Abstract:
This article explores the remedies available to victims of the international crime of trafficking in persons for sexual exploitation. In the 2009 case of AT v Dulghieru (Dulghieru), the English High Court awarded the victims of an unlawful conspiracy to traffic general, aggravated and exemplary damages. Treacy J based the exemplary award on the rationale of preventing unjust enrichment. The appropriateness of the finding of unlawful means conspiracy is considered, as are each of the damages awards. This article concludes that the prevention of unjust enrichment is an inappropriate basis for an award of exemplary damages, and argues that the better approach would be to strip a defendant's gains by the equitable remedy of account of profit. The overlap of civil remedies and the criminal law is also addressed. It is proposed that an account of profit should take priority over any criminal confiscation order as the victims have a greater entitlement to the profits than the State does.

Herbs from the kitchen are not complicated to take as a medicine. Regular use of a few herbs in the straightforward form proves its importance as a medicine. In this article a review of herbs is done which we are available in our kitchen, we are using it in our daily life, and we are getting the benefit of these which a common man might not be fully aware of about.

The problem of criminality prevention is being updated. The relevance of issues related to crime prevention as the main factor of criminality prevention in general is substantiated. The essence of criminality prevention is in implementation of the law's educational function. Its mission is not in punishment, but in fostering anti-criminal cogitative-behavioral “in-stincts” of a personality. Criminality prevention should be based on certain universally rec-ognized international and national principles aimed at decriminalizing the identity of poten-tial criminals. Crime theory is a whole system of modern scientific knowledge, forms and methods (historical, socio-political, psychological, medical, legal, economic, etc.). The urgency of the research is caused by the fact that in the conditions of the Russian re-ality criminality is the most serious form of a social disease, in the “treatment” of which there are no universal and final remedies. There are only means to stabilize it, to minimize, to reduce it, etc. It is really utopian to remain on its complete eradication by state-legal means. However, the latter is very relevant for society, the state, the citizen. The problem of criminality prevention is notable for its complex and multifaceted character. Therefore, the state has applied and is now applying all available civilized means of its social and legal control. Effective criminality prevention requires improved law en-forcement activities, namely, focusing on identifying, researching, analyzing the main as-pects of criminality prevention, as well as on characterization and evaluation of the crim-inality prevention system in modern conditions, taking into account domestic and foreign experience. Various methods for prevention of crimes and offenses are analyzed. Criminality preven-tion must be understood as a specific direction in the state activity to affect the causal set of illegal behavior and conditions conducive to it, which results in the reduction, stabilization, quantitative reduction and qualitative mitigation of crime.

Abstract:
Fatigue cracks from high cycle vibratory loading have developed in a centrifugal fan impeller after a relatively short period of operation. Based on vibration tests of the impeller and acoustic analysis of the internal spaces of the fan, structural-acoustic coupling with matching frequencies involving two-nodal diameter modes (structural and acoustic) was identified as the cause of the vibration problem. This paper gives a description of the problem and identifies available remedies for its elimination. Special attention is given in Case 1 to the acoustics of the system, where changes to the fan casing utilizing a decoupling acoustic chamber attached to the casing was investigated, and in Case 2, where changes needed to the structural characteristics of the impeller by utilizing a modified impeller with a substantially increased natural frequency (by 44%) of the two-nodal diameter vibratory mode shape were studied. Experimental tests confirmed that the structural-acoustic coupling and vibration were significantly reduced in Case 1 and were fully eliminated in Case 2.

