Abstract:
La rupture d’un contrat peut survenir pour cause d’inexécution des obligations contractuelles. Il s’agit alors d’une rupture-sanction qui a pour but de mettre un terme à la relation contractuelle. Ce droit de rompre, comme tout autre, n’est pas sans limite et doit être exercé selon les exigences de la bonne foi. Le présent texte jette un regard sur certaines facettes du rôle de la bonne foi dans un contexte de rupture du contrat. Il convient premièrement de s’interroger sur la possibilité d’invoquer un manquement à l’obligation de bonne foi pour fonder le droit à la résolution de contrat. Malgré l’origine légale de l’obligation de bonne foi, celle-ci fait partie du cadre contractuel. L’auteur conclut qu’un manquement aux exigences de la bonne foi lors de l’exécution du contrat constitue une faute contractuelle qui donne ouverture à la résolution du contrat. Deuxièmement, l’examen des conditions de fond du droit à la résolution amène l’auteur à souligner que l’obligation de bonne foi pourrait permettre d’offrir une solution au problème de l’inexécution anticipée. Finalement, l’examen de la mise en œuvre du droit de rompre permet de constater qu’au stade de la demeure, la bonne foi exige que la dernière chance qu’a le débiteur pour s’exécuter ne soit pas illusoire et que de façon générale, le principe de la bonne foi sert à contrôler le comportement du créancier et du débiteur dans l’exercice de la résolution ou de la résiliation du contrat.

Devant la reconnaissance judiciaire accrue des clauses d'exonération clairement rédigées, il est devenu pratiquement impossible d'écarter l’application de telles clauses aux litiges en responsabilité. L'auteur affirme que le monde commercial a besoin de ces clauses, mais souligne qu'il faut également protéger la bonne foi entre les co-contractants afin d'assurer des normes minimales de rendement dans l'exécution des contrats. A cet égard, l'auteur pose le problème suivant : supposons que le demandeur engage une compagnie de sécurité pour protéger son usine contre les risques de vol et de feu. Une clause d'exonération parfaitement rédigée protège la défenderesse, la compagnie de sécurité, contre la responsabilité qu'elle pourrait encourir par sa négligence ou celle de ses préposés dans la garde des lieux. Un gardien de sécurité met feu intentionnellement à l'usine. Est-ce que la compagnie de sécurité est protégée par la clause ? Selon la jurisprudence des provinces canadiennes de common law et celle d'Angleterre, la réponse est affirmative, l'arrêt de principe (Photo Productions v. Securicor) est étudié à cet égard. Au Québec, selon l'auteur, la réponse serait négative : la responsabilité de la compagnie de sécurité serait engagée. L'auteur prétend que cette différence substantielle s'explique par l'histoire et les conceptions théoriques de base qui ont donné lieu aux deux systèmes de droit. L'auteur examine la division retrouvée en common law entre le droit délictuel (tort) et contractuel (contract) par rapport à l'unité théorique de « responsabilité civile » du droit civil québécois. Il constate ensuite que les clauses d'exonération ont été facilement acceptées dans le droit des « contracts » de la common law mais qu'elles ont été jugées sévèrement en droit civil québécois en utilisant la notion de bonnes moeurs et d'ordre public. Malgré les différences entre la common law et le droit civil québécois, les deux systèmes reconnaissent aujourd'hui les clauses de non-responsabilité. L'auteur soumet, cependant, que le droit civil québécois offre la meilleure réponse au problème exprimé ci-haut. Selon lui, lorsque l'exécution négligente d'une obligation contractuelle équivaut à un manque de bonne foi, elle doit donner lieu à la responsabilité civile malgré la clause d'exonération, vu la notion de « faute lourde » développée par la jurisprudence québécoise. Cette notion est comparée favorablement aux notions de fundamental breach de la common law et celle de l'obligation essentielle du droit civil. Après avoir examiné et discuté de la notion de « faute lourde » en étudiant les arrêts québécois avec référence particulière aux contrats de sécurité/surveillance, l'auteur termine son étude en proposant que la common law a besoin de ce genre d'analyse pour redresser le problème des clauses de non-responsabilité parfaitement rédigées en évoluant vers une théorie générale des obligations et de la responsabilité civile.

