On conclut que les contextes et les dates différentes des deux textes ne changent pas le fond de l’interprétation hégélienne des deux cartésiens, laquelle mesure par rapport à sa propre conception de l'Absolu ces deux philosophies, comprenant leur principe - unilatéral et contradictoire - de la totalité (Spinoza) et de l'individualité (Leibniz) comme un moment indispensable, mais dépassé, de l'auto-conception de l'Idée.

Abstract:
Cet article vise la définition d’une structure de base de la complexité dans le couple attitude cognitive/action par la remise en cause du principe de tiers exclu. Prenant pour point de départ la volonté humaine, il est montré que, celle-ci faisant preuve de faiblesse (akrasie aristotélicienne et objectifs que l’on se fixe relevant des effets essentiellement secondaires de Jon Elster), la personne met en oeuvre des stratégies d’autocontrainte (comme l’engagement) irrationnelles mais efficaces. Leur efficacité découle de la capacité humaine à être de mauvaise foi, au sens sartrien du terme : une mauvaise foi en toute bonne foi. La structure de cette mauvaise foi est fondée sur le résultat de la coprésence contradictoire entre croyances incompatibles et, même, leur renforcement réciproque, malgré le fait que se forcer à croire est un exemple d’effet essentiellement secondaire, soit un objectif que l’on ne peut vouloir. C’est le mécanisme de cette contradiction qui est décrit, remettant en cause ce principe du tiers exclu. Le résultat de ce mécanisme peut être pensé comme la « brique élémentaire » de la complexité humaine.

Qu’il soit ou non le reflet d’une stratégie procédurale, le silence est valorisé lorsqu’il s’inscrit dans une optique respectueuse des droits de la défense et du principe du contradictoire. Le Code de procédure civile lui attribue une valeur fonctionnelle qui dépend à la fois de la maîtrise des parties sur le déroulement du procès et de la responsabilité du juge en matière juridictionnelle, concernant la régulation de l’instance. Accepté, toléré ou réprouvé, le silence n’est pas un, mais s’exprime de différentes manières dans le cadre du procès civil, ce qui rend aléatoire toute tentative d’intégration dans telle ou telle catégorie juridique. Il n’est pas pour autant l’expression d’une quelconque anarchie procédurale, la loi encadrant ses différentes manifestations et les effets juridiques qu’elles produisent.

Abstract: Complete Systematic Land Registration is a program which taken by the government in providing legal certainty in the field of land in Indonesia. PTSL activities at Sidoarjo Regency and Pasuruan Regency Land Office are carried out with third parties. Before starting the measurement, it is necessary to carry out the contradictoire delimitatie principle to ensure legal certainty of ownership of land rights. The research used a qualitative method with a descriptive approach. The data analysis carried out by compiling logically proportional statements to answer research questions. Problem analysis is carried out by making a description based on premier data and secondary data obtained through interviews and observations of implementation. The results of the research showed that the implementation of the contradictoire delimitatie principle is broadly following PP. No. 24 of 1997 and PMNA KaBPN No. 3 of 1997. The results of the study also showed that there were obstacles in the implementation of the contradictoire delimitatie principle, such as the third parties were not following technical guidelines No. 01 / JUKNIS-300/1/2018 annex 10 in the making of measurement drawings. Quality control is needed to improve the quality of work and results of third party products and minimize land problems in the future.Keywords: principle of contradictoire delimitation, third party. Intisari : Pendaftaran Tanah Sistematis Lengkap (PTSL) merupakan langkah pemerintah dalam memberikan jaminan kepastian hukum dalam bidang pertanahan di Indonesia. Kegiatan PTSL di Kantor Pertanahan Kabupaten Sidoarjo dan Kabupaten Pasuruan dilaksanakan bekerjasama dengan Pihak Ketiga yang sebelumnya melalui tahapan asas contradictoire delimitatie untuk menjamin kepastian hukum kepemilikan hak atas tanah. Metode penelitian yang digunakan adalah metode kualitatif dengan pendekatan deskriptif. Teknik analisa yang dilakukan yaitu dengan menyusun pernyataan-pernyataan proposional secara logis untuk menjawab pertanyaan penelitian. Analisa permasalahan dilakukan dengan membuat uraian berdasarkan data premier dan data sekunder yang diperoleh melalui wawancara serta observasi langsung terhadap pelaksanaan kegiatan. Hasil penelitian menunjukkan bahwa pelaksanaan asas contradictoire delimitatie secara garis besar telah sesuai dengan PP. No. 24 Tahun 1997 dan PMNA KaBPN No. 3 Tahun 1997. Dalam pelaksanaanya terdapat hambatan yakni pembuatan Gambar Ukur oleh Pihak Ketiga tidak sesuai dengan pedoman JUKNIS No. 01/JUKNIS-300/1/2018 lampiran 10. Sehingga diperlukan pengawasan kendali mutu terkait pekerjaan dan hasil produk dari Pihak Ketiga agar kedepannya hasil pekerjaan yang dihasilkan lebih baik dan tidak menjadi permasalahan pertanahan dikemudian hari.Kata Kunci : asas contradictoire delimitatie, pihak ketiga.