Background: Herbal extracts have been employed since ages in dentistry as tooth cleansing and antimicrobial agents. The use of herbal medicines continues to expand and trend rapidly across the world. Herbal extracts have been used in dentistry for multiple uses as reducing inflammation, as antimicrobial plaque agents, for preventing release of histamine and as antiseptics, antioxidants, antimicrobials and analgesics. They also aid in healing process and are very effective in controlling microbial plaque and other disorders related to gums. Objective: The present review aims towards the combined review as well as compilation of available herbs under the category of various dental associated problems. Materials and Methods: The herbs were studied by sectioning them as for looking after different works or findings done against dental caries, tooth ache, scouring teeth, gum troubles and herbs as mouth fresheners. Results: Herbal extracts have been used on a large scale in dentistry as tooth cleansing and antimicrobial plaque agents. Many people take herbal derived medicines or herbal based products for the purpose of reducing inflammation, as antimicrobial agents, for preventing release of histamine and as antiseptics, antioxidants, antifungals, antibacterials, antivirals and analgesics. Herbal extracts are used in dentistry for treatment of various dental disorders. Conclusion: The use of herbal medicines are blooming rapidly across the world. Herbal extracts and the various herbs on the whole or their specific parts have been used in dentistry. They relieve the problems of gums and act as excellent mouth fresheners. The natural herbal remedies act as an effective substitute to antibiotics and represent a promising approach for prevention and as therapeutic strategies for various oral infections as they are natural, eradicate the problem from its root and provide long lasting relief. The herbal remedies are advantageous over conventional treatment.

Abstract:
Here we review means of immunomodulatory therapy for coronavirus infection caused by SARS-CoV-2 (COVID-19). It has been appreciated that highly limited arsenal of relatively effective means and methods of prevention and treatment of the COVID-19 pandemic is available. The goal of our study was to analyze some therapeutic approaches based on available publications for COVID-19 treatment viewed from acting via innate immunity system. Convalescent plasma serotherapy represents one of the means with verified therapeutic efficacy that was accompanied with decreased viral load and relief of the disease symptoms. The drawback of serotherapy results from limited number of potential plasma donors and profound variety in amount of SARS-CoV-2-specific antibodies found in donor plasma. Another approach to COVID-19 therapy is based on using monoclonal antibodies engineered to target specific virus antigenic determinants, most often surface spike antigen. Antibodies blocking such antigen are able to prevent virus entrance into target cells and development of overt infection. On the other hand, there are monoclonal antibodies abrogating production or binding of excessive amounts of pro-inflammatory cytokines, such as IL-6, TNFα, etc., some of which (tocilizumab) have been already tested in COVID-19 therapy, whereas the remaining preparations are being currently investigated and tested. A certain breakthrough in COVID-19 therapy was provided by the well-known drugs chloroquine and dihydrochloroquine, which have proven to be effective as antiviral, anti-inflammatory and immunomodulatory means. Finally, a new multicomponent immunomodulatory preparation Cytovir-3 has been proposed already passed clinical trials and recommended for use in prevention and treatment of influenza and SARS and might have found its own niche in preventing COVID-19, as SARS-CoV-2 also belongs to the group of acute respiratory viruses. Thus, the arsenal of means for COVID-19 prevention and treatment contains the drugs for immunomodulatory therapy and prevention of immune-related disorders developing in response to invasion pathogenic viruses and lowering a risk of possible damage. Hence, correct and scientifically justified use of such remedies will increase overall effectiveness of fight against the coronavirus pandemic.

Garlic (Allium sativum L. fam. Alliaceae) is one of the best-researched, best-selling herbal remedies and is also commonly used as a food and a spice. Garlic constituents include enzymes (for example, alliinase) and sulfur-containing compounds, including alliin, and compounds produced enzymatically from alliin (for example, allicin). Traditionally, it has been employed to treat infections, wounds, diarrhea, rheumatism, heart disease, diabetes, and many other disorders. Experimentally, it has been shown to exert antilipidemic, antihypertensive, antineoplastic, antibacterial, immunostimulant and hypoglycemic actions. Clinically, garlic has been evaluated for a number of conditions, including hypertension, hypercholesterolemia, intermittent claudication, diabetes, rheumatoid arthritis, common cold, as an insect repellent, and for the prevention of arteriosclerosis and cancer. Systematic reviews are available for the possible antilipidemic, antihypertensive, antithrombotic and chemopreventive effects. However, the clinical evidence is far from compelling. Garlic appears to be generally safe although allergic reactions may occur.

