Abstract:
Swedens membership in the European Union have resulted in an international characterized labour market. The construction sector is the area who employs most posted workers among the 7400 employees who monthly enters the market. It’s also the sector where a big part of the work-related deaths occurs. The purpose of this study is therefore to contribute to a greater understanding of the regulation regarding posted workers, their work environment and the consequences of it. I have been using the right dogmatic method and a social science perspective as complement in order to answer the purpose of the study. The application of the posted workers directive has been criticized for opening opportunities for false self-employment and limiting the trade unions rights. Combined with the Laval-case the trade unions have restricted possibilities to enforce the collective agreements and protect the posted workers rights. Subcontracting processes complicates the investigation regarding which employer who has the overall responsibility for safety regulations and work environment. Foreign workers tend to be a big part in these subcontractor chains with major linguistic difficulties and lack of legislation knowledge which increases the risk of accidents. Arbetsmiljöverket is the authority who has the general responsibility for monitoring that the health and safety legislation are respected by all employers. Their investigations are partially based on the statistics of work-related accidents. But when it comes to foreign workers only more serious accidents are reported to the authority. Which means that minor incidents regarding foreign workers never reaches the statistics.          In summary, conclusion is drawn that the inspection of posted workers working environment are unsatisfied. The hands of the trade unions are tied by the legislation while the inspections by the monitoring authority are based on inadequate statistics. All that combine with the fact that posted workers tend to be unwilling or lack the knowledge to take action for their rights, leads to openings for employers to take advantage of foreign workers.

Abstract:
The objective and purpose of this PhD is to provide pragmatic solutions to the Posted Workers Directive 96/71/EC.1 This European Union legislation is designed to govern a unique category of worker that moves throughout the internal market temporarily under the provision of services. The Directive was created to protect workers’ rights, combat social dumping by ensuring a climate of fair competition and promote the transnational provision of services. In practice, it has failed to fulfil its objectives, as seen by the Laval Triplet.2 Therefore, following a thorough analysis of the issues that are intrinsic to the Directive itself and also highlight wider issues such as the competing interests of the internal market and national labour law as well as the conflicting economic and social policy interests, this thesis will provide legislative solutions which will constitute the requisite original contribution to knowledge. The thesis is composed of five parts, beginning with the Introduction and ending with the Conclusions. The central Chapters follow the chronological order of the Directive’s story as follows: Chapter 1 details why and how the Directive was created including an analysis of the early case law; Chapter 2 analyses the issues associated with the Directive and it offers an original critique of the Court’s interpretation of the Directive; and Chapter 3 reviews the solutions that have already been suggested by the EU Institutions, the European Social Partners and the academic literature before providing my own input to the field. The form of methodology adopted throughout is therefore doctrinal.

La mobilité internationale des travailleurs est perçue comme un facteur de développement pour les États, qu’ils soient d’origine ou d’accueil. Elle est la solution aux carences de compétences et de mains d’œuvres, elle constitue un facteur de transfert et d’acquisition du savoir-faire et de technologie pour les États de même que pour les travailleurs. Cependant, la mobilité internationale des travailleurs révèle un cadre juridique complexe, puisque d’un côté elle est liée à certains droits fondamentaux qui impliquent forcément des conséquences, et d’un autre côté l’usage inapproprié de ses qualifiants prête à la confusion entre les différentes formes de cette mobilité. Toutefois, sa mise en œuvre ne reste pas sans conséquences puisqu’elle implique des effets mitigés pour les trois principaux acteurs : les États, les entreprises et les travailleurs. The international mobility of workers is seen as a states development factor, whether it is their home or host. It is an answer to skills deficiencies and labor work. It is an acquisition and transfer factor of knowledge and technology for States and their workforce.However, international mobility reveals a complex legal framework, since on the one hand, it is linked a certain fundamental rights witch necessarily involve consequences, and on the other hand, inappropriate uses of his qualifying it leads to confusion between the different forms of mobility. However, its implementation is not without consequences since it involves mixed effects for the three principal actors: States, companies and workers. That is what this study will illustrate