Abstract:
The article examines current legal problems which arise in connection with trade mark license contracts. In the contemporary business environment a problem of liability for non-ensuring quality control under trade mark licensing law has become increasingly important. Restrictive business practices and regulation of parallel import is another concern. Authors analyze not only provisions of the substantive law but also legal regulation of the relevant issues concerning the conflict of laws rules. The article also tackles a major problem in the sphere of international private law: correlation of lex contractus and lex loci protectionis connecting factors. Lex contractus covers contractual aspects of the trade mark license such as contract interpretation, mutual obligations of the parties, their performance, discharge and consequences of breach thereof. And lex loci protectionis governs non-contractual aspects such as existence, validity and protection of the right to the trade mark itself. Sometimes it is difficult to label certain issues, like the licensee’s allowed continued use of the mark after the termination of the license, as contractual or non-contractual. The article offers comprehensive analysis of all these questions on the basis of the most recent legislation, court practice and doctrines, both Russian and foreign.

The contracture release was performed under thoracic epidural analgesia. This technique can benefit patients with mentosternal contractures to avoid the problems of entubation and it can also assist in postoperative recovery and analgesia. The epidural catheter can be used to extend the height or duration of intraoperative block and is also useful to provide postoperative epidural analgesia.

Dit artikel bespreekt het ontwerp van contractuele beheersingsstructuren voor transacties tussen ondernemingen. Met behulp van uitgebreide enquêtedata over transacties in informatietechnologie wordt geanalyseerd hoe kopers en leveranciers contracten voor hun transacties vormgeven, hoe karakteristieken van de transactie(partners) op contractontwerp van invloed zijn en of transacties met weinig en veel ex post transactieproblemen van elkaar verschillen in contractontwerp. De analyses duiden aan dat contractafspraken worden gemaakt in regelmatig voorkomende combinaties met eenzelfde doel, die verschillende dimensies van beheersing weergeven. Transactiepartners maken meer gebruik van contractafspraken bij een toename van de financiële omvang, specificiteit, onzekerheid en taakcomplexiteit van de transactie. De contracten van succesvolle transacties blijken daarbij meer te worden aangepast aan de verschillende karakteristieken van de transactie(partners) dan die van minder succesvolle transacties. Vooral voldoende aandacht voor transactieonzekerheid en taakcomplexiteit lijkt in contracten van transacties met veel ex post problemen te ontbreken.

Abstract:
Reconstruction of the first web is an important technique for thumb adduction contracture accompanying congenital anomalies. Our previous cases have been reviewed here to evaluate and compare the indications, results, and problems for these two techniques. The angle formed by the first and second metacarpals (first-second metacarpal angle; 1–2 MCA) on the anterio-posterior (AP) view of the hand, with the thumb in maximum radial abduction, was measured from X-ray. There were 37 patients (43 hands: 27 males, ten females). The average age at the time of surgery was 6.6 years (range, two to 22 years). The five-flap Z-plasty was performed on 20 hands. The spinner flap was performed on 23 hands. The Spinner flap is indicated when contractures are severe or when the preoperative 1–2 MCA is <20°. The five-flap Z-plasty is indicated when contractures are mild or when the preoperative 1–2 MCA is ≥20°.

