Full text
Abstract:
This thesis investigates the seven promises of the Promise Keepers movement using the rhetorical criticism method of fantasy theme analysis. In order to understand this movement, four research questions guided the study: ( 1) What common themes are embedded in the rhetoric of the Promise Keepers? (2) What is the rhetorical vision promoted by the Promise Keepers movement? (3) What makes the vision of the Promise Keepers movement so persuasive to so many Christian men in America? (4) Based on an examination of the rhetoric of the Promise Keepers movement, what can be ascertained about the motives of the movement?" In order to answer these questions, a rhetorical analysis was conducted on the primary literature of the movement. The analysis indicated that the Promise Keepers are trying to transform America into a Christian nation. The Promise Keepers believe that change can be brought about if men follow the movement's seven promises for Christian living. Through these promises, the movement emphasizes a patriarchal view of men in society. In addition, the analysis of the movement's rhetoric suggests that the Promise Keepers are not interested in political change, but moral change through the lives of individual men.

Abstract:
NOTA: NOT A GOOD ACT FOR TISSUES TO FOLLOW The National Organ Transplant Act of 1984 (NOTA) articulates the U.S. federal policy for organ transplantation. It seeks to ensure equitable allocation of donor organs and strives to increase the number of organs available for transplant. A trio of ethical concerns—commodification, exploitation, and coercion—motivated passage of NOTA broadly and the prohibition on organ sales in particular. Notably, NOTA does not distinguish between organs and tissues, a devastating oversight given the differences between the two, which include: who can donate; when donation can occur; how donated items are procured, processed, and stored; who receives the donated item and why; and government oversight. Tissues are not like organs in the ways that made NOTA an appropriate legislative solution to commodification, exploitation, and coercion. Rather, NOTA failed to address tissue-specific concerns both ethical and practical in nature. Thus, there is an acute need to develop tissue-specific legislation that enhances informed consent to protect donor autonomy; sets a schedule of payments for donors and intermediaries to promote distributive justice; and improves tracking of donated tissues to address patient safety concerns. REGULATORY UNCERTAINTY, CONCEPTUAL CONFUSION, AND A PATH FORWARD ON OFFERS OF PAYMENT TO RESEARCH PARTICIPANTS The practice of offering payment to individuals in exchange for their participation in clinical research is widespread and longstanding. Nevertheless, such payment remains the source of substantial debate, in particular about whether or the extent to which offers of payment coerce and/or unduly induce individuals to participate. Yet, the various laws, regulations, and ethical guidelines that govern the conduct of human subjects research offer relatively little in the way of specific guidance regarding what makes a payment offer ethically acceptable. This paper systematically examines the legal and ethical dimensions of offering payment to research participants. It argues that concerns about offers of payment to research participants can be attributed to the misguided view that such offers ought to be treated differently than offers of payment in other contexts, a form of “research exceptionalism.” We show that rejection of research exceptionalism with respect to payment helps settle open debates about both how best to define coercion and undue influence, and how to understand the relation between these concepts and offers of payment. We argue for adoption of our preferred definitions, ideally by regulatory authorities, and against the conventional conservatism toward payment of research participants. Instead, we draw attention to the rarely asked, even radical, question: are research participants paid enough? We conclude by arguing that we ought to change the default to favor, rather than encourage suspicion of, offers of payment to research participants. EBOLA & FDA: REVIEWING THE RESPONSE TO FIND LESSONS FOR THE FUTURE In 2014, West Africa confronted the most severe outbreak of Ebola virus disease (EVD) in history. At the onset of the outbreak—as now—there were no therapies approved by the U.S. Food and Drug Administration (FDA) for prevention of, post-exposure prophylaxis against, or treatment of EVD. As a result, the outbreak spurred interest in developing novel treatments and vaccines; sparked calls to use experimental interventions in the field; and highlighted challenges to the standard approach to FDA approval of new drugs. Although the outbreak was geographically centered in West Africa, it brought to the fore issues of food and drug law and showcased FDA’s global role in drug development, approval, and access. FDA’s response to EVD highlights the panoply of Agency powers and demonstrates the flexibility of FDA’s regulatory framework. This paper evaluates the strengths and weaknesses of FDA’s response and makes policy recommendations regarding how FDA should respond to new and re-emerging public health threats going forward. The current pandemic of Zika virus infection is but one example of an emerging health threat that will require FDA involvement in order to achieve a successful response.