Abstract:
Since Sweden joined the European labor market there has been an increase of posted workers, primarily in the construction industry. The aim of this thesis is to study how the EU has affected the Swedish health and safety regulation in the case of posted workers in the construction industry and what room for maneuver there was on the government agency level in the application of the EU-regulations, during the period of 1994–2018. Three research questions are examined: 1) How has the number of posted workers in the construction industry changed? 2) How has the work environment for the posted workers in the construction industry developed? and 3) How has the Swedish Work Environment Authority ap-plied the work environment regulation for posted workers in the construction industry? The results show that there are major gaps in the statistics and enforcement. Most alarmingly, while the posted workers’ share of employment, according to public records, at its highest is around 2 percent, in 2018, their share (together with unregistered foreign workers) of the death accidents in 2008–2017 is much higher, at 14 percent. The EU has weakened the regulation but there have also been hindrances on the national level.

Abstract:
L’étude de la question de la conciliation entre protection des droits des travailleurs et promotion des libertés économiques dans le cadre du détachement de travailleurs montre que, l’Union européenne étant fondée sur la promotion des libertés économiques, la Cour de justice privilégie la libre prestation de services. Pour autant, on constate que c’est un véritable choix de politique juridique car dans d’autres domaines, ou dans le cadre d’autres ordres juridiques, une telle conciliation n’engendre pas les mêmes résultats. L’intervention du législateur de l’Union par l’adoption d’une directive relative au détachement de travailleurs n’a pas modifié ces conclusions. Pour autant ces solutions amènent aujourd’hui à une situation paradoxale d’un point de vue économique, les États de l’ouest de l’Union dénonçant un dumping social important de la part des entreprises établies dans les États d’Europe centrale et orientale. Ce dumping a amené à l’adoption d’une nouvelle directive en 2018 qui vise à rétablir un équilibre entre protection des droits des travailleurs et promotion de la libre prestation de services. L’analyse approfondie de ce texte et l’influence des arrêts de la Cour de justice laissent toutefois planer des doutes sur l’atteinte d’un tel équilibre
Studying the question of conciliating the protection of workers' rights and the promotion of economic freedoms in the framework of the posting of workers shows that, as the European Union is based on the promotion of economic freedoms, the Court of Justice favors freedom to provide services. However, we note that it is a real choice of legal policy because in other areas, or in the context of other legal orders, such conciliation does not produce the same results. The intervention of the Union legislature by the adoption of a directive on the posting of workers has not changed these conclusions. However, these solutions lead today to a paradoxical situation from an economic point of view, the western States of the Union denouncing significant social dumping by the part of the companies established in the Central and Eastern European States. This dumping led to the adoption of a new directive in 2018 which aims to restore a balance between the protection of workers' rights and the promotion of the freedom to provide services. However, the in-depth analysis of the text and the influence of the judgments of the Court of Justice, allow some lingering doubt regarding the achievement of such a balance