Background: The aim of the study is to facilitate choosing the surgical technique that will be suitable for improving both function and aesthetics of each patient through this suggested algorithm system. Any post burn neck contracture usually causes severe impairment of function and aesthetics, which causes serous psychological and social problems. That’s why it is very important to sub-categorize this type of deformity by anatomical location and cause of burn to allow choosing the ideal method of surgical management.Methods: This is a prospective study which was performed in Plastic Surgery Department, Menoufia University Hospitals over the period from March 2017 to March 2019. The study included 30 patients suffering post burn neck contracture deformities.Results: Patients were carefully examined, and the post burn neck deformities were analyzed according to age, condition of skin at the contracture site, the range of sternomastoid muscles movement at both sides of the neck and patient's general condition. Patients were given scores and categorized into 4 grades. And according to each patient's grade, the suitable surgical technique was chosen and fulfilled. 25 patients showed great satisfaction to their post operative’s outcomes and the rest were poorly satisfied.Conclusions: Application of patients with post burn neck contractures to this algorithm system will make it easy to choose the ideal method of management and gain the best surgical results possible when performing surgical correction.

Background: Management of severely contracted ocular socket with inability to retain ocular prosthesis is one of the most difficult problems to tackle. This study aimed to evaluate feasibility, cosmetic outcome and donor site complications of multistage Mucous Membrane Grafting (MMG) from single donor site. Methods: In this prospective, non-randomized study, 07 patients with severely contracted ocular socket (grade 3-5 Gopal Krishna classification) underwent repair with oral MMG in multiple stages under general anaesthesia. Graft harvested from single donor site from inner aspect of lower lip at every surgery. Subsequent surgery was done 08 weeks later after healing of donor site and reassessment of residual socket contraction. All patients were given customised ocular prosthesis. Patients evaluated for ability to retain the prosthesis and cosmetic outcome. Results: Mean age of patients was 43.5 years. Majority of patients were grade 4 socket contraction. Majority required 2 stages of MMG surgery. While 2 patient required 3 stages of MMG. One patient with grade 5 contraction unable to achieve satisfactory retention of prosthesis even after 3 stages of MMG. Rest all patients had adequate expansion of surface and were able to retain customised ocular prosthesis with satisfactory cosmetic outcome. No patient developed donor site infection or contracture. Conclusion: MMG from single donor site in multiple stages for repair of severely contracted ocular socket is effective technique in terms of ease of surgery, cost effectiveness, ability to retain prosthesis and cosmetic outcome. Keywords: contracted socket, mucous membrane graft, buccal mucosa, ocular prosthesis.

Nepal is a nation with an emerging economy that traditionally has faced challenges related to terrain, weather, political instability, natural disasters and poverty. It has a high rate of burn injury. Due to the above factors, adequate primary treatment of burns is frequently rudimentary, resulting in a significant burden of human suffering in the form of chronic debilitating burn-scar contractures. For several decades, international health teams have played a significant role in relieving the burden of disease and deformity, such as cleft lip and palate and burn-scar reconstruction. The current article summarises the experience of an Australian surgical team assembled to manage problems of burn-scar contracture in Nepal over the ten year period 2004-2014. The article discusses patient assessment protocola, patient statistics, conditions treated, procedures and results, complications.

Part of the legal aid treaties between Ukraine and other states contains rules concerning conflict of laws. Where those that determine the law applicable to contractual obligations, family, and hereditary relations are not in line with current approaches to determining the law applicable to the specified groups of relations. The purpose of the paper is to uncover the differences between the regulation of conflict of laws in private relations in the legal aid treaties between Ukraine and some EU countries and the modern approaches to the regulation of conflict of laws in such relations, contained in other sources of private international law; an explanation of how to solve conflicts between legal aid treaties and other international treaties; outlining the main areas of improvement of rules concerning conflict of laws in legal aid treaties. The methods of the study were comparative, dialectical, and Aristotelian, which allowed to identify the problems of regulation of conflict of law in legal aid treaties and to draw conclusions for their elimination. Application of these methods allowed to find out that lex loci contractus is most often used to regulate contractual obligations in the absence of an agreement of the parties on the choice of applicable law. The agreement between Ukraine and Romania does not provide for the choice of the law for contractual obligations. Legal aid treaties imperatively determine the law applicable to the property relations of the spouses. They apply a dualistic approach to determining the right to inherit. It has been established that competition between the rules of this Convention and the rules of legal aid treaties between Ukraine and Poland and Ukraine and Estonia should be decided in favour of the Hague Convention. It is proposed to amend the legal aid treaties concluded between Ukraine and the EU Member States: the rules concerning conflict of laws, which define the law applicable to contractual, family, and hereditary relations should be revised using the relevant EU regulations as a model.

