<p>Durante os governos do Partido dos Trabalhadores (PT), o número de centrais sindicais cresceu no Brasil e uma acirrada competição por representatividade se estabeleceu entre elas. Este artigo tem como objetivo analisar como essa concorrência se manifestou no movimento sindical por meio do estudo de caso do sindicalismo de trabalhadores rurais, enfatizando as mudanças ocorridas na Confederação Nacional dos Trabalhadores Rurais Agricultores e Agricultoras Familiares (Contag), a principal entidade sindical desse segmento. A investigação foi realizada por meio de entrevistas com dirigentes e assessores sindicais, análise de documentos e imprensa sindical e observação de eventos de entidades selecionadas. Concluímos que a criação de novas centrais sindicais e a possibilidade de obter o seu reconhecimento legal nos anos 2000 estimularam alianças e rupturas no sindicalismo de trabalhadores rurais, as quais levaram à formação de novas entidades rurais e retroalimentaram o processo de criação de centrais.</p><p><strong>RURAL WORKERS’ UNIONISM AS AN OBJECT OF DISPUTE AND AS AN AGENT FOR THE CREATION OF UNION FEDERATIONS IN BRAZIL (2003-2017)</strong><br /><br />During the Worker’s Party (Partido dos Trabalhadores – PT) governments the number of union federations grew in Brazil, establishing a fierce competition<br />for representation between them. This article analyzes how this competition manifested in the labor movement by the case study of rural workers’<br />unionism, emphasizing the changes that occurred in the Confederação Nacional dos Trabalhadores Rurais Agricultores e Agricultoras Familiares (Contag), the main union entity in this segment. The study comprised interviews with union leaders and advisors, analysis of documents and union press and observation of events from selected entities. We conclude that the creation of new federations and the possibility of obtaining their legal recognition in the 2000s promoted alliances and ruptures in rural workers’ unionism, leading to the formation of<br />new rural entities and fed back into the process of creating union federations.</p><p>Keywords: Union Federations. <p><span>O artigo se propõe a identificar os impactos iniciais da reforma trabalhista sobre o sindicalismo em um contexto desfavorável aos trabalhadores e à ação coletiva, dado o crescimento da precariedade e da informalidade no mercado de trabalho. A análise trata da reconfiguração das classes trabalhadoras e da fragmentação sindical, bem como dos impactos da reforma sobre as estratégias e ações sindicais e sobre as negociações coletivas. A metodologia combinou pesquisas quantitativas sobre mercado de trabalho com análise documental (instrumentos normativos, matérias de imprensa comercial e sindical) e observação participante. Os resultados mostram que os sindicatos buscam se adaptar ao novo contexto, com pequenas inovações substantivas na ação e organização, e que as negociações têm sido tanto espaço de resistência quanto de legitimação do conteúdo da reforma.</span></p><p> </p><div><p class="trans-title"><strong>LABOR REFORM: precarious work and the challenges for unions</strong></p><p>The paper proposes to identify the initial impacts of the labor reform on trade unionism, in a context that is unfavorable to workers and to collective action, resulting from the transformations in the reconfiguration of the working classes, with the growth of precariousness and crisis of the labor market. The analysis focuses on the impacts of this reconfiguration of the working classes and the fragmentation of trade unions, as well as the impacts of the labor reform on union strategies and actions and on collective negotiation. The methodology combined quantitative labor market research with documents (collectives work contracts, commercial and trade union press materials) and participant observation. The results show that the trade unions are searching to adapt to the new context with some substantive innovations in action and organization. Abstract:
The article presents the main aspects of organisation, formation and management of a syndicate of banks in the syndicated lending market. A syndicated loan is provided to a borrower by two or more creditor banks on equal terms within one loan documentation package. This market has the following main characteristics: significant amounts of financing; transactions are organised and syndicated by the largest investment and commercial banks; standard legal documentation; centralisation of agency function. The syndication process is a key factor in a successful transaction in the syndicated lending market. The research objective is a structured description of the syndication business process in the credit market. The following tasks have been set and solved: 1) determining the optimal syndication schedule; 2) transactional and legal documents classification; 3) development of methods of risk management of the syndication process. The methodological basis is the process approach to the formation of a syndicate and the role distribution among the bank transaction participants (organisers, underwriters, bookrunners, agents). Based on the regulatory specifics of syndicated lending, legal documents of the process (mandate letter, confidentiality agreement, syndication letters) have been described. The optimal schedule has been proposed to implement a syndicated loan transaction. It includes five stages: 1) planning; 2) formation of a “senior” syndicate; 3) formation of a “common” syndicate; 4) management of the final structure of the syndicate; 5) legal closing of the transaction. Marketing materials (investment presentation, information memorandum) and key transaction activities (press releases publication and bank meeting) have been examined. Key risks of syndicated lending have been defined and described; they include market risk underwriting and funding. From a practical point of view, the article is of interest for representatives of the Russian commercial and investment banks and corporate borrowers who plan to attract corporate financing in the international syndicated lending market.