Byggarbetsplatser med flera språk och kulturer representerade innebär utmaningar för kommunikationen kring arbetsmiljö och säkerhet. Under 2015 sände utländska arbetsgivare drygt 18 000 arbetstagare till Sverige för att utföra byggnadsarbeten. Med bakgrund i de närmaste årens mål för bostadsbyggande och den planerade utbyggnaden av infrastrukturen, spås ytterligare 60 000 byggnadsarbetare krävas varje år. För att möta de utmaningar som ökningen kan komma att innebära krävs studier om svenska byggarbetsplatser med utländsk arbetskraft. Denna studie är ur den svenska produktionsledningens perspektiv och syftar till att öka förutsättningarna att skapa en god arbetsmiljö för utstationerade arbetstagare på byggarbetsplatsen. Studien genomfördes i fyra delar med olika angreppssätt för att identifiera vilka utmaningar som uppstår med utländska underentreprenörer, och hur de kan hanteras. En omfattande litteraturstudie genomfördes och samtal med branschmänniskor fördes för att skapa en teoretisk grund. Fallföretagets ledningssystem utforskades som en sorts nulägesanalys för att skapa en utgångspunkt för diskussionen. Slutligen genomfördes intervjuer med åtta produktionsledande tjänstemän från fallföretaget. Förhoppningsvis kan rapporten bidra med mer kunskap kring tvärkulturell kommunikation på byggarbetsplatser och samordning av säkerhetsarbetet med utländska underentreprenörer. Diskussionen kretsar främst kring internationella inköp, språk och kommunikation, arbetsplatsintroduktioner samt daglig styrning. Tydligt avgränsade entreprenader och uppföljning av ställda krav verkar vara förutsättningar för ett fungerande arbete med utländska underentreprenörer. Utstationerade arbetstagare bör genomgå en gedigen arbetsplatsintroduktion och involveras fullt ut i daglig styrning för att skapa delaktighet och ansvarskänsla samt undanröja säkerhetsrisker. På sikt bör engelska nyttjas som arbetsspråk även i normalstora byggprojekt.
Building sites with multiple languages and cultures represented create challenges for the communication about work environment and safety. In 2015 foreign employers sent more than 18 000 workers to Sweden to carry out construction work. According to the next years' objectives for housing construction and the planned expansion of the infrastructure, it is predicted that an additional 60 000 construction workers are needed each year. To meet the challenges that the increase may imply, studies on Swedish building sites with foreign labor are needed. This study is from the Swedish production management’s perspective, and aims to increase the conditions to create a good work environment for posted workers on the building site. The study was carried out in four parts with different approaches to identify the challenges which arise with foreign subcontractors, and how they can be managed. A comprehensive literature study was conducted and discussions with industry people were carried out to create a theoretical basis. The studied company’s management system was explored as a sort of situation analysis to create a basis for discussion. Finally, interviews were conducted with eight production leading officials from the studied company. Hopefully, the report can contribute with more knowledge about cross-cultural communication at building sites and coordination of the safety work with foreign subcontractors. The discussion mainly revolves around the international procurement, language and communication, workplace introduction and daily management. Clearly defined contracts and monitoring requirements seem to be prerequisites for functioning work procedures with foreign subcontractors. Posted workers should pass through a thorough workplace introduction and be fully involved in the daily management to create participation and a sense of responsibility, and eliminating safety risks. Over time, English should be used as a working language even in normal-sized building projects.

Abstract:

The Latvian building company Laval un Partneri Ltd (Laval) posted Latvian construction workers at the rebuilding of a school in Vaxholm in autumn 2004. Because the company refused to sign a collective agreement with Svenska Byggnadsarbetareförbundet (Byggnads), which is the Swedish trade union for constructions workers, Byggnads put the construction site under a boycott. Next Laval sued Byggnads for damages in the Swedish Labour Court (AD) because Laval considers the boycott as well as Byggnad´s demand that Laval signs a collective agreement incompatible with EC Law. AD has now demanded a preliminary ruling from the European Court of Justice (ECJ). While waiting for the preliminary ruling from the ECJ, several important questions of principle stand unanswered. Two such questions are whether Lex Britannia and the way in which Sweden har implemented the directive for posted workers (96/71/EC) are compatible with EC Law. In this thesis the author seeks to answer these two questions.


Det lettiska byggbolaget Laval un Partneri Ltd (Laval) utstationerade under hösten 2004 lettiska byggarbetare på ett skolbygge i Vaxholm. Eftersom bolaget vägrade teckna kollektivavtal med Svenska Byggnadsarbetareförbundet (Byggnads) satte Byggnads bygget i blockad. Laval stämde därefter Byggnads i Arbetsdomstolen (AD) och krävde skadestånd eftersom Laval anser att blockaden, liksom Byggnads krav på att Laval skulle teckna kollektivavtal, strider mot EG-rätten. AD har nu begärt ett förhandsavgörande i målet från EG-domstolen. I avvaktan på EG-domstolens avgörande står flera principiellt viktiga frågor i målet obesvarade. Dessa är bl a huruvida Lex Britannia och Sveriges sätt att implementera utstationeringsdirektivet (96/71/EG) är förenliga med EG-rätten. Det är dessa frågor som författaren ämnar besvara i uppsatsen.