Au tournant du xxe siècle, alors que l’histoire littéraire se transforme profondément et s’essaie à de nouvelles approches, alors que s’opposent des visions contradictoires de la fonction de la critique littéraire et que le lectorat s’élargit et se diversifie, il semble qu’un goût pour le contemporain s’affirme de manière relativement consensuelle au sein de la discipline. Le consensus est d’autant plus étonnant que l’ambition d’une histoire du présent est paradoxale et qu’elle contrevient à une certaine idée de l’histoire littéraire comme conservatrice. L’article propose d’observer le sort que les historiens de la littérature du tournant du xxe siècle ont réservé dans leurs histoires à la littérature de leur temps, et de répondre à quelques-unes des interrogations que cette pratique contradictoire soulève. L’observation des pratiques mais aussi des justifications des premiers historiens modernes de la littérature quant à l’étude du contemporain sera ainsi l’occasion de saisir plus largement les préoccupations et les principes de l’histoire littéraire au moment où elle se fonde et s’institue, se faisant alors la chambre d’échos des inquiétudes nationales et identitaires de la France du dernier xixe siècle.

La problématique « commerce et environnement » a de multiples facettes et l'interprétation de l'article XX b) et g) du General Agreement on Tariffs and Trade (GATT), qui sert dans cet accord d'interface entre les deux aspects, en est une. La jurisprudence relative à cet article semble désormais lui accorder une valeur équivalente aux dispositions de fond du GATT. Cette évolution très souhaitable démontre que la jurisprudence est enfin prête à donner un poids convenable aux considérations environnementales. Seulement, le problème de concilier les objectifs contradictoires de libéralisation des marchés et de protection de l'environnement persiste. C'est le droit communautaire européen qui livrera un mécanisme d'harmonisation approprié : le principe de concordance concrète. Pour réaliser cette dernière, il est utile de recourir au principe de proportionnalité, bien établi en droit communautaire. Avec ces principes, l'Organe de règlement des différends de l'Organisation mondiale du commerce (OMC) dispose d'importants outils de réflexion qui lui permettent de bâtir sur une base plus cohérente et plus logique sa jurisprudence pourtant bien amorcée.

Con base en la teoría general del proceso, la investigación determina que en el Procedimiento de Investigación y Sanción del Hostigamiento Sexual (PISHS)es identificable la estructura del contradictorio, por lo que su naturaleza es la de un proceso. Sin embargo, la revisión del tratamiento normativo que el PISHS ha dedicado al derecho a la prueba de la parte acusada pone en evidencia que, en la estructura de dicho proceso, el contradictorio no ha sido implementado más que parcialmente, dado que su dimensión sustancial (específicamente, el poder de influencia) no ha sido cabalmente asegurada a favor del presunto/a hostigador/a. Dos escenarios se erigen como posible solución al problema: uno a través de la vía de hecho (preferencia del principio del debido proceso) y otro mediante la reforma legislativa del art. 17.2 del reglamento.
 Based on the general theory of the process, the investigation determines that in the Investigation and Sanction Procedure for Sexual Harassment (PISHS) the structure of the contradictory is identifiable, so its nature is that of a process. However, the review of the normative treatment that the PISHS has dedicated to the right to proof of the accused party shows that, in the structure of said process, the contradictory has only been partially implemented, given that its substantial dimension (specifically, the power of influence) has not been fully secured in favor of the alleged harasser. Two scenariosare erected as a possible solution to the problem: one through the facto route (preference for the principle of due process of law) and the other through the legislative reform of the art. 17.2 of the reglament.

