This fully updated and revised 3rd edition of Preliminary References to the European Court of Justice provides a meticulous and yet easily accessible examination of all aspects of the preliminary reference procedure. A reference for a preliminary ruling is a request from a national court of an EU Member State to the European Court of Justice to give an authoritative interpretation on an EU act or a decision on the validity of such an act. Preliminary rulings have played a pivotal role in the development of the European Union. The European Union’s preliminary reference procedure has been copied by several other international organisations – including not least the European Economic Area (EEA) and the EFTA Court. Since the second edition, the European Court of Justice has rendered a considerable number of rulings which have led to important changes to the book. This is particularly reflected in the treatment of the Court’s acte clair doctrine, of preliminary references from administrative appeal boards and arbitration tribunals and of preliminary references regarding international agreements. And it is reflected in the interaction between the preliminary reference procedure and the European Convention on Human Rights as well as in a more general revision of the text bringing it up to date by taking into account new case law and new legal writings. With backgrounds as both practitioners and academics the two authors have produced a book that caters for the needs of both practitioners and academics.

This chapter examines to what extent and how the preliminary reference procedure provided in Article 267 TFEU can be used as a means for private parties to enforce EU law against the Member States. The procedure enables national courts to apply to the Court of Justice to obtain a ruling on the interpretation or validity of an EU legal act. It has in fact become a highly important means for private parties’ enforcement of EU law. Today, the preliminary reference procedure has attained such importance as an enforcement measure that the prospect of a reference to the Court of Justice can of itself induce a Member State party to proceedings before a national court to settle the dispute. Indeed, the preliminary reference procedure is sometimes referred to as ‘indirect enforcement’.

This chapter explains how the Andean Tribunal of Justice (ATJ) has significantly diverged from several foundational integration law doctrines developed by the European Union's Court of Justice (ECJ). As such, this updated analysis discusses how the ATJ refined the complemento indispensable principle to more clearly delineate the boundary between Community and national legal authority and to uphold the primacy of clear Andean rules. This principle is a doctrine that permits national laws and regulations to implement and fill gaps in Andean secondary legislation (known as Decisiones). The ATJ has also asserted the supremacy of Andean law over conflicting bilateral and multilateral treaties, and accepted preliminary references from administrative agencies and arbitral panels. In addition, the ATJ has for the first time addressed human rights, stating, albeit in dictum, that governments must prioritize the socio-economic rights of Community citizens over free trade and integration rules.

This book contains spectra of the doubly charged positive ions (dications) of some 75 molecules, including the major constituents of terrestrial and planetary atmospheres and prototypes of major chemical groups. It is intended to be a new resource for research in all areas of molecular spectroscopy involving high energy environments, both terrestrial and extra-terrestrial. All the spectra have been produced by photoionisation using laboratory lamps or synchrotron radiation and have been measured using the magnetic bottle time-of-flight technique by coincidence detection of correlated electron pairs. Full references to published work on the same species are given, though for several molecules these are the first published spectra. Double ionisation energies are listed and discussed in relation to the molecular electronic structure of the molecules. A full introduction to the field of molecular double ionisation is included and the mechanisms by which double photoionisation can occur are examined in detail. A preliminary chapter covers double photoionisation of an atom in order to explain the basic principles of the technique, then five chapters present spectra of molecules of increasing size. A seventh chapter on the new fields of core–core and core–valence double ionisations, with selected examples, completes the main body of the book. Appendices explain the detailed mechanisms of double photoionisation, the calibration of the electron spectrometers, and give a brief summary of the methods by which double ionisation energies are calculated theoretically.

Principle 6 is concerned with the establishment and role of truth commissions, outlined in two paragraphs. The Principle recommends criteria that can be applied ‘to the greatest extent possible’. The first paragraph encompasses three different aspects of the issue: the preliminary ‘decision to establish a truth commission’, the subsequent creation of its ‘terms of reference’, and the related determination of its ‘composition’. In the second paragraph, the term ‘role’ refers to the functional end-goal that a commission is expected to serve: ‘securing recognition of such parts of the truth as were formerly denied’. After providing a historical and contextual background on Principle 6, this chapter discusses its theoretical framework and the ways in which the Principle is exercised in practice.

This article sketches the political traditions of female rulership in medieval Europe. A brief introduction containing preliminary remarks on the history of research is followed by overviews of perceptions of gender and power and of the construction of queens as wives, mothers, and rulers. Coronation orders conceived of queenship with reference to biblical women and formulated a concept of participation in royal rulership that persisted through the high Middle Ages. The article then turns to differing traditions of political practice. Women could exercise political power through different functions and in diverse ways: as wives, as regents, or as reigning queens legitimated through inheritance and ruling in their own right. The mechanisms and strategies for obtaining and exercising power are illustrated by a few selected examples.

Some 767 arbitration cases have been initiated so far under the total of 3,324 bilateral investment treaties and other international investment agreements signed to date. This chapter provides an overview of the technical and fairly complex procedures for initiating proceedings and constituting tribunals in investment treaty arbitration. It examines the prevalent practices from the perspective of the International Centre for Settlement of Investment Dispute (ICSID) Convention and Rules, and other leading sets of international arbitration rules such as the United Nations Commission on International Trade Law Arbitration Rules, the Rules of Arbitration of the International Chamber of Commerce, and the Arbitration Rules of the Arbitration Institute of the Stockholm Chamber of Commerce, which are among the non-ICSID Rules more commonly referenced in investment treaties.

Esta circunstancia brindó una buena oportunidad de ensayar sobre el terreno una “lista de verificación”, con el fin de investigar la situación de la hepatitis en el país y la respuesta nacional a la enfermedad. Esta lista de verificación se elaboró específicamente para la misión y se ha revisado en muchas ocasiones después de este ensayo inicial, a partir de la retroinformación de numerosas personas. La lista se presenta ahora en el anexo 4 del manual como una guía temática para la evaluación de un programa nacional contra las hepatitis. La versión preliminar del manual se utilizó en el Pakistán, Arabia Saudita, Omán, Indonesia, Kuwait, Mongolia y Georgia durante las evaluaciones del país y como guía de la planificación del 2013 al 2015. A medida que se ampliaba el trabajo de la OMS en el campo de las hepatitis, los países empezaron a solicitar orientación para su elaboración de los planes nacionales contra las hepatitis. Dado que una respuesta integral a las hepatitis virales abarca muchas esferas de trabajo, fue importante reunir toda la orientación pertinente de la OMS a fin de facilitar la consulta. Por esta razón, la sección del manual sobre la planificación “general” es breve a propósito y contiene referencias a los documentos actuales de la OMS sobre esta disciplina de trabajo; se ha dedicado más espacio a la información y las orientaciones vigentes que son específicas de la respuesta a las hepatitis. El presente manual contiene referencias extensas a los documentos y enlaces sobre temas específicos como la seguridad de la sangre, la seguridad de las inyecciones, la vacunación y la reducción de daños, entre otros...