Abstract:
How were immigrants, immigrant issues and their histories represented through radical poster art created during the 1968 protests and strikes in France? The May 1968 protests remain one of the most significant moments in contemporary French history and it occurred during a time when immigrant populations were rapidly increasing. There is a multitude of research, analysis and reflections on the protests and strikes; yet there is very little mention of the place of immigrants during this event. Art collectives that were created during the protests designed and produced posters that later became a symbol of the strike. By using a variety of primary and secondary sources including small press publications, interviews, manifestos, historical and artistic secondary soured this work argues that it is during this social movement that immigrants and immigrant issues entered French social discourse and this can be seen by exploring the messages presented in the posters.

Le téléchargement dit de « pair à pair » est un procédé d’échange d’informations via Internet qui permet aux internautes de se procurer des œuvres protégées par la propriété littéraire et artistique et de procéder à leur diffusion sans l’autorisation des ayants droit sur les œuvres ainsi échangées. Cette pratique a donné naissance à un mode d’exploitation alternatif aux circuits légaux de diffusion des créations intellectuelles, empêchant l’exercice de l’exclusivité octroyée par le droit d’auteur qui est apparu démuni face ce phénomène. Particulièrement touché, le secteur musical qui a pourtant démontré par le passé une grande capacité d’adaptation aux nouvelles modalités d’exploitation des œuvres de l’esprit engendrées par le progrès technologique constitue un angle d’attaque privilégié pour étudier la difficulté du droit d’auteur à appréhender le « pair à pair ». Le choix du domaine musical qui ne bénéficie pas, à la différence du cinéma, d’une réglementation spécifique permet de plus l’approche la plus limpide possible des questions soulevées par ce procédé qui a remis en cause la légitimité du droit d’auteur dans l’esprit d’une partie du public. Au lendemain de l’adoption d’un régime légal spécialement conçu pour mettre un terme à l’impunité dont ont bénéficié de facto les échanges d’œuvres protégées sur Internet, cette étude se propose de livrer un panorama juridique des tentatives d’adaptation de la propriété littéraire et artistique au phénomène complexe du « pair à pair » afin donner les clés d’une lecture éclairée des solutions finalement dégagées par les pouvoirs publics et des conséquences que ces dernières pourront avoir sur l’avenir du droit d’auteur
The so-called Peer to Peer is a downloading and uploading procedure of information exchange, through the Internet, allowing users to gain access to works normally protected by intellectual property rights, and to broadcast them without the agreement of the rights owners. This practice has given rise to an alternative means of exploitation for intellectual creations, which is removed from legal distribution circuits. It has therefore been forbidding the preservation of exclusivity granted by intellectual property rights. Law has appeared at a loss when confronted to this new phenomenon. The musical sector was particularly hit, even though it had shown in the past a great capacity in adapting to any new condition of exploitation generated by technological progress. This is why this sector represents a good field of study in order to approach the difficulties intellectual property rights encounter when confronted to the Peer to Peer occurrence. Unlike the movie sector, music is not specifically regulated and this particularity enhances the various and complex questions raised by the Peer to Peer which shakes the notion of legitimacy of intellectual property rights in the eyes of a part of the public. After the adoption of a specific legal system, expressly elaborated in order to put an end to the impunity of Peer to Peer exchanges, this study sets out to present a legal panorama of the attempts carried out to adapt intellectual property rights to this new phenomenon. We hope to have provided the keys to an understanding of the solutions finally adopted by the French State, and a clear view of the consequences these may bear on the future of intellectual property rights

Abstract:
High-profile instances of workplace violence and increased pressure from competitors have threatened the viability of one of the nation's largest employers, the United States Postal Service (USPS). As a result, the USPS began a massive change effort in the early 1990's. One of the initiatives implemented to improve labor-management relations was a derivative of the self-managed work team known as the crew chief program. This study provides a mixed-methods and multi-level approach to understand the impact this unique program had on organizational attitudes. The first aim of this study was to investigate whether the crew chief program reduced employees' stress and strain and improved job and supervisory satisfaction and company and union commitment, while controlling for the nesting of employees within sites and employee demographic characteristics. The second aim was to replicate and extend the stressor-strain-outcome (SSO) model of stress and to determine whether employee perceptions of crew chief support moderated the relationships between stressors, strain, and outcomes. I evaluated Aim 1 using data from 177 mail processors from 27 units matched from baseline to one-year follow-up with hierarchical linear modeling. This was followed up with an implementation analysis of qualitative data to determine the extent to which the program was implemented compared to the original design. I evaluated Aim 2 using structural equation modeling from 538 mail processors who participated at follow-up. There was little quantitative support for Aim 1. However, the results of the implementation analysis suggested that the crew chief program was not functioning as conceived. Aim 2 received strong support, with almost all of the main effects of the SSO model replicated. However, there was no support for the moderator effects. Additionally, I found role ambiguity to have direct relationships with other organizational outcomes beyond the indirect effects via strain and that crew chief support was strongly related to stressors and outcomes. These findings reinforce the notion that employing both quantitative and qualitative methods can dramatically improve the quality of organizational research. Based on these findings, I describe several suggestions for improvements to this specific program and for improving future initiatives aimed at enhancing labor-management relations.