Introduction.Pompe disease (PD), a lysosomal storage disease as well as a neuromuscular disorder, is a rare disease marked by progressive muscle weakness. Enzyme replacement therapy (ERT) in recent years allowed longer survival but brought new problems to the treatment of PD with increasing affection of the musculoskeletal system, particularly with a significantly higher prevalence of scoliosis. The present paper deals with the orthopedic problems in patients with PD and is the first to describe surgical treatment of scoliosis in PD patients.Patients and Methods.The orthopedic problems and treatment of eight patients with PD from orthopedic consultation for neuromuscular disorders are retrospectively presented. We analyzed the problems of scoliosis, hip dysplasia, feet deformities, and contractures and presented the orthopedic treatment options.Results.Six of our eight PD patients had scoliosis and two young patients were treated by operative spine stabilization with benefits for posture and sitting ability. Hip joint surgery, operative contracture release, and feet deformity correction were performed with benefits for independent activity.Conclusion.Orthopedic management gains importance due to extended survival and musculoskeletal involvement under ERT. Surgical treatment is indicated in distinct cases. Further investigation is required to evidence the effect of surgical spine stabilization in PD.

Issues related to research of the corporate sector efficiency are extremely important because it is the corporations, which act as a nucleus of almost any economic system. Efficiency of the corporations is largely due to internal corporate quality interactions, i.e. the level of contractual relations efficiency. In the existing economic literature, the questions of contractual relations efficiency still lack sufficient investigation. The present article examines the efficiency of the contractual relations and the factors affecting it, as well as problems of opportunism in Russian corporations and its impact on the contractual relations efficiency. In the graphic models presented, the efficiency curves of contractual relations and opportunism are described; the major factors that reduce the contractual relations efficiency in corporations are highlighted. The article examines the impact on the contractual relations efficiency of quality of corporate institutes. The basic corporate institutes and their key features are allocated. A quantitative analysis of the contractual relations efficiency, by building production functions of Cobb-Douglas, is conducted; this analysis introduces indicators characterizing the dividend policy and the level of remuneration for management personnel as factors.

In anophthalmic patients, shallow lower fornices make wearing ocular prostheses impossible and maintaining normal social activities difficult. This study retrospectively investigated the long-term surgical outcomes of autologous auricular cartilage grafting for contracted orbits. From 1995 to 2013, 29 anophthalmic contracture sockets with inadequate lower fornices and poor prosthesis retention presented to Chang Gung Memorial Hospital in Linkou, Taiwan, were treated using this surgical method. The success rate, aesthetic outcome, recurrence, and complications were analyzed. Among the 29 patients, 15 were women, 14 were men, their mean age was 45 years, and the mean follow-up time was 52 months (range = 6–159 months). Satisfactory lid position was achieved in 25 cases (86%), and lower fornix retraction recurred in four cases (14%). Neither donor site morbidity nor auricular deformity was noted during the follow-up period. Therefore, an auricular cartilage graft can be used successfully as a compatible spacer for anophthalmic patients with shallow lower fornices and prosthesis-fitting problems in long-term follow-up.

Abstract:
The article is devoted to the issues of legal regulation and law enforcement practice of determining the terms of performance and termination of contractual obligations, in particular, given the ambiguity of interpretation in practice of terms of termination of contract and terms of termination of obligations, including security. The urgency of the problem lies in the ambiguity of the interpretation in practice of the terms of termination of the contract and the terms of termination of obligations, which, as can be seen, is a consequence of the insufficiently successful legal regulation of this issue by law. The issue of extension of the obligation after the expiration of the contract is analyzed from the standpoint that the contract and the obligation are not identical concepts. Contracts are the basis for the occurrence and form of existence of obligations, which simultaneously constitute the content of the contract, but the civil obligation is not covered only by the concept of contract. Discussion issues of certainty of the period (moment) of execution are considered, as the civil turnover is aware of the obligations with a definite and indefinite term (term) of execution, terms of fulfillment of obligations with regular payments. The problematic issues of determining the terms of fulfillment of security obligations, in particular, guarantees, are also analyzed. The practice of application by courts of the provisions of the legislation on the terms of fulfillment of contractual obligations has been analyzed and a number of proposals have been made to improve the current civil legislation.

