Full textPopular destination for retirees but also for Western tourists, Morocco has introduced numerous reforms in the last few years to attract foreign investors. In spite of an important modernization of the legal and fiscal environment, French people but also Moroccans living in France have to avoid numerous traps to acquire a property in Morocco. They often believe that the history of the country as well as the French legislative influence ensure them a protection similar to that existing in France.Actually, the Moroccan real estate law presents numerous specificities. The study of the land tenure system but also of the rights and obligations of contracting parties or even of the various issues linked to financing can attest to this and help to advise potential buyers. The applicable tax system can also be a determining factor in the choice of property.The notary's practice highlights a second series of difficulties frequently encountered by people wishing to purchase a property in Morocco. If they are married or plan to marry in Morocco, they should be aware of the particularities of local Islamic law. Despite a major reform in 2004, the current provisions may upset the expectations of some investors who will be surprised to learn, for example, that their marriage validly concluded in France is not recognized in Morocco or that their matrimonial regime differs from one shore of the Mediterranean to the other. The very economy of some real estate projects could be then jeopardized.With a practical approach, this thesis attempts to identify the various pitfalls to be avoided when acquiring real estate in Morocco. Full textThe land system in Morocco is marked by the coexistence of two regimes. The first is atraditional one and has its origins in the Muslim law and local customs. The so-called modern"land registration system" was introduced in 1913 and originates in the Act Torrens Act ofAustralia following the name of its author Sir Robert Torrens "Registra" General of Australia.This modern law was intended to guarantee the right of ownership.The cohabitation and the amalgamation of the traditional and the modern law make it a richfield because of its originality and complexity.Thus, the land regime in Morocco presents an extraordinary diversity of statutes that havebeen established throughout the country's history and some of which do not provide thestability and necessary guarantees to undertake investments in the long term: Melk lands,collective lands, Guich lands, Habous lands, Crown lands and registered lands.This diversity and complexity of statuses present an obstacle to the development of thecountry.The direction of the current evolution suggests, in the near future, a unified and simplifiedland tenure

Full textThe law of real property in Morocco is governed by two regimes: a traditional system that has its source in customs and religious law to which was added a modern system. This duality seems to cause an overlap in face of the judge is powerless. The aim of this study is to review some theoretical analyses to test the evolution of Moroccan society without considering a unification plan of the two regimes. The ownership of personnel property suffers from a lack of systematization. The general principles that govern it are set primarily by court decisions even though they are sometimes taken directly to the general property law. The intrinsic nature of personal property has not been the subject of development and must be inferred from scattered rules. That's why we proposed to clarify the status of some traditional estates on the one hand, and securities, on the other. The law of property in Morocco is far from being a closed topic

Full textLand ownership is an interesting and fundamental issue in Vietnam. The relationship to the land has been framed in different ways throughout the history of this country, in both feudal and colonial and socialist periods. The differences in design and soil management technique in each period explain the complexity of contemporary Vietnamese land law; increased complexity in a market economy context with the socialist orientation maintained by the Communist Party. This ambiguous situation refers to the image of a country that is ready to implement structural reforms, particularly in the economic sector, without breaking with its socialist ideology. The land issue is a major focus of current issues, at the center of which lies the confusion between public property and private property. As a result of land laws and various amendments, particularly after the 2013 Constitution, land tenure and private property rights have been better protected than before. The State of Vietnam has recognized the real nature of the land use right, which has allowed the emergence of a dynamic and attractive real estate market by national and international investors. On the other hand, urbanization has led to many upheavals in the use of land in rural areas. Despite its efforts, however, the State of Vietnam can not adapt to the demands of this new context. There has been a long history of debates on land ownership, the concept of the right of use and other elements related to land management. The leaders are fumbling and the land administration still raises many difficulties. One of the most remarkable aspects concerns the maintenance of the land requisition, a procedure that involves the precariousness of the right of use of individuals.So, who owns land in Vietnam today? Are the components of the Vietnamese people, especially the poor peasants, really the masters? Can the right of use be considered as the equivalent of a right of property within the meaning of French law? All these questions, which are at the heart of this thesis, lead to suggest a new reform of Vietnamese law in the near future

Full textIn Cameroonian land law, the administration appears, in fact as in right, as the guard of the right of property. This statement can be surprising for the reason that the administration is not always respectful of rights and fundamental liberties. To entrust him the guarding of the right of the landed property would mean confiding the guarding of the lamb to the wolf. This reflection asks the fundamental question to know how is organized the system of regulation of the land disputes resulting from the access to the earth in Cameroon. The analysis reveals that the land settlement dispute is shared between the administration, the administrative justice and the judicial jurisdictions. It reveals especially that it is dominated by the administration, the judicial being relegated to play supporting roles in the guarantee of the land ownership. The occupants of the national domain are recognised action intended to sanction infringements on their customary rights. Left domains of the State as for them are in a legal impasse, the Cameroonian law seems to offer them no alternative in front of recurring events of the evictions to the bulldozer