Over the years, although AHP has proved its success in various diverse fields, many authors in the literature have also shown its shortcomings, often called as criticisms of AHP. One such criticism is allowing the consideration of contradictory judgement matrices. Such matrices violate the principle of ordinal transitivity and thus there does not exist any ranking of corresponding decision elements which satisfy all the judgements. In this paper, the results of our investigation towards measuring this criticism are further explored and discussed by comparing the quality of priority vector of contradictory judgement matrices and non-contradictory judgement matrices under Rank Reversals and the common frame work of “aggregated deviation”. The results further strengthen the notion of contradictory judgement matrices as a strong criticism of AHP for higher order judgement matrices and necessitate some proper avoidance (if not elimination) procedure for them.

Abstract:
The paper discusses the principle of complete absorption, which plays the same role in relational theory as the principle of equivalence in general relativity and the principle of waveparticle duality in quantum theory. The physical essence of this principle boils down to the fact that a sufficiently large number of particles must be present in the Universe so that complete absorption of radiation from any source is possible. This implies complete equivalence, from the experimental point of view, of direct interparticle interaction and the interaction carried by a local field in spacetime. It is noted that in its classical interpretation the Fokker variational principle, on which the theory of direct interparticle interaction is based, contains a dilemma caused by two mutually contradictory necessary properties of the interaction action. One of the options for overcoming this dilemma is proposed.

AbstractIn De Interpretatione 6-9, Aristotle considers three logical principles: the principle of bivalence, the law of excluded middle, and the rule of contradictory pairs (according to which of any contradictory pair of statements, exactly one is true and the other false). Surprisingly, Aristotle accepts none of these without qualification. I offer a coherent interpretation of these chapters as a whole, while focusing special attention on two sorts of statements that are of particular interest to Aristotle: universal statements not made universally and future particular statements. With respect to the former, I argue that Aristotle takes them to be indeterminate and so to violate the rule of contradictory pairs. With respect to the latter, the subject of the much discussed ninth chapter, I argue that the rule of contradictory pairs, and not the principle of bivalence, is the focus of Aristotle’s refutation. Nevertheless, Aristotle rejects bivalence for future particular statements.

The precautionary principle is a legal principle concerned with the process of how decisions are made. In implementing and interpreting it regard must be had to the surrounding legal culture and in particular the principles of good administration in operation. Highlighting those principles emphasises that within a particular jurisdiction there is often very little agreement over their nature. Within the European Union contradictory principles are the product of: assumptions about risk problem-solving, the ambiguous nature of European administration, a concern with accountability in the face of recent food controversies, and the impact of international trade rules. These contradictory principles present a number of challenges for implementing the precautionary principle.

In the article, the author examines the matter of the expression and content of the principle of legality in civil procedure, more specifically focusing on the procedural and substantive problems of the principle of legality. Civil procedure is universal as a compulsory form of protection of subjective rights or, in other words, civil procedure is a procedure for compulsory exercise of civil rights, which is reduced to a set of norms that determine the type of actions of both existing legal protection institutions and persons who use this protection or are involved in it in any other way. Legality plays an important role in this regard. Legality means a state of life of the society which, firstly, has a legal framework, which is not logically contradictory and which generally meets the objective needs of this society and, secondly, natural and legal persons respect and follow the legal norms adopted. In civil procedure, this is not only a principle, but also one of the aims of legal proceedings. According to its content, the principle of legality includes, firstly, the requirement that the courts apply the norms of the substantive law correctly and carry out procedural actions in accordance with the legal norms; secondly, the requirement that other participants of the procedure comply with the procedural and substantive legal regulation when adjudicating and considering civil cases in court. Thus, the principle of legality includes procedural and substantive components. The aim of the article is, by analysing the moral-legal content of the principle of legality, to evaluate the aspects of its application. Material and methods used in the study for the empirical basis of the research include scientific works and collections of articles, publications in periodicals and primary sources, laws, internet resources, as well as other publicly available information. Analytical, inductive and deductive research methods have been used in the research.