Abstract:
In the twentieth century, a dynamic expansion of its activities and powers has made government a major supplier of information on an enormous range of topics of concern to citizens. Unfortunately, the information which it provides is not always completely reliable: sometimes it is inaccurate, and government is powerless to protect the citizen from the consequences; at others, it proves misleading because government chooses later to disown it. The purpose of this thesis is to analyse the legal remedies available to citizens misled by government information. The analysis has two principal areas of investigation. First, consideration is given to the means whereby the citizen may be able to hold government bound by information which it has provided to him. Separate treatment is given to the situations in which the misleading information deprives the citizen of a benefit or inflicts on him a loss, and in which it subjects him to the risk of criminal liability. Secondly, consideration is given to the possibility of holding government responsible in damages for the consequences of its information being misleading. Of central importance in this wide-ranging analysis is the issue of the proper role of the courts. This stems from the fact that complaints about misleading government information frequently involve challenges to government decisions. Thus the majority of attempts by citizens to hold government bound by its information are generated by the making by government itself of a decision inconsistent with that information. Again, attempts to hold government responsible in damages for the consequences of providing misleading information commonly involve an allegation that a particular government decision relating to the provision of that information was negligent. It is emphasized throughout this thesis that the courts should refuse assistance to a citizen whose complaint of misleading government information is directed essentially towards a government decision, where that decision involves a determination of the priority of competing interests and values represented in society. The provision of a remedy in such a case would enable the courts effectively to review the choices embodied in value-laden government decisions, and as such would facilitate an unwarranted extension of their constitutional role.

The resolution of disputes, including unfair dismissal disputes under the Labour Act 2007 is being criticised for being too complex, inefficient, protracted, expensive, and highly legalistic. This thesis would denote that the provision of proactive and expeditious dispute resolution systems helps to resolve labour disputes in the most effective and efficient manner, without necessarily having to resort to the courts. The ultimate goal is to ensure that the legal framework regulating the labour dispute system in Namibia assures the use of alternative dispute resolution (ADR) of its credibility, thereby creating confidence and enabling stakeholders to trust the system. Ideally, disputes should be resolved at the conciliation level, resulting in the minority of disputes being referred to arbitration or the Labour Court. The Office of the Labour Commissioner must be independent of the state, since the state is the largest employer, to ensure the stakeholders trust the system. However, it has been established that there are gaps between the legal framework relating to labour dispute resolution and the application of laws and regulations in practice, making the attainment of effective and efficient labour dispute resolution difficult. Therefore, the thesis will analyse the ADR in Namibia to finding out if the system is sufficient and appropriate for society’s need and to provide a recommendation for the system that is a quicker, equitable, and amicable way of resolving the disputes outside the courts through conciliation and arbitration.

Documented as serving in the midwife capacity from the 1880s to the 1930s, the “granny-woman,” often was the only line of defense regarding childbirth support practices for many childbearing age women living in the region during the late nineteenth and early twentieth centuries. The early twentieth century saw the granny-women discredited and subject to elimination as a result of a purposeful campaign conducted by the male-dominated medical profession. Using knowledge of herbal remedies, the granny-woman played an integral part in the survival of the inhabitants of the region, especially related to childbirth. These centuries-old, herbal-based ministrations have been explored to aid in dispelling the erroneous conclusions related to the vital community role fulfilled by the Southern Appalachian granny-woman. Possessing knowledge of herbal-based childbirth prevention measures, the Southern Appalachian granny-woman rarely provided specifics related to the use of these measures by the women living in the region during that era.

AbstractThe main consequence of Sentenza 238/2014 is that Germany has been denied jurisdictional immunities before Italian courts. However, the inflexible conception of the right of access to courts adopted by the Corte Costituzionale gives rise to a number of questions that go well beyond the issue at stake in Judgment 238/2014. First, there is the issue of whether the right of access to justice should also prevail over the international customary rule on immunity from execution. Secondly, one may ask whether the need to protect the right provided by Article 24 of the Italian Constitution could trump the criteria established by Italian law for exercising civil jurisdiction in order to allow access to justice in respect to all international crimes, even those committed outside Italian territory and involving individuals having no link to Italy. Finally, there is the question of whether a sacrifice of the right of access to justice would be justified if alternative, non-judicial means of redress were available to the victims; in particular, whether an alternative means of redress should in any case ensure to each and every individual victim full compensation or whether instead, in light of the specific circumstances of the case—the fact that the crimes occurred in the course of an international armed conflict affecting hundreds of thousands of victims—such alternative means could provide only symbolic compensation based on a lump sum settlement. This chapter aims at exploring these and possibly other issues arising in connection to the broad interpretation of the principle of access to justice given by the Corte Costituzionale.

