Conklin, Michael. "Precise Punishment: Why Precise Punitive Damage Requests Result in Higher Awards Than Round Requests." Michigan Business & Entrepreneurial Law Review, no. 10.2 (2021): 179. http://dx.doi.org/10.36639/mbelr.10.2.precise.

Full text
Abstract:
Imagine a setting where someone asks two people what the temperature is outside. The first person says it is 80 °F, while the second person says it is 78.7 °F. Research regarding precise versus round cognitive anchoring suggests that the second person is more likely to be believed. This is because it is human nature to assume that if someone gives a precise answer, he must have good reason for doing so. This principle remains constant in a variety of settings, including used car negotiations, eBay transactions, and estimating the field goal percentage of a basketball player. This Article reports the results of a first-of-its-kind study involving over 600 participants designed to measure if this same principle applies to punitive damage requests from plaintiffs’ attorneys. In other words, can a plaintiff’s attorney increase the punitive damages awarded simply by requesting $497,000 instead of $500,000. The stark differences produced from such a subtle and costless change provide a valuable strategy for plaintiffs’ attorneys, a cautionary warning for civil defense attorneys, and constructive insight into the subjective nature of juror decision-making.

Abstract:

Abstract:
The article notes that the replacement of the English name «Precise Point Positioning» (PPP) in Russian-language sources is possible using the term «accurate differential positioning» (TDP) technique. The author proposes to use both terms. This article contains information about the practical implementation of the PPP in the on-line service. The author has analyzed the research on the accuracy of PPP foreign and domestic experts and scholars. The author analyzed the data about the convergence time for PPP solutions. These data belong to another Russian scientist. The results of evaluating the accuracy of the PPP of different scientists led to the next. The author of this article gave the mean square errors topocentric coordinates of the geodetic points. The coordinates of the points must be obtained by dual-frequency GPS-measurements for a period of 24 hours with the help of PPP. The author proposed a formula for the calculation of the mean square error of the spatial position of geodetic point, if its position is obtained in the processing of dual-frequency GPS-observations of less than 24 hours. The article written conclusions about the features, defects and PPP development.

Full text
Abstract:
In German, the subject usually precedes the object (SO order), but, under certain discourse conditions, the object is allowed to precede the subject (OS order). This paper focuses on main clauses in which either the subject or a discourse-given object occurs in clause-initial position. Two acceptability experiments show that OS sentences with a given object are generally acceptable, but the precise degree of acceptability varies both with the object‘s referential form (demonstrative objects leading to higher acceptability than other types of objects) and with formal properties of the subject (pronominal subjects leading to higher acceptability than non-pronominal subjects). For SO sentences, acceptability was reduced when the object was a d-pronoun, which contrasts with the high acceptability of OS sentences with a d-pronoun object. This finding was explored in a third acceptability experiment comparing d-pronouns in subject and object function. This experiment provides evidence that a reduction in acceptability due to a prescriptive bias against d-pronouns is suspended when the d-pronoun occurs as object in the prefield. We discuss the experimental results with respect to theories of German clause structure that claim that OS sentences with different information-structural properties are derived by different types of movement.

Abstract:
Preeclampsia is a major health problem because it determines higher incidence in maternal and perinatal morbidity. Early prediction of preeclampsia in pregnancy can improve both the maternal and perinatal outcome by ensuring appropriate management. There are multiple algorithms using maternal risk factors, biophysical markers, biochemical markers and they try to predict preeclampsia. Low doses of aspirin can improve the prognostic of preeclampsia.