Abstract:
For decades, scholars have debated the significance of the Works Progress Administration (WPA), emphasizing its political, economic, and artistic impact. This historiography is dominated by the accomplishments of white men. In an effort to highlight the long-neglected legions of black women who contributed to WPA projects and navigated the agency’s discriminatory practices, this paper will examine WPA operations in New Orleans where unemployment was the highest in the urban south, black women completed numerous large-scale projects, and white supremacist notions guided relief protocol. By analyzing the New Orleans WPA Photography collection, along with newspapers, government documents, and oral histories, a new perspective of the WPA emerges to illuminate the experiences of marginalized black women workers, illustrate how the legacies of slavery and effects of segregation impact black women’s employment opportunities, and highlight how black women made substantive contributions to public projects in the face of societal constraints.

Abstract:
This research project is concerned with workers’ narratives, specifically those who have been employed in paid work below the national minimum wage in New Zealand. As a graphic designer who has direct experience of exploitation through employment, I am interested in researching the subjective experience of underpaid workers in New Zealand. In doing this I have sought to creatively synthesize experiences into artworks that provide a deeper insight into the impact of underpaid work. Through this investigation I have attempted to contribute to a broader discussion of underpaid work than what is currently provided, through the analysis of statistical data. In undertaking this project I have also been concerned with investigating new potentials in serigraphy (a graphic medium traditionally associated with working-class politics). I have inquired into how it might be used to create a visual ‘voice’ for contemporary workers’ narratives. Accordingly, this project has employed audio recordings of three personal stories. The research has led to the production of a series of serigraphic prints that artistically interpret the journeys and experiences of the participants. These images sit in discourse with looped audio excerpts of their recorded interviews. In this approach, narratives of marginalisation that have often been muted through their presentation as written records, have been re-conceptualised as an artists' images, with which the recordings are in discussion.

