Volatile substance abuse (VSA, solvent abuse, ‘glue sniffing’), carries a risk of sudden death (some 700 deaths in the UK, 1996-2006). However, mortality data take no account of the social cost of the habit. From press cuttings we have identified 508 instances (569 individuals: 507 male, median age 25 yr, range 8-51 yr and 62 female, median age 18 yr, range 11-36 yr) where VSA, either alone or together with alcohol/other drugs, was reported in association with criminal or antisocial behaviour that resulted in a criminal conviction or caution. Chapter 16 deals with contempt cases against journalists. Restrictions on freedom of the press have been striking at international criminal tribunals, where violations of protective measures granted to, for example, witnesses have led to several landmark yet controversial prosecutions of journalists for contempt of court. This chapter examines these practices from a human rights law perspective, as part of the recognized exceptions to the principle of public trials. In doing so, it reviews the law and jurisprudence of international and hybrid tribunals, including the International Criminal Tribunal for the former Yugoslavia (ICTY), the Special Tribunal for Lebanon (STL), and the International Criminal Court (ICC). In addition, it surveys contempt of court, offences against the administration of justice, and the law on reporting restrictions in a number of common law and civil law domestic jurisdictions. It concludes that the right to freedom of the press in the context of international criminal trials is not absolute, and that limits ordered by international tribunals, despite the polemics they may cause, are actually fully in line with both human rights law and domestic legal trends.

This chapter outlines a model regime of prior record enhancement (PRE), designed to promote more rational, parsimonious, and humane sentences. It provides general principles and specific rules reflecting what is known about PRE justifications, costs, benefits, and adverse consequences. The principles specify which punishment purposes justify PRE, while also recognizing the overarching importance of maintaining proportionality to conviction offense seriousness, ensuring that PREs are necessary and cost-effective, minimizing racial disparities and imprisonment of aging and nonviolent offenders, avoiding interference with offender efforts at desistance, and striking a reasonable balance between rule and discretion. The model’s PRE counting rules exclude juvenile and misdemeanor priors, convictions more than 10 years old, upweighting of felonies based on their severity or similarity, and custody status points. First offenders receive substantial sentence mitigation, after which PRE magnitude increases modestly and is capped. High-history offenders are punished no more than twice as severely as first offenders.

This chapter focuses on the work of Lord Radcliffe, a member of the Appellate Committee of the House of Lords and evidently a man greatly trusted by government. Lord Radcliffe presided over what was one of the most detailed inquisitions of journalism ever conducted in the United Kingdom, to which the press was legally bound to submit by virtue of the 1921 Act. Some of his judgments on press standards were excoriating. While few would be willing to justify the reporting criticized by Radcliffe, it is to be recalled that there was no evidence of any offence having been committed by any of the newspapers. The chapter also examines two important reports: the Committee on Security Procedures in the Public Service, a censored version of which was published in April 1962; and the detailed report of a Tribunal of Inquiry appointed to inquire into the Vassall case, the complete text of which was published in April 1963.
