ourselves" comes to feed our research in historical and geographic dimensions, revealing among other things the engineering institution , the formation of the emigration and immigration, uprooting, the new community formed by the movements, which shape the subjectivities and the performances of the different actors of the movements around the the construction of dam and reservoir of Xin'an Jiang. This holistic, structured and social morphological analysis seeks to understand the complex relationships and transformations that operate during the construction of large dams and the forced migration that accompanies it with the objective of establishing a national planned economy and a powerful Chinese nation. Our research shows that China, which is in the process of modernization, is moving towards a society uprooted and suspended from its tradition of Xiangtu shehui. The movement by the construction of big dam and reservoir allows us to grasp this change driven by a future for autonomy, which seems uncertain but creates a new subject for modernisation

Full textMayotte a French overseas department since 2011, is part of the comorian archipelago from which it was separated from the State of Union of the Comoros islands since 1975. The introduction of a visa in 1995 and the order n° 2002-688 delivered on 12 july 2004 and entered into force on April 1st 2005 with regard to the extension of social security in Mayotte exclude the foreign sick from Mayotte's health system. This leads to a process of medical evacuation following an illegal immigration way that causes shipwrecks and the violation of the patient's rights. The attraction of Mayotte and Mainland France for disadvantaged populations lead to conflict situations and competition in the access to health and social protection. Mayotte's disadvantaged populations, who are struggling to catch up with the mainland, do not get along with that competition. At the same time the illegal immigrants living clandestinely and with the threat of expulsion are facing difficulties to assert their right to health care and to benefit from social system assistance. Obstacles are numerous and most of the time considerable, mainly because of discrimination, because of their judicial status, of disparity in their social and economical difficulties and because of their generaly very hard living conditions. The control of migratory flow and the fight against illegal immigrant remain the top priorities of the French government policy as far as immigration is concerned. The singularity of the situation in the department of Mayotte and the huge migratory flows that have been observed led healthcare authorities to handle migratory movements related to illegal medical evacuations. France has a healthcare policy and continues to support the Union of Comoros in the effort to improve healthcare access and quality, through support programs to health sector. These programs aim at improving the health of mothers and children, mainly in reducing maternal mortality. Through its organisation AFD, France aims at supporting health ministry in elaborating and implementing public policies and helping comorian state to put in place regulatory mechanisms of a private service within public sector and to reform the national pharmacy. This work focus on the issues related to the right to social protection and the health law for foreigners on the national territory, in mainland France and in Mayotte as well. Diversity of national laws applicable in Mayotte is a significant barrier to local devices in terms of medical and social assistance. It is necessary to seek legal solutions related to standardization of this health and social law in order to better the healthcare system. During our field research we observed that local devices such as the "pink warrant" and the "good AGD" are not at all equivalent to the national devices (AME and CMUc)

This phenomenon, which primarily results from personal choice and individual decisions, intrinsically linked to the context of their departure, is analyzed within the framework of a collective social configuration which is engaged in a process of difficult and selective illegal mobility. From the perspective of comprehensive sociology, this research analyzes the social bond that ties, in time and space, migrants involved in illegal migration networks, in order to approach, through their backgrounds and experiences, their organizational and survival strategies in France. The purpose of this research is therefore is therefore to analytically evaluate the strength of the social networks underlying illegal migration and illegal migrants' ability to act in the context of increasingly restrictive migration. Thus, the analysis of social bonds in the process of illegal migration process sheds light on the ways in which the interweaving and adjustments of social bonds, assembled in relationships of solidarity and reciprocity, ensure invisibility and survival. Finally, young Algerians' experience of illegal migration, which is primarily an experience of individual emancipation, autonomization and up-ward social mobility, is a challenge for European migration policies that are at odds with the logic of illegal migrants