Abstract:
Recent technological developments have allowed the petroleum and natural gas industry to drill horizontal wells on a cost-effective basis. Although the technology is still relatively new in Canada, it has potentially significant benefits to the industry, including greater flow rates per well and greater ultimate recovery of petroleum substances. It has been estimated that by 1995 there may be as many as 450 horizontal wells drilled in Alberta per year. The implications of horizontal drilling are that the current regulatory schemes and certain of the common agreements utilized in the industry do not readily accommodate it. The author draws the conclusion on uselessness of tightening the legislation in relation to public procurement. The author considers “conditional application of the law” to be unacceptable: the applicable law is chosen depending on the background of the origin of money. The author suggests cancellation of the institute of examining contract performance results; and establishment of accurate differentiation of contractual and post-contractual obligations. The article notes truncated application of information disclosure norms and bad regulation of the Blacklist of suppliers. The author arrives at the conclusion of uselessness of tightening the legislation in relation to procurements.

Thirty-eight fingers in 27 patients with Dupuytren’s contracture of the proximal interphalangeal joint (PIPJ) in excess of 70° were treated using a staged technique. The first stage involved applying a mini external fixator across the PIPJ for continuous extension over 6 weeks with intensive hand therapy to maintain mobility of the joint and help correct the deformity. Twice weekly during hand therapy sessions the tension of the elastic band across the mini ex-fix was increased, allowing that full active flexion of the PIPJ against the elastic band could still be achieved. The second stage, 4 weeks after the external fixator was applied, involved an open palm technique of fasciectomy for the contracted cords restricting metacarpophalangeal joint movement and dermofasciectomy with full-thickness skin grafting over the proximal phalanx for bands restricting PIPJ movement. The external fixator was used to maintain active extension force until the graft healed. It was generally removed in the outpatient clinic under ring block 2 weeks after the second stage procedure. The patients were followed for a mean of 20.6 (6–48) months. The mean preoperative PIPJ deformity improved from 75° to 37° postoperatively. Overall, 69% of results were rated as good to excellent. Only one patient reported any on-going functional problems. There were eight cases of pin site infections and one case each of loose pins, osteoarthritics at the PIPJ, reflex sympathetic dystrophy, and disease recurrence needing PIPJ fusion. We conclude that our simple staged procedure is a valid alternative in the management of severe Dupuytren’s PIPJ contracture.

AbstractThe paper critically discusses the deontological interpretation of Hobbesian contractual obligation which has been advocated by commentators such as Brian Barry, D. D. Raphael and Bernd Ludwig. According to this interpretation, the obligation to comply with contracts and covenants is fundamentally different from the obligation to observe the laws of nature. While the latter is taken to be a prudential obligation that is logically dependent upon the individual aim of self-preservation, the former is viewed as an absolute or unconditional moral obligation that solely follows from the fact that the individual has bound himself to the performance or omission of certain actions. As can be shown, the deontological interpretation suffers from inherent problems and does not provide an appropriate interpretation of the Hobbesian texts. In particular, it can be demonstrated that the attempt to use Hobbes's concept of 'freedom as deliberation' in order to explain how obligations arise from contractual agreements faces serious difficulties.