AbstractThe outcome of Judgment 238/2014 does not directly rely on the fact that the international dispute on state immunity involves two member states of the EU. Also, it is difficult to envisage at the European level any normative development on the international rules on state immunity. It seems, however, that some useful lessons can be learnt from the judicial dialogue between the European Court of Justice, the European Court of Human Rights, and constitutional courts. In very general terms and for many reasons, the relationship between constitutional courts and the International Court of Justice (ICJ) cannot rely on particularly sophisticated techniques of judicial dialogue.This encourages us to consider the importance of involving state-level political organs as one of the counterparts to the dialogue. The potential power of judges to address these political organs in order to find a diplomatic solution raises the thorny question of whether this availability of alternative means of dispute settlement at the international level might impact on (or somehow restrict) the right of access to justice for Italian victims. Since both ICJ and the Italian Constitutional Court (ItCC) seem to agree that negotiation is the alternative dispute settlement par excellence (and the only means available to settle the present dispute at the international level), the ItCC might have given more importance to the availability of alternative means of redress—in the form of negotiations between the two states—in order to wear down the absolute character of the principle of judicial protection enshrined in Article 24 of the Italian Constitution.Of course, a negotiated solution depends upon the willingness of both parties, whereas an Italian political initiative aimed at unilaterally granting reparation to the victims is always possible. Moreover, the latter solution may stop the enforcement of Judgment 238/2014 and reduce Italy’s exposure to international responsibility for non-compliance with the 2012 ICJ Judgment. So long as Italian victims and their heirs are compensated, the restriction on their right to seek justice through the courts might become more tolerable for the Italian tribunals.

Fatigue cracks from high cycle vibratory loading have developed in a centrifugal fan impeller after a relatively short period of operation. Based on vibration tests of the impeller and acoustic analysis of the internal spaces of the fan, structural-acoustic coupling with matching frequencies involving two nodal diameter modes (structural and acoustic) was identified as the cause of the vibration problem. The paper gives a description of the problem and identifies available remedies for its elimination. Special attention is given in Case 1 to the acoustics of the system where changes to the fan casing utilizing a decoupling acoustic chamber attached to the casing was investigated, and in Case 2 where changes needed to the structural characteristics of the impeller by utilizing a modified impeller with a substantially increased natural frequency (by 44%) of the two nodal diameter vibratory mode shape were studied. Experimental tests confirmed that the structural-acoustic coupling and vibration was significantly reduced in Case 1 and was fully eliminated in Case 2.

Squats are a type of rolling contact fatigue on the top of rails of straight tracks or shallow curves. In some countries they have become a major type of rail damage. Although it is widely recognized that preventive and early corrective actions are cheaper than late remedies such as rail replacement, timely treatment is hindered by the lack of automatic detection of early squats. So far, the treatment of squats has mainly been dependent on ultrasonic detection, which detects deep cracks and is applicable only to severe squats. The life cycle costs (LCC) of squat-infected track are therefore high. The operational safety and availability of the networks are also adversely affected. Based on a new method which detects initiating squats, this paper proposes a methodology for squat related LCC reduction. First a squat classification is introduced that facilitates early identification of squats. Then the growth phases of squats are discussed; typical growth rate of squats is analyzed, and thereupon based threshold values for minimum action by rail grinding are proposed. After a review of the currently available detection methods, the new detection method is presented, with results of field test demonstrating the capability of the method to detect light squats. Finally, a case study of the LCC of a monitored squat-infected track section shows that the proposed treatment can significantly reduce the LCC. In addition, operational safety and network availability can also be improved.