Abstract:
The author explains what «diligent bidder» means during bidding processes. First, he starts analyzing some civil law matters as due diligence and compliance with obligations. Then, he states his position about whether the consultation during bidding processes is a right or an obligation for the bidder, and under what conditions it would work. Furthermore, he explains the relevance of identifying strict liability on developing the technical file to set the compensation of damages. Finally, the author offers some cases to determine when contractors are «diligent bidders» and when they are not. He points out that when contractors are «diligent bidders», the owner must take full responsibility; on the other hand, when they are not «diligent bidders» and they partially caused the damage, the judge or the arbitrator should reduce the compensation.
El autor aborda el tema relacionado al «postor razonable» en los procesos de selección de obra pública. Su aproximación al tema parte por analizar aspectos civiles relacionados con la diligencia y el cumplimiento de obligaciones. Asimismo, presenta su posición respecto de si la formulación de consultas es una obligación o un derecho de los postores, y en qué casos se aplicaría. Además, explica porqué es importante determinar la responsabilidad objetiva en la elaboración del expediente técnico, a la hora de determinar el resarcimiento del daño. Al finalizar, presenta algunos criterios que deberían ser tomados en cuenta para analizar cuándo nos encontramos frente a un «postor razonable», y cuándo no. This thesis examines the relationship between the three artists' workshops Røde Mor (Red Mother), Folkets Ateljé (The People's Studio) and GRAS, who worked between 1968 and 1975 in Denmark, Sweden and Norway. Røde Mor was from the outset an articulated Communist graphic workshop loosely organised around collective exhibitions. It developed into a highly productive and professionalised group of artists that made posters by commission for political and social movements. Its artists developed a familiar and popular artistic language characterised by imaginative realism and socialist imagery. Folkets Ateljé, which has never been studied before, was a close knit underground group which created quick and immediate responses to concurrent political issues. This group was founded on the example of Atelier Populaire in France and is strongly related to its practices. Within this comparative study it is the group that comes closest to collective practises around 1968 outside Scandinavia, namely the democratic assembly. The silkscreen workshop GRAS stemmed from the idea of economic and artistic freedom, although socially motivated and politically involved, the group never implemented any doctrine for participation. The aim of this transnational study is to reveal common denominators to the three groups' poster art as it was produced in connection with a Scandinavian experience of 1968. By ‘1968' it is meant the period from the late 1960s till the end of the 1970s. It examines the socio-political conditions under which the groups flourished and shows how these groups operated in conjunction with the political environment of 1968. The thesis explores the relationship between political movements and the collective art making process as it appeared in Scandinavia. To present a comprehensible picture of the impact of 1968 on these groups, their artworks, manifestos, and activities outside of the collective space have been discussed. The argument has presented itself that even though these groups had very similar ideological stances, their posters and techniques differ. This has impacted the artists involved to different degrees, yet made it possible to express the same political goals. It is suggested to be linked with the Scandinavian social democracies and common experience of the radicalisation that took place mostly in the aftermath of 1968 proper. By comparing these three groups' it has been uncovered that even with the same socio-political circumstances and ideological stance divergent styles did develop to embrace these issue.

The main topics for selected technological phases are transportation, bill of quantities, technological regulations, construction organization’s principles, time schedule, machinery, control and testing plan, work safety and worker’s health protection. These topics are prepared for the technological phases of ground works, fundamental contruction, upper load-bearing structure, construction of the floor and sheathing of the object. In a context of rising inequalities in the European Union, accompanied by a certain mistrust in the capacity of the European institutions to improve and secure the social conditions of the citizens, the question of ‘social Europe’ is more than ever source of debate and interrogations. Focusing on the revision of the Posting of Workers Directive, proposed by the Commission in 2016, this thesis analyses the way the European Ministers framed this revision and ‘social Europe’ more broadly during the negotiations.This work contributes to the existing research on elite framing and expands this field to ‘negotiations analysis’, a topic which has rarely been addressed. The analysis, based on Helbling’s frame categorisation, shows that workers’ social protection is a divisive issue which opposes two main groups: the proponents (high wage member states) and the opponents (low wage member states). The first group frames ‘social Europe’ as a way to restore trust in the European economic model, jeopardised by the downward pressure on wages and social conditions caused by low wage member states. On the other hand, opponents to the revision frame social policies as disruptive forces damaging the single market’s competitiveness and economic freedoms. They portray themselves as the victims of an unwelcome protectionism orchestrated by high wage member states.These findings question the future of ‘social Europe’, as they bring to light the unwillingness of both sides to rethink the European economic system. In the absence of a strong and positive ‘counter-narrative’, it seems that social policies will continue to beseen as hindering economic freedoms or as a mean to legitimise a system that has proven to be unequal. In that sense, the European social project did not yet reach the ‘status’ of the economic project and is still understood as a side issue that cannot challenge the status quo. If framed differently, social welfare in the Union could become a priority and take precedence over the fundamental freedoms that have been defined twenty-five years ago, in a very different socio-economic and political context.

