La résidence alternée, légalisée en France en 2002, est une pratique minoritaire qui touche toutes les catégories de la population des parents séparés. Elle est entendue de manière stricte comme une organisation qui sépare de façon égale les temps de résidence des enfants entre leurs deux parents. Sous ce principe de symétrie coparentale, le temps vécu par les parents est bichronique, marqué par la succession réitérée de temps de même dimension, les uns avec enfants et les autres sans. Nous explorons l’expérience temporelle de cette parentalité alternée à partir d’une méthode mixte qui croise l’analyse de 55 entretiens avec le traitement de 5 103 questionnaires passés auprès des allocataires de la Caisse d’allocations familiales qui ont des enfants en résidence alternée. Dans une première partie, nous contextualisons la question de la résidence alternée dans la France contemporaine. Nous présentons une cartographie des polémiques qu’elle soulève, précisons les évolutions juridiques et les modalités judiciaires de sa mise en place, avant de remarquer que les études existantes sur cet objet sont peu nombreuses et souvent partielles. Si les déterminants socio-économiques du choix de la résidence alternée sont assez bien connus, le fonctionnement concret des alternances est peu étudié. Notre contribution consiste à ouvrir cette boîte noire. Nous inscrivons notre recherche dans une perspective temporaliste qui consiste à interroger les temps différenciés de l’expérience humaine. Dans la deuxième partie, nous caractérisons l’économie générale du cadre temporel de la résidence alternée, en montrant que le partage égal des temps de résidence ne peut se soustraire au temps calendaire dominant. Les deux espaces créés dans ces conditions se constituent en territoires temporels sur lesquels chacun des parents exerce une souveraineté relative selon des règles qui se construisent à l’usage. Nous proposons une topologie des territoires de l’alternance, attentive à leur structure et à leur plasticité. Dans la troisième partie, nous envisageons l’expérience parentale de la succession des temps avec et sans enfant en commençant par préciser les différences de texture temporelle, avant de décrire les modalités de la concordance de ces temps. Nous terminons en changeant d’échelle temporelle pour interroger l’évolution de l’expérience parentale de l’alternance dans la durée, quand elle est confrontée à la survenance de divers événements comme la recomposition familiale ou la mobilité professionnelle. It is strictly understood as an arrangement in which the residence times of children is equally shared between their two parents. According to the principle of coparental symmetry, the parents’ experience of time is bichronic, marked by the repeated succession of periods of time of equal length, some with children and others without. We explore the temporal experience of this alternate parenthood using a mixed method that combines the analysis of 55 interviews and 5,103 questionnaires sent to French Family Allowance Fund who have children in shared residence. The first part contextualizes the question of shared residence in contemporary France. The thesis maps the controversies it raises, specifies the legal developments and judicial modalities of its implementation, before noting that existing studies on this subject are few and often partial. While the social and economic determinants of the choice of shared residence are fairly well known, the concrete functioning of alternating residence is not well studied. Our research adopts a temporalistic perspective that consists in questioning the differentiated times of human experience. In the second part we characterize the general economy of the temporal framework of alternate residence, showing that the equal sharing of residence times cannot escape the dominant calendar time. The two spaces created in these conditions are constituted into temporal territories over which each parent exercises relative sovereignty according to rules that are built incrementally. We propose a topology of the territories of alternation, attentive to their structure and plasticity. In the third part, we consider the parental experience of time sequences with and without children by first specifying the differences in temporal texture, before describing the modalities of time harmonization. We conclude by looking at the issue from a long term perspective to question the evolution of the parental experience of alternation over time, when it is confronted with events such as family reconstitution or professional mobility. Throughout the thesis, we are attentive to variations in the organization and temporal experience of shared residence according to major sociological variables, gender, age, social background or parents' place of residence

Shared residence was previously viewed with suspicion by the judiciary, but following D v D [2001] a line of cases has developed, where this order is said to benefit children, firstly, by helping them feel cherished, and, secondly, by improving parental cooperation and thus protect children from the harmful effects of exposure to their conflicts. This thesis reviews available research to conclude that shared residence is so unlikely to achieve either objective where it is ordered against a parent's wishes, that the order should be restricted to families where both parents agree. Autopoietic theory is combined with feminist critique to explain the selfreferential nature of law, its tendency to prioritise children's abstract need for fathers and its inability to fully understand parents' complex disputes. The thesis compares the preconditions for, and use of, shared residence in England and in Sweden, concluding that despite better preconditions, Swedish court-imposed shared residence arrangements are unlikely to last, and can harm children by increasing their exposure to conflict. There is also, in contested cases, a worrying focus on equal rights for parents, with children who have grown up in these arrangements complaining of feeling objectified. This, combined with a growing emphasis in English case law on sending symbolic messages about status, is a strong argument against a shared residence presumption. It seems naïve to assume that new, collaborative co-parenting patterns can develop after separation merely because law coerces the adults into a particular kind of formal arrangement. The suspicion is therefore raised that law's agenda is in fact something very different: to mask familial and societal change by making post-separation families conform to a binuclear pattern which resembles the nuclear ideal not only in membership but also in its hierarchical structure.