Anthony Bellanger est secrétaire général de la Fédération internationale des journalistes. Établie en 1926, la FIJ regroupe aujourd’hui près de 190 syndicats et associations de 150 pays. Sa création fait suite au mouvement de création et d’internationalisation du mouvement syndical et associatif. Dès les années 1890, de nombreux regroupements de journalistes ou d’éditeurs organisent des congrès pour échanger sur les pratiques professionnelles et partager les expériences de défense du journalisme. A leur suite, la FIJ va tenter de fédérer les initiatives et de promouvoir « l’action collective pour défendre les droits de l’homme, la démocratie et le pluralisme des médias ». Elle soutient les organisations de journalistes locales ou nationales pour faire valoir leurs droitssyndicaux et professionnels, et contribue à la prévention des risques, à la sécurité des journalistes et à la dénonciation des violences. Anthony Bellanger a été journaliste de la presse régionale et dirigeant syndical en France.

Certains acteurs s’impliquent simultanément dans les deux réseaux, à l’instar de Freinet. Au-delà de la figure emblématique de ce grand pédagogue qui développe un mouvement spécifique autour de ses propres techniques, on peut observer diverses formes d’expression des thèmes de l’Éducation nouvelle à l’intérieur du syndicalisme. Idées et pratiques se diffusent au sein des espaces de débats ouverts par les périodiques. En procédant à une comparaison des grandes revues syndicales des années 1920 au début des années 1930 – L’École émancipée (révolutionnaire) et la Revue de l’enseignement primaire qui laisse place à L’École libératrice en 1929 (réformistes) –, l’article analyse le positionnement des deux courants syndicaux vis-à-vis de Freinet et de l’Éducation nouvelle en général (notamment de la revue Pour l’Ère nouvelle).

Cet article analyse les projets de réforme de l’évaluation des enseignants en France depuis la fin des années 1990 ainsi que les réactions, notamment syndicales, qu’ils ont suscitées. Cette évaluation est considérée comme un analyseur privilégié pour étudier les réactions des enseignants au développement de nouvelles politiques de reddition de comptes.A partir de méthodes qualitatives (entretiens, analyse de dépêches de presse et de corpus de documents), il étudie plus spécifiquement les systèmes de négociation des différents projets de réforme d’une évaluation régulièrement contestée mais jamais réformée au moment où nous terminons cet article.Adoptant une perspective de sociologie de l’action publique, il envisage les échecs de ces différents projets non pas comme le résultat d’une culture de contestation particulièrement prononcée parmi les syndicats d’enseignants dans un système certes encore fortement régulé de manière corporatiste ; mais comme la conséquence de la mise en œuvre de différents répertoires d’action publique par les acteurs de ce dossier. Selon leur mise en adéquation plus ou moins grande avec la configuration d’action publique d’ensemble dans laquelle ils sont déployés, ces répertoires produisent des mouvements de politisation ou de dépolitisation plus ou moins propices au changement.Après avoir décrit le système d’évaluation actuellement en vigueur en France, ainsi que les problèmes qu’ils posent et qui ont été identifiés à maintes reprises, nous analysons quatre séquences d’action publique (deux statuquo et deux projets de réforme) et mettons en évidence le déploiement de trois répertoires d’action publique différents : statutaire-conservateur (1997-2009), managérial-réactif (2009-2012) et professionnaliste-coopératif (2012-2016).