The aim of this thesis is to present the phenomenon of posting workers within the EU in the context of the freedom to provide services. The author introduces the de lege lata legal framework in a complex and chronological manner, taking into consideration the motives and political pressure behind key modifications. Accordingly, the thesis examines relevant Treaty provisions, case law and its evolution, key secondary acts, as well as the relation of such sources to legal acts which address posting workers in an indirect manner. The author focuses on the analysis of existing key provisions, their practical impact and insufficiencies. However, she also approaches the topic from the de lege ferenda perspective by presenting the ongoing revision of the current legal framework and by considering other potential changes which could improve the regulation of posted workers in the future. Furthermore, the thesis demonstrates the complexity of posting workers by drawing attention to the colliding interests of involved member states and parties, showing the sensitivity of the subject. This thesis focuses on the position of the Czech Republic towards the proposal of the revision of the Posting of Workers Directive, which was introduced by the European Commission in March 2016. Although the Czech Republic's statement was negative in March 2016, the Czech position supported the proposal during final voting in the Council in June 2018. The thesis aims at identifying causes of the position change using the Advocacy Coalition Framework and at confirming the main proposition, that change of the position may be explained by an existence of advocacy coalitions which tried to enforce their beliefs. The thesis concludes that the main proposition may be confirmed only partially. Although the existence of two advocacy coalitions with opposing beliefs was identified, it is not possible to claim absolutely that this is the true reason of the change. Two hypothesis were defined. First one is based on existence of the external sources whose presesnce was confirmed, as well as their dominant influence on the change. Therefore, this hypothesis was confirmed. The second hypothesis was disproved. The second coalition was much weaker and rather passive than the first one, so there was no need to overcome the "hurting stalemate" situation at the national level. The change was not absolute. The cross-sectional study investigates the occupational and personal risk factor related to the prevalence of Carpal Tunnel Sydrome(CTS)in postal workers. A comparsion was done between a case study group consisting of 75 people with symptoms of CTS and a non case study group of 264 people without signs of CTS. Results showed a significant relationship between the repetitive motions associated with postal workers daily work routine and CTS. Also evidence was the use of hand tools(such as a stamp, chop,etc.)over an exttended period of time led to incidences of CTS. Although not statistically significant, mail sorters were 1.57 times more likely to acquire CTS compared to administrative workers. A case group of 31 and a control group of 94without CTS was selected and ratio of wrist volume was measured and finger vibration threshold was determined by vibrameter. Results showed mail soerters had a higher finger vibration threshold than administrative workers and the former also had a greater number of people withmedian nerve damage across the wrist. Also analyzed was the relationship between finger vibration threshold and the ratio of wrist volume. Results showed ration of wrist volume increased one unit would lead to 0.57g increase of finger vibration threashold on left hand and an increase of 0.38g on the right hand. Also found, but not statistically significant, was the higher the ratio of wrist volume, the greater the finger vibration threahold. Postal workers with CTS symptoms were found to have a greaterratio of wrist volume than the control group. Of special note, a personal risk factor for developing CTS was having square-shaped wrists.

