Full textHereditary transmissions are largely responsible for the social differentiations observable in peasant societies: what is transmitted is generally more important than what is acquired. These devolutions lie within the framework of two different normative registers: that of law and that of custom. Moreover, they proceed through the medium of two entirely different conceptions of the nature of property, one roman, which lays emphasis on real rights, the other Frankish, which lays emphasis on personal rights. The point of view upheld in the thesis in the following : 1)the rights and customary uses governing inter-generational transmissions can be ranked under two different headings : succession (transmission of authority) and inheritance (devolution of goods); 2) it is possible to characterize the inter-generational transmission systems of a given society by showing how its particular rules of succession and inheritance combine ; 3) the combination of these two types of rules is the expression of an equilibrium between two opposite tendencies, a residential tendency, which strives towards the individualization of domestic groups and a kinship tendency, which strives to establish the supremacy of a kin group. Three main ideal types (characterized by congruent rules of succession and inheritance) are defined: house centered systems, kindred centered systems and lineage centered systems. The possibility of social change, the logic of evolution of each system is also considered, both through the eventual transmission of one type into another and through the change leading from a major type to its marginal forms, or to an intermediate type, between the three main systems

Full textThe question as to whether ownership can bear on claims is a controversial one in Romano Germanic legal systems. Yet the on-going trend towards the dematerialisation of wealth invites legal experts to ally ownership and claims much in the same way in which, in ordinary parlance, people are said to own personal rights. Both history and economics would seem to point to a common recognition of the property nature of claims. Yet acknowledging the possibility that ownership bear on claims is no longer enough. The consequences of viewing the object of ownership as extending beyond material things must be recognized more generally. This is what the recent Civil Code of Québec appears to have done. Just as the material conception of ownership rests upon a technical infrastructure of the law of property, so too does the extension of ownership to claims require the elaboration of a technical regime. Traditionally obscured by a theory of titularity of rights, ownership as a means for explaining title to claims has the same juridical nature as ownership of things. Simply stated, ownership adapts to the object to which it attaches. Just as ownership can accommodate both movable and immovable property, so too can it be adapted to accommodate the peculiarities of claims as the object upon which it bears.

Full textThe relations between the state and property are characterized by prerogatives attributed to the State, whose legal qualification has remained indeterminate until now. Although these intimate relations have constantly questioned and are still questioning, calling a variety of theories (eminent domain, universal property, superior right of disposition), there is however an unnoticed concept which clarifies them. This dissertation proposes to shed light on this legal unnoticed, and to give voice to this unnamed, which can qualify the state’s rights as regards property and its own property right. To do so, it firstly leans on the positive legal system of property and the prerogatives of the state it establishes, to observe their variety and the conceptual embarrassment they cause. If the eminent property of the state has been the latest attempt to qualify such state prerogatives, the adopted genealogical approach reveals a more effective concept. By looking for the historical and legal roots of the state prerogatives regarding property, we discover an appropriate one, always skimmed but never embraced – the reserve property of the state. Opting for this qualification firstly allows to understand the relations between the state and private property. It proposes a proprietary foundation for the various prerogatives that the state practices over it. But it has become clear that this new qualification also clarifies the relations between the state and public property. As a result, this dissertation attempts to show the state as the holder of a reserve of property that both organizes private property and distributes public property

Full textA short outlook of the Byzantine law history demonstrates that said law history is dissociated from the historical reality from both jurists and historians. The aim of the present study is based on the historicity of the legal concept. The study of both texts of laws and practice and the comparison between these two categories of documents allow studying the functionality of the Byzantine legal system. In view of the fact that said functional element couldn't be conceived but in a context determined by time, territory, political power and population, the paradigm chosen is the 13th-15th centuries, the era of the last Byzantine dynasty, - the Palaiologan on the territory on which they could impose their authority. In this area, coexist various ethnic groups under different political regimes. Two civilizations are faced. The Byzantine civilization in decline, that of the Occident at the eve of the Renaissance. Mutual influences manifest themselves. The relation between positive law and custom or (and) customary law can be approached. In the "Law books" of the Byzantine jurists, we may discern a new approach concerning the classification of the legal contents, a new proposal concerning the codification of a law based on the positive law, on court decisions and customs. In other words, a combination of the two legal systems, which evolved alter the definitive fall of the Byzantine Empire: the Continental legal system, based on positive law and the Anglo-Saxon legal system based on customary law (common law)

Full textThe heirs of Caesar promised their soldiers lands in Italy to facilitate mobilization for war. According to ancient authors, the triumvirate settled in Italian soil about 50. 000 veterans after the victory which led to massive expropriations. In fact, four of the five major poets of the Augustan period were affected by those expropriations. Virgil was probably deprived of his land by an unscrupulous veteran. Horace was involved with Caesar’s murderers, so he too was deprived of all his land. Sextus Propertius was deprived of the land of his family because his father had supported Lucius Antonius. Tibullus laid emphasis on the recent and sudden poverty of his family. Ovid wasn’t affected by the expropriations of 41-40 BC. However, he had important difficulties with his land because of his relagatio. Thus, roughly directly and critically, these poets made reference to expropriations. Then, as the war was over in Italy and their personal situation was getting better, they celebrated rural world and land ownership, the latter being the principal structure of Italian agriculture. Moreover, these poets wrote about gods and rituals used to protect domains. This thesis examines this particular historical situation in addressing poetic and engaged works of these five poets about lands ownership as well as about religious practices related to the guarantee of land property