Les décisions de tout État de droit s'inscrivent généralement dans un contexte juridique global où l'arbitraire et la discrimination sont systématiquement dénoncés et sanctionnés et où la population s'attend des acteurs politiques qu'ils agissent avec un minimum de rationalité et d'une manière conforme au droit, y compris le droit international. Le principe de précaution a été conçu pour gérer une situation d'incertitude : l'absence d'une certitude scientifique absolue ne doit pas servir de prétexte pour différer l'adoption de mesures de précaution, c'est-à-dire de mesures qui permettraient d'éviter le danger ou d'en atténuer les effets. Parce qu'il entend couper avec la rationalité scientifique dont il n'y a plus rien à attendre puisque, par définition, toute action s'accomplit dans un contexte d'incertitude scientifique, l'appel au principe se situe inévitablement sur le plan politique et va nécessairement opposer des valeurs et des intérêts contradictoires ; il faut une opinion publique éclairée et bien informée des principaux enjeux en cause et un forum ouvert où les diverses options peuvent être débattues. En même temps, dans la mesure où ce principe apparaît comme une approche rationnelle dans la gestion des risques, son application présuppose qu'il y a eu une analyse sérieuse et objective des risques envisageables et cette dernière relève essentiellement de l'expertise scientifique : c'est même son point de départ; on aurait donc tort de penser que le principe est une licence générale pour justifier l'arbitraire ou voiler des mesures protectionnistes. Abstract Incongruency, when regarded as a verbal behavioral act that functions to create contradictory meanings in discourse, seems to violate aspects of the Gricean "Cooperative Principle" that are supposed to guide our every-day conversational encounters. With the aid of actual examples, this paper looks at incongruent conversational exchanges and discusses the factors governing their toleration in conversational interaction, the cross-cultural aspects of incongruent behavioral acts, their translational implications, and suggests that strict observances of the "Cooperative Principle" are restricted to particular types of discourses.

This proposed article seeks to analyse the Hariyali guidelines in order to show how a capitalistic, managerial and scientific rationale is used which presumes that nature in order to be valued must have a productive value. As a capitalist enterprise, nature is only useful if it serves the livelihood needs of the populace. All other values are elided in favour of one overarching idea of productivity for the market. This productivity is sought to be harnessed through the twin ideas of proper managerial and scientific principles. The ‘Watershed Users Association’ is premised on the principle of people being rational maximisers who will put aside their caste, gender, religious and class differences in order to transform the topographical watershed into a productive entrepreneurial community enterprise. On the ground, people of course manage to subvert and resist these processes even as they acquiesce in the larger development plan.

The article analyzes the status of the principle of non-contradiction as an eternal truth in Descartes' metaphysics, and tries to answer the question is it caused. After making the difference between created and uncreated eternal truths, the reached conclusion is that the principle of non-contradiction is created eternal truth. As such, it could be applied even to God but only if we understand him as the most perfect being. The very essence of God, that is absolute power i.e. causa sui is beyond the range of this principle, because absolute power as the essence of God is the realm of absolute identity between His essence and His existence. Since man can think only in accordance with the principle of non-contradiction, even God's infinite power he must understand with regard to that principle. Nevertheless, since the principle of non-contradiction is not applicable on God's absolute identity, its absence man understands as its negation, and because of that, that identity appears to him as self-contradictory. <p>The settlement of this research conclude that; the Resolution of Constitutional Council Number 69/PUU-XIII/2015 with regard to nuptial agreements is contradictory to the purpose of the publicity principle. Ratio legis of The authorization related to the publicity of notaries is also contradictory to the obligations of notaries to maintain the confidentiality of the content of a deed and the professional oath of notaries as regulated in Article 16 paragraph (1) letter f of the Amendment to UUJN, in conjunction with Article 4 paragraph (2) of UUJN. The existence of the Letter from the Director General of the Demography and Civil Registry as well as circular letter of the Directorate General of Islamic community guidance (Ditjen Bimasislam) on the registration of Reporting Nuptial Agreements; such letter does not follow up in relation to the resolutions of the Constitutional Council. However, the endeavour made to interpret the resolutions of the Constitutional Council by the Director General of Demography and Civil Registry is inconsistent with the resolution already mentioned by the Constitutional Council (MK). In its first point it is stated that a nuptial agreement can be made drawn up in a notarized deed, on the other hand, the Constitutional Council, in its resolution, only mentions that a nuptial agreement may be drawn up in writing, which means that it may be executed by the parties only or be drawn up as a notarized deed.</p>