A managed programme to review engine failures and take necessary preventative measures has been in place successfully in the Royal Navy since the introduction of gas turbines into service in the 1970’s. One of the more prominent failure mechanisms with the Tyne RM1C and Spey SM1A engines has been the degradation of main line bearings accounting for 25 percent of all engines rejected. Historically, since the first recorded incident in March 1987, the failures pointed to poor performance of the bearings themselves. However, maintenance studies and recent analysis indicates that a vast proportion have occurred through previously unidentified chloride corrosion as a result of contamination of the lubricating oil system with salt water from the seawater lubricating oil cooler (SWLO cooler). Despite joint ownership of both engine variants with the Royal Netherlands Navy, there was no clear evidence until about five years ago to suggest why tube perforation was occurring. Indeed, the fact that failures have only occurred in Royal Navy service is an interesting twist to the problem. This paper summarises the phenomenon of SWLO cooler corrosion caused by Microbial Induced Corrosion (principally Sulphate Reducing Bacteria – SRB). It highlights the conditions in which SRB occurs along with demonstrated prevention in Royal Navy gas turbine service through the combined efforts of maintenance and development of a new titanium tubestack. The fault finding and remedial recovery experience may well be of interest to operators of marine gas turbines, both naval and commercial, who use tube type heat exchangers, especially when operating or undertaking work in estuarial waters and non tidal basins or when undertaking littoral duties. This is a practical view of the issue from an operators perspective and whilst utilising a wealth of research and technical data available on the subject, it relates the issues at hand to the particular corrosion problem and is not intended as an introduction into organic chemistry.

The availability and operational efficiency of a steam surface condenser is a critical aspect of, and significant contributor to, a power plants overall thermal performance. In order to ensure reliability and maintain operational efficiency, inspection and testing is often required to determine the condition of the condenser. Inspections tend to support condition based maintenance and usually assist with monitoring the real time condition of the condenser, they are essentially reactive. Regular testing has the advantage that it can be pro-active and provide valuable benchmark data which in turn can be used to monitor a condensers condition throughout its operational design life, and beyond. Testing also provides valuable recordable information which can be utilized in preventive maintenance regimes to minimize condenser deterioration, thereby helping to ensure peak efficiency, and in some instances it can even be used within predictive failure models. Testing often greatly assists with avoiding expensive & unnecessary shutdowns by helping to determine optimal timing for any necessary remedial and/or major repair work, as well as helping to identify and address real time issues.

Dry gas seals have become the pipeline industry standard for sealing of centrifugal gas compression equipment. Recent applications have pushed the limits of materials used in their construction from exposure to ever increasing levels of pressure, speed and temperature. This provides the focus for a discussion of recent advances with the use of advanced materials, higher pressure, speed and temperature applications and bidirectional designs. Operating experience has been very favourable, enough to make dry gas seals a preferred standard, but the failures that have occurred raise two fundamental questions. The first concerns the resistance of gas seals to contamination and the second is their influence upon rotor dynamic behavior. Both of these predominant issues are reviewed along with advancements and preventive measures now available to address these concerns.

Until a vaccine is widely available, face masks and other nonpharmaceutical interventions (NPIs) will continue to be the frontline defense against Covid-19 in developing countries. But their effectiveness depends critically on compliance by young adults, who are most likely both to become infected and to infect others. We conducted a randomized controlled trial in Bogotá, Colombia, to assess the effectiveness of informational nudges on university students concern about Covid-19, recent compliance with NPI recommendations, and intended future compliance. Although nudges boosted concern, they had limited effects on either recent or intended future compliance. We attribute these null results to high baseline levels of information about and compliance with NPIs an informational diminishing returns scenario that is likely to be increasingly common globally. Nudges were more effective at boosting recent compliance among participants who were politically left-wing, were relatively poor, and lived with more people.

The purpose of the meeting was to disseminate newly available research findings on how to change youth reproductive health/HIV knowledge, attitudes, and behaviors in developing countries. Consistent and correct use of the male condom is a critical measure for preventing STI-related morbidity and mortality, yet condom use remains low worldwide and researchers have made limited progress in identifying positive factors that facilitate regular condom use. From 2001 to 2003 the Population Council explored the behavior of individuals who use condoms successfully. Findings on factors that facilitate or impede successful use could be used to develop more effective condom promotion strategies in family planning and STI prevention programs. The projects used qualitative data from successful condom users within three categories: male and female factory workers; male and female high school and university students; and female sex workers and their male clients. Researchers screened successful condom users through a 75-point scale that assessed the frequency and effectiveness of condom use as well as positive and negative experiences with condoms. Studies in the Dominican Republic and Mexico showed that regular condom users obtained personal benefits, including a sense of security. As noted in this summary, condom promotion initiatives should emphasize the positive aspects of condom use and make condoms available through alternative venues.