Abstract:
This study comes within the scope of mythocritics, image and postcolonial studies. It seeks to identify and analyse literary images from the sixteenth to twenty-first century Polynesia through biblical and Polynesian myths which are at the basis of these representations. The most famous image is obviously the Polynesian Eden, a cliché constructed by Western travellers and deconstructed by Insular writers. Literatures of the Triangle are also tinged with a reinterpreted Old Testament imaginary and with re-written traditional Polynesian myths. The biblical culture of a deeply evangelised region then mingles with the highlighted representation of pre-contact Polynesia which was so often denied or disparaged by missionaries, settlers and Western writers. Crossing disciplines and using Polynesian concepts have favoured a global vision of how myths (inter)act within literary works that take part in this territory of archipelago’s representation

Abstract:
The historical survey of social movements in the United States reveals that the movement is a rhetorical ground occupied by groups who have been marginalized by society. Today, however, the distinctions between those who are marginalized and those who are part of the establishment have become difficult to distinguish. This study considers the emergence of Promise Keepers, an all-male social movement, and the rhetorical themes that emerge from the group. This study identifies five rhetorical themes in Promise Keepers. These themes include asserting authority of men in the home and church, the creation of a new male identity, sports and war rhetoric, political rhetoric, and racial reconciliation. The implications of these themes are considered from a critical perspective and areas for future research are provided.

Khopuangklang, Korrasut. "A critical analysis of promise in Scots law and Thai law." Thesis, University of Edinburgh, 2016. http://hdl.handle.net/1842/22831.

Full text
Abstract:
This thesis critically analyses the law of promise. It does so for the purposes of identifying potential solutions to practical and doctrinal problems in the Thai law of promise. Scots law is chosen as the main point of comparison because, inter alia, both jurisdictions are mixed jurisdictions. Scots promissory law was influenced by the Canon Law and was part of the ius commune tradition. Scots law was not influenced by English law in this area. Scots law has developed its own promissory obligation as a free standing legal entity outwith contract. Thai promissory legal principles were derived from both Civilian and English sources. Consequently, promissory language is used both in the sense of a unilateral obligation and a contractual promise. Moreover, the Thai drafters did not acknowledge the different attitude towards a unilateral promise of French law (where a promise must be accepted in order to be binding) and German law (where particular types of unilateral obligations are recognised). This thesis argues that the flaws in promissory provisions under the Thai Code stem from the fact that, inter alia, the drafters did not understand the difference between unilateral and bilateral obligations. This thesis argues that the Scots promissory approach presents a more efficient structure of the law of obligations than the Thai approach. It encounters fewer problems than Thai law because a promise is deemed to be a standalone obligation. This thesis further analyses the practical applications of promise, arguing that a promissory analysis is useful in conceptualising practical circumstances. Adopting a promissory approach is beneficial, making doctrinal analysis clearer in comparison with the offer and acceptance approach. This thesis takes into account the role given to promise in the DCFR. The notion of a unilateral undertaking in the DCFR illustrates that the most recent model rule of European private law recognises the importance of a unilateral obligation. This reflects the fact that the notion of a contract cannot appropriately deal with certain situations in which a person unilaterally intends his/her undertaking to be bound without acceptance. It is concluded that the Scots approach of regarding a promise as an independent obligation separate from contract could be adapted to Thai law. There are certain resemblances between Scots and Thai law in promissory theories and the obligational nature of a promise. Therefore, Thai law is not unfamiliar with the notion that a declaration of wills can unilaterally create an obligation. The proposed approach provides a number of advantages e.g. eradicating an overlap between a promise and an offer; clarifying the legal status of promise; and making the legal status of a promise to make a contract compatible with a promise of reward. In particular, this thesis postulates that promise has a substantive role to play in governing an offer specifying a period of acceptance. This particular observation has, to date, not been made in relation to Thai law.

