On Monday, May 14, 2018, the Supreme Court of the United States struck a fatal blow to the federal Professional and Amateur Sports Protection Act (PASPA) when it determined PASPA violated the Tenth Amendment of the United States Constitution. Prior to the PASPA repeal, Nevada had been the only state in the United States (US) authorized to offer a full complement of legal sports betting options. Because, Nevada’s race books and sports pools have had the ability to offer wagers on sports since 1947, those legal sports betting operations were “grandfathered” into PASPA when it was passed by Congr

The Professional and Amateur Sports Protection Act (PASPA), was a 1992 law that, as has been well-documented, effectively restricted sports betting to Nevada. PASPA accomplished this by dictating that states could not "sponsor, operate, advertise, promote, license, or authorize by law or compact," sports wagering. A separate provision forbade private parties from operating state-authorized sportsbooks. In 2018, the Supreme Court invalidated PASPA as a violation of the 10th Amendment to the US Constitution. The Court held that Congress did not have the constitutional authority to tell a state h

In Gov. Murphy, et al. v. Nat’l Collegiate Athletic Ass’n, et al., the Supreme Court resolved one sports betting-related federalism issue and teed up another. In deciding the constitutionality of the Professional and Amateur Sports Protection Act (“PASPA”), the Supreme Court considered PASPA vis-à-vis the anti-commandeering doctrine embedded in the Tenth Amendment. The Supreme Court’s majority opinion, written by Justice Alito, concluded: “The PASPA provision at issue here—prohibiting state authorization of sports gambling—violates the anti-commandeering rule.” Justice Alito also foreshadowed

The foundation for this special issue was laid when the U.S. Supreme Court announced on May 14, 2018, that the Professional and Amateur Sports Protection Act (“PASPA”) violated the anti-commandeering principle contained within the Tenth Amendment. The decision in Murphy v. National Collegiate Athletic Association opened the door for states around the country to begin legalizing sports wagering for the first time in more than 25 years. The response to this newfound opportunity has been met with enthusiasm, with more than 15 states passing legislation to legalize sports gambling of various types

The 2018 ruling by the United States Supreme Court essentially legalized sports betting across the nation. Prior to that ruling, sports books were restricted by virtue of the Professional and Amateur Sports Protection Act (PASPA). But with a landmark 6-3 decision, the opportunity door for sports betting has been opened in all 50 states and the District of Columbia. This research focuses on two considerations regarding the opening of that door. Who are the potential beneficiaries, and what benefits might those beneficiaries derive? The main objective of this article is to present an overall insight into the legal status of sportsmen in Poland, from 1984 to 1996, i.e., in the period when the sports system was thoroughly transformed. The study uses historical and formal-dogmatic methods. In addition, the author interviewed a long-time curator of Legia Warsaw Museum and a sports fan, perfectly familiarised with reality of sport in Poland at that time, which enriches theoretical and legal considerations with a practical value. IntroductionBallarat’s Theatre Royal was the first permanent theatre built in inland Australia. Upon opening in 1858, it was acclaimed as having “the handsomest theatrical exterior in the colony” (Star, “Editorial” 7 Dec. 1889) and later acknowledged as “the grandest playhouse in all Australia” (Spielvogel, Papers Vol. 1 160). Born of Gold Rush optimism, the Royal was loved by many, yet the over-arching story of its ill-fated existence has failed to surface, in any coherent fashion, in official history. Introduction: Bubbles and Sport The ephemeral materiality of bubbles – beautiful, spectacular, and distracting but ultimately fragile – when applied to protect or conserve in the interests of sport-media profit, creates conditions that exacerbate existing inequalities in sport and society. Bubbles are usually something to watch, admire, and chase after in their brief yet shiny lives. There is supposed to be, technically, nothing inside them other than one or more gasses, and yet we constantly refer to people and objects being inside bubbles. The metaphor of the bubble has been used to describe

The role risk taking has played in American history has helped shape current legislation concerning gambling. This thesis attempts to explain the discrepancies in legislation regarding distinct forms of gambling. While casinos are heavily regulated by state and federal laws, most statutes dealing with lotteries strive to regulate the activities of other parties instead of those of the lottery institutions. Incidentally, lotteries are the only form of gambling completely managed by the government. It can be inferred that the United States government is more concerned with people exploiting gamb

This chapter examines the growing and transformative body of law governing sports betting, with a special emphasis on the Interstate Wire Act of 1961 and the Professional and Amateur Sports Protection Act of 1992, the two principal federal laws addressing sports betting. The provisions of PASPA, in particular, will serve as a launch point to a discussion of the true driver behind current efforts to legalize sports betting in the United States: the recent litigation pitting the State of New Jersey against the four major U.S. professional sports leagues and the National Collegiate Athletic Assoc

This chapter examines the recent trends in gambling and fixing in college football. Despite the passing of the Professional and Amateur Sports Protection Act (also known as the Bradley Act) in 1992, betting on sports has become a more serious problem than drug or alcohol abuse in educational institutions from elementary schools to college campuses. Included in this alarming trend are bookmaking operations run by between one and fifty students on college campuses. And because gambling has become so widespread in the country, most people do not take seriously the legal ban on sports betting. How
