Abstract:
In the twentieth century, a dynamic expansion of its activities and powers has made government a major supplier of information on an enormous range of topics of concern to citizens. Unfortunately, the information which it provides is not always completely reliable: sometimes it is inaccurate, and government is powerless to protect the citizen from the consequences; at others, it proves misleading because government chooses later to disown it. The purpose of this thesis is to analyse the legal remedies available to citizens misled by government information. The analysis has two principal areas of investigation. First, consideration is given to the means whereby the citizen may be able to hold government bound by information which it has provided to him. Separate treatment is given to the situations in which the misleading information deprives the citizen of a benefit or inflicts on him a loss, and in which it subjects him to the risk of criminal liability. Secondly, consideration is given to the possibility of holding government responsible in damages for the consequences of its information being misleading. Of central importance in this wide-ranging analysis is the issue of the proper role of the courts. This stems from the fact that complaints about misleading government information frequently involve challenges to government decisions. Thus the majority of attempts by citizens to hold government bound by its information are generated by the making by government itself of a decision inconsistent with that information. Again, attempts to hold government responsible in damages for the consequences of providing misleading information commonly involve an allegation that a particular government decision relating to the provision of that information was negligent. It is emphasized throughout this thesis that the courts should refuse assistance to a citizen whose complaint of misleading government information is directed essentially towards a government decision, where that decision involves a determination of the priority of competing interests and values represented in society. The provision of a remedy in such a case would enable the courts effectively to review the choices embodied in value-laden government decisions, and as such would facilitate an unwarranted extension of their constitutional role.

The resolution of disputes, including unfair dismissal disputes under the Labour Act 2007 is being criticised for being too complex, inefficient, protracted, expensive, and highly legalistic. This thesis would denote that the provision of proactive and expeditious dispute resolution systems helps to resolve labour disputes in the most effective and efficient manner, without necessarily having to resort to the courts. The ultimate goal is to ensure that the legal framework regulating the labour dispute system in Namibia assures the use of alternative dispute resolution (ADR) of its credibility, thereby creating confidence and enabling stakeholders to trust the system. Ideally, disputes should be resolved at the conciliation level, resulting in the minority of disputes being referred to arbitration or the Labour Court. The Office of the Labour Commissioner must be independent of the state, since the state is the largest employer, to ensure the stakeholders trust the system. However, it has been established that there are gaps between the legal framework relating to labour dispute resolution and the application of laws and regulations in practice, making the attainment of effective and efficient labour dispute resolution difficult. Therefore, the thesis will analyse the ADR in Namibia to finding out if the system is sufficient and appropriate for society’s need and to provide a recommendation for the system that is a quicker, equitable, and amicable way of resolving the disputes outside the courts through conciliation and arbitration.

Abstract:
Documented as serving in the midwife capacity from the 1880s to the 1930s, the “granny-woman,” often was the only line of defense regarding childbirth support practices for many childbearing age women living in the region during the late nineteenth and early twentieth centuries. The early twentieth century saw the granny-women discredited and subject to elimination as a result of a purposeful campaign conducted by the male-dominated medical profession. Using knowledge of herbal remedies, the granny-woman played an integral part in the survival of the inhabitants of the region, especially related to childbirth. These centuries-old, herbal-based ministrations have been explored to aid in dispelling the erroneous conclusions related to the vital community role fulfilled by the Southern Appalachian granny-woman. Possessing knowledge of herbal-based childbirth prevention measures, the Southern Appalachian granny-woman rarely provided specifics related to the use of these measures by the women living in the region during that era.

Abstract:
This study evaluated the effectiveness of HIV prevention groups for men-who-have-sex-with-men conducted in 4 Montana communities: Butte, Bozeman, Helena and Missoula. A convenience sample of participants (n=37) were recruited from MSM who voluntarily signed-up for participation in the evaluated groups. Comparison group participants (n=31) consisted of a convenience sample of MSM recruited by Montana Targeted Prevention (MTaP) workers during the course of their regular HIV/Hepatitis C outreach activities. Behavioral changes in unprotected anal intercourse and substance use and seven HIV-transmission-behavior influencing factors (sexual communication skills, attitudes towards condoms, HIV transmission knowledge, internalized homophobia, social isolation, self-esteem and depression) were assessed at baseline and again following 9 hours of intervention exposure. No significant changes in frequency of unprotected anal intercourse were observed, however participants reported that they more regularly wear a condom as a result of the intervention. Changes in frequency of unprotected anal intercourse may have been underestimated by the short 9-week evaluation period. Forty-eight percent (n=10) of participants engaging in binge drinking (5 or more drinks in one sitting) and 22% (n=4) of marijuana using participants reported a reduction in use. Intervention group participants indicated significant positive changes in measures of depression (p=.00) and self-esteem (p=.00). Participants identified factors related to community involvement and social support as being the primary factors facilitating MSM participation in HIV prevention groups. Group participation generated multiple positive intrapersonal and interpersonal outcomes that may facilitate short-term and long-term adoption and maintenance of positive health behavior changes. In the rural and geographically vast frontier state of Montana, HIV prevention groups may also play a critical role in the health and well being of Montanas MSM community by providing gay community infrastructure and positive social norms of sexual health that may serve to reduce the damaging effects of social stigma often experienced by rural MSM.

