In the wake of the numerous institutional questions raised by the so-called Unitary Patent Package, the thesis aims to analyze the limits of the legitimate resort to differentiated integration techniques (or differentiation) within the EU legal order. In particular, the thesis focuses on the tools of enhanced cooperation, regulated by Article 20 TFEU, and international agreements concluded between Member States (the so-called inter se agreements) to exercise their shared competences.
