Abstract:
The monograph examines topical issues of reforming the organization of public power in our country in connection with the adoption in 2020 of the Law on Amendments to the Constitution of the Russian Federation. The logic of changes in the organization of public power and the directions of concretization of constitutional values, taking into account the laws of the development of the constitutional system of Russia, are revealed. The most significant characteristics of the updated model of interaction of federal public authorities in accordance with the principle of separation of powers are identified, the trends of constitutional transformations in the spheres of federal relations and local self-government, ensuring the fulfillment by public authorities of international obligations of the Russian Federation are investigated. Particular attention is paid to the development of the legal mechanism of interaction between public authorities and civil society. The authors of the book take into account the results of legislative support for the reform of public power in 2020-2021, a forecast assessment of the implementation of the relevant constitutional and legislative novelties is given, including taking into account the existing legal risks. Solutions are proposed to a number of legal issues of legislative regulation of public power, which can increase the efficiency of its functioning. For researchers, teachers, students and postgraduates, deputies of representative authorities, state and municipal employees, as well as anyone interested in constitutional law issues.

This chapter examines how the issue of separation of powers is treated in the Indian Constitution. More specifically, it considers whether the separation of powers is a principle in the constitutional law of India and if so, what sort of doctrine of separation of powers is embraced by the Indian Constitution. The chapter begins with an overview of the three models of separation of powers articulated in the Indian Constitution, along with the constitutional provisions showing the functional overlap between the executive, legislature, and judiciary. It then turns to a discussion of the legislative branch’s judicial powers under the Constitution, as well as its control of the judiciary; the executive’s administration, legislative, and judicial functions; and the courts’ judicial power and independence. Finally, it looks at the allocation of powers relating to governance to autonomous bodies such as the Election Commission and the Comptroller and Auditor-General.

Abstract:
This chapter considers the meaning, scope, and application of three constitutional principles of surpassing importance in Canada. The rule of law is foundational to Canada’s constitutional framework and may properly be characterized as the first principle of Canadian constitutional law. It is linked to, and in some respects, forms the underpinning for other fundamental principles, including constitutionalism, federalism, democracy, and parliamentary sovereignty. As the latter principles are the focus of chapters by other commentators in this Handbook, this chapter will examine the rule of law primarily in relation to the separation of powers and judicial independence. The principle of judicial independence is also essential to the functioning and structure of the Constitution, given the role the courts are called upon to play in policing the constitutional limits of legislative power and administrative action. The separation of powers is still an emerging principle in Canada, but also increasingly viewed as fundamental.

This chapter examines how the exercise of legislative privileges is treated in the Indian Constitution. More specifically, it considers whether the exercise of legislative privileges by members of the Indian Parliament is justiciable and if so, to what extent. While the courts have ruled in favour of limited judicial scrutiny, the broader principle of ‘separation of powers’ invites further debate. This article begins with an overview of the justifications for legislative privileges and prominent judgments related to their scope, along with some instances where their invocation has become the subject of political controversy but not litigated. In particular, it discusses the Indian Supreme Court’s lack of a clear position on press freedoms vs legislative privileges, as well as legal questions concerning the validity of invoking privileges against acts committed outside the legislatures and the permissibility of judicial review over them.