Abstract Introduction Traumatic brain injury (TBI) and / or spinal cord injury (SCI) usually occur in a polytraumatic context, and may produce catastrophic central nervous system (CNS) damages and secondarily extensive dysfunctional biomechanical alterations. This study aims to illustrate the interdisciplinary collaboration between neurorehabilitation and orthopedic clinics in our hospital, focusing on the results of surgical interventions intended to correct the fixed-flexion deformity of knees, in patients with disabling sequelae after CNS severe lesions. Material and methods Between 2005-2018, in the Neuromuscular Rehabilitation Clinic of Teaching Emergency Hospital "Bagdasar-Arseni", 13 young patients (mean age 37.4 +/- 12.6; median 31; limits 26-43) with multiple articular stiffness and joint deposturing sequelae after severe CNS trauma have been transferred from other medical units. Twelve had bilateral knee flexion contractures, two associated additional elbow stiffness, and in three patients ectopic ossifications of the hips, with ankylosis in extension or painful flexion were found. Patients were subsequently transferred for iterative orthopedic interventions: hamstring lengthening (pes anserinus and femoral biceps tendon transpositions) in 12 cases, associated with posterior knee capsulotomy, traction and/or resection of neurogenic heterotopic ossification around the knee or hip joints and casting in 8 of them. All orthopedic interventions were followed by progressive rehabilitation programs. Spasticity was assessed with modified Ashworth scale (mAS). In pre-/ and post orthopedic surgery, all patients were assessed using an adaptation for adults of the Gross Motor Function Classification Scale, Expanded and Revised (GMFCS – E&R). Results Twelve patients had knee joint stiffness and chronic flexion contracture: 77% were severely limited in their walking ability, depending on wheelchair (GMFCS – E&R level IV), respectively 23% were bedridden, non-ambulate and totally dependent in all aspects of care (GMFCS – E&R level V). Knee orthopedic serial interventions were followed by iterative, individualized rehabilitation treatments, and 50% subjects have regain their capacity to walk independently (GMFCS – E&R level II), respectively 50% succeeded to walked with assistive devices (GMFCS – E&R level III). Discussion Both neuro-muscular system deficits and joint disorders can produce locomotor system abnormalities, joint complications and limb dysfunctional problems. These disturbances represent targets and therapeutic objectives for rehabilitation. Chronic knee flexion contracture, stiff elbows and/or hips, periarticular neurogenic heterotopic ossification: all represents major challenges in the complex management of patients with sequelae after CNS severe traumatic events. Posterior capsulotomy addressed to a stiffed, distorted knee joint, corrects the limb axis and expands the range of motion (through the angle gained by the eliminated flexion contracture), and sometimes restores the patient's ability to walk. Serial orthopedic interventions, followed by sustained postoperative rehabilitation, had a decisive influence on obtaining good functional results. Conclusions Comprehensive, multiprofessional approach and collaboration between neurorehabilitation and orthopedic teams are essential for the therapeutic management of patients with severe contractures post neuraxial lesions. Proper evaluation and goal setting are mandatory for rehabilitative management, pre-/ and post orthopedic corrective surgery. Harmonized timing for iterative interventions, followed by postoperative structured, sustained (often for life-time) rehabilitation are essential for obtaining functional results. Adequate prophylaxis of complications represents a main therapeutic objective, as well. An increased emphasis on due diligence, disclosure and contractual accommodation of environmental problems at the time of the acquisition or disposition is believed to he the best approach as it allows for flexibility, negotiated responsibility and ensures an appropriate level of investigation and recognition of identifiable environmental problems.

All these methods in their convergence made it possible to find out the current state of the existing legislation and legal doctrine in the context of contractual representation and to offer the authors’ own vision of directions of improvement of the studied legal institute.In the result of the study the authors made a conclusion that a contractual representation is a kind of representation, arising out of a contract or other act that underlies the will of the person represented (the principal) and the person representing (the attorney) and the agreement between them. It is important for both the practice of law and the theory of law that the understanding of the essence of the said institute and the approaches to regulating relations of representation in the Civil Code and in the Civil Procedure Code be the same.

