Gould and Davis (2014) have recently argued for the claim that Propositional Platonism is mistaken since it is not able to explain how a proposition comes to bear its representational properties. But, say Gould and Davis, if Propositional Platonism is mistaken, then Divine Conceptualism must be true and we should therefore identify propositions with the contents of a divine mind, i.e., God. The at-issue status of a proposition and its availability for anaphora have been tightly linked in the literature (e.g., Tonhauser 2012; Syrett & Koev 2014). In particular, a frequently used diagnostic for at-issueness crucially relies on propositional anaphora. I argue that two different QUD-based diagnostics from Tonhauser 2012--—which do not rely on anaphora—--more reliably identify at-issueness. AbstractThis chapter advocates legal peace between Germany and Italy as the most sensible and appropriate way to deal with the aftermath of Sentenza 238/2014 of the Italian Constitutional Court and its declaration of the unconstitutionality of the 2012 International Court of Justice (ICJ) Judgment in Jurisdictional Immunities. This plea does not only arise from frustration with the current impasse but also from the suspicion that the public good of legal peace has never seriously been canvassed by the Italian and German governments. Section II takes stock of the legal developments relating to the dispute between Germany and Italy since Sentenza 238/2014 was delivered. It especially focuses on the attitudes of the governments concerned, both in the context of the ongoing proceedings before Italian courts and elsewhere. It finds such attitudes opaque and unduly dismissive of the necessity to devise legal peace in the interest of the victims and of the integrity of international law. Section III highlights how the behaviour of the governments so far was at odds with the successful outcome of other intergovernmental negotiations concerning reparations for crimes committed during World War II (WWII), a process which has not been entirely finalized, as evidenced by the 2014 Agreement between the US and France on compensation for the French railroad deportees who were excluded from prior French reparation programmes. The Agreement between the US and France and all previous similar arrangements were concluded under mounting pressure of litigation before domestic courts against those states (and/or their companies) that were responsible for unredressed WWII crimes, thus a situation resembling the current state of the dispute between Germany and Italy. It is telling that litigation ended when the courts took cognizance of the stipulation of intergovernmental agreements establishing fair mechanisms for compensating the plaintiffs and victims of the relevant crimes. Such practice, therefore, is essentially in line with the proposition that state immunity (for human rights violations) is essentially conditional on effective alternative remedies for the victims. This and other controversial aspects related to the law of state immunity—such as the nature of state immunity, the North American remedies against immunity for state sponsors of terrorism, and the persistent dynamism of pertinent practice—are revisited in section IV. The purpose is to suggest that certainty about the law of international immunities, as allegedly flowing from the 2012 ICJ Judgment, is more apparent than real and that this consideration should a fortiori urge the realization of legal peace in the German–Italian affair.

AbstractA number of commentators have acknowledged the decline of gayborhoods and the concomitant emergence of non-heteronormative diasporas in societies where sexual and gender diversity is normalized (Ghaziani 2015; Nash and Gorman-Murray 2017; Bitterman 2020). Academic studies tend to focus on the new lives that are being led beyond the gayborhood and the diminished distinctiveness of the territories left behind (e.g. Ghaziani 2014). In contrast, this chapter explores the possibility that gayborhoods can continue to influence sociospatial dynamics, even after their physical presence has diminished or disappeared altogether. Individuals and collectives may still be inspired by the memories, representations, and imaginaries previously provided by these erstwhile places. Indeed, the metaphor of a non-heteronormative diaspora relies on an ‘origin’ from which a cultural network has dispersed. In this sense gayborhoods can continue to function as post-places, as symbolic anchors of identity that operate even if they no longer exist in a material form, even if they are used simply as markers of ‘how far the diaspora has come’. The proposition that gayborhoods are becoming post-places could be more fully theorized in a number of ways, but the approach here is to adapt Deleuze and Guattari’s (1987: 22) notion of plateaus, which denote a “region of intensities whose development avoids any orientation towards a culmination point or external end”. From this perspective gayborhoods are not spatial phenomena that reach a climax of concentration and then disappear through dissipation. This conceptualization is consequential for theory, practice, and political activism, and ends the main body of this edited volume on a more ambitious note.

AbstractThe decentralization of responsibilities has led to considerable variation in subnational performance. In this chapter, we explore the determinants of subnational government performance by suggesting that governors’ education (codified knowledge) and experience (uncodified knowledge) explain education outputs and health outcomes. We test our propositions in two data sets derived from 32 Mexican states and 32 Colombian departments during 1995–2010 and 2004–2013, respectively. Based on their findings, we caution against generalizing results, because factors driving performance in Mexican states differ from those boosting performance in Colombian departments. Neither governors’ codified nor uncodified knowledge drives subnational performance in Colombia. However, governors’ uncodified knowledge (experience) does explain health outcomes in Mexican states. Moreover, although political factors (e.g., partisanship and party ideology) explain health performance in Mexican states, no political factor does so in the Colombian departments. In sum, what drives performance in one country may not have the same explanatory power in another country.