The present thesis examines the themes of ‘shared history,' ‘place-making,' and ‘reconciliation' to assess how these come together in the establishment of an Aboriginal identity in Perth, Western Australia. Focusing on individuals who do not represent the common stereotypes associated with Aboriginal Australians, it will be demonstrated that these individuals are forced into an in-between place where they have to continually negotiate what Aboriginality means in the twenty-first century. Taking on this responsibility they become mediators, stressing a ‘shared history' in order to create a place for themselves in the non-Aboriginal landscape and to advance reconciliation between Aboriginal and non-Aboriginal Australia by fighting the dominant discourse from within. Beginning with the State and Government's Native Title appeal premiss that Nyungar never existed, this thesis will examine this claim by first presenting an account of the history of southwest Western Australia to establish the place Aboriginal people have been forced into by the colonists during early settlement, and the processes of which extend into the present day. From there on in the focus will be on individual Aboriginal people and their careers and businesses, examining how they attempt to redefine what is perceived and accepted as Aboriginality through different interaction and mediation ‘tactics' with non-Aboriginal Australians. Finally, this thesis will take a closer look at the reconciliation movement in Australia and the people involved in it. It will determine different approaches to reconciliation and assess their possibility and meaning for the construction of a twenty-first century Aboriginal identity. The thesis will conclude that although Nyungar are forced into the dominant discourse, their resistance from within credits a new kind of Aboriginality that is just as valid as the ‘traditional' and ‘authentic' Aboriginality imagined by non-Aboriginal Australia.

Modernisierungstheoretischen Annahmen zufolge sind soziale Beziehungen in Gesellschaften der zweiten Moderne keine gegebenen Größen mehr, sondern Gegenstand von Aushandlungsprozessen, handlungsleitende gesellschaftliche Wissensvorräte erodieren und das bürgerliche Kernfamilienmodell sieht sich zunehmend soziokulturell legitimierten Alternativen gegenüber. Zahlreiche Wandlungstendenzen von Familie lassen sich ablesen, unter diesen die Zunahme von Fortsetzungsfamilien nach Trennung und Scheidung und im Zuge dessen die Aufweichung der monolokalen Haushaltsbindung von Familie. Diese Dynamiken werfen die Frage nach der Ausgestaltung der Herstellungsleistungen von Familie auf, die mit Doing und Displaying Family im Rahmen einer praxistheoretischen Wende innerhalb der Familiensoziologie bereits angeschnitten sind. Hier setzt das Forschungsinteresse der vorliegenden Arbeit an: (1) Bereits vorliegende empirische Erkenntnisse und theoretisch-konzeptuelle Überlegungen maßgeblicher Forschungsfelder werden zusammengeführt und diskutiert. (2) Aus praxeologisch-wissenssoziologischer Perspektive richtet die Empirie der vorliegenden Studie ihre Aufmerksamkeit auf die Rekonstruktion familialer Identitätspolitiken und der Herstellung von Gemeinschaft im sogenannten paritätischen Wechselmodell, in dem Kinder regelmäßig und zu gleichen Teilen an den Orten der getrenntlebenden Eltern wohnen. Mit den Befunden kann gezeigt werden, dass eine von Eltern und Kindern geteilte Differenzthese zentraler Ankerpunkt für die Identitätskonstruktionen der untersuchten Familien bildet. Zwei Familienkerne stehen sich nach der Relokalisierung eines Elternpaares im Zuge der Auflösung ihrer Zweierbeziehung als zwei Familienwirklichkeiten mit je unterschiedlichen Behauptungen sozialer Ordnung gegenüber. In diese müssen sich die Kinder aktiv einpassen bzw. regelmäßig durch die monolokalen Familienmitglieder re-integriert werden. Die Behauptung und Stabilisierung der lokalen Ordnungen wird über fünf Formen physischer und symbolischer Schließung als Teil familialer Identitätspolitiken abgesichert: (1) kommunikativ, (2) räumlich, (3) personell, (4) materiell und (5) habituell. Zwischen materieller und habitueller Schließung zu verorten, wurde das Olfaktorische als Medium der Vergemeinschaftung identifiziert. Das empirische Material eröffnet zudem einen Blick auf die Normalisierungsstrategien der untersuchten Eltern und Kinder im Umgang mit extern herangetragenen Markierungen von Andersartigkeit, Abweichungsvermutungen und