Abstract:

This dissertation addresses the discrepancy between the Colombian national legislation for Internally Displaced Persons (IDPs) and the actual realization of rights. Colombia possesses one of the world’s most advanced IDP laws, covering all stages of displacement, and the authorities have developed a complex set of institutions responsible to enforce the law. However, the implementation of the legislation has proven highly complicated. The Colombian government has been able to achieve important improvements in providing emergency humanitarian assistance to the IDP population, but significantly less in terms of prevention, resettlement and return. This thesis argues that the challenge of internal displacement in Colombia is perceived by the IDP regime as a technical rather than a political problem, which detaches the displacement from its structural and underlying causes and complicates prevention and resettlement.

The causes of the failure of complying with the IDP law are highly complex and must be analysed in relation to political, historical and cultural structures in the Colombian society. The ownership of territory is vital in terms of power and extensive income generating activities, which imply strong interests in access to land, and complicating the prevention of displacement and protection of abandoned land. The relationship between the land owning elite and policy-makers on the one hand and the poor, rural and displaced population on the other hand is characterized by mutual distrust due to historical patterns of oppression and exploitation. The political structures are analysed in light of the current government’s discourse on the political situation, which argues that there is no longer a conflict going on in Colombia, but rather isolated terrorist acts. The government claims to have achieved a complete demobilization of the right-wing paramilitary groups, in spite of continued denouncements from displaced persons demonstrating the existence of these groups. In light of James Ferguson’s thesis of how a development intervention is depoliticized by focusing on technical solutions, is it here argued that the underlying political causes of internal displacement in Colombia are largely overlooked because of the focus on concrete and measurable solutions.

Liisa Malkki’s theoretical concepts of depoliticizing and dehistoricizing are applied to show how the emphasis on humanitarian assistance portrays the displaced population as a ‘universalized mass of victims’ unable to voice their claims. This further contributes to illustrate how displacement becomes detached from its political and historical context, and hence renders it impossible to grasp the underlying causes of displacement. Anthony Giddens’ theory of structuration contributes to explain how these structures limit the possibilities for manoeuvrability, but simultaneously how the same structures may enable a level of power and choice. The actors are furthermore perceived to be capable of influencing the structures, as it is the actors themselves how have defined these structures. Through legal mechanisms ensured by the 1991constitutional reform and increased organization within the displaced population, the IDPs have improved their possibility to voice their claims and create spaces for communicating with the authorities. This thesis argues that small improvements are made because of an increased space for agency among the displaced population, but that the implementation of crucial sections of the IDP law are still highly complicated because of the emphasis on technical measures which removes the focus away from the underlying political causes of displacement.

Miettunen, Juuso V. M. "Prefigurative politics : perils and promise." Thesis, University of Kent, 2015. https://kar.kent.ac.uk/50228/.

Full text
Abstract:
Many recent social movements have been characterised by their commitment to direct democratic decision-making procedures and leaderless, non-hierarchic organizational structures. This political tendency also implies the search for autonomy from existing political institutions and practises. Movements seek instead to embody in the political action itself the social relations, ways of collective decision-making and values that are ultimately desired for the whole society. This prefigurative approach to social change is often criticized for being naiive or marginal. This thesis argues first that this is not the case, but that prefigurative politics is misunderstood due to its differing view on questions of strategy, organisation and ultimately the possibility of fundamental societal change. The dissertation first outlines the often implicit strategy or vision of change underpinning prefigurative politics. It then identifies as the key challenge for prefigurative movements their ability to avoid reproducing oppressive forms of power, ‘power-over.’ This understudied aspect is investigated through extensive ethnographic field research with the unemployed workers movement, MTD Lanús in Buenos Aires, and the Zapatista movement in Mexico. The thesis concludes that it seems impossible to completely avoid reproducing old forms of power. Often key individuals in the movements end up in a paradoxical position whereby, in an effort to ensure the group’s prefigurative nature, these individuals enjoy non-prefigurative influence. The findings imply that the state and corresponding political forms and practise are not the only source of hierarchic pressures. As such, it would be more useful to view prefigurative political action as desirable, yet impossible.