The present study’s aim was to assess the test−retest reliability (TRR) of the ‘Welfare Quality® animal welfare assessment protocol for sows and piglets’ focusing on the welfare principle ‘appropriate behavior’. TRR was calculated using Spearman’s rank correlation coefficient (RS), intraclass correlation coefficient (ICC), smallest detectable change (SDC), and limits of agreement (LoA). Principal component analysis (PCA) was used for deeper analysis of the Qualitative Behavior Assessment (QBA). The study was conducted on thirteen farms in Northern Germany, which were visited five times by the same observer. Farm visits 1 (F1; day 0) were compared to farm visits 2 to 5 (F2–F5). The QBA indicated no TRR when applying the statistical parameters introduced above (e.g., ‘playful‘ (F1–F4) RS 0.08 ICC 0.00 SDC 0.50 LoA [−0.62, 0.38]). The PCA detected contradictory TRR. Acceptable TRR could be found for parts of the instantaneous scan sampling (e.g., negative social behavior (F1–F3) RS 0.45 ICC 0.37 SDC 0.02 LoA [−0.03, 0.02]). The human−animal relationship test solely achieved poor TRR, whereas scans for stereotypies showed sufficient TRR (e.g., floor licking (F1–F4) RS 0.63 ICC 0.52 SDC 0.05 LoA [−0.08, 0.04]). Concluding, the principle ‘appropriate behavior’ does not represent TRR and further investigation is needed before implementation on-farm.

The article examines the potential of the dialectical principle of ascending from the abstract to the concrete for transforming practices of learning. It is shown that V.V. Davydov’s work has created a foundation for such transformation. The theory of expansive learning builds on Davydov’s legacy and brings the principle of ascending from the abstract to the concrete into learning and concept formation outside schools, “in the wild.” Three studies investigating different scales of expansive learning are discussed, focusing on the internally contradictory germ cells discovered and used in those studies. The article concludes by emphasizing the need to integrate Davydov’s revolutionary pedagogy and the broader agenda of school transformation as part of societal transformation.

Physicians are obliged to provide treatment that is consistent with their commitment to avoid or minimize harm (nonmaleficence) and their commitment to do good (beneficence). Therefore, if patient’s desires were contradictory to the primary aim of medicine, the doctor’s calling would require him/her to thoroughly analyze the cause of the disease and provide an adequate as well as ethical treatment rather than obediently follow patient’s requests. Yet, chemical and surgical sex reassignment is one of the areas where some physicians surrender to the desire of their patients instead of finding out what their real condition is and trying to manage it in a way the essence of medicine would require. The objective of this article was to provide specific pharmacovigilance search details for the evaluation of the current situation and the scientific background of the treatment of gender dysphoria and to analyze its conformity with one of the two main ethical principles of medicine – nonmaleficence. Literature retrieval was accessed through Medline (1979–2011) using the terms “gender dysphoria,” “replacement hormonal therapy,” and “pharmacovigilance.” The article concludes that hormonal and surgical interventions have not proven to be medically justified and could be harmful, not treating the cause, but resulting in irreversible disability. Thus, these interventions contradict the principle of nonmaleficence and goals of basic therapeutics and pharmacovigilance. They are not based on clinical trials and are lacking a thorough follow-up assessment.