Abstract:
This study employed a non-random, quasi-experimental design to assess the impact of a diabetes prevention and health promotion program on the health behavior of older African American adults in a church setting. Social Cognitive Theory (SCT) (Bandura, 1986, 1977) and Socio-ecological (McLeroy et al., 1988) and PRECEDE- PROCEEDE Planning (Green & Kreuter, 1999) models were utilized as guiding frameworks. A modified curriculum from the Lifestyle Balance: Healthy Eating and Being Active Diabetes Prevention program was used. Significant decreases were found in fasting blood sugar over the eight-week period for both program participants and the comparison group. However, there was not an increase in diabetes knowledge, daily moderate-vigorous exercise levels or self-efficacy for physical activity for individuals who participated in the program from Time 1 to Time 2. The findings are discussed relative to their contributions to health-related research and interventions with African Americans and the role of African-American churches as a conduit for health messages and behavior change.

Abstract:
The purpose of this dissertation study was to evaluate a child abuse prevention program for families considered at-risk for abuse. Specifically, this study sought to gain a better understanding of how program participation was associated with parenting behavior and child maltreatment risk, and if this relation was partially mediated by social support and parental empowerment. The sample consisted of 187 parents and grandparents who attended Circle of Parents groups throughout a southeastern state. It was hypothesized that (a) higher program participation would predict improvements in parenting behavior, lower levels of maltreatment risk, higher levels of social support within and outside the group, and higher feelings of parental empowerment; (b) higher levels of social support within and outside the group, as well as higher levels of parental empowerment, would predict improvements in parenting behavior and lower child maltreatment risk; (c) the relation between program participation and parenting behavior, as well as child maltreatment risk would be mediated by social support and parental empowerment. Results revealed that program participation significantly predicted improvements in parent behavior and social support within the group. In addition, social support within the group significantly predicted improvements in parent behavior. Social support outside the group also significantly predicted levels of lower child maltreatment risk. There was no support for mediation effects. Considerations for interpreting results, limitations, directions for future research, and implications for practice are discussed.

Abstract:
The therapeutic potential of a novel multi-targeted small-interfering RNA (siRNA) was investigated in human breast cancer cells. Previous studies had identified an siRNA that specifically and potently inhibited expression of thymidylate synthase (TS) by directly targeting human TS mRNA. TS is a folate-dependent enzyme that catalyzes the key reaction involved in synthesizing nucleotide precursors for DNA biosynthesis, and as such, it plays a critical role in maintaining cell growth. The goal of this thesis was to design and develop a novel siRNA molecule that targeted TS mRNA as well as a cellular mRNA that encodes a different cellular protein involved in cancer cell growth and proliferation, such as a member of the ErbB family. Gene sequence analysis was performed and identified an overlapping sequence between TS and ErbB2 mRNAs. An siRNA duplex was then designed to simultaneously target human TS and ErbB2 mRNA. Transfection of the multi-targeted siRNA (TS1M17) revealed that both ErbB2 and TS proteins were significantly suppressed in a time and dose-dependent manner in ErbB2-overexpressing human breast cancer SKBR3 cells. The corresponding mRNA levels, as determined by RT-PCR, were also decreased. Protein levels of other ErbB family members, including ErbB1 and ErbB3, remained unchanged with siRNA treatment. An ErbB2-specific siRNA (B2450) inhibited ErbB2, but had no effect on TS expression demonstrating the specificity of the multi-targeted siRNA against both TS and ErbB2. Mismatched (TS1-Mismatch) and control (GL2) siRNAs had no inhibitory effects on expression of the two target proteins. Suppression of activated ErbB2, as determined by expression of phosphorylated ErbB2 protein, was observed with transfection of TS1M17 siRNA. In addition, the expression of downstream signaling proteins, such as phosphorylated mitogen activated protein kinase (p-MAPK), p27Kip1, p21Cip1, cyclin D1, and survivin were significantly changed. In contrast, control siRNAs did not exert any inhibitory effects on downstream signaling. Taken together, these findings suggest that TS1M17 siRNA inhibits signaling of the ErbB2 pathway. The effect of TS1M17 siRNA on cytotoxicity was analyzed by WST-1 assay. Upon transfection into SKBR3 cells, the TS1M17 siRNA significantly suppressed cell proliferation with an IC50 value of 0.65 nM, which is 154-fold more potent than ErbB2- and TS-specific siRNAs. This study suggests that targeting expression of ErbB2 and TS, two key proteins involved in distinct and critical pathways for cancer growth and proliferation, with a single siRNA molecule may provide a novel approach for cancer chemotherapy.
