Abstract:
This chapter comments on Article 62 of the Rome Statute of the International Criminal Court. Article 62 establishes the seat of the Court as the place of the trial. International courts have a ‘seat’. It is where they ‘sit’. Article 3, entitled ‘Seat of the Court’, specifies that the seat ‘shall be established at The Hague in the Netherlands’. It does not state clearly that the Court is to sit, as a general rule, in The Hague, but this is implied by paragraph 3 of article 3. Article 62 seems somewhat redundant and even confusing. Taken literally, its placement in Part 6 of the Statute (‘The Tr

This chapter comments on Article 63 of the Rome Statute of the International Criminal Court. Article 63 establishes the right of the accused to be present at trial. For some pre-trial proceedings it is either implicit or explicit that the accused will not be present. This is the case, for example, in the hearing before the Pre-Trial Chamber on a decision by the Prosecutor not to proceed, the taking of evidence in the case of a ‘unique investigative opportunity’, and the issuance of an arrest warrant or summons. A right to be present is specifically provided for some pre-trial proceedings, such

This chapter comments on Article 76 of the Rome Statute of the International Criminal Court. Article 76 governs the imposition of sentence in the event of a conviction. If the accused is convicted, the Trial Chamber is required to establish the ‘appropriate sentence’. In so doing, the Statute instructs it to consider the evidence presented and submissions made during the trial that are relevant to the sentence. This chapter comments on Article 69 of the Rome Statute of the International Criminal Court. Article 69 deals with specific evidentiary issues but lacks a general provision like the one in the Nuremberg Charter. This is addressed in article 64, stating that the Trial Chamber has the power to rule on the admissibility or reliability of evidence. According to a Trial Chamber, ‘the drafters of the Statute framework have clearly and deliberately avoided proscribing certain categories or types of evidence, a step which would have limited — at the outset — the ability of the Chamber to assess eviden

This chapter comments on Article 67 of the Rome Statute of the International Criminal Court. Article 67 confers the right to a ‘fair hearing’ to an ‘accused’ person ‘[i]n the determination of any charge’. Article 67 closely resembles article 14(3) of the International Covenant on Civil and Political Rights as well as fair trial clauses found in national constitutions. It is not, however, a typical provision found within criminal or penal codes as such. In effect, such texts generally belong in constitution-type instruments, where their role is hierarchically superior to the criminal law texts

This chapter comments on Article 66 of the Rome Statute of the International Criminal Court. The presumption of innocence is enshrined in article 11(1) of the Universal Declaration of Human Rights and echoed in the universal and regional human rights conventions. It provides a cornerstone for the fairness of the trial in a substantive as well as a procedural sense. Article 66 declares that everyone shall be presumed innocent until proved guilty before the Court in accordance with the applicable law. This chapter comments on Article 68 of the Rome Statute of the International Criminal Court. Article 68 governs the protection of victims and witnesses. The Court is required to take ‘appropriate measures’ for the protection of ‘the safety, physical and psychological well-being, dignity and privacy of victims and witnesses’. The provision places special emphasis upon victims of sexual or gender violence, or violence against children.
