This chapter discusses the fundamental principles governing international relations. The principles represent the fundamental set of standards on which States are united and which allow a degree of relatively smooth international dealings. They make up the apex of the whole body of international legislation. They constitute overriding legal standards that may be regarded as the constitutional principles of the international community. These principles are: the sovereign equality of States; the principle of non-intervention in internal affairs; the prohibition of the threat or use of force; peaceful settlement of international disputes; the duty to co-operate; the principle of good faith; self-determination of peoples; respect for human rights; and the prevention of significant environmental harm. The discussions then turn to the distinguishing traits of the fundamental principles and the close link between the principles and the need for their co-ordination.

Abstract:

The theory of Islamic Peaceful Resolution of Disputes discusses four distinct legal features that define Islamic law states’ most preferred form of social interaction: a unique logic of Islamic justice, nonconfrontational dispute settlement (sulh), collective embeddedness of the third party, and incorporation of Islamic religious principles into the resolution process. The chapter describes characteristics of negotiations, international non-binding (conciliation, mediation) and binding methods (arbitration, adjudication). Islamic law states engage in forum shopping because of uncertainty associated with dispute resolution. Their preferences toward international resolution methods are not constant across space and time, but depend on the balance between Islamic law and secular law in their domestic legal systems. ILS whose legal systems are deeply infused with tenets of Islamic law embrace international settlement venues that resemble traditional Islamic law: conciliation and mediation. States whose domestic legal systems embrace secular features are drawn to binding resolution methods: arbitration and adjudication.

Without assuming prior legal knowledge, books in the Directions series introduce and guide readers through key points of law and legal debate. It discusses European Convention law and relates it to domestic law under the HRA. Questions, discussion points, and thinking points help readers to engage fully with each subject and check their understanding as they progress and knowledge can be tested by self-test questions and exam questions at the chapter end. This chapter considers Article 11 and relates it, in outline, to aspects of public order law in the UK. Article 11 protects the rights of people to ‘peaceful assembly’—to hold and take part in peaceful meetings, marches, and demonstrations. Related issues such as the notion of peaceful assembly and positive duties in respect of facilitating political action are discussed. Article 11 also guarantees the right to ‘associate’: to join and be active in ‘associations’ such as political parties, pressure groups, religious organisations, and trade unions. Both these rights are subject to restriction under the terms of Article 11. The importance of Article 11 rights for democracy is fully recognised, and any restrictions must be consistent with the principles of tolerance and pluralism. Article 11 also permits significant restrictions on the political freedom of police, civil servants, and other public officials.

The Church of Jesus Christ of Latter-day Saints (LDS) ecclesiastical policy on health, medical, and moral issues has seldom addressed itself to the healing professions or to questions of public policy, an ethical insularity coherent with the principles of respect for moral agency and trust in the healing vocation of the professions. However, some issues reveal limits to peaceful compromise between ecclesiastical policy with both professional morality and public policy of the secular state and have prompted the LDS Church to forgo ecclesiastical silence and present a public witness of its values and positions on a policy question to a broader civic audience. This chapter focuses on two such examples, elective abortion and medical marijuana. The public square of moral reasoning within LDS teaching is constructed by principles of engaged citizenship, separation, and the moral core.

This chapter explores how international humanitarian law and international human rights law initially developed independently, but have converged and are now deeply interwoven. Since ancient times, some who take part in armed combat have recognized that placing certain limits on the way in which they conduct hostilities can be advantageous. It can be a sign of civilized behavior, enhancing their own prestige; it may be a way to encourage their opponents to behave in a similar manner; and it may contribute to the reestablishment of peaceful relations in which the rule of law prevails.