Abstract:
The dissertation starts with an analysis of the requirements for Intelligent Computer-Assisted Language Learning systems (ICALL), which partially depend on didactic aspects of foreign language teaching. Based on this a type of exercise can be identified, that on the one hand allows the learner to enter free formed input supporting the so called communicative competence as a major didactic goal and on the other hand may be realised with advanced computational linguistics'' methods. In the following chapter a look at grammar theories and especially Lexical Functional Grammar (LFG) is taken. The grammar theory needs to be tractable in an implementation and it is of a further advantage if the concepts of the theory are similar to the concepts in learner grammars in order to simplify the generation of feedback. Subsequently the user interface of the actual program is presented with a focus on error messages. The implementation is named PromisD, which stands for "Projekt mediengestütztes interaktives Sprachenlernen - Deutsch". Finally an anticipation-free parsing method is developed using neither information from the lexicon nor the grammar in order to identify grammar errors. The recognition is restricted to those areas where errors occur frequently in a learner corpus in order to allow for a greater efficiency parsing authentic data. Along the two structural levels in LFG the presentation of the algorithm follows: the constituent-structure with a modified Early-algorithm integrating error hypotheses into the chart and the feature-structure with a new unification-strategie storing information about clashing values in the f-structure. The dissertation closes with an evaluation and an outlook on the generation of error messages.

Abstract:
Thesis advisor: Patrick McQuillan
The challenges facing our communities are complex, interconnected, and urgent (Kania & Kramer, 2011). Recognizing these challenges, policy makers, funders, and practitioners are turning to social partnerships as a promising strategy for community and educational change (Bess, 2015; Henig et al., 2015). Social partnerships involve the joining together of organizations from across sectors of society to tackle social problems (Crane & Seitanidi, 2014). The underlying premise of the Promise Neighborhoods program, one such social partnership, is that providing access to resources, services, and supports in a comprehensive manner will have the greatest effect on educational and community outcomes (U.S. Department of Education, 2018). This study seeks to shed light on the process of initiating and implementing a social partnership. In this study the author employed a two-phased, mixed methods design using social network analysis and interviews with organizational representatives to examine the network structures of communication and collaboration within one Promise Neighborhoods initiative: the Boston Promise Initiative. The sample for the social network analysis consisted of 33 individuals from 27 partner organizations. Further, follow-up interviews with 11 individuals were held to understand how network structures and processes might impact educational and community change. Findings from the social network analysis and qualitative interviews reveal networks of communication and collaboration rooted in a deep history of place-based change efforts, facilitating access to network resources and social capital among partner organizations. The findings highlight the importance of recognizing both challenges and opportunities of partnering with schools. Further, the findings highlight the importance of a lead organization’s ability to attend to both technical processes, such as facilitating communication among partners, and cultural processes, such as negotiating organizational identity. Taken together, the findings from this study point to the complex nature of cross-sector collaboration and identify structural factors and network processes that may impact the success of the efforts. By better understanding the structure and processes inherent in social partnerships, organizations can be better supported as they develop and implement cross-sector initiatives aimed at making meaningful change in their communities

Abstract:
The prevalence of corporate social responsibility has been continually increasing over recent years. The debate of whether a business should act in a manner that furthers societal needs or if they should simply focus their efforts on maximizing shareholder value is of popular interest since it affects the fundamental structures of how a business will operate. One of the major influencing theories in favor of social responsibility is the stakeholder theory. The opposing viewpoint is the shareholder theory, which highlights that the sole responsibility for a corporation is to act in a way that maximizes profits. This thesis will outline the stakeholder and shareholder theories to gain a more comprehensive understanding of the debate and then offer a critical and philosophical analysis of shareholder theory to ultimately argue why the moral significance of a promise better promotes maximizing shareholder value.