There is a growing understanding that teacher education should not be handled either exclusively by the University or in School settings. Nevertheless, the issues on how to foster a fruitful partnership between these two different institutions remains an open and challenging point. The practicum is a critical point in the pre-service teacher’s development, usually because it is the first time they have to face the concrete professional issues, which they only had a partial view of as students. This research is a year-long inquiry on practicum in the Physics teaching program developed in the Institute of Physics at the University of São Paulo, Brazil. Drawing on cultural-historical activity theory, contradiction is used as an explanatory principle to examine change and development in the practitioners’ activity. Therefore, the research includes in the analytical framework the contradictions and the processes of overcoming it. Examples are provided in which there is little control therefore demanding extra efforts but makes room for active participation. The data analysis indicates that the source of agency and activities transformation is precisely a contradictory process, which might be overlooked. The pre-service teachers’ agency is shaped by contradictory process within the activity – practicum - rather than aligned forces pushing it toward autonomy, student sensitiveness or professional identity. Según esta norma, el crédito no impugnado que sea reconocido en una resolución judicial, en una transacción judicial o en un documento público con fuerza ejecutiva, podrá ser certificado como título ejecutivo europeo y, por tanto, podrá circular libremente por todala Unión Europea –excepto en Dinamarca– y ser ejecutado automáticamente en cualquier país de este entorno. Para certificar una resolución judicial como título ejecutivo europeo se exige, entre otros requisitos, que el procedimiento que da lugar al título haya sido notificado al deudor, para que tenga conocimiento de la existencia del mismo y pueda impugnarlo si lo desea (art. 6). Ce dernier affirme qu’Aristote n’a pas réussi dans sa tentative pour justifier le principe de contradiction. En fait, ce principe est moins logique qu’éthique, selon Lukasiewicz, et cela explique bien des difficultés posées par la théorie d’Aristote. On discute également de la façon dont Lukasiewicz utilise la notion d’« objets contradictoires », empruntée à la Théorie des Objets de Meinong ; on montre que Lukasiewicz se situe dans le cadre d’une version brentanienne de l’aristotélisme. En effet, cet équilibrage des gains en efficience et des effets anticoncurrentiels doit fondamentalement tenir compte de tous les objectifs de nature économique et sociale poursuivis par le droit canadien de la concurrence. Dès lors, la question principale que suscite cette étude est de savoir comment faudrait-il concilier les objectifs de nature économique et sociale dans l’interprétation de l’exception d’efficience ? Cette étude explore ainsi la possibilité de la réception de normes de nature sociale au sein du droit de la concurrence qui, par ses objets, est caractérisé par une forte prégnance économique. Elle a pour objet de montrer à travers l’appréciation de l’exception d’efficience qu’une conciliation des objectifs en apparence contradictoires de nature sociale et économique est possible et souhaitable. When the duty to protect of Tarasoff was imposed upon psychotherapists by the Supreme Court of California, therapists in other states wondered whether or not other courts would adopt the legal reasoning and apply the Tarasoff Principle to them. Resulting court decisions have been much more complex and contradictory than this early question would suggest. Even the legal underpinnings of the Tarasoff Principle, where it has been adopted, are diverse: it is as amorphous and plastic as any principle can be, molded so differently by various courts. This updated review argues that the trend toward diversity and inconsistency has become greater with the increase in Tarasoff-like cases in recent years, beclouding any real moral value that may be present. Given the conflicting social values involved in this kind of public policy, it is best crafted in statutory law, not by the courts.

Many proposed moral principles are such that it would be difficult or impossible to always correctly identify which act is required by that principle in a given situation. To deal with this problem, theorists typically offer various methods of determining what to do in the face of epistemic limitations, and we are then told that the right thing to do – given these limitations – is to perform the act identified by the given method. But since the method and the underlying principle can diverge, it would seem that in such cases we are being given contradictory advice: some particular act will be both right (since it is so identified by the favored method) and not right (since it does not conform to the underlying principle). Various theories that purport to explain the relationship between incest taboos and exogamous marriage customs are reviewed. These include sociological, psychological, and sociobiological approaches. Each of these approaches poses challenges not easily addressed by its competitors and yet no satisfactory synthesis seems available given the currently existing explanatory paradigms. It is argued here that exogamy is not a simple outgrowth of incest taboos and incest taboos are not a simple extenuation of inbreeding avoidance. Relationships between the sociobiology of inbreeding avoidance and social institutions such as exogamy and incest taboos are recast with the help of evolutionary psychology, which provides additional tools with which to approach this complex and contradictory set of interlocking problems.

Abstract:
The effectiveness of judges' verdict in the trial should ideally contain aspects of the rule of law, justice and expediency. In its implementation is not easy to synergize these three aspects, especially the aspect of legal certainty and fairness are usually contradictory. The results showed that the judge in examining and deciding cases not forever fixated on one principle alone. Constraints faced by judges tend to rule of law in deadlock when written provisions can not answer the problems that exist. Emphasis is more inclined to the principle of justice means should consider a law in society, which is made up of customs and unwritten laws. Judge within reason and legal considerations must be able to accommodate all the provisions that live in the community in the form of customs and unwritten laws. Emphasis tends to be on the principle of expediency over economic nuances.