Full textThis study offers a critical analysis of the Canadian immigration system through a detailed examination of the process of an immigrant’s selection from within the category of “skilled workers.” It questions the relationship between the Canadian and Quebecois society and immigration by focusing on the way the state operates through the management of the exclusion/inclusion of immigrants, while trying to understand what is at stake during the immigration process by underlining the effects which that unfold upon those involved in this process. Specifically, the study seeks to see how various representations of the immigrant have crystallized over the time, in turn influencing current representations. It is not a matter of questioning the conditions of their emergence, but rather to see the effects they produce. It is also important to identify the range of strategies and practices at work in the immigration process. Starting with a particular case, it is possible to highlight wider dynamics and make apparent the links between global trends in immigration (commodification and securitization) and their articulations with a specific national policy. This research is articulated around three approaches: an anthropology of institutions, an anthropology of the state, bureaucracy and bureaucrats and an anthropology of policy. The intricacies between these approaches places the focus on several constitutive elements of the apparatus surrounding immigration, in particular Canadian and Quebecois immigration institutions, legislative and statutory texts, policies, speeches, diverse measures and procedures implemented, the practices of employees within these institutions, etc. Through a “problematisation” of the relationship to immigration, the aim is to retrace the transformations and movements of this relationship and to recast it in its historicity so as to see how immigration and immigrants are constituted as subjects. More succinctly, it is a questioning of the historic horizon within which the current management of immigration takes shape. This understanding of the implementation of migratory control in Canada is also based on an examination of current immigration policies. It seeks to highlight the implicit categories associated with the constitution of the “subject-immigrant,” starting from bureaucratic and administrative categorizations, in order to question the construction of polarized categories – “commodity” and “threat” – accompanying the “manufacturing” of the “perfect” immigrant. The ethnographic data provided allows an understanding of the strategies and daily practices that are materialized within immigration institutions in order to highlight the effects they produce on immigrants – processes of desubjectivation/resubjectivation, negation of personal life history, reduction to a simple preestablished category – and to examine the micropolitics at work. Finally, the arguments are recast into a wider logics of contemporary migration management. The commodification and securitization of immigration are effectively at the heart of the apparatus surrounding immigration, the “actualisation principles” of the migratory management that allow the indirect regulation of migratory flows that facilitate circulation deemed “beneficial” for Canada, while, at the same time, restricting those who could be “threatening”. In short, this research allows us to understand what consists of the management of immigration in Canada.

The interlocutors interviewed are from Senegal, Algeria, Morocco, Vietnam, Laos, Comoros etc. The analysis developed from biographical interviews underlines the influence of the different migration paths of the parents, and the common experiences of their children on the construction of their political attitudes; it questions their possible specificity. This analysis pays particular attention to the family memory and the dynamics of intergenerational transmission, to the socio-professional trajectories of immigrants’ descendants and those of their parents as well as their local context of residence

Full textTraditionnally regarded as lands of immigration, the United States, Australia and the European Union have gradually closed their borders and are adopting similar policies in the fight against irregular immigration. These three major centers of immigration are trying to find solutions to secure their borders in order to prevent the entry of irregular migrants. In this context, the externalization of migration controls appears to be a relevant complementary method to fight against irregular immigration. The migration controls will no longer take place at national borders but they will be relocated to the territory of a third country or to an area of legal vacuum as the high seas. The countries of emigration and immigration shall cooperate and use the instruments of international law in order to carry out this goal. The complexity of the migration phenomenon and the lack of influence of international law on this field will make this issue particularly tricky. The compatibility of the actions led by the United States, Australia and the European Union will be assessed regarding conventions, customary law and jurisprudence, legal black holes will be revealed and some improvements will be suggested

Full textThis dissertation deals with the practices surrounding the law regarding foreigners in Morocco. Its aim is to observe and describe, in context, the activities of diverse people who find themselves involved or faced with the law, institutions and procedures related to the presence of foreigners. The intention, however, is to analyze various mechanisms involved in the ordinary mobilization of law. This goes through the study of legal and administrative activities in this domain. The clarification of methods used by people, both professional and lay, in their daily practices includes de facto to take into consideration the social and political dimensions of the law, and in particular that related to foreigners. By adopting a praxiological perspective, the purpose is to deal with law in action and to revisit a set of practices, methodical and structurally organized, in order to better understand the endogenous methods of production and intelligibility of law.The first part seeks to present the praxiological approach while shedding light on several social and political phenomena in the contemporary Moroccan context. The second part is devoted to the description and the analysis of various situations in which people are involved and face administrative and judicial institutions. Through a series of episodes and in an empirically documented manner, it fleshes out the way in which the law practically and contextually operates. A third part focuses on methods of reasoning, of understanding and of interpreting, and in particular the working of categorizations and inferences, which are actively at play in the law regarding foreigners in Morocco.All the chapters provide an original treatment of processes and mechanisms of the grammar of law in action and bring out the relation between law and society, as well as the intrinsically political dimension of the law regarding foreigners