The paper provides the rationale for using the public contractual system of the Russian Federation as a mechanism of a proactive economic policy. A number of works are analyzed that consider expenditure stimulation through a public contractual system as the main regulatory tool, for instance, in building national innovative systems, advancing research and technology, modeling the structure of the economy as well as solving social problems. An empirical analysis of the role of the Russian contractual system is given in view of its impact upon development of the regional economies in 2012–2019. Regular significant relations between the scope of financing public procurement within the contractual system of the Russian Federation and adequate own funds in the regional budgets are confirmed. The trends in elasticity coefficients characterizing correlations between the scope of financing of public and municipal procurement within the Russian public contractual system and particular tax groups in consolidated budgets of the subjects of the Russian Federation in 2012–2019 indicate economic appropriateness of increased procurement costs in terms of simultaneously providing own funds to the budgets. A positive influence of public and municipal procurement upon the level of employment and innovative activity of entities is shown, verifying, therefore, the potential of the Russian contractual system to support social and innovative policy, which is consistent with international evaluations. Conclusions are reached on the expediency of employing the budget and contractual system cumulatively as a proactive mechanism of economic policy to achieve efficient economic orders.

While attention for the social and environmental impacts of international business is certainly not new, the past years have seen renewed interest due pressing global problems such as climate change, poverty, and human rights violations. Multinational enterprises (MNEs) are increasingly called upon to play an active role and thus contribute to a more sustainable development. Interestingly, legal scholars are studying how MNEs are adopting codes of conduct advancing sustainable development goals to rule their commercial relationships with their suppliers in global supply chains. Some of these goals are incorporated in contractual terms when the company insert sustainability contractual clauses in international supply agreements. These contractual provisions dealing with public values represent "irritant clauses" for contract theory and pose some challenging questions to contract law scholars. The article considers, in particular, the following research questions: firstly, are these contractual provisions binding and enforceable by the parties or by a third party to the contract? Secondly, are they really "part of the contract" or do they play many functions? Thirdly, do they have an impact in advancing sustainability goals? Finally, the case of sustainability contractual clauses confirms that a new, specifically intergenerational, contract theory is needed.

AbstractPolyamory means consensual, aspirationally gender-egalitarian, non-monogamous relationships. People who engage in such relationships often seek relationship advice. This article is a critical review of a self-help webcomic and other texts in the light of contract theory. Polyamorous people often use contractual concepts to understand their relationships and how to carry them out. Applying critical contract theory, we can trace how problems typical of contractual framing in other fields play out in the poly context. At the same time, these problems are recognized and responded to by poly people, and they dynamically reinterpret core contract concepts. This article thus makes two contributions. First, it provides a study in the way legal concepts percolate out into, and are transformed by, everyday life. Second, in consolidating some ways poly people have solved old contract problems, it offers conceptual tools for the continuing project of imagining more just ways of relating.

Esto con la finalidad de determinar qué corrientes han sido recogidas por dichos instrumentos y cuál ha sido la fundamentación de la jurisprudencia para hacerlo. Clenched fist is a rare disorder of the hand associated with fixed contractures of fingers. The condition is often preceded by minor trauma or surgery, but these do not explain the severity of the contractures. Extension of the fingers is painful and hygienic problems can be considerable. Psychiatric disease is frequent in clenched fist patients. The patients may express a strong wish for amputations. In a review of eight patients with clenched fist who had claimed economic compensation from the Danish Patient Insurance Association, four patients had amputations. Three of them subsequently developed new contractures.