Perceptibility and robustness are two incongruous requirements demanded by digital image watermarking for digital right management and other applications. A realistic way to concurrently satisfy the two contradictory requirements is to use robust watermark algorithm. The developed algorithm uses DTCWT and PCA techniques to embed watermark signal in host signal. To prove the algorithm robustness without much affecting perceptibility several attacks like noises, cropping, blurring, rotation are applied and tested by varying attack parameters. Parameters like Peak signal noise ratio and Correlation Coefficient are calculated for each attack. Attack percentage is varied and performance parameters are calculated to prove the robustness of the developed algorithm.

AbstractJoona Räsänen has proposed a concept he calls Schrödinger’s Fetus as a solution to reconciling what he believes are two widely held but contradictory intuitions. I show that Elizabeth Harman’s Actual Future Principle, upon which Schrödinger’s Fetus is based, uses a more convincing account of personhood. I also argue that both Räsänen and Harman, by embracing animalism, weaken their arguments by allowing Don Marquis’ ‘future like ours’ argument for the immorality of abortion into the frame.

Abstract Two epistemic principles are Knowledge Exclusion and Belief Exclusion. Knowledge Exclusion says that it is necessarily the case that if an agent knows that p, then she does not believe that ∼p, and Belief Exclusion says that it is necessarily the case that if an agent believes that q, then she does not believe that ∼q. Many epistemologists find it reasonable to reject the latter principle and accept the former. I argue that this is in fact not reasonable by proposing a case in which an agent can use that she has contradictory beliefs towards a proposition as decisive evidence for that proposition. A natural response is that this case conflicts with common assumptions about the relation between knowledge, contradictory beliefs and rationality. I reply by drawing ideas from Lasonen-Aarnio’s (2010) remarks on unreasonable knowledge to explain why these common assumptions do not threaten my argument.

<p><em>There are various thoughts on the integration of religion and science, such as the model i‘jâz al-Najjâr, the model of Islamization of al-Faruqi, Ijmâlî Sardar, the Islamic science of Husein Nasr and the universal science of ‘Abd al-Salâm. According to Nidhal, those thoughts still have weaknesses and can not be developed so it needs another alternative. Therefore, Nidhal offers a quantum approach to the integration of religion and modern science. It is based on three principles: non-contradictory principle, layered interpretation principle, falsifiable-theistic principle. The first one is as a basis to integrate religion and science, the next is treated to understand and interpret the sacred text (Qur’an) as the basis of religion, the latest is to ensure the pattern applied in science. Based on these principles, where there is a "movement" connecting religion and science, both religion and science become possible to be reconciled.</em></p>

The combination of choice as a contested concept and its increasing adoption as a policy principle necessitates a critical analysis of its interpretation within Australia’s reforms to disability services. While choice may appear to be an abstract and flexible principle in policy, its operationalization in practice tends to come with conditions. This paper investigates the interpretation of choice in the National Disability Insurance Scheme (NDIS), via an interpretive policy analysis of assistive technology (AT) provision. Analysis of policy artefacts reveals a diminishing influence of disability rights in favor of an economic discourse, and contradictory assumptions about choice in the implementation of legislation. The language of choice and empowerment masks the relegation of the presumption of capacity to instead perpetuate professional power in determining access to resources by people with disability.

Abstract The delimitation line that after 40 years of negotiation (2010) marks the offshore border between Norway and Russia is resulting from longstanding talks according to the negotiation principle as manifest in UNCLOS (1982) Article 74 and 83. Beyond the territorial sea the function of the median (equidistance)- and the sector line is nothing but diplomatic pretensions at the negotiation table. This article illustrates the demise of the sector line as a delimitation principle of the law of the sea in the Barents Sea. The reference point of the outcome of the negotiation is not geodetic nor geographic physical points, but simply the “half way solution” between two politically based claims, the sector line (Russia) and the median line (Norway). This solution is not contradictory to court practice.