Abstract Equity markets fail to account for the value-relevant nonpublic information enjoyed by syndicated loan participants and reflected in publicly posted loan prices. A long-short strategy that buys (sells) the equities of firms with recently appreciated (depreciated) loans earns large risk-adjusted returns, suggesting a surprising and economically important level of segmentation across the same firm’s capital structure. The information lag captured by trading strategy returns is not affected by drivers of firm-specific attention, including the publication of loan returns in the Wall Street Journal. Instead, returns to the strategy are eliminated among equities held by mutual funds also trading in syndicated loans. De Vlaamse afdeling van de Belgische Pers-bond kwam in Gent tot stand in 1888. Ze verenigde journalisten van alle politieke strekkingen met uitzondering van Vlaams-nationalistische. De verdediging van enkele specifieke belangen die deels ruimer en deels beperkter dan syndicale belangen waren, bleef het voornaamste bindmiddel. Op het politieke terrein bleef ze strikt neutraal. Onder het Duitse bezettingsregime van 1914-1918 bleef het merendeel van de journalisten actief, ondanks de censuur, wat na de oorlog tot spanningen leidde.________The Flemish Section of the Belgian Press Association and the First World War (1887-1918)The Flemish section of the Belgian Press Association came into being in Ghent in 1888. It united journalists from all political tendencies, expect Flemish nationalist. The defence of a few specific interests that were in some ways broader and in some ways narrower than union interests remained the primary link between members. On the political field, the Flemish section remained strictly neutral. Under the German occupation regime of 1914-1918 the majority of journalists remained active despite censorship, which led to tensions after the war.

AbstractThe past four decades have witnessed profound transformations in the Egyptian legal system and in the Egyptian legal profession. Article 2 of the Egyptian Constitution now enshrines Islamic jurisprudence as the principle source of law, thus establishing an important symbolic marker at the heart of the state and opening avenues for Islamist activists to press litigation campaigns in the courts. Additionally, the Islamist trend gained prominence within the legal profession, a development that is particularly striking given the long and illustrious history of the Lawyer's Syndicate as a bastion of liberalism. Despite these significant shifts, however, Islamist litigation has achieved only limited legal victories. This article traces the political and socio-economic variables that underlie the Islamist trend in Egyptian law, and examines the impact of Islamist litigation in the Egyptian courts.

One of the less noticed events of the “January 25 Revolution,” as Egyptians call the popular uprising that ousted President Hosni Mubarak, is the formation of the Egyptian Federation of Independent Trade Unions (EFITU). Its existence was announced at a press conference on January 30, 2011, in Cairo's Tahrir Square—the epicenter of the popular movement. The independent unions of Real Estate Tax Authority workers, healthcare technicians, and teachers established since 2008 initiated the new federation. They were joined by the 8.5 million-member retirees' association, which has just received permission to reorganize itself as a professional syndicate, as well as representatives of textile, pharmaceutical, chemical, iron and steel, and automotive workers from industrial zones in Cairo, Helwan, Mahalla al-Kubra, Tenth of Ramadan, and Sadat City. The independent trade union federation was the first new institution to emerge from the popular uprising, and it linked the cause of workers to what was, after January 28, an explicitly revolutionary movement.

This essay looks at the American popular reception of modernist little magazines and of writers who were regularly published there, including James Joyce and Gertrude Stein. In the 1920s, book reviewers, syndicated daily book columnists who reached millions, and celebrity columnists took notice of authors or books that were considered news. Experimental modernist writing was frequently discussed, even when it had appeared in obscure little magazines. Even editorials in major newspapers debated literary trends. This national conversation about modernist writing has been largely ignored by critics, although it dramatically affected the canonization of writers in this period. Examining the popular understanding of modernism rather than the ways modernists understood popular culture reveals that there was an intimate exchange between literary modernism and mainstream culture and that modernist writers and texts were better known and, indeed, more popular than has been previously acknowledged.