Abstract:
Research involving nerve transplantation has shown that tissue rejection limits the neurologic recovery unless the host is immunosuppressed. This study investigates an alternative to permanent or temporary immunosuppression using a rat model with nerve transplants from Brown- Norway rat donors to bridge defects in the sciatic nerve of Lewis rat recipients as these two inbred strains differ at both major and minor histocompatibility loci.The specific aim of this study was to evaluate if predegenerated nerve grafts decreased the tissue rejection and improved the neurologic recovery of animals with allogenic nerve grafts to avoid the problems associated with either short- or long-term immunosuppression. The animals in the experimental groups received cyclosporin-A, predegencrated grafts, both, or neither. The predegenerated grafts were produced by division of the nerve three weeks prior to grafting to allow for Wallerian degeneration to occur. The outcome was assessed by measurements stressing functional recovery (sensory testing, gait analysis, joint flexion contracture), studies of muscle recovery (muscle weight and hydroxyproline concentration), and histologic studies (axonal counts and inflammatory reaction). The animals receiving the predegenerated grafts without cyclosporin did have an improved recovery (joint flexion contracture 35° ± 8 ° and hydroxyproline ratio 1.52 ± 0.16) as compared to the joint flexion contractures and hydroxyproline ratios of the allograft group of animals without either cyclosporin- A or pretreatment and the ungrafted control group (47° ± 18°, 1.68 ± 0.34, and 53° ±15° ,4.50 ± 0.27, respectively, p < 0.01). However, all the isograft groups and allograft groups with cyclosporin-A, regardless of whether the graft had been predegenerated or not, had greater neurologic recovery than the allograft group with predegenerated grafts but without cyclosporin-A by the same parameters (p < 0.01). Allograft groups with short-term immunosuppression with cyclosporin-A did as well as isograft groups, and isograft groups with predegenerated grafts did not do any better than isografts without pretreatment (p <0.01).Clinical Relevance:Predegenerated nerve allografts will allow for greater neurologic recovery than standard nerve allografts avoiding the complications of immunosuppression, but the level of recovery is less than that of recipients of nerve allografts with immunosuppression. Nerve transplants would avoid the problems of neurologic deficits at the donor site and allow multiple large deficits to be treated easily.

La obra de Hans Jonas tiende a ser olvidada por los filósofos de la ética ambiental. Quisiera mostrar como su Principio de Responsabilidad pueda ayudarnos a guiar el desarrollo efectivo de instituciones públicas orientadas hacia metas ambientales. Efectivamente, se puede usar el Principio de Responsabilidad para desarrollar una concepción deliberativa y ambiental de la democracia. Por ende, después de recordar unos aspectos esenciales del Principio jonasiano de Responsabilidad, tomaré en consideración sus implicaciones para el cuadro socio-contractual de la democracia deliberativa. Es posible mostrar que la concepción jonasiana de la responsabilidad conduce a una concepción deliberativa y ambiental de la democracia pues permite acomodar los distintos sentidos del bien de los ciudadanos en el marco de una gobernanza global y ambiental.

What are, however, the attitudes toward each other which those two groups — representing management and the union respectively — will have to adopt to solve such problems ? This article is a tentative solution to the important problem of the sharing of authority in the enterprise.

The article shows the features of innovative technologies in the development of document management of international trade. Blockchain is defined as the most stable, transparent and secure system. It allows businesses to accelerate the workflow and business operations associated with signing a contract, making payments and transferring information about the supply of goods or services to logistics services. We suggest using a smart contract as the main technology that can improve the system of building contractual relations between the parties to international trade. The article identifies the main problems on the way to using technology, as well as the benefits of using smart contracts. The study shows the ways of implementing technology in a business. The smart contact technology allows you to simplify the process of using a letter of credit as the main method of payment in international trade, as well as monitor cash flow, the circulation of documents and goods.

El presente artículo realiza un análisis sobre la posibilidad de demandar en forma autónoma la acción de perjuicios en el sistema contractual ecuatoriano. Este problema jurídico no tiene una salida legal clara, de modo que este estudio expone la situación del régimen jurídico y las diferentes posturas existentes sobre el tema. Para ello, el trabajo se estructura de la siguiente forma: en primer lugar, para comprender la relevancia del problema jurídico planteado, se explican los conceptos de condición resolutoria tácita, responsabilidad contractual e indemnización de perjuicios. En segundo lugar, se exponen las diferentes corrientes doctrinarias al respecto. Asimismo, se analiza la postura tradicional de la jurisprudencia ecuatoriana y la tendencia moderna adoptada por los jueces en Chile. Por último, con el objetivo de comprender la corriente internacional, se examina la Convención de las Naciones Unidas sobre Compraventa Internacional de Mercaderías.