der Normalisierungsmacht des bürgerlichen Kernfamilienmodells. Guiding social knowledge is eroding and the nuclear family model is increasingly confronted with sociocultural legitimate alternatives. There are numerous transformations of the family observable – among these increasing numbers of families after separation and divorce, and in consequence the dissolution of the monolocal household family in favour of multi-local family arrangements. These dynamics raise the question of Doing and Displaying Family practices, addressed within the framework of a practice turn within family sociology. Main aim of this paper is (1) to discuss existing empirical findings and theoretical/conceptual considerations of relevant research fields, and (2) by employing a praxeological approach, to focus on identity politics as a means to establish and stabilize family identity and belonging within shared residence arrangements where children regularly shuttle between their separated parent’s households. Data suggest that passive multi-locally living parents and their partners oscillate between referring to the other household on behalf of the active multi-locally living children to create a cross-spatial sense of commonness and belonging and at the same time applying territorialisation practices to promote a place-bound social order and family identity. This includes processes of communicative, spatial, personal, material, and habitual closure. Moreover, in a way between material and habitual closure, the olfactory was identified as a medium of identification and distinction. However, children face the challenge to merge both residential places and family nuclei into a coherent whole and simultaneously need to distinguish between different family sociotopes. Moreover, the empirical material provides insights into the normalization strategies of parents and children in dealing with externally applied difference markers, deviance attributions and the normalization power of the nuclear family model. The basis of the empirical research is a multiple methods comprising qualitative research design. Narrative interviews, group discussions and visual methods were employed. Abstract, key words Title of the thesis: Shared residence in Czech and German law The aim of this thesis is to compare the approach to shared residence in the legal order of the Czech Republic and the Federal Republic of Germany, i.e. to find out to what extent the approaches of these countries to shared residence differ. This is examined in relation to selected issues which courts had to deal with when deciding on the shared residence, i.e. the influence of the child's wishes, the parents' will, their ability to communicate and long distance between the parents' households on the suitability of shared residence. Special attention is paid to the presumption of shared residence, or shared residence as a rule. The thesis focuses on the effective regulations. The thesis is divided into three parts. The first part deals with the Czech regulation of the shared residence. The individual chapters explain basic terminology, sources of law, legal regulation of shared residence, case law on the selected issues, including the presumption of shared residence, and some of the specifics of maintenance obligation. The second part of the thesis follows the same structure as the first part. However, there is a special chapter regarding drafts on shared residence as a rule. Perante estas situações ou perante uma situação em que os progenitores da criança decidem não partilhar uma vida marital ou quando se verifica uma situação de união de facto, torna-se imperativo determinar como será regulado o exercício das responsabilidades parentais. O aumento desses casos de divorcio e de separação dos progenitores repercutiu-se num incremento dos pedidos de regulação das responsabilidades parentais, que pode ocorrer mediante um acordo entre os progenitores, previsto no artigo 1905.º, n.º 1 do Código Civil, atendendo as necessidades de todos os envolvidos.No âmbito do exercício das responsabilidades parentais, estatuído nos artigos 1905.º a 1912.