Après avoir revu les principes s'appliquant en droit français, québécois et anglais, dans les provinces canadiennes de common law et américain, le Conseil a fait l'étude de la notion d'« employé » que l'on retrouve à l'article 107 du Code. Il conclut que toute personne visée par une demande d'accréditation, économiquement subordonnée à un employeur et qui n'est pas un entrepreneur, est un « employé » au sens du Code. Ayant constaté que les critères développés par le common law l'ont été en fonction d'objectifs étrangers à ceux promus par le Code canadien du travail, le Conseil conclut qu'ils ne pourront s'appliquer que dans la mesure où ils sont compatibles avec les objectifs dudit Code. Dans ce contexte, d'autres critères, dits de relations de travail trouveront application. Le Conseil a également énoncé sa politique quant aux délais de présentation prévus à l'article 124 (2) c) et d) du Code et la recevabilité de requêtes en accréditation visant une unité dont la délimitation diffère de celle pour laquelle une convention collective est en vigueur. En l'espèce, le Conseil a jugé recevables, quant aux dates où elles avaient été présentées, des requêtes en accréditation visant une unité englobant des employés couverts en partie par deux conventions collectives distinctes et s'étendant sur des périodes différentes. AbstractNon-Germans—particularly “displaced persons”—were routinely blamed for crime in occupied western Germany. The Allied and German fixation on foreign gangs, violent criminals, and organized crime syndicates is well documented in contemporary reports, observations, and the press. An abundance of such data has long shaped provocative historical narratives of foreign-perpetrated criminality ranging from extensive disorder through to near uncontrolled anarchy. Such accounts complement assertions of a broader and more generalized crime wave. Over the last 30 years, however, a literature has emerged that casts doubt on the actual extent of lawlessness during the occupation of the west and, in turn, on the level non-German participation in crime. It may be that extensive reporting of non-German criminality at the time reflected the preexisting bigotries of Germans and the Allies, which when combined with anxieties about social and societal integrity became focused on the most marginalized groups in postwar society. This process of “group criminalization” is common and can have different motivations. Regardless of its cause, it was clearly evident in postwar western Germany and we hypothesized that it should have created harsher outcomes for non-German versus German criminal defendants when facing the Allied criminal justice system, such as greater rates of conviction and harsher punishments. This hypothesis was tested using newly collected military government court data from 1945 to 1946. Contrary to expectations, we found a more subtle bias against non-Germans than expected, which we argue reveals important characteristics about the US and British military government criminal justice system.

Design – Asynchronous online survey and activity. Setting – A small private, liberal arts college in the southeastern United States of America. Subjects – Participants included 511 incoming first-year college students. Methods – Using the Moodle Learning Management System, incoming first-year students completed a mandatory questionnaire that included multiple choice, Likert scale, open-ended, and true/false questions related to news consumption. Two questions asked students to identify which news sources and social networking sites they have used recently, and the next two questions asked students to define fake news and rate the degree to which fake news impacts them personally and the degree to which it impacts society. The end of the survey presented students with screenshots of three news stories and asked them to reflect on how they would evaluate the claim in the story, their confidence level in the claim, and whether or not they would share this news item on social media. The three items chosen represent certain situations that commonly cause confusion for news consumers: (a) a heading that does not match the text of the article, (b) a syndicated news story, and (c) an impostor URL and fake news story. Researchers coded the student responses using both preset and emergent codes. Main Results – Eighty-two percent of students reported using at least one social media site to access political news in the previous seven days. Students reported believing that fake news is a worrying trend for society, with 86% labelling it either a “moderate” or “extreme” barrier to society’s ability to recognize accurate information. However, they expressed less concern about their own ability to navigate an information environment in which fake news is prevalent, with 51% agreeing that it has only somewhat of an effect on their own ability to effectively navigate digital information. Of the three news items presented to them, students expressed the least confidence (an average of 1.55/4) and least interest in sharing (12%) the first news item, in which the heading does not match the text. However, only 14% of respondents noted this mismatch. In evaluations of the second item, an AP news item on the Breitbart website, 35% of students noted the website on which the article was found, but fewer noted that the original source is the Associated Press. Student responses to the third article, a fake news item from a website masquerading as an NBC website, show that 37% of students believed the source to come from a legitimate NBC source. Only 7% of students recognized the unusual URL, and 24% of respondents indicated that they might share this news item on social media. Conclusion – The study finds that impostor URLs and syndicated news items might confuse students into misevaluating the information before them, and that librarians and other instructors should raise awareness of these tactics.