Abstract:
The broadcasting sector is a subject of continual debate in modern society. One of the oldest segments of the rapidly-evolving information technology and communications industry, it is still the most content rich and the most popular. Australians who watch television spend more time doing so than doing any other leisure activity – except those who fish (ABS 1998). Broadcasting is highly pervasive. Some kind of service is available and used in every Australian household. Everyone is an expert, everyone has an opinion. Since the Federal Government decided to allow the introduction of domestic subscription television in 1992, pay television has been broadly dismissed by its media rivals as being unpopular, unprofitable and unnecessary. In turn, the Australian pay television industry considers that it is over-regulated, especially compared to the free-to-air sector, and that much of this regulation severely constrains its ability to grow its subscriber base. This thesis examines whether the Australian subscription television industry has achieved the aims set for it by the legislators in 1992 – that is, whether it has ‘met its promise’. To achieve this, the thesis first identifies the ‘promises’ of an Australian subscription television industry. In assessing whether the industry has met its promise, the thesis considers various aspects of the industry, including what the industry has needed to do to make itself profitable and ensure its longevity and the environment within which the industry operates. The thesis examines the role that content plays in attracting subscribers and considers whether minimal content regulation has resulted in a paucity of local content on subscription television in Australia. The thesis draws on existing academic literature, government publications, information released by the subscription television industry itself and interviews conducted in the course of the project with the Australian subscription television sector. It also uses and builds on ratings data to examine the programs and channels that are offered by Australian pay television services. In concluding, this thesis makes an assessment of whether the Australian pay television industry has met its promise.

This thesis examines whether the Australian subscription television industry has achieved the aims set for it by the legislators in 1992 - that is, whether it has 'met its promise'. To achieve this, the thesis first identifies the 'promises' of an Australian subscription television industry.

Guimarães Rosa used to say that one can only talks about the “sertão” by means of the tale, or the legend. Considering Grande Sertão: Veredas a big-sized tale, I defend the importance of this form as an essay that seeks for the rediscovery of the New Land, by means of an illiterate, former jagunço’s speech. If our History was not strong in the sense of a philosophical contribution, geography, realm of tales, announces the thinking as a force, whose founding gesture is based on the power to make a pact with the quotidian, giving birth to Literature.

Abstract:
The dissertation begins with an introductory chapter that examines the short story cycle as a specific genre, outlines tendencies found in minimalist fiction, and discusses proposed definitions of the short story genre. The introduction examines the problems that short story theorists encounter when they try to.define the short story genre in general. Part of the problem results from the lack of a definition of the short story in the Aristotelian sense of a definition. A looser, less traditional definition of literary genres helps solve some of the problem. Minimalist fiction and the short story cycle are discussed as particular forms of the short story. Sixteen short stories follow the introduction.

Abstract:
International Telemetering Conference Proceedings / October 20-23, 2003 / Riviera Hotel and Convention Center, Las Vegas, Nevada
Wireless interfaces are becoming ubiquitous in terrestrial applications ranging from local area networking in business and commercial environments to large scale factory automation and process control. The pressure to develop these wireless interfacing techniques has come from the need to reduce cabling, reduce installation costs, and make it easier to extend network infrastructures. Concerns about electromagnetic compatibility, safety, reliability, and security have lead to the development of techniques and protocols that enable such wireless interfaces to be operated in electromagnetically harsh environments, without generating unacceptable interference, and providing reliable, dependable and secure data communications. On the face of it, the use of wireless interfaces onboard spacecraft looks like a good way of reducing the spacecraft harness mass and bulk. However, recent work by the European Space Agency has shown that, while harness reduction will undoubtedly be one benefit of using wireless interfaces, they offer many other benefits that will be more significant in the near future. Amongst these are significant advantages during integration and testing, the ability to retrofit and upgrade facilities, and cable replacement in moving structures such as robotic arms. In this paper we briefly survey the benefits of wireless interface technologies for spacecraft onboard use, and identify the challenges involved in adapting them for flight use. We then look at the considerations that should be taken into account in establishing the financial case for developing wireless interface technologies for flight applications.