º do Código Civil, regulam-se questões inerentes a relação da criança com os progenitores. Uma das questões tidas em consideração é a fixação da residência da criança, o foco desta dissertação. A determinação da residência do filho, influência outros pontos da regulação do exercício das responsabilidades parentais. A presente investigação, tem como ponto de partida o estudo de situações em que o Tribunal, terceiro imparcial, é chamado a decidir sobre a fixação da residência de uma criança, no âmbito de um processo de regulação do exercício das responsabilidades parentais. Pretende-se analisar qual a posição dominante na jurisprudência dos tribunais portugueses, verificando o regime estabelecido para a mesma, assim como as diversas posições doutrinais sobre o tema, cuja dissertação será abordada numa perspetiva da jurisprudência e doutrina nacional atendendo a sua aplicação na atualidade.<br>The cases of divorce and separation are an evident reality, in our current society. Before these situations or before a situation in where the child's progenitors decide not to share a marital life or when a situation of union is verified, it becomes imperative to determine how the exercise of the parental responsibilities will be regulated. The increase of those cases of divorce and of the progenitors' separation it was echoed in an increment of the requests of regulation of the parental responsibilities, that can happen by an agreement among the progenitors, foreseen in the article 1905.º, n.º 1 of the Civil Code, assisting the needs of all involved them.In the extent of the exercise of the parental responsibilities, present in the goods 1905.º to 1912.º of the Civil Code, inherent subjects are regulated the child's relationship with the progenitors. One of the subjects had in consideration is the fixation of the child's residence, the focus of this dissertation. The determination of the son's residence, influences other points of the regulation of the exercise of the parental responsibilities.The present investigation has as starting point the study of situations in that the Court, third impartial, that is called to decide about the fixation of a child's residence, in the extent of a process of regulation of the exercise of the parental responsibilities. Intends to analyse which is the dominant position in the jurisprudence of the Portuguese courts, verifying the established regime for the same, as well as the several doctrinal positions on the theme.

Purpose The purpose of this thesis is to develop a conceptualized model, which identifies the significant variables of perceived risk for current Airbnb users towards becoming a host of their own residence on Airbnb’s platform. There is a lack of information concerning the host’s risk perception to cross the trust barrier in order to become a host on Airbnb (Ter Huurne, et al., 2017). For Airbnb it is of significant importance to provide new residences since it contributes to the growth of its platform. Likewise, it applies to managing potential risks in order to generate a positive vicious circle with the absence of trusted authorities or third parties (Wu, et al., 2017). Methods A new applicable model was constructed that served as the conceptual framework for this thesis. The model consists of twelve variables, where each variable has a possible influence on the overall perceived risk for Airbnb users to become a host of their own residence on Airbnb’s platform. The survey embodied the perceived risk variables and applied a predetermined set of answers. A prerequisite was that the respondents were familiar with the platform Airbnb by having a registered account. Findings There was found to be a discrepancy between millennials’ and non-millennials’ perception of risk. Millennials found financial risk, privacy risk (payment), social risk (neighbours), physical risk, and lack of control risk to be significant. Non-millennials found performance risk, privacy risk (in-house), and lack of control risk to be significant. Both models showed that the variable ‘lack of control’ was the biggest influencer on overall perceived risk. The results also indicate that millennials are more susceptible to let financial benefits outweigh their perceived risk in comparison to non-millennials, whereas social benefits are perceived similarly. On a last note, non-millennials’ overall risk perception was found to be considerably higher than for millennials. Implications The results present a conceptual model that is based on perceived risk for e-commerce (Featherman &amp; Pavlou, 2003). Moreover, this conceptual model added the components physical risk (Jacoby &amp; Kaplan, 1972) and lack of control risk (Das &amp; Teng, 2004) in order to identify overall perceived risk for Airbnb users to become a host of their own residence on Airbnb’s platform.

