Full textWhy weren’t the removing guilt about sexuality, the expansion of discursive practices about desire, the excitement of pleasure and the enjoyment in the years 1960-1970 switched to any dynamics of emancipation or to a process of increasing the autonomy of the individuals, or simply why did not they give a boost to a new quest of happiness? On the contrary, how did the sexuality become, on a permissive mode, the breeding ground for various forms of gouvernementalisation of the individuals and populations along with the normalization of the pleasures and the relationships? Is it a question of releasing oneself sexually or of restricting oneself to a single shape of "freedom"? If the discourse of the « sexual liberation » is contradictory to its treatise, then how can we consider it differently? The objective of this thesis is to put forward several reflections on these problems by taking as vital lead the relationships concerning bodies and pleasures in contemporary Western societies. This is to analyze how, in which frames, through which processes and instruments, the relationships concerning bodies and pleasures are constituted as well as how they are made visible and intelligible, thought, experimented and lived. Such formulation also implies a reflection on the flip side, that is on the relationships which are excluded by what is unthinkable, inexpressible and unbearable by what is "worthy" of knowledge and legitimacy

Full textThe protection of the Constitution by the constitutional Council in Morocco, possible thanks to the constitutional revision of 1992, joins the reforms started by King Hassan II to strengthen the State under the rule of law. Unlike its predecessor (the constitutional Chamber of the Supreme Court which was not in good conditions to control the constitutionality), the constitutional Council seems to be a serious guarantee of the constitutional ascendancy. In addition of having inherited the former Chamber’s contribution, it also has been attributed the role of controlling the constitutionality of the common laws. The purpose of this thesis is to know if the Moroccan constitutional Council, which was based on the French model, can, in the long term, be effective in a political system supported by traditions and religion. The issue will be approached by pointing out the legitimacy and the efficiency of the constitutional Council. This thesis considers that the constitutional Council suffers from a deficit of legitimacy which prevents it from taking root in the legal political compost. It also considers that the High jurisdiction evolves in an environment which prevents it from carrying its mission as guardian of the Constitution

Full textThe relations between the internal law and the international law in the constitutions of african french speaking states along with their practice in this field includes two main aspects, independant, but mostly complementary. It concerns the drafting of international law in internal law and the hierarchy between these two branches of law's rules in the internal judicial order. Concerning the drafting of international law, if theoretically it appears that there is the worry of reconciling the executive body's role and the one played by the legislative body in practice, it seems that against the constitutions, the reality takes a revange which goes to the benefit of the governments making, so a space for an unequal distribution of international competences between the different state's bodies. As for the hierarchy between internal law and international law, the primary importance of international law limited to the treaties, prescribed by most of the constitutions is in spite of some applications of this principle in practice, the result of the reproduction of article 55 of the french constitution written in 1958

Full textThis dissertation aims to examine how the great organization in 7th -5th century Babylon treated subjects who violatesocial, moral, or religious norms to define the concept of faults and crimes against the organization and determine the particularity and punishment given to such transgressions. In religion, the conception of faults and crimes was associate with two principles: ritual taboo and respect toward the hierarchy of priests. ln the case of faults involving judicial procedure, a guarantor was punished with the same sanction given to a criminal or suspect. In the case of moral and social transgressions, the great organization treated its subjects in a fatherly manner. Crimes against the great organization can be classified into two categories: those against authority and those against property. Crimes against authority were punished severely. Meanwhile, in the case of violations against the temple’s legal right to property the crirninal were punished by the amended 30-time payment without exception. During this period, several punishments coexisted, and we can see the persistence of certain rules since the Old Babylonian period until 5th century B.C.E; however, we can also see some interference by Persian law

Full textStill subject to a certain level of vagueness in France, the concept of programmatic constilutional norms (PCN) required acomparative analysis based on the Italian experience in order to identify its trontiers and subsequently study ils place in law. Il appears that the PCN reters ta a multiplicity of normative categories ot axiological and teleological character, serving as political strategy while structuring the legal system. Moreover, the introduction of programmalic form in modern constitutions combines the vagueness of the norm in its modern formulation to the law in ils classical variant. Programs have struggled to find their place in law. The peN seem to be a priori denied of legal effect, their rather vague wordings would only established simple goals. However, their development in the legal space seem important enough 10 avoid PCN to be considered as legal oddities that couk' attend ta the purity of law. Indeed, Ihe concept of PCN connects to real programmatic constitutional norms whose normativity remains peculiar, sign not of a "crisis" of the law, but of its "evolution"

Full textThis thesis aims at describing and understanding the communication practices that sustain the consensual decision-making of an interorganizational collaboration (CI) collective, the “Table québécoise de la sécurité routière” (TQSR). We adopt a communication constitutive of organization (CCO) approach, as developed by the “Montréal School,” to understand the constitutive dimensions of these practices. After an overview of the available literature on CI and consensus decision-making, we propose to adopt the perspective of “consensus by non-opposition” developed by Urfalino (2014) to focus on the communicative practices that sustain this decision-making process. Conversation analysis and principles of a rhetorical approach are combined to analyze a plenary session from the TQSR third cycle of work, specifically aimed at drafting the collective’s final report. This analysis allows us to identify and discuss 1) the communication practices used to facilitate the consensus decision-making process and 2) the constitutive effects of consensus as it upholds the collective of collaboration’s unity.