Abstract:
A persistent gap exists between established federal, state, and local standards for housing habitability and the condition of rental housing. The condition persists despite local code enforcement mechanisms, leaving significant potential to improve housing. Such housing can have adverse impacts on people's physical and mental health, economic stability, education, crime, community development, and municipal budgets. The purpose of this case study was to identify factors that create and perpetuate the problem, make it difficult to resolve, and to identify policy actions with the potential to help mitigate it. Rational choice theory and public choice theory formed the framework to analyze motivations and behaviors of policy makers, policy enforcers, policy influencers, and renters who are affected by policy. Data were collected through 23 semi-structured interviews with city officials, property owners, local housing advocates, low-income renters, investigative reporters, and legal aid attorneys. Interview data were open coded and subjected to a thematic analysis. Themes emerging from the study include lack of accountability for owners and renters, barriers to adequate local code enforcement, financial and investment practices that place properties into the hands of owners who fail to maintain them, historical influences related to construction practices and changing ownership patterns, broader costs to families and the community, and external influences related to economic and demographic trends. The positive social change implications stemming from this study include recommendations for policy makers to address factors that create and perpetuate this type of housing, strengthen code enforcement, and ensure habitable housing for all citizens regardless of their income.

Abstract:
The ultimate goal of SPIN and indeed of all testing or validation methodology is to demonstrate, with a certain degree of confidence, that a proposed design or implementation meets its requirements. SPIN is a tool to simulate and validate Protocols. Promela, its source language, is a formal description technique like SDL and Estelle that is based on communicating state atomata. Unlike most other tools, SPIN is in the public domain and therefore is one of the most widely used formal verification tools today. Paper presents a formalization method of piece linear aggregates (PLA) and an investigation of possibilities to use SPIN system for validation of PLA specifications of distributed systems. It is shown that in order to write Promela specifications, processes used in the PLA model should be represented by finite state automata. PLA specification of two protocols, its description by finite state automata and its verification results in SPIN system are presented. It is shown in this paper that the SPIN system can be used for the verification of aggregate specifications. Using the SPIN system the finite state graphs of the processes used in the formal specification have to be formed. Then they have to be described in the Promela language.

Abstract:
Nowadays, many companies attempt to adapt their production planning and strategy to make order fulfillment more flexible. In manufacturing, the capacity and capability constraints are key factors which need efficient production planning for controlling service level and minimizing inventory cost. This thesis focuses on looking for the economic and efficient strategies for Capability to Promise or CTP handling. This strategy is proposed to work for Low Volume/High Mixed product manufacturing. Moreover, SAP is used as Enterprise Resource Planning (ERP) system for steering the CTP handling strategies in order to increase automated order handling regarding cost efficiency. The results of this research are both concepts and implementations on how to set CTP handling by using SAP, regarding the demand uncertainty environment in Make to Order (MTO) fulfillment.

This paper brings a reflection on the nature and democratic character of the Collaborative Budgeting experience in the city of Fortaleza between the years 2005 and 2014. A public policy of collaborative administration, characterized by the perspective of articulation between democracies of the participative and representative sorts. A systematic accompaniment of this policy through an investigative effort â initiated in the first decade of the year 2000, in the social science scope â unveils defining features of liberal democracy to limit the collaborative potential of this experience, which raises a central question about the actual manifestation of collaborative democracy at the context in study. The Collaborative Budgeting in Fortaleza began in 2005, during the first term of Luizianne Lins, a mayor affiliated to the PT party. Its continuity until the first half of 2014, during the second year of the following mayor, Roberto ClÃudio, which is affiliated to the PROS party, continues enigmatic. This work investigates the effective participation of the specific public â related to local public policies â, the percentage of the municipal budget that is in fact discussed and deliberated by the population, and the continuity of this experience with the shift of municipal administration, among other phenomena. For such task, this paper rescues conceptions and democratic theories of contemporaneous analysts, such as Santos (2001, 2003, 2006, 2007, 2010, 2012 and 2013) Coutinho (1979, 1988, 1989, 1994 and 2008) and Wood (1998, 2007, 2011 and 2014). The public policy in question is assessed through an experimental methodological approach that articulates several methodological principles found in the works of Silva e Silva (2008), Guba & Lincoln (2011), Lejano (2012) and Rodrigues (2008, 2011). The field research is completed by interviews with participants and politics coordinators. There are also studies with statistical and documental outlines on Fortalezaâs Collaborative Budgeting involved in the research.