The arrival of digital era has completely changed the way people live, think, and interact with each other; it also materialized in such a rapid fashion that the world has never seen before. Consequently, brand new forms have been brought to the process of creation in art. In the digitalized world, a vast array of computer tools are for artists to create numerous forms of art digitally, allowing a more widespread appreciation of higher-quality artistic creations. Meanwhile, the popularization of digital photography has not only made it a universal hobby among people, this also allows easier access of image creation to be experienced by people. As for media of art utilizing visual expression, the aforementioned phenomenon turns out to be a revolution unforeseen. All in all, digitalized forms of art differ most significantly from traditional forms of art by the application of computerized techniques. However, the essence of creation does not differ, even though all kinds of art could technically be expressed in digitalized forms. Image Processing is currently the most rapid, powerful method of visual communication design. The progress of technology has reformed most aspects of design. Therefore, as a designer, one has to recognize and be adaptable to the latest computer technology, so as to induce the freshness into works of design for the viewers to experience. The motivation of this essay is to research the essence of image, through analyzing related documents of how the essence of image is utilized in the field of visual communication design. And at the same time, the essay also involves in discussions of the evolution, and the features of digital media. Moreover, the author intends to apply fundamental techniques of digital photography and image processing, from a visual expression design point of view, to design a series of posters of visualized image of music based on the works of the French composer, Claude Debussy's “ Préludes”. The essay serves as the result of researching on the theoretical side, and on the other hand, the design of posters represents the work of proof on the practical side. Last but not least, the author is in the hope that this presentation of research would lay the foundation for efforts of future study on design. Due to limited time frame, many ideas and thoughts were left aside without being further researched and developed. Abstract Since corporatization of Chunghwa Post in 2003, it has become the company which mainly relies on profits. However, Chunghwa Post still undertakes social responsibility from the country. It is important to find the balance between corporate profit and social responsibility. In recent years, total economic environment changes dramatically and enterprises must frequently adapt to new change. In original survival model, different types of stress intrude in daily lives. Besides, the government continuously promotes organizational reengineering. With complicated tasks and simplified manpower, post offices have fewer employees and more complicated works and service quality is continuously required. Post office employees in modern time encounter enormous work stress. Employees tend to seek help from labor union and post office associations in order to find the balance between labor and capital. However, post office employees’ intention to seek help from labor union usually depends on their identification with labor union. Leadership of labor union when dealing with employees usually determines employees’ trust in labor union. Therefore, post office employees’ organizational identification with labor union and leadership & capacity of coordination are important for members’ trust in labor union. Members should trust labor union in order to inform it of their difficulties or needs at work. Labor union needs members’ support to work for employees. This study aims to probe into effects of Chunghwa Post Association (CPA) members’ organizational identification and leadership of labor union on employees’ trust in labor union. It aims to balance the work in post offices, enhance harmony in workplace of post office employees and help solve life, physical and mental problems of post office employees and obstacles at work. This study adopted questionnaire survey and distributed questionnaires to 450 CPA members. 437 questionnaires were retrieved, including 401 valid ones, with a valid return rate of 92%. The data were analyzed using SPSS for descriptive statistics, t test, one-way ANOVA, Scheffe’ method, Pearson’s product-moment correlation, and regression analysis. The hypotheses were validated, and the findings are shown as follows: 1.CPA members mostly agree with “involvement” of scale of “organizational identification”; as to scale of “leadership”, “total leadership” is the most important; in addition, in scale of “trust in labor union”, “trust in total labor union” is the most important. 2.CPA members with different post office working years have significant difference on “organizational identification” and “trust in labor union”. 3.CPA members of different genders and marital statuses and educational levels and post office identities and service units have significant difference on “organizational identification”, “leadership” and “trust in labor union”. 4.CPA members’ “organizational identification” with labor union has highly positive correlation with “leadership”. 5.CPA members’ “organizational identification” with labor union has highly positive correlation with “trust in labor union”. 6.CPA members’ perceived “leadership” of labor union has highly positive correlation with “trust in labor union”. 7.CPA members’ “organizational identification” with and perceived “leadership” of labor union can significantly predict “trust in labor union”. “Total leadership” and “cohesion” are the most significant predictors. This thesis thematically deals with Uzbek minority in Prague, which was formed during the last two decades. Main part contain and analyze the structure of the Uzbek minority, and I used the statistics concerning number, working and educational activities, gender representation, territorial decomposition, crime and infringements of residential regime of Uzbek immigrants. I focus also on determination of expanse and method of integration in the majority society environment, patterns of behavior and thinking and culture aspects of everyday life in the minority group. From the research methods I use survey, in-depth interviews and participant observation. I place emphasis on the definition of "push" and "pull" factors of immigration. In addition, I document how the Uzbek Immigrants assess social and cultural environment of the host country, their attitudes and opinions to the people of the Czech Republic and members of other nationalities, especially to those with whom they come in a host country usually in contact, and how they integrate in the Czech environment. I also pay big attention to the changes that took place in the Uzbek community during life in the Czech Republic, including the period after 2008 due to the recession of Czech economy and restrict working opportunities and perspectives....

The thesis focuses on the attitudes of health care professionals in intensive care to patients after a suicide attempt. First chapter deals with suicide issues in detail, outlines sources of emotional problems and stress which can health care professionals encounter. The next chapter talks about burnout syndrome. The research part surveys the attitudes of healthcare professionals to suicidal patients, investigates the level and effectiveness of the awareness of health care professionals in the psychiatric and psychological issues and its impact on their attitudes, assesses awareness of burnout syndrome and eventual respondent's own experiences with this condition and evaluates the degree of mental and emotional demands of care of suicidal patients. On the qualitative research in the form of semi-structured interviews participated 20 respondents. We found that the attitudes of health care professionals to patients after a suicide attempt are rather positive.
