AbstractModern challenges, such as global environmental change, cannot be dealt with via the generation of knowledge alone. Even in-principle public support requires broad recognition of responsibility to translate knowledge into appropriate action. This cannot be achieved where minds are closed, in which case greater levels of knowledge can actually feed into perverse outcomes. Overcoming these dynamics is facilitated to the extent that individuals adopt a deliberative stance (Owen D, Smith G, J Political Philosophy 23:213–234, 2015), which involves, inter alia, openness to ideas and hastens the rush to judgement on issues involving uncertainty and complexity—a scepticism of the self. In this paper, the author demonstrates the effects of the deliberative stance and the conditions under which it is best achieved. I draw my evidence from small-scale settings described by deliberative minipublics, but the observed mechanisms can be “scaled up” to inform possibilities for wider reform of the processes governing the uptake and use of knowledge.

Supervision as an empowerment-based intervention is described. This pivotal chapter presents a novel justificatory foundation for the principle of freedom of expression. It elaborates a Stoical ideal of ethical strength as self-restraint, and it contends that a key element of the realization of that ideal by any system of governance lies in the system’s compliance with the principle of freedom of expression. Through arguments based on some of the ideas in Matthew Kramer’s 2017 book Liberalism with Excellence, the chapter then shows how the compliance with that principle by a system of governance crucially affects the levels of self-respect that are warranted for the members of the society over which the system presides. As a consequence, that compliance is essential for the fulfilment of the system’s paramount responsibility to bring about the political and social and economic conditions under which every member of its society can be warranted in feeling a strong sense of self-respect.

This chapter considers Plotinus’s claim that human beings are subject to blame (in a way other animals are not) because they possess a ‘free principle’. It argues that the ‘free principle’ is the soul’s undescended intellectual part, and asks how having such a free principle could be relevant to responsibility. Sections 2 and 3 suggest two answers. (i) Because the human soul has a ‘free principle’, it can achieve freedom by uniting itself with this part. It only needs to focus its attention on the free, self-intellective activity in which it is already, though unconsciously, engaged. (ii) The rational soul’s possession of an undescended intellectual part influences its ability to engage in ordinary reasoning. This suggests that, provided the soul can engage in ordinary reasoning, it will have (even when acting badly) a kind of access to the correct standards in its undescended part.

This chapter seeks to determine the content of the federal principle in Australia from the historical context of the Constitution, the text and structure of the Constitution, and the jurisprudence of the High Court of Australia. The federal principle is a foundational element of the Constitution, along with representative democracy, responsible government, separation of judicial power, and the rule of law. The Commonwealth of Australia Constitution Act 1900 (UK) provided for the people of the six Australian colonies to be united in ‘a Federal Commonwealth under the name of the Commonwealth of Australia’, a self-governing polity within the British Empire. Hence, the chapter reveals three core ingredients of the federal principle: multiple polities, limited authority of polities, and reciprocal responsibility among polities. This chapter examines the role of humanitarian intervention in world politics. It considers how we should resolve tensions when valued principles such as order, sovereignty, and self-determination come into conflict with human rights; and how international thought and practice has evolved with respect to humanitarian intervention. The chapter discusses the case for and against humanitarian intervention and looks at humanitarian activism during the 1990s. It also analyses the responsibility to protect principle and the use of force to achieve its protection goals in Libya in 2011. In his 2012 book The Harm in Hate Speech, Jeremy Waldron has argued sustainedly in favor of hate-speech laws like those that have been enacted in most of the European liberal democracies and in Canada and the Antipodes. His main target is the American position on hate speech, for in the USA any laws along the lines of those just mentioned would be violative of the First Amendment to the American Constitution. This chapter maintains that the gist of the American position is not only a corollary of the First Amendment but also a corollary of the moral principle of freedom of expression. Even more strongly, the chapter contends that the hate-speech statutes championed by Waldron are profoundly demeaning for any country wherein they are adopted. The adoption of such statutes both ensures and presupposes that a system of governance has failed to meet its responsibility to bring about the political and social and economic conditions under which every member of a society can be warranted in harboring an ample sense of self-respect.

This chapter addresses the distinction between offenses and defenses in criminal cases. The Rome Statute draws a clear line between the four crimes subject to the jurisdiction of the Court and the grounds for excluding criminal responsibility in Article 31. The significance of the distinction between these offenses and defenses should not be underestimated. For example, the principle of nullum crimen sine lege, which applies to the former but not the latter, as evidenced by Article 31(3) permits the recognition of new defenses at trial. The four classic defenses of insanity, intoxication, self-defense, and duress spelled out in Article 31 are subject to controversy. Among the major legal systems of the world, there is considerable divergence in approaching these issues. Meanwhile, there are two reasons for the nullum crimen principle. One is to warn defendants of their possible liability. The other is to control the discretion of judges.