Dissertação de mestrado em Direito das Crianças, Família e Sucessões<br>Este trabalho propôs-se a desenvolver estudos comparativos entre o ordenamento jurídico português e o brasileiro no concernente à prática da residência alternada (dupla residência) da criança pós-divórcio ou separação, com o intuito de avaliar se há viabilidade jurídica para a sua aplicação, bem como se tal instituto tem efetiva incidência nos processos em que sejam reguladas as responsabilidades parentais e em que circunstâncias. Para tanto, examinaram-se as origens dessa dinâmica de organização familiar pós-divórcio que remonta aos Estados Unidos da América, na figura da joint physical custody, abordando o seu conceito e principais atributos, após o que se adentrou no contexto jurídico de países como a Espanha e França, onde o instituto já usufrui de mais aceitação social e jurídica, através do cotejo doutrinário e jurisprudencial. A seguir, dedicou-se um capítulo para o estudo do ordenamento jurídico brasileiro com foco no poder familiar, discorrendo-se acerca das modalidades de guarda admitidas pela legislação civilista, além de se examinar como os tribunais brasileiros se posicionam atualmente a respeito da dupla residência da criança após divórcio, no contexto da guarda compartilhada e, por fim, expôs-se os casos de inaplicabilidade do instituto. O último capítulo é dedicado ao estudo do ordenamento jurídico português, ocasião em que se teceu breve evolução legislativa do exercício exclusivo do poder paternal ao exercício conjunto das responsabilidades parentais a partir da Lei nº 61/2008, bem como se avaliaram as principais repercussões dessa reforma legislativa no tocante à residência da criança, à luz do art.º 1.906º do Código Civil Português (CCP). Ademais, destacaram-se os posicionamentos doutrinários desfavoráveis à aplicação do instituto, bem como se examinou o posicionamento da jurisprudência portuguesa no que tange à residência alternada da criança pós- divórcio. O presente estudo pretendeu, pois, demonstrar que ambos os países possuem embasamento jurídico para a implementação da alternância de residência da criança após divórcio, contudo há premente necessidade de se ampliar o debate sobre o tema, considerando ainda haver grande resistência, principalmente no Brasil, em se aplicar tal modalidade de arranjo familiar, que tanto favorece a coparentalidade e atende às necessidades da criança de vinculação afetiva com ambos os progenitores.<br>The purpose of this study was to develop comparative studies between the Portuguese and Brazilian legal systems concerning the practice of shared residence (shared physical custody) of the child after divorce or separation, in order to assess whether there is legal feasibility for its application, as well as whether such institute has an effective impact on the processes in which parental responsibilities are regulated and under what circumstances. For this purpose, we examined the origins of this dynamics of post-divorce family organization that goes back to the United States of America, in the figure of the joint physical custody, addressing its approaching and main attributes, after this it was inserted in the legal context of countries as Spain and France, where the institute already enjoys more social and legal acceptance, through the doctrinal and jurisprudential comparison. Next, a chapter was devoted to the study of the Brazilian legal system with a focus on parental responsibility, discussing the modalities of custody allowed by civil law, and examining how the Brazilian courts currently stand on dual residence of the child after divorce, in the context of shared custody, and, finally, the inapplicability of the institute were exposed. The last chapter is devoted to the study of the Portuguese legal system, in which legislative brief was developed from the exclusive exercise of parental responsibility to the joint exercise of parental responsibilities as of the Law under n. 61/2008, as well as evaluating the main repercussions of this legislative reform on the child's residence in the light of Article 1.906 of the Civil Code. In addition, the doctrinal positions unfavorable to the application of the institute were highlighted, as well as the positioning of the Portuguese jurisprudence regarding the shared residence of the post-divorce child. The present study aimed to show that both countries have a legal basis for the implementation of the child's shared residence after divorce, but there is a strong need to broaden the debate on this topic, considering that there is still great resistance, especially in Brazil, in applying this modality of family arrangement, which both favors co-parenting and meets the needs of the child of affective attachment with both parents.

Main aim of this paper is (1) to discuss existing empirical findings and theoretical/conceptual considerations of relevant research fields, and (2) by employing a praxeological approach, to focus on identity politics as a means to establish and stabilize family identity and belonging within shared residence arrangements where children regularly shuttle between their separated parent’s households. Data suggest that passive multi-locally living parents and their partners oscillate between referring to the other household on behalf of the active multi-locally living children to create a cross-spatial sense of commonness and belonging and at the same time applying territorialisation practices to promote a place-bound social order and family identity. This includes processes of communicative, spatial, personal, material, and habitual closure. Moreover, in a way between material and habitual closure, the olfactory was identified as a medium of identification and distinction. However, children face the challenge to merge both residential places and family nuclei into a coherent whole and simultaneously need to distinguish between different family sociotopes. Moreover, the empirical material provides insights into the normalization strategies of parents and children in dealing with externally applied difference markers, deviance attributions and the normalization power of the nuclear family model. The basis of the empirical research is a multiple methods comprising qualitative research design. Narrative interviews, group discussions and visual methods were employed. Data are analysed by means of the documentary method for text and picture interpretation within a qualitative reconstructive approach